Trade Contractor shall participate in BIM Coordination Meetings and follow up review meetings as requested by McCarthy. Trade Contractor agrees that as a result of the information exchanged at such meetings, both the digital submission and the Work depicted in the Trade Contractors’ digital submissions, may require changes or modifications by the Trade Contractor to achieve compliant coordination with other elements of the Project, including when provided by others. Such changes/modifications shall be accomplished at no additional cost or time impact to the project, time is of the essence. The Trade Contractors acknowledge that such meetings will require attendance of personnel that are familiar with both the data entry aspects of BIM, as well as an understanding of the Work to be performed and its relation to other elements of the Project. The Trade Contractor therefore agrees that personnel conversant in both shall attend all said meetings. Trade Contractor agrees that neither participation in the BIM process, nor the use of BIM, relieves the Trade Contractor of the responsibilities described in this document, including to, coordinate the Work, with the work of other trades, and strictly comply with other requirements of the Subcontract Agreement, the Contract Documents, and Specifications. It is expressly understood and agreed that, notwithstanding the requirement for submittals in connection with BIM, traditional shop drawings and other submissions shall be provided by Trade Contractor as described in the Contract Documents. No party will be entitled to any claim for extra time or money, dispute, controversy, cost or expense increase, arising out of the direct or indirect use of BIM. McCarthy does not waive any of its intellectual property rights and shall have the sole and exclusive right to use BIM project products, all submissions made by Trade Contractors as it deems appropriate; before, during or after construction. Trade Contractor agrees, notwithstanding the fact they participate or are involved in the BIM process, or receive information of materials from others in connection with the Project, throughout the course of use and development of BIM, they shall not take any position that receipt of such participation or information has, or will, in any respect, waive, release, or otherwise invalidate any of its obligations or responsibilities under their Subcontract Agreement, or any intellectual property rights (copyrights, trademarks/logos, patents, etc.) that may apply to such information or materials. Trade Contractor acknowledges and agrees, that McCarthy shall incur no responsibility or liability with respect to the BIM or use thereof, including that resulting from errors, omissions or deficiencies in the BIM process. In the event that Trade Contractors provide deficient information or data that does not represent the Work, or is corrupted, or contains a virus, and/or otherwise damages or delays the BIM process, Trade Contractor(s) shall bear all costs associated with reconstructing their BIM’s, and to remediate such deficiencies and their negative impact and effects at no additional costs to McCarthy, the Owner or other Trade Contractors. The foregoing process is part of the Trade Contractors’ obligations to make the traditional submissions, and shall not relieve, or lessen in anyway, the Trade Contractors’ obligations contained throughout this Agreement and the Contract Documents.

SECTION H: COORDINATION PROCEDURES 1.

FINITE COORDINATION PROCESS

The processes and responsibilities outlined below will walk you through the Trade Contractor expectations and deliverables associated with McCarthy’s 3D Finite Trade Coordination Requirements for this project – which occurs after the development of 100% Construction Documents. Trade Contractor fabrication & coordination model submissions shall be of sufficient Level of Development (LOD) as specified in this BIM Execution Plan and related attachments to enable accurate and complete clash detection of all building systems and validation to the final as- built conditions. Submissions shall be provided by Trade Contractors within two working days from Contractor’s request, or as defined by McCarthy at the time of request. Shop drawing submittals and the subsequent on-site construction of the Trade Contractor’s work shall contain details, elevations, dimensions, as described in the contract documents and specifications, or as directed by McCarthy. Each Trade Contractor is required to complete 100% CD / IFC documents to progress into the 3D Finite Trade Coordination clash detection analysis to ensure no finite conflicts exist between LOD 400 elements that are progressed further than the 100% CD modeled content inclusive of fabrication-level elements such as bracing, hangers, supports, etc. McCarthy will confirm compliance with clash reports for building systems in conflict with other trades and systems. A clashed model will be posted to the McCarthy cloud-coordination site, and notice sent to all parties involved to notify
