During the past few weeks, sports promotional guru, Barry Hearn, CEO of Matchroom Sports, was a visitor to Legends Pool Hall. Pattaya City Uncovered were fortunate enough to get an interview with Barry, who told us of his reasons to visit Pattaya, what he thinks of Legends, and how he believes Pattaya could be home to an international sporting event in the not-too-distant future. Please see a daytrip itinerary of three of the best temples and cultural attractions to visit in the Pattaya region. 10am - Viharnra Sien Temple A 30-minute drive out to Bangsaray is a great way to start the day to visit what is the most unique temple in the Pattaya region. Viharnra Sien is a Chinese-Thai temple complex located within luscious countryside near to the Buddha Mountain and Silverlake Vineyard on the banks of a large reservoir. Famous as being the Kingâ&#x20AC;&#x2122;s own project, the main temple is akin to a museum with many Chinese artifacts and even a full scaled down version of the famous Terracotta Army. Check out the art, sit by the banks of the reservoir and absorb cultural Thailand.

A bail bond is one method used to obtain a temporary release of an alleged offender or accused person awaiting trial upon criminal charges from the custody of law enforcement officials, sometimes on condition that a sum of money or other form is lodged to guarantee their appearances in court on scheduled dates. If the individual is proven not guilty, or appears for imprisonment upon being found guilty, the Court will order the bail bond returned on the day the judgement is read without the need to submit a request. If the alleged offender escapes, or otherwise fails to appear in court, the bail is forfeited. In many cases, when the alleged offender cannot raise the bail themselves, they hire a bail bondsman or bail bond agent to pledge the security to the court. A bail bondsman can be any individual, juristic person, or entity that acts as a surety and pledges money or assets as bail to ensure the future appearances of an alleged offender in court. Private bail bond companies have already been allowed by the Thai Law to post bail for alleged offenders except for drug-related cases. This is provided by most insurance companies through a bail bond policy. Alleged offenders may be released without bail in less serious cases such as defamation, extortion, minor theft or injury caused in a fight. The judge will decide whether the alleged offender is eligible to be released on bail and at what cost. The minimum bail amount may vary because the amount of bail for each case is set by the presiding judge of each jurisdiction, considering each particular criminal action and its evidences. The more serious the charge is, the higher the bail will be. A written request with all the necessary documents must be submitted by a bail bondsman to the investigating officer. The result of the bail review shall then be announced within 24 hours.

In Thailand, there are 3 guarantee categories when submitting a request for a temporary release: 1. Request for temporary release by using assets (title deeds, bank accounts, etc.) 2. Request for temporary release by using cash 3. Request for temporary release by using the employment status of a public official (Government, Police, Military, Political officials and State Enterprise Employees may be used as Bail Bondsmen wherein bail rates are set from 60,000 Baht up to 800,000 Baht depending on one’s position) In considering a temporary release, the court shall use the following criteria: • Seriousness of the offence • Sufficiency of the existing evidence and the credibility of the witness • Circumstances of the case • Trustworthiness of the person filing the request or the guarantee given • Likelihood of the alleged offender to escape • Likelihood of the alleged offender to create danger caused if released • Likelihood of the alleged offender to destroy evidence or threaten any key witness • Existence or non-existence of an objection by an inquiry official, public prosecutor, plaintiff or witness If provisional release is ordered, the court will issue a receipt for the asset or for the amount of cash posted as a guarantee along with an appointment letter. The bail bondsman or the person providing guarantee or security shall be bound to sign a guarantee agreement in which he ensures to bring the suspect or alleged offender to court on the date of the appointment. Failure to comply shall subject the bail bondsman to penalty as provided for in the agreement. he 1980s ushered in a more modern time where electrical gadgets were becoming a part of everyday life and elephant-sized mobile phones were starting to be seen in the yuppie and financial worlds. On the music scene, punk came and went, leaving a cyclone of devastation behind; MTV gave birth to the first music video platform, a new music culture called hip-hop was born in South Bronx and Cameo’s red leather jockstrap was aggressively protruding its way into our living rooms making us all feel inadequate – word up! Things were also changing in Pattaya, as what was once a fishing village was becoming a burgeoning tourist destination in its own right. The word was out and there was no turning back. Pattaya had now garnered a reputation as being one of the sex capitals of the world and things would never be the same again. The city became a Mecca-like location for middle-aged bar mongers looking for cheap thrills or as a sort of therapy or after-pill remedy for recent divorces. The world had finally discovered Pattaya and it was intrigued to say the least. Impoverished Thai girls, mainly from the Northeastern Issaan region, were still flocking to the city looking for work, like starving lionesses sweeping majestically across the Serengeti, praying on the ambling wildebeests that came their way. The term ‘sex tourism’ hadn’t even been coined before Pattaya became a sex capital, but it sure had by the end of the 1980s.

There were many hotels and resorts in the city such as the Montien, Royal Cliff, Grand Palace (Dusit), Siam Bayshore, Siam Bayview and the Merlin (Hard Rock). The demographics of the city were quite eclectic at the time with also lots of Thai families also visiting for a few days to see what all the fuss was about. By the late-1980s, more infrastructure was starting to be constructed such as a footpath along the beach and water treatment plants. Visitors had started moving away from the Walking Street area and began to explore other areas such as Naklua and Jomtien. This sparked the next phase of growth that started in the 1990s and is still ongoing today.

On the 31st October at the Corner House in Jomtien, we are proud to announce that Pattaya City Uncovered will be running a fundraising evening for the Pattaya Crocodiles charity. The charity was founded and is run by Heiko Diehl, giving local kids from poor backgrounds an opportunity to play football, by not only practicing, but also by actually taking part in a real team in the local junior leagues. The project ensures that the children get to play for free on pitches throughout the city, with Heiko also managing to provide the kids with football shoes, socks, shorts, balls, match jerseys and all manner of equipment for their under-14s team that currently plays in the local youth league. Our fundraiser will be hosted at the Corner House in Jomtien on the 31st October, aiming to raise

20,000 THB for the Pattaya Crocodiles teams, to help pay for the league fees for 4 teams, pitch fees, new kits, balls and other equipment needed to keep the charity going. It really is a great cause. the lowest in 10 years, (2) You can avoid tying up all of your invest-able cash into one asset, which allows you to diversify into other investments that offer good returns, (3) Financing gives the buyer time to sell off other assets to possibly pay back the mortgage faster, and (4) A flexible pay back schedule can be negotiated so that the buyer does not over-extend themselves. So how does it really work - Let’s start from the beginning. We have a seller who wants to sell their property with the option of financing. Most sellers we have been dealing with are interested in financing an average of 50% of the total cost of the property. So let’s say the property is 6 million Baht. We manage to secure a buyer for the property who can put down 3 million Baht up-front and wants to have the last 3 million Baht financed by the seller for five years. The seller is asking an interest rate of 6% per annum.

hough the market is quite buoyant at the moment, given the amount of houses on the market, it’s not surprising that many house sellers are more open to flexible payment terms than before.

We all know how difficult it is for us unsavoury foreigners to successfully obtain bank financing/mortgages from Thai banks. I’ve had a few customers over the years who have managed to secure financing for 50% of the bank’s estimated value of the property (usually around 85% of the actual selling price). But, speaking from personal experience, it’s not an easy process to go through. In the past, if you haven’t been in a position to pay the full agreed selling price, your best option was to buy something (house or condo) off-plan and at least be able to make stage payments throughout the build period (typically 6 – 9 months for houses and between 12 and 48 months for condos). But

what if you want to buy something that’s already built and ready to move into? This is where seller financing comes into play, and it’s becoming more common today than ever before. It is a very easy, safe, legal and affordable solution to many buyers and sellers. It can be fully registered at the land office and is even indicated on the back of the title deed (chenoud), much like a registered lease. Seller financing really can work well for both the buyer and the seller. From the seller’s point of view, the benefits are really three-fold: (1) Your property is appealing to a broader customer base, (2) With the interest collected, your return is much better than having your money sit in the bank, and (3) If the buyer defaults on the agreement during the course of the finance period, the property is yours again with all monies collected in pocket. From the buyer’s perspective, there are four major benefits: (1) The current market interest rates are

There are a couple of options as far as how the money is paid back. Some owners aren’t too fussed if they get back any of the 3 million Baht principal during the five year period – only have the interest paid to them during the finance period with the 3 million principal sum paid in full at the end of this period. Meaning they would make payments of 180,000 Baht per year as interest with 3 million Baht paid at the end of the five-year term. The most popular option works the same way a fixed bank mortgage would work – as in the payments are amortized over the five year period (First year - 3 million x 1.06) x (Second year – 3.18 million x 1.06)…etc., etc…Whereas the total sum of five years of amortized interest and the principal are divided into 60 monthly payments.

now be in the name of the new buyer, but underneath it will show that there is an outstanding mortgage owed to the old owner (seller). If you have ever transferred a property at the land office where the seller has a bank mortgage on the property, it’s essentially the same thing. Once the mortgage has been paid off, another 1% of the mortgaged amount must be paid to the land office to have the mortgage removed from the chenoud…and that’s that. Should the buyer default on their mortgage, according to the terms and conditions in their mortgage agreement, the seller simply has to take the mortgage contract to the land department, show that the buyer has defaulted and the buyer’s name is removed from the chenoud, and the property’s ownership is reverted back to the original seller’s name. I’ve had a couple of sellers who have asked to have their mortgage agreement remain private. The seller doesn’t want to transfer the property whatsoever until the full amount has been paid back to them. In this case, it is easier for the seller to take back their property should the buyer default on their payments. However, from the buyer’s perspective, they don’t have the same sense of security as when you register the mortgage at the land office. Having said this, a solid contract can be drafted and notorized that clearly outlines the terms and conditions of this private agreement.
