President’s Message While waiting in an office for an appointment (in complete boredom I might add), I began searching for something to pass the time. I then noticed several prints hanging on the wall and all had an inscription within. As I began to read them to occupy my mind there was one that distinctly stood above the rest. It read ”The sea of business can pull customers in many different directions. It is our responsibility to light the way and take care of them before the competition does”. For the purpose of this article, let’s consider the reference of competition in the inscription as non-PAA members. I immediately thought of what we do as PAA members and auction professionals. The word “competition” could be thought of as a way to manipulate us to ponder how to undercut or think negatively towards the other party, but as professionals is that really the mindset we should be geared to have? Of course not. As professionals, it is the ability and the knowledge we have available to convince potential sellers as to why we are better than the next competitor through the door. As past PAA President Tim Keller taught in a seminar, an important part of that process should be utilizing the “Features & Benefits” approach to explain to customers why business should be done with us while focusing on what WE can do instead of another company, without delving into any ill will towards the competitor. To help with this, we need to use the professional tool kit that we are continuously building. As is the norm, it will consist of both good and not-so-good experiences, learning what tasks work and which do not, and items we have obtained from professional education. This education is available not only at the PAA Annual Conference but intermittently at monthly/quarterly local chapter meetings. I encourage you to utilize this opportunity to help your business. About a decade ago, then PAA President, Bill Anderson Sr. wrote an article titled “Membership In a Professional Organization is More Important Now Than Ever”. The same thought process should still be used in today’s auction industry. As we all have heard many, many times “What do I get for being a member”? I believe that just the idea of being a part of a professional organization can convey an unspoken positive vibe that is very visible to almost any client. The passion you have for what you do is reinforced by the extra effort and financial investment you have made to become and remain a member. I have never understood the ideology of one who feels that there should be some sort of physical reward for joining the association...sorry but there isn’t! But what IS important, is that being a member of the PAA should encourage you to see that the possibilities are endless for you and your company. The utilization of tools and knowledge from your growing tool box can never be measured in dollars and cents. In closing, I would like to say THANK YOU for the opportunity to serve as your President of the PAA for 2019. It has been a humbling and enjoyable experience that I will never forget………SOLD !

HEY PAA, KNOW YOUR PSA Do you know what PSA stands for? Prostate Specific Antigen. If you are a male, and do not know what a PSA test is, ask your doctor. The National Cancer Institute and your doctor have guidelines for when and how this test can help with detection of prostate cancer. It is a simple blood test. Just as all of us are different, so are our individual PSA levels. A PSA level of 4.0 ng/mL or less is considered “normal”. It is usually checked at intervals prescribed by your doctor at age 50 and checked regularly.

A higher than normal PSA can indicate prostate cancer. If caught early, you have a lot more options and alternatives. Mine was found at an early stage and my treatment was so far, successful. My PSA tests for the last 3 years have been “undetectable”, <.006. If you don’t know what your PSA level is, find out - the sooner the better. I was amazed when talking to people how many friends, colleagues and relatives have had, do have, or know someone who has prostate cancer. Prior to my surgery, I felt comfort in them sharing their stories of treatments and situations with prostate cancer and a lot of them have been clear or having good results for a long time. There are new procedures, medicine and tests being developed every day.

But I Don’t Have Any Employees … Or Do I?

As a sole proprietor of an auc on company, you have no employees...Except when you hire your cousin, Sam, to help you with some of those bigger auc ons each year. You tell yourself he’s not your employee because he just works for you maybe five or six mes a year and you pay him cash under the table. Then Sam injured his back li ing a heavy chest of drawers at one of your auc ons. The doctor said he herniated several disks and is permanently disabled. No worries though. He wasn’t your actual employee. Sam was an independent contractor...Right? Wrong! It doesn’t ma er how your cousin, daughter, or next-door neighbor is compensated. Perhaps all they receive from you is a free lunch and dinner and a pat on the back. But they are s ll considered your employees. According to the Pennsylvania Department of Labor and Industry, any employer who hires at least one employee, partme or full- me, is required to provide Workers’ Compensa on insurance. It provides medical care, lost wage protec on and even rehabilita on services for an employee if he or she is injured at a job site or off-site while working for you. It also protects you, the employer, from a lawsuit brought on by the injured worker. Failure to obtain the required Workers’ Compensa on insurance coverage could result in the injured employee filing a lawsuit against you in civil court or filing a claim against the state Workers’ Compensa on system. In addi on to the money necessary to fight a lawsuit and the resul ng loss of the lawsuit, stop-work orders and fines most likely will be levied against your business and personal assets by the Department of Labor and Industry because you did not carry Workers’ Compensa on insurance. The auc oneer in this example made four mistakes:  He didn’t have Workers’ Compensa on insurance.  He thought he didn’t need Workers’ Compensa on insurance because Sam was paid under the table as an independent contractor.  He thought Workers’ Compensa on insurance was too expensive.  Other auc oneers told him he didn’t need it and he took their advice. The auc oneer was wrong on all four counts. The Pennsylvania Compensa on Ra ng Bureau assigns every business a classifica on code. There are over 300 different classifica ons used in Workers’ Compensaon insurance. These classifica ons are a way of grouping together businesses of

similar types. Each insured employer is assigned a classifica on, which most accurately describes its line of work. The basic premium for Workers’ Compensa on insurance is calculated by the business’s classifica on code, the rate (the insurance company’s mul plier for the classifica on code), and an es mate of the auc oneer’s annual payroll (per $100 of payroll). “Ra ng factors are determined by actuaries,” said Greg Magnus, a producer with E. R. Munro and Company in Pi sburgh. “Auc oneers who travel around doing auc ons on-site should be classified as an auc oneer. However, if the auc oneer has a permanent establishment where he or she conducts aucons, they are classified by the state of Pennsylvania as a retail establishment.” Workers’ Compensa on insurance is purchased as an annual policy and not insurance you pick up for an individual auc on and then cancel because you aren’t going to have another auc on for several months. A Workers’ Compensa on policy is audited once a year to make sure the payroll is correct and that the auc oneer has paid the correct price, not too li le or too much. Workers’ Compensa on insurance is part of the cost of doing business. It’s a much smaller cost than draining your business and personal savings accounts to pay the injured worker’s medical bills and fines from the Department of Labor and Industry. Many jurors have freely admitted that they have overlooked whether the defendant was at fault if they felt sorry for the plaintiff. Step 5. Judgment If the plaintiff (person filing the lawsuit) wins the trial and the defendant (the person they are suing) is found responsible for the injury or loss, the court renders a judgment to compensate the plaintiff for their injury and/or loss. It is now routine for judgments to be in the millions of dollars.

Attorneys exploit all of these factors when they sue you. The attorneys know that you may be willing to settle the case—even if the case holds little or no merit—just to have it behind you. If you have available and reachable assets, the attorneys know they have leverage to get you to settle. Many attorneys make a living collecting settlement after settlement from innocent defendants (victims). This is what we call legal extortion. Conclusion The best way to defend against a lawsuit it to take away the financial incentive of attorneys to prevent the lawsuit from ever happening. If you have no reachable and seizable assets, the trial attorney’s strategies of legal extortion will not be effective against you. With proper asset protection in place, attorneys will not want to pursue a lawsuit against you.

Pennsylvania Auctioneers Association Notice is hereby given that the annual meeting of the Pennsylvania Auctioneers Association will be held at 2:30 am, Thursday, January 9, 2020, at the Sheraton Harrisburg-Hershey in Harrisburg, Pennsylvania. New officers will be elected at this meeting, and reports from all standing committees will be read. Nominations for PAA Offices to be Accepted According to the PAA Constitution and Bylaws, the election of officers shall be held annually at the first regular meeting. This traditionally has been the annual meeting held at the PAA Conference; this event will be held on Thursday, January 9, 2020, at the Sheraton Harrisburg-Hershey. To be eligible for elective state office (president-elect, vice President and Treasurer), the PAA member must be a resident of Pennsylvania, hold a valid Pennsylvania auctioneer’s license and have been a member in good standing of the PAA for five years or more. This year Tim Keller is the nominating committee chairperson. Members of his committee will be past PAA presidents representing the remaining five PAA Chapters, including, Fred Toomey-C; Brent Souder-LV; Kim Williams-NE; Sherm Hostetter-NW; Mike Charnego-SW. The committee will interview candidates during the reception on Wednesday, January 8, 2020. Meeting location will be printed in the conference schedule. All subdivisions and categories are subject to change at the discretion of the committee. Only entries prepared and submitted by members in good standing in the Pennsylvania Auctioneers Association will be judged in the advertising contest. Each individual category submission requires a $5 entry fee. Checks are to be made out to “PAA”. The auction advertising for a particular auction need not be dated, but suitable documentation of the prior year (January 1 to December 31) must be furnished, i.e., copy of the auction contract (commission may be deleted) or a tear sheet from the newspaper showing the auction ad and date on the paper, etc. Three (3) copies of each advertising piece, clearly marked as to the division in which it is to be judged, with the exception of Newspaper and Website, are to be submitted along with the completed contest entry form. a. For entries in Specialty Division Website, please submit the full name of the website and the URL. Criteria for Internet site: The site that is the easiest to navigate and offers the most information while using no more than 6 clicks of the mouse. Other attributes that may be used in judging include but are not limited to quality of content (i.e., informative articles & strong ad copy); ease of navigation and mobile friendly; use of rich media such as video; user interactive elements (i.e. comments, surveys, polls, online bidding, etc.); subscriptions and syndication (i.e. email lists, SMS text lists, RSS feeds, etc.);

All contest entries must display the PAA logo or include the statement that the auctioneer is a member of the PAA. All contest entries must display a valid PA Auctioneer license # and/or Auction Company # (except the Stationery and Photography divisions). All PAA members or firms may enter, but each member is limited to one entry and one award per subdivision. The date rule does not apply for all Specialty categories; however, if content of entry is substantially unchanged and has won in any prior year, the entry is not eligible. Best of Show, which is strictly a judges’ award, is not to be entered into other individual subdivisions. Best of Show will be removed from competition with other entries. Auctioneer's Choice will be chosen by the members and guests in attendance at the PAA conference. Entries will not be returned. Judges will be impartial, outside judges may be obtained. PAA Guidelines for Hall of Fame Candidates Nominees must be a licensed and bonded auctioneer in Pennsylvania for a minimum of 25 years and must have been a PAA member for 25 years. Must currently be a PAA member in good standing. Must be of good moral character. Must also have participated in promotion of the PAA through having held an office, worked on a committee, or performed a service that furthered the PAA. An out-of-state auctioneer member may also be considered if he or she meets all of the PAA guidelines. This award may be given posthumously. Each of the six PAA chapters shall be requested to submit a nominee each year. Application forms shall be on current, pre-printed PAA Hall of Fame forms which are provided by the PAA Administrator or Hall of Fame Secretary to each chapter. Applications must be accompanied by a photo of each candidate. Personal assessment of each nominee shall be limited to both the space provided on the form, along with an additional 8-1/2” x 11” page with a 4” x 4” (or similar) photograph. The Hall of Fame committee is comprised of all current Hall of Fame members, plus a president, secretary and two directors. The application should be submitted to the Hall of Fame Committee before the start of the next annual PAA conference. 2020 PA Auctioneer Competitions Hosted by:

The 2020 Pennsylvania Auctioneer Championship Competition will be held on Wednesday, January 8, 2019, at 5:30 pm at the PA Farm Show Complex & Expo Center, PA Preferred Banquet Hall. Complimentary bus transportation for contestants, judges, members, and guests will be provided by the Pennsylvania Auctioneers Association to and from the Sheraton Hotel to the Farm Show. Eligibility Requirements

Any auctioneer (excluding past champions and apprentice auctioneers) residing in the Commonwealth who is currently licensed and bonded to practice the profession of auctioneering in Pennsylvania is eligible to participate in the contest. Your license number must appear on the entry form. For the Rookie Competition (licensed less than 24 months), a copy of your PA Department of State certificate which shows original date of licensure must be included with pre-registration or brought with you to register on-site at contest. All competitions require you display your PA auctioneer license AND a photo ID.

The contestant must fill out an entry form to register for the competition. The pre-entry fee is $50 for PAA members and $125 for non-PAA members; the non-member amount includes a NEW ONLY 6-month PAA membership (those who have been a member in the past do not qualify for the free membership). To qualify for pre-registration, all entries must be postmarked on or before December 31 of the current year and mailed to the contest chairperson (listed at bottom of form). Please make all checks payable to the Pennsylvania Auctioneers Association or PAA; You may pay online using PayPal™ by making payment to info@paauctioneers.org; or by credit card on the entry form. You will receive confirmation that your entry has been received. All contestants (even those who pre-register for the contest) are required to register at the auction site between 4:15 and 4:45 pm. Any entries after 5 pm cannot be accepted. The contestant meeting and drawing for placement will start promptly at 5 pm; any contestants not present for the start of the meeting will be disqualified. Late entries post-marked after December 31 of the current year may still register in advance but will be subject to the late registration fee of $75 for PAA members and $150 for non-PAA members; the non-member amount includes a NEW ONLY 6-month PAA membership until June 30 of current year (those who have been a member in the past do not qualify for the free membership). Registration the night of the contest is at the late registration fees stated above. Although it is not required, it is requested that all contestants please register in advance. The competition is limited to the first 30 contestants who register.

      

Each Contestant is required to supply three (3) items to sell. The contestant will sell one of those items during the warm-up round and two of those items during the preliminary round. Items will be provided by the chapter in charge for the final round. It is the intention of the Pennsylvania Auctioneers Association that the contest be conducted as an actual auction; all sales are to be bona fide, actual sales, and all items will be sold to Farm Show spectators. Professional dress/business attire is required for contestants as well as for the committee members conducting the contest, judges, etc.

The sound system will be preset and will not be adjusted during the contest. If you wish to test the microphone, please arrive prior to 4:45 pm. It will be available for contestants to do a brief sound check. The contest chairperson or designated individual will introduce contestants by number only. A contestant’s failure to appear when his or her number is called will be disqualified. Scores from the preliminaries will determine finalist contestants. The contestant who scores higher will break a tie in the preliminaries in the bid-calling portion. A tie in the finals round will be broken by the contestant with the overall higher score in the preliminary round. At least two ring people selected by the chapter conducting the contest will be used in the contest. If a contestant does not wish to use ring personnel, he or she may choose not to; the contestant will need to notify a stage assistant prior to going up to sell his or her items. Each auctioneer will be allowed a maximum of three minutes to demonstrate his or her ability. Each contestant will sell one item in a warm-up round that is not scored and two items consecutively in both the preliminary and the finals round (if you advance). Scores from the preliminaries will determine finalist contestants. In the case of a tenth place preliminary tie, all ballots (including highs and lows originally dropped) are to be used to determine tenth place to proceed to finals. If this still results in a tie, a coin will be tossed (off camera) by the MC. Any auctioneer competing in the Rookie category will compete in drawn order with all other contestants; his or her status will not be announced until the Champions are awarded at the end. The number of finalists will be ten (10), not dependent on the total number of contestants.



By entering this contest you give permission for the PAA to use photographs taken at the contest in which you may appear for advertising/promotion purpose.

The chapter conducting the contest or the PAA Administrator will notify the judges of their responsibilities during the competitions. There will be 8 judges, to include an NAA representative, one representative from Antiques & Auction News, AntiqueWeek or Lancaster Farming (on a pre-determined rotating basis), and one auctioneer judge from each of the 6 PAA chapters. The immediate past champion, if a PAA member, will automatically represent his/her chapter. Judges shall refuse to serve if there is a conflict of interest with any contestant. If a non-PAA member wins the contest, there shall be 9 judges for the next year’s competition (six chapter representatives, NAA rep, publication rep, and previous nonmember champion).

Contestants will be judged on the following (a total of 100 points): * Introduction/Initial Command/Overall Appearance/Poise (20 points); * Voice Control, Clarity, Speed, Rhythm, and Voice Expression (45 points); * Article Description, Eye Contact, Body Language, Holds Attention of Audience, Concludes Sale with “SOLD” and Salesmanship (35 points) Contestants are required to announce his/her contestant number to the jury. Contestants have the option of saying their name and location. If a contestant does not announce his/ her contestant number as they begin, he/she will automatically be disqualified. Judges will be assigned the task of noting whether the contestant says his/her number before beginning the round. A contestant will not be disqualified during the warm-up round, only in the preliminary and final rounds. The high and low scores for each contestant on scorecards will be eliminated, using an average score except in the case of a tie as listed above.

Each contestant will receive badges with his or her contestant number after the drawing for placement.

The PA Auctioneer Champion will receive a $200 cash prize, a laser-engraved plaque and a gavel. The 1st runner-up will receive a $100 cash prize, a laser-engraved plaque and a gavel. All finalists will receive Finalist’s Gavels (up to 10). The PA Rookie Auctioneer Champion will be chosen from any qualifying contestants who have entered the contest. The Rookie with the highest final score will be awarded the championship regardless of whether or not he or she advances to the finals round. If more than one Rookie would advance to the finals round, the champions will be selected from the highest scores in the finals round. It will be possible for a Rookie to win or place in the regular championship as well. The PA Rookie Auctioneer Champion will receive a $100 cash prize, a laser-engraved plaque and a gavel. The top female competitor will be acknowledged. The top ten contestants will be announced by name in descending order and will receive gavels. At the close of the competition, the MC shall acknowledge the top scoring female, then the Rookie Champion, followed by the 1st runner-up auctioneer champion, and finally the PA auctioneer champion. If the PA Auctioneer Champion chooses to enter the International Auctioneer Championship Competition sponsored by the National Auctioneers Association, the PAA will award an additional $350 toward his/her expenses in entering the IAC Championship Competition during the next scheduled NAA Conference.

A copy of the rules shall be given to each judge prior to the contest.

The PAA requests that the Auctioneer Champion and Rookie Champion be present at the Friday banquet during the annual conference for recognition and photo opportunities. The Auctioneer Champion shall automatically serve as a judge for the contest the following year, if available. Speaking engagements throughout the year for the Auctioneer Champion shall be scheduled when convenient. Laser engraving of the Auctioneer Champion’s name and year in which he/she won on the large trophy shall be the responsibility of the champion. It is suggested that a jeweler perform this task due to the complexity of the engraving. The Auctioneer Champion shall bring the trophy to the conference the following year.
