President’s Message I've been reflecting on the fact that this association was founded on the opinion of professionals, within the auction industry, that there was a need to create a platform around which auctioneers could rally and have a united voice to represent what we stand for. That platform is now known as The Pennsylvania Auctioneers Association. Although the way the industry functions has changed, the basic principle has remained the same: marketing, education, ethics, positive consumer relations, and, of course, selling. With all of that being said, why or how has the industry changed to the point where involvement in this association is becoming less important? I am puzzled as to how this happened. Is it because of the expense? Is it because education is not valued as it once was? Is it because social media has taken over so much that personal or face to face communication has become irrelevant? I don’t know the answer and I am genuinely concerned. If you are reading this, I am sure your thoughts are similar to mine…so WHAT IS THE ANSWER? In an industry where we all conduct auctions, it is truly amazing that there are so many different methods used to complete the same task. As to the questions in the previous paragraph, I am sure there are many available answers and, really, there are no wrong answers. We have all sat at the conference lunch and dinner tables talking about the need to obtain/retain members, but HOW? What is the best way to do that? My feeling is that when Einstein came up with the E=mc2 theory, it was easier than figuring out how we can solve the PAA membership issue. As we all know, the function of this association is tremendously affected by the number of members. From a financial and also a personal perspective, it pains me to say that the effects of declining membership are evident. The decrease in participation causes chapters to struggle to cover their Conference responsibilities and, in general, dwindling numbers of faces at lunch & dinner. Financially, decisions come down to how to remain at the same account balance, instead of more pertinent issues, such as allocating funds to be used for legal matters or association tasks. It is also frustrating when I hear that the Conference and Chapter meetings are “not really that important”. It's up to each of us to MAKE THEM IMPORTANT. Education, involvement, and current event awareness is vitally important to our industry! Sustainability is extremely difficult when we try operate on a 600 member budget with only 400 members. Please take the opportunity to consider the future of this organization, especially as it relates to you and your company. The opportunity for a full year membership is just around the corner and there is no better time to influence someone to join or renew. In closing, the PAA is strong and we have a strong voice! Going forward, I trust you will help keep this association growing stronger than it has ever been; all it takes is a little time and effort. Thank you. SOLD ! Harry F. Long: Folk Artist Of Reinholds By Karl Pass Folk artist Harry F. Long was born April 13, 1895, and died Jan. 27, 1970. The son of Jacob and Amanda Long, he lived in the West Cocalico Township, northern Lancaster County village of Reinholds, Pa. Harry served in WWI and was later employed at Eberly’s Hardware Store at the corner of Harry F. Long is top left, ca. 1918-19, location unknown. Photo Mechanic Street and courtesy of Dennis Stephen. His nickname was “Shorty.” Antiques dealer Mary Snyder also had her first antiques shop in the Eberly’s Hardware Store building, prior to moving her shop down East Main Street toward Trinity Chapel (Reinholds Station Trinity Chapel). Harry lived next to the chapel. Harry’s younger brother (by one year), John F. Long (1894-1984), was a carpenter and house painter by profession but also a self-taught artist. John was a profilic painter and worked on reverse glass. Harry did not, primarily working in oil-onboard and also gouache-on-paper. Also, Harry was not an active painter,

unlike his brother, who outlived him by 14 years. His output likely numbered under 100 paintings. By comparison, John produced nearly 1,000 paintings on reverse glass during his lifetime. Harry was just as known for his woodworking as he was in town for his paintings. He constructed and paint-decorated children’s chairs and toy boxes. Harry also did cane seating repair, according to relative Dennis Stephen. It is not known if Snyder or Continued on page 2

Hartzell’s Auction Gallery in Bangor, Pa., held a multi-consignor sale on Feb. 2 that provoked bidder competition and several newsworthy results. Founded in 1943, the family-owned and operated auction company is in its fourth generation. The following are a few of the prices realized. A very small lidded Newton’s Improved pocket celestial globe sold for $6,325. A Sterling Strauser oil-on-canvas painting went for $3,200; a Rookwood vellum vase, $738; an 18th-century high chest, $6,785; an early top hat, $1,170; and a marbleized slate checkboard sold for $984. This outstanding team of eight will play a vital role in developing a transition plan and timeline while utilizing its strengths in problem solving, organizational skills and compassion. After years of accumulating personal property, the thought of moving one’s belongings can be overwhelming. The Alderfer Auction Transition Team will develop the downsizing plan, orchestrate the transition, design the new home floor plan, coordinate appraisal of personal property, pack and sort, unpack and make the new house a home. The Transition Team helps the customer envision and design their new home floor plan. They take measurements and provide a visual blueprint that brings the

customer’s furniture and belongings to life in a new environment. Is Your Home Protected? Larry Oxenham, American Society for Asset Protec on The PAA was fortunate to have Larry Oxenham as a presenter during the 2020 Annual Conference in Harrisburg PA and we look forward to having him back in 2021

Homestead laws have been created by states to protect personal homes against creditors. These laws vary widely between the states with some providing unlimited protection and others providing little or no protection. There are six states (Florida, Iowa, Kansas, Oklahoma, South Dakota, and Texas) that have a no dollar cap on the homestead exemption, which means that your primary home in these six states, regardless of value, cannot be taken by a judgment creditor and is thus protected from lawsuits by state law. In the other forty-four states with limited homestead protection, you may want to put your home into a separate legal entity to protect it against a lawsuit. For example, if you have $200,000 equity in your home and your state’s homestead laws only protects $5,000, a creditor could take $195,000 of the equity in your home to satisfy a judgment. Homestead laws are only for your primary residence, so vacation or second homes are not protected by homestead laws. Also, homestead laws do not protect you against federal tax liens.

What Can Happen if Your Home is Not Protected? If someone were to obtain a judgment against you, they can seek to satisfy the judgment by taking your home. The collection process begins by the creditor filing a summary of the judgment (Abstract of Judgment) with the county recorder in the county where you own the property. Just as you cannot sell your property without satisfying liens from a mortgage or deed of trust, you cannot sell or refinance your home until the judgment is paid or expires. The creditor can also file a Writ of Execution with the county recorder for the right to sell your home to the highest bidder at a public sale. The money collected from the sale of the property is used to pay the judgment and

any interest and collection expenses. If the property sells for more than the amount of the judgment, interest, and collection cost, the excess is given to you.

How to Protect Your Home Let’s say you have $500,000 equity in our home and your state homestead laws only protect $100,000. To insure your home cannot be taken to satisfy a judgment, you can own your home in a properly drafted and worded limited liability company (LLC). A LLC has what is called charging order protection, which prevents a creditor from seizing the property. To ensure that you can still take advantage of the capital gains exclusion when you sell the home, you can place your home into a single-member LLC. A single-member LLC is a disregarding legal entity for tax purposes so no yearly tax return is required. In the eyes of the IRS, it is as if you still own the home personally. This allows you to have the charging order protection of an LLC while still qualifying to take the capital gain exclusion on the sale of the home and the mortgage interest deduction. While most states provide charging order protection for multi-member LLCs, only two states currently provide charging order protection for single-member LLCs. Those state are Wyoming and Nevada. Your primary residency does not have to be in Wyoming or Nevada to be owned by a Wyoming or Nevada LLC. Most people own their home in their individual name(s) which provides no protection from lawsuits. Placing your home in a single member LLC in Wyoming or Nevada is very simple. The use and function of the home will be the exact same and no tax return is required. The only difference will be that on the title the LLC is listed as the owner instead of an individual name(s). Implementing this asset protection strategy can ensure your home is protected from loss as the result of a lawsuit. LLCs can also be used to protect other real estate you may own from lawsuits.

\Ç `xÅÉÜç JAMES S. DAVIS, JR. James S. Davis, Jr., age 63, of Kinzers, PA, passed away at his home on Monday, March 9, 2020. He was the son of the late James S. Sr. & Mabel Ammon Davis. Jim was a partner with Barr/Davis Auctioneers of Gap. He was involved with the Shad Restoration Program with the Exelon Corporation. He was a member of the Eastern Lancaster County Rod and Gun Club, Gap V.F.W., Christiana American Legion and the Pennsylvania Auctioneers Association (member since 1986). He enjoyed fishing, hunting, reading, being outdoors and he loved life and his animals, especially his dog, Tatoo. Surviving is a companion of 34 years Carolyn Eldridge of Quarryville and a nephew, Wade Eshleman of California. He was preceded in death by 2 sisters: Donna Jean Davis and Sandra F. Eshleman.

Are your Insurance Needs Different for Live and Online Auc ons?

The answer is no. Liability Insurance Liability insurance protects your assets if you are held responsible for accidents and/or damage that occurs during a live or online auc on. It also provides protec on against false adver sing and false representa on if you are sued because a client believes you falsely adver sed and represented a live or online auc on item. Consignment Coverage Consignment coverage insures the property of others in your care, custody or control, which includes property being held in your storage facility (for a live or online auc on) or during transit to a live auc on or to a shipment facility for an online auc on sale. Errors and Omissions Insurance Errors and Omissions Insurance (E&O) protects you financially if you must make up a shor all in sales to your client due to an error or omission on your part. This includes coverage for live and online auc ons. Cyber Insurance In 2020 and beyond, the biggest threat to your auc on business is a cyber‐a ack. Your clients may want to pay for their live or online auc on purchase with a credit card. Cyber insurance protects an auc oneer’s business from cyber‐crime and data breaches (customers’ personal informa on, including but not limited to their credit card informa on). Addi onally, if you have customers, employees and vendor informa on stored on a computer or a flash drive for your live or online auc on business, you could be held liable if your business experiences a cybera ack. “Many auc oneers think they are too small to be a target for hackers and that only large companies like Equifax, Target and Sony have to worry about being a vic m,” said Greg Magnus, insurance agent at E. R. Munro and Company. “Auc oneers may be more at risk of a breach because they are small businesses and some mes lack the proper firewalls and security to protect not only their own informa on, but their customers’ personal informa on. In fact, more and more small businesses have been targeted by cyber‐a acks, including computer viruses, phishing, hacking, data breaches, ransomware, and unauthorized access

to customer informa on. According to the 2018 Verizon Data Breach Inves ga ons Report, 58 percent of cyber‐a ack vic ms were small businesses (organiza ons with fewer than 250 employees). Recent sta s cs show that around 60 percent of small businesses were forced to suspend opera ons a er a cyber‐a ack and never reopened for business. In 2018, there was a 424 percent increase in authen c and new breaches of small businesses. Hackers a ack small businesses in order to gain access to data on customers and employees, such as credit card informa on, Social Security numbers, passwords and authen ca on data. “When I speak with some auc oneers, they believe because the personal informa on is stored in the Cloud or on a third‐party so ware pla orm, they are not responsible if that informa on is hacked,” Magnus added. “However, because the auc oneer is the one collec ng the personal informa on or swiping the credit card, they can be held liable.” And Don’t Forget Workers’ Compensa on and Business Auto Insurance According to the Pennsylvania Department of Labor and Industry, any employer who hires at least one employee, part‐ me or full‐ me, is required to provide Workers’ Compensa on insurance. It provides medical care, lost wage protec on and even rehabilita on services for an employee if he or she is injured at a job site or off‐site while working for you. It also protects you, the auc oneer, from a lawsuit brought on by the injured worker. A commercial automobile insurance policy is required under most circumstances when you use a vehicle for business purposes. It’s not just the registra on that determines the requirement for a business automobile insurance policy. Other requirements include ownership by a corpora on, use in hauling goods for hire, and gross vehicle weight of the vehicle. Commercial automobile insurance policies are not regulated in pricing, as are private passenger policies. There is price compe on between insurance companies for good commercial automobile insurance. The Pennsylvania Auctioneers Association was formed by a group of successful businessmen who knew that in order to provide a better business environment for themselves and strengthen their share of the auction market, they needed to work together. They invested in their futures by forming the PAA. Their purpose was to speak with one voice to the auction industry across the Commonwealth of Pennsylvania, to the public, to governmental agencies, and to others, and in the process obtain tools to help them make sound and profitable decisions in their auction businesses. For 67 years, the PAA has been one of the best investments its members have made.
