It might currently be the low-season months for the Thailand tourism industry, but there are still plenty of things happening in Pattaya at the moment. With the opening of the new Stones House music venue on Walking Street, launched at the end of last month with an ass-kicking live performance from Thai music superstar, Dome Pakorn Lum and his band at the grand opening, which literally shook the tourist police booth on Walking Street. VISA Regulations Foreigners from most countries can obtain a visa on arrival which is valid for 30 days. Foreigners from most countries can apply for a tourist visa in their own country, which is normally valid for 90 days. However on arrival first you get only a stamp for 60 days and after that you have to contact the immigration office for an extension for the full 90 days.

Warning: Do not risk being here on an over stay. If on departure you have an over stay, you will have to pay a penalty for every day of the over stay, except if the total over stay is only one day. But worse than that, if the police obtain you somewhere else than at the airport or the border without a valid visa they may put you into prison and you might have a lot of problems. So always contact the nearest immigration office if you do not want to leave the country in time or if you cannot leave for serious reasons, i.e. health reasons. An extension for 7 days is normally never a problem. Another option is a so called "Visa Run", i.e. to Cambodia. You exit the country, even for only for some minutes and on re-entering the country you are granted a 30 day visa. However with this kind of visa you are not allowed to stay more than 90 days in the country within a period of 180 days. People with an age of 50 years or older can easily apply for a retirement visa. They have to prove, that they have more than 800,000 Baht in a Thai bank account or they have to prove that their monthly income is more than around 70,000 Baht. Foreigners married to a Thai National get a 50 % "discount" on these amounts. The retirement visa allows you to stay in Thailand for one year without leaving the country. After that it can be renewed. However people staying more than 3 months in Thailand have to report at the immigration office every 90 days with a document, which clearly shows their current address. Bira is the only internationally certified racetrack in Thailand. Named after the famous Prince Bira, the first and only Thai driver to race in Formula One, the extensive facilities include a full-service karting track, an off-road test track, and a recently renovated and FIA certified 2.41km racetrack. The circuit can be rented on daily bases or shared basis. This expansive racing site covers an area of 164 rai (65 acres), with facilities for rally car races, formula series events, international level kart racing, and dirt-track testing. If you love pushing it to the limits, you will love a couple of hours at Bira, and if this is not your kind of thing, you can sit in the purpose-built stadium or grab a drink.

any people visiting the city ask us about East Pattaya, which for those that don’t already know is the area of Pattaya that lays to the opposite side of Sukhumvit Road and covers locations such as Nongprue, Nong Plalai, Lake Mabprachan, Soi Khao Noi and Khaotalo. Popular as a place of residence for a vast majority of Pattaya’s foreign expats, there are lots of things to see and do in East Pattaya that makes for a fantastic daytrip exploring a part of Pattaya that is normally untouched by tourists. 9am - million year stone park & Crocodile Farm Whether you are travelling with family, your significant other or with mates, a trip out to Million Year Stone Park makes for a great couple of hours. If you ever wanted to see a man put his head in the mouth of a crocodile, this is the place to see it. With crocodile, elephant and monkey shows, alongside massive megalithic stones (as the name might suggest), large ponds with an array of Giant Catfish, a couple of hours having your photo taken with the animals is a great introduction to wildlife in Thailand. The kids will love, and with lots of park areas, restaurants and souvenir shops, this is a great way to start the day.

Being in the presence of the sheer size of these beasts that step so carefully at all times is a joy to behold. Pattaya Elephant Village showcases the daily life of elephants and their masters, also known as mahouts. It also offers stage shows, which demonstrate how to catch wild elephants, elephants-at-work in the jungle, elephants playing football, a grand war and elephants’ parades. Elephant rides around the village are recommended. Useful Tips Thailand Q&A Q: are there any poisonous/dangerous animals or insects in thailand? A: Yes there are a few poisonous animals in Thailand, although there are very few incidents that occur. Generally speaking, you will only come into contact with venomous creatures when in countryside or jungle environments. Thailand does have poisonous snakes, scorpions, jellyfish and centipedes, but 99.9% of travelers never have any problems. Q: What are the penalties for drug possession like in thailand? A: If you are caught in possession of drugs in Thailand, whether it is a so-called ‘soft drug’ such as Cannabis or a Class A such as Heroin, you will be in deep trouble. Although some forms of recreational drugs are more socially accepted in Europe, you will receive the harshest punishments in Thailand, such as 25-years in a Thai prison. Please keep away from drugs, or it could be a mistake you’ll regret for the rest of your life. Q: Is the water in thailand safe to drink? A: Negative! Although drinking the tap water in Thailand will not kill you, you could get an upset stomach by doing so. Buy bottled water from the shop and use that instead, even when cleaning your teeth. Q: are the staff who work in the small roadside massage parlors fully trained, and would it be safe for me to take a massage there? A: If you are looking for a ‘proper’ massage in the hands of a fully trained specialist, it would be recommended for you to visit a real spa or health club to ensure you receive the best services possible. The roadside massage shops are very hit and miss, although they are quite cheap – but you get what you pay for. Q: In case of emergencies, what standard are the hospitals? A: bearing in mind you will have holiday insurance which covers medical bills from accidents or illness; you will most likely be treated in one of the nation’s international hospitals. Q: I am already in thailand but I didn’t ingest any malaria tablets before I came. Will this cause me any problems? A: Unless you are visiting the North of Thailand or marshland areas, there is no need to take malaria tablets. Q: Will I need to speak thai to get by? A: In all the major tourist destinations such as Bangkok, Pattaya, Phuket, Koh Samui, Chiang Mai and Hua Hin, you will easily get by just using English. However, if you are travelling across the country through rural areas and Thai towns, you will struggle to converse, so some kind of translation book might be a good idea, just in ase you find yourself in a squeeze. Q: Can I just turn up in a thailand beachside destination on spec and find accommodation? A: Generally speaking, yes, of course. However, during the high season months of November to April (especially Christmas and New Year) you might find yourself stranded without a bed for the night. This is a document that regulates the company’s operations and external activities. • Convene a statutory meeting Convene the first shareholders meeting to make all the necessary appointments, which must take place within a given time after it is formed. • Registration of the Articles of Association The articles of association of a Thai limited company together with the memorandum of association form the constitution of the company. The articles of association administer the internal affairs of the company and define the rights and responsibilities among the Thai or foreign shareholders and the kind of business to be undertaken. • Company Registration / Obtaining License and permits After the statutory meeting is held, the promoters shall turn over the business to the directors, who shall then cause the promoters and subscribers to pay immediately upon each share payable in money such amount, not less than 25%, as detailed by the notice, advertisement or invitation. When the shares have been paid, the directors must then apply for the registration of the company within 3 months from the date of the statutory meeting. • Tax / Social Security System Registration All companies in Thailand have to be registered for tax purposes and must obtain a company income tax identity card from the Revenue Department within 60 days of incorporation or start of operation. Same as all other business forms, once established, a limited company must also follow accounting procedures specified in the Revenue, Civil and Commercial Code. he atmosphere was palpable, as the hundreds of people in attendance patiently waited for the arrival of Thai singer/artist, Dome Pakorn Lum and his band, to grace the official launch party of Walking Street’s newest live music venue, The Stones House. The time was reaching 1am, the crowd were at fever pitch, and goodwill vibrations bounced off the walls like flubber. Camera phones and TV crews were capturing the ambiance of the club in full swing as neon lights jutted out in every direction creating mesmerizing visual effects. The house band were keeping the audience happy, kicking out their own rock renditions from the likes of Linkin Park. The crowd was electric to say the least, an interesting mixture of hi-so Thai clientele, trendy westerners, screaming Thai hotties salivating at the thought of meeting their hero, and even the appear-

ance of Pattaya Mayor, Ittipon Khunpleum, who is always good value for money. Sweat and excitement dripped from The Stones House mosaic-clad walls, within a beautiful looking music venue set over two floors where the best views are enjoyed from every part of the venue, even from the toilets! The Stones House has been open for the past couple of weeks, but tonight’s extravaganza was the official launch party, and boy did it take off in explosive fashion. All of a sudden, camera phones started clicking away like pump-action shotguns, the jubilant screams intensified as Dome Pakorn Lum entered the building. For those of you who don’t know, Dome Pakorn Lum has been in the limelight since he was four-years-old, working as a model for a cacophony of major magazines across the nation and appearing in over 30 TV commercials. Dome created his own band, NOLOGO, who were an instant success, forging their own brand of rock/ punk/pop/electronica, and the rest as they say is history.

In true rock star fashion, Dome and the band took to the stage over two hours later than advertised. Blasting through an 80-minute set showcasing his most famous numbers to the ecstatic and hero-worshipping crowd that bowed beneath his presence. Sounds crazy I know, but that’s exactly what it was like. As the show came to an end, the people filtered into Walking Street, where the sounds of excitement still filled the air. No doubt they will be back to visit The Stones House in the near future, because if their house band was anything to go by, then every night at the venue is set to be something special. The house band, with their excellent female vocalist, play a great selection of pop 38

music and a fantastic choice of classic rock, both English and Thai, along with contemporary sounds from the modern era. hopes of huge capital gains and simply listed the property knowing in the back of mind I’ll never get an enquiry on it. These are not the makings of a good realtor. Further along the spectrum is the realtor who advises a seller to list well under market price to ensure a sale – one that’s not going to be beneficial to the seller. Of course there are times when a seller asks how low to go to snag a quick sale – this is another situation altogether. But when someone asks what is the fair market listing price for a property and a realtor goes in well under, it really is detrimental to the market as it sets a low level of expectation for other sellers and unrealistic expectations for other buyers. It’s true the market has changed a lot over the past five years and there are definitely a few dinosaurs around town who have stubbornly refused to change with it, but even their cynicism would be more welcome to me than listening to the advice of the greenhorn handing me a brochure at Central. Making a snap investment of at least $40,000 just isn’t on the cards for most people, nor should it be. Market statistics are quite easy to come by in the west. In Canada I worked as an account manager for a sizeable newspaper chain and the databases we had at our disposal were incredible (this was 15 years ago - I can only imagine the info available nowadays). Sales statistics, household income,

This experience is invaluable to both buyers and sellers as we’ve seen the ebb and flow of trends and I believe have excellent foresight into future trends, opportunities and pitfalls. For instance, though there are several accredited valuation agencies in Thailand, including most Thai banks (albeit technically more appraisals for loan purposes than true market valuations), most sellers 52

still rely on local area professionals for property valuations, accredited or not, and most base their asking prices on the merit of their agent’s experience. It’s never easy telling a seller or potential landlord that their listed property is overpriced - yet this is something that we as agents are obligated to do. I have no problem telling someone they’re 10 – 15% overpriced, though when someone comes in with a property that’s worth 5 million and they think it’s worth 10, this is when things can get uncomfortable – though it’s our job to be honest. I must admit that there were times years ago when I really didn’t want to be the one to crush their

purchasing trends by district, age, education and you name it could be cross-referenced and combined to give very specific market stats and analysis. Needless to say it’s a much different animal here in Thailand. In a country where even the population of Pattaya can’t be nailed down, you can’t expect any true, concrete statistics. One would expect the land registry office to be at least somewhat forthcoming with sales statistics, though it certainly isn’t the case. Forget the number of sales - that most actual selling prices aren’t declared at the land registry make it virtually impossible to truly gauge what is selling and for how much. Though I do see market statistics printed here in Thailand, they are almost exclusively compiled from new condo/house sales – and though compiled by reputable developers and respected international brokers, I frankly don’t think they cover some of the more heavily traded aspects of the market. And considering the purpose of so many property purchases in Thailand are solely for rental investment, rental statistics here are also unfortunately lacking. Again, the responsibility of this falls on the dependence of brokers to be knowledgable and forthcoming with their clients. No one knows the true market better than the agents who are entrenched and are not only listing, selling and renting these properties on a regular basis, but have an ear to the ground for other sales and rentals happening around town. Insightful and legally legitimate contracts, assistance with bank transfers, foreign remittance documentation, title & company searches and property registration are all additional services that a well established agency should assist you with during your property purchase in Thailand. Proper navigation through this process can make or break your purchasing experience in Thailand, so be sure to choose your agent wisely.

When Buying Property in Thailand Although we are constantly told that a foreigner can’t buy anything in their own name in Thailand, this is simply not true. We cannot buy land, but motorbikes, cars and condos can be purchased in our own names. However, when buying property, there are some things you need to take into account to protect yourself further down the line that could surface if you and your Thai partner divorce. The first factor to remember is that if you are thinking of setting up a Thai company to purchase property, please make sure you don’t include your wife as one of the Thai shareholders, and also ensure that you don’t make any of your Thai shareholders the Managing Director of your company. ALWAYS transfer the money from your foreign account to a Thai account in your own name, which is very important. NEVER transfer the money directly into your wife’s account because the court will rule this as a gift if you try and retrieve the money during a divorce.

Always keep the Chanote title deeds for the property locked away safely and guard it with your life, even if the title is not in your name. By following the above steps, you can do your utmost to protect your best interests. It’s all about taking the correct steps and precautions at the start of a marriage.

Buying a Car or Motorbike Many foreign men in the past have tried to sell their motorbikes and cars, only to discover that their Thai wife has used them as security on a loan. It is important once again to ensure that you keep the titles of the vehicles in a very safe place. If you have already purchased property or a vehicle in your Thai wife’s name, it would be wise to ask her to sign a special agreement stating that all the money came from you and if at any time in the future you wish to have your money back that she agrees to sign a document at the land office. This is not a 100% guarantee, but if you do end up in court it shows intention on your and your wife’s behalf. British Law will give you sensible and considered advice from the outset. All you need to do is visit one of their offices and listen to their experiences.
