Choosing between cremation or burial?

The Funeral

The first choice people usually make is about the type of funeral service that will take place. Whether you choose a burial or a cremation, we will be there to make all the arrangements on your behalf.

Some things to consider about a burial:

The first decision to be made for any funeral service is whether it is a burial or a cremation. You will also need to decide where the service will be held, this may be at a church or place of worship, at a crematorium, at the graveside or somewhere else. In the case of cremation, there can be a service at a church combined with a shorter service at the crematorium chapel.

• Y ou may already have a family grave or plot. We can arrange for this to be reopened and the headstone removed before burial. • I n some areas, burial space may be limited. • Y ou might want to reserve plots or a large plot if you or your family want to be buried close by. •W oodland burials are now available in many areas in the country. • Y ou can hold the funeral service in a local church or in a cemetery chapel. •A fter the burial, you will need to consider if you want a memorial headstone or a new inscription on an existing headstone.

Some things to consider about a cremation: ​• A full funeral service can be held at the crematorium. Most will have a service room or other appropriate facilities. •T he service may also take place in a church or another location before going to the crematorium. •T here will be a strict time limit for the length of the service. This will vary depending on the crematorium. • Y ou will need to decide the final resting place of the ashes. You can keep the ashes in an urn, scatter or bury them. •W e can advise you if any restrictions are in place at your chosen crematorium with regards to the choice of dress for the deceased, or placing any possessions in the coffin. •S upplying information about the deceased

Whether there will be a burial or a cremation may already have been made by the deceased, this might have been in discussion with family members or in their will. The arranging of the funeral service involves many elements. We will take care of all of the details. We will listen carefully to your requirements, help you make important and difficult decisions, liaise with third parties, and are responsible for ensuring everything runs as smoothly as possible on the day. We will guide you through the options when you have to make decisions about the arrangements.

The funeral service is a way of saying goodbye to someone who has died. We are here to take you through the decisions you need to make to ensure you can arrange the funeral you want for your loved one.

•C ost to purchase a new grave. •O pening or re-opening an existing grave. •R emoval and replacement of any existing memorials, headstones, etc. •A n exclusive right of burial.

In order to make the funeral arrangements we will need: •T he full name of the person who has died. •T heir full address. •T heir date of birth. •D etails of where and when they died. •C onfirmation of whether the person who has died had a pacemaker fitted. •P acemakers/ defibrillators (ICD) must be removed before the cremation.

Mark Forth Funeral Plans

We currently offer the Ecclesiastical Funeral plans Advantages of a Prepayment Plan ​ any people wish to provide for their funeral expenses and M a funeral prepayment plan is a caring, sensible and costeffective way to do so. ​ The advantage of a prepayment plan over a savings account or life insurance policy is that you can secure the cost of our professional funeral directing services in advance. Once your plan is in place, as long as we carry out your funeral and your requirements don’t change, these services are covered, no matter when the service might be required. You can also make a contribution to third party costs which are outside of our control and cannot be guaranteed. ​ Funeral prepayment plans are provided by Ecclesiastical Planning Services in association with a network of Funeral Directors throughout the UK. Funeral prepayments are held in guaranteed whole of life assurance policies and every penny (minus the initial management fee) is ring-fenced for your funeral. When your plan is needed, the money is released to us immediately, enabling us to carry out your funeral.

You can choose your own funeral arrangements, for your own peace of mind You will save your family from having to make many difficult decisions, trying to guess what you would have wanted, at such a distressing time.

Making sense of the legal stuff . . . When someone in the family or close to you dies, you will have a number of legal responsibilities to manage. Calthrops Solicitors can help Clients just like you. Sorting out the legal aspects of bereavement can be emotional, stressful and can seem overwhelming at times. Calthrops Solicitors can help you work through it all and will do everything we can to make things that little bit easier.

There are a lot of practical things that need to be done after someone dies. There is not a set order to do them in but most will need to be sorted out within the first few days. If the person lived alone, you will need to make sure that their home and possessions are secure. Someone should go to their house as soon as possible and take security precautions, such as, moving valuables out of sight, cancelling milk and paper deliveries and locking windows and doors. All of the persons possessions should be left in the house until they have been valued (this may need to be done for inheritance tax purposes). You will then need to establish whether or not the person who died left a Will and, if so, the names of the individuals they have appointed as their Executors. The death will need to be registered, this should be done within 5 days in England and Wales and 8 days in Scotland. The only exception to this is if there is going to be an inquest. In this case you will be given an interim death certificate by the Coroner to prove that the person has died. The Executors will gather in all of the information concerning the deceased’s estate. They will need to know the value of investments and balances in bank or building society accounts as at the date of death. They will need to seek valuations of any houses or other real estate. They will need to contact insurance companies and pension organisations. In addition to finding out information about assets, they will also need to gather information about any liability that the deceased person had at the date of their death, such as loans or credit cards. It may be that they had outstanding care home fees or utility bills. All of this information is needed in order that it can be assessed whether there is a need to apply for a Grant of Probate. If there is no Will, then the law sets out who is entitled to administer the estate and who inherits it. If you cannot find a Will, the closest relative of the person who has died (usually a spouse, parent, child or sibling) should contact a solicitor. They will be able to help carry out a further search.

If you are unsure whether the estate is liable to inheritance tax, or if you are unsure whether any exemptions and reliefs apply, then it is best to get advice from your solicitor. If an estate contains real estate or is valued over £5000 it may be necessary to obtain a Grant of Probate before an Executor can administer the estate. A Grant of Probate is a legal document issued by the Probate Court. It confirms that the Executors have the authority to administer an estate. Where there is no Will you will be issued a document called a Grant of Letters of Administration. The Grant of Probate and the Grant of Letters of Administration are collectively referred to as Grants of Representation and both will allow you to access and close bank accounts, sell property, pay debts, distribute funds and reimburse funeral expenses. Whilst you can apply for a Grant of Representation yourself, you do need to complete lengthy forms and this is particularly the case if there is inheritance tax to pay or if you are claiming a residence nil rate band. If you think there will be inheritance tax to pay, it is often best to speak to a solicitor. The process can be complicated and usually you will need to pay at least some of the tax, before you can apply for a Grant of Representation. Executors have personal liability for loss to the estate from a breach of duty, failing to protect the value of assets, failing to pay the people entitled or paying the wrong person. A breach of duty can also arise from the failure to do something, ignorance of the process is not an excuse. HMRC have a new penalty regime and penalties are now due to careless mistakes. An Executor is legally responsible for administering the testators estate in accordance with the term of the Will. An Executor can be held personally liable for a loss to the estate resulting from the actions they take as well as any actions they do not take.
