Section 56.4: Has the use of the expression ‘Department of the Attorney General’ in Section 4 any special significance? The Attorney General’s Office is not a Department under the Ministers and Secretaries Acts.131 Article 57: Section 3 provides that the place of any member of the Commission to exercise the Presidential functions who may be unable to act shall be taken by the ‘next senior judge of the Supreme Court available’. (What is to happen if one of the officers designated as a member refuses to act)132 or (if the Chief Justice, the President of the High Court or the Chairman of the Chamber of Deputies dies in the rather long interval between the coming into operation of the Constitution and the entry of the first President upon his office?)133 Although it is provided that the Commission may act by two of its members, (the question arises whether the loss of one member would not automatically terminate the existence of the Commission or deprive it of its right to function),134 in view of Section 2 which refers to ‘a Commission consisting of the following persons, etc.’ One of these persons is the ‘member of the Chamber of Deputies (Dail Éireann) who is immediately before the said repeal’— i.e. of the present Constitution—‘Ceann Comhairle’. He is unique and irreplaceable. The others are persons holding officers to which appointment is by the President or a validly constituted Commission to exercise the Presidential functions.135 Article 58: It is observed that there is no precise provision to the effect that the Chief Justice of Saorstát Éireann shall become and be the Chief Justice of Éire such as has been inserted to cover the transfer under Article 56.4 of the Department of State, under Article 59 the transfer of the Comptroller and Auditor General, and under Article 60 the transfer of every Commissioned Officer of the Defence Forces. Without such express provision it is not quite clear how the Chief Justice of Saorstát Éireann becomes the Chief Justice of Éire and yet he has got to function in such office under Article 57.2 before the entry of the first President to his office.136 Dréacht-Bhunreacht na hÉireann Notes on Revised Draft Annotated: ‘The reference to the A.G.’s Department has been deleted’.
