LAW OFFICE

YOU AND THE LAW

TROUBLE SORTING THINGS OUT WITH YOUR EX? THERE'S HELP It’s no secret that settling disputes with your ex after you’ve split can be difficult. And where children are involved, you can’t just walk away from each other, as you’ll both want to be involved in the kids’ lives. Going to court to sort things out is not always the best. And with accusations flying back and forth and the adversarial nature of the whole exercise, it can result in increased bitterness and poison an already broken relationship further, no matter who “wins.” But there’s some good news. The new family law that’s been around for a couple of years now is refreshing. It encourages other preferred ways of dealing with family law disputes, with court as only a last resort. These other options offer a wide spectrum of approaches for sorting things out so there’s a better chance you each get what’s most important to you and the children come out ahead. Here’s a quick rundown. Mediation: The two of you agree to engage a neutral individual, who must be properly qualified and trained as a mediator, to help you negotiate compromise solutions to thorny issues. She will help you see what’s key to each of you, so that you can settle on a solution that works for you both. Unlike a judge or an arbitrator, a mediator doesn’t hand down a decision or award, so there is no imposed solution. Mediated solutions, perhaps because mutually agreed, therefore tend to stick. Mediation is relatively informal, and can be surprisingly successful. Arbitration: You both agree to engage a neutral individual, who is a properly qualified and trained arbitrator, to listen

to both sides. The arbitrator then makes a decision, called an “award,” deciding the tough issues before her, like a private judge. This is a more formal process, though less so than court, and the arbitrator’s decision is binding on both of you. Mediation/Arbitration: This is a combination of mediation and arbitration. The two of you agree to try, with the help of the neutral mediator/arbitrator, to work out a compromise solution. But should that fail, the two of you also agree that the mediator/ arbitrator can make an arbitration award, which is binding on both of you. So unlike mediation, there can’t be a deadlock, and unlike arbitration, there’s a better chance at a negotiated compromise up front. Parenting Coordination: This can come into play where there’s a separation agreement or court order which covers parenting arrangements, but the two of you have continuing conflict about how to carry them out. Pick-ups and drop-offs, suitable recreational activities, birthday parties on the other parent’s time, play dates, the start and end dates of holidays like spring break (Friday or Monday?), are just some of the more frequent flashpoints. A properly qualified and trained parenting coordinator, appointed by mutual agreement or the court, acts as a mediator/arbitrator to try and work out a mutually acceptable solution or, if that fails, makes a “determination” that is binding on both of you. Tyleen Underwood is an accredited Family Law Arbitrator and Mediator. She is also a trained neutral child interviewer who is on the roster of the BC Hear the Child Society.

Winning Photographs Grace Nelson Library Walls

The West Kootenay Camera Club has clicked with our region’s camera enthusiasts for 25 years, sharing tips and expertise, enthusiasm and support, and a love for the art of photography. In celebration, the club is showing work throughout the Kootenays, including a special show at the Nelson Public Library in May and June. Each year the Club holds a photography show and competition, this year at the Kootenay Gallery in Castlegar June 5 -12, showcasing the work of talented local photographers vying for prizes. This year’s show, with more than 200 entries expected, celebrated a quarter century for the West Kootenay Camera Club. Last year’s winning photographs make up the Nelson Library show. Photographers include Jim Ford (portrait and travel categories), Jim Lawrence (wildlife and nature categories), Peter Moll (human interest), Marie Croteau (flowers), Jerry Schmidt (junk), Ross Scott (open category), and Nel Vandergaag (architecture). The Camera Club meets every second Monday, September through June in the Castlegar Library meeting room, and they welcome new members. Monthly friendly competitions help hone skills, and there’s an annual photo show. There are workshops, field trips, and opportunities for good fun. Cafe Langham Water Series

The Salmon Ambassador’s Story is the third Cafe Langham of the WATER series, to be presented on Thursday May 28 at 7 pm. Recently appointed as one of two, Salmon Ambassadors by the Canadian Columbia River Inter-tribal Fisheries Commission and the Ktunaxa Nation Council, Gerry Nellestijn will share information about water, the Columbia River Treaty and the opportunity of Treaty initiatives focusing on salmon reintroduction in the Basin waterways. On Monday June 15, join other Café Langham enthusiasts for a rare opportunity to learn first hand about the archaeology of the area at Lemon Creek on the Slocan River and visit one of the largest and oldest pithouse village sites in the Columbia Basin with anthropological archaeologist, Dr. Nathan Goodale. Cafe Langham is organizing a field trip to the Slocan Narrows Archaeology Project (SNAP) with Dr. Goodale, who leads the field school from Hamilton College, New York. He will take participants for a walk-about and introduce his students who are working on the pithouse site which has a history of occupation by Aboriginal peoples going back more than 3,000 years. From Columbia River Treaty Roundtable website: “The Columbia River is one of the most remarkable rivers on earth, and draws water from a basin about the size of France. When, in the early 1800s, explorers Lewis & Clark and David Thompson first stepped into the watershed, they found a river of life. 16 to 40 million salmon returned each year to natal streams in the Basin’s forests and deserts, renewing a great cycle of life. This was a place where indigenous people lived as they had from time immemorial, depending on salmon and the river.” The Langham Cultural Society invites residents and visitors both to join us in varied conversations about rivers, salmon, history and the importance of water as a life-sustaining element. For more details and to register, contact the Langham Living Arts WATER series by email langham@netidea.com or phone 250-353-2661. Submitted Langham Cultural Society

Harrop Wetland Restoration Project

Over the last year many people have helped out with restoring the Harrop wetlands in the Harrop portion of Sunshine Bay Regional Park. On Friday, April 24 Friends of Kootenay Lake held a community celebration to help raise awareness about their values. The celebration included the unveiling of the beautiful interpretive signs made with artwork from Redfish Elementary School students. PAGE 30

The goal of the wetland restoration project was to improve the fish and wildlife habitat on one of the few remaining wetland areas on the shores of Kootenay Lake. The project focused on: restoring three existing wetland ponds; building a snake hibernaculum; establishing a long term citizen science amphibian monitoring group; raising community awareness about the values of wetlands; creating painted turtle nesting habitat; and planting native trees and shrubs. The restoration will improve habitat for provincially blue-listed species including western toads, great blue heron, and painted turtle. Submitted by Claire de la Salle

A Win-Win Situation

What could have been a problematic issue in Procter was resolved through cooperation between the West Arm Outdoors Club (WAOC) and Nelson Hydro. The wildlife organization has been working on building a fishing platform just east of downtown Procter across from the Balfour ferry terminal for over five years. Pilings have been driven and walkways are expected to be installed in the coming months. This is in close proximity to where Nelson Hydro is running their line as part of the Outlet area upgrades. Nelson Hydro amended their routing slightly and provided mechanical assistance to club members replacing I-beam cross members with box beams to ensure proper engineering specifications. In turn, the club worked within Nelson Hydro’s scheduling and has adapted a section of walkway to ensure the utility has easy access should it be needed in the future. “We really appreciated Hydro’s understanding, and the assistance they provided with their on-site vehicle made switching out the beams so much easier,” said WAOC President Gord Grunerud. Nelson Hydro’s project manager Doug Pickard was also pleased. “The guys were understanding, cooperative and didn’t impede our work at all. It was nice to be able to lessen their workload with equipment that was on-site.” The fishing platform will enable children, those without boats and the physically impaired to fish in the West Arm. The $100,000 project will feature wheelchair accessible ramps and walkways with a 32 foot by 20 foot fishing platform attached. “Lots of kids used to fish off the old wharf that was here,” said Grunerud. “When we finally get it built we hope it will attract anglers of all ages, especially those just starting out in the sport. They are the future members of the club.” Submitted by Bill Macpherson

Recycling Hours Reduced At Kokanee Marina

Visitors at the Kokanee Marina next to Kokanee Creek Park have been seeing more than just recycling at the collection bin the last few weeks. A bear has been spotted around the recycling bin several times. “I’ve seen bears stand up with their paws on the bin and reach in for items at this site. If people are going to use it (the recycling depot) then they should use it properly. If recyclables are cleaned, then the attractant is minimized,” says conservation officer Nathan Smienk. When bears become dependent on a human provided food source it can become a potentially dangerous situation for the bear as well as people in the area. In response to this situation, the RDCK is working with the marina owner to try and prevent the bins from being an attractant. The recycling depot has historically been open 24/7, but as part of efforts to mitigate human/wildlife interactions, the collection bins will now be open from 8 am to 7 pm daily. The public is requested to assist the RDCK by limiting their use of the Kokanee depot to only the hours that the bin is open. The RDCK will be posting signs at the site and encouraging people to manage their recycling responsibly, as that will have the biggest effect on the outcome of this situation. If the issue persists, we may need to consider closing the bins temporarily in which case residents can bring their recyclables to the Balfour Transfer Station during open hours. Residents and visitors to the area can help out this bear and other wildlife by doing the following; • Clean all recyclables (the scent is an attractant for bears and wildlife) • Do not dispose of garbage in recycling bins • Do not leave garbage or recyclables outside of the bins. This could potentially make the problem worse. • Remember that bears belong in nature, and we can all help to ensure they stay there if everyone is responsible with their waste We are all lucky to live in such a wild, beautiful place and we want to do our part to keep it that way. Everyone, everywhere, every day, uses tools for something ‌ gardening, exercising, eating, building, farming, an endless list. Vans Susan and daughter Rachael, at 2014 walk

Walk For Arthritis

Run, jog, bike, swim. We all hear about these events that are fundraising for research for cancer, heart, MS, etc. However, for some folks with arthritis it’s a very hard thing to do. I’d like to tell you my daughter Rachael Kimola’s story. When Rachael was 18 months old we discovered she had JRA, Junior Rheumatoid Arthritis. That’s when our lives changed. There were many trips to Vancouver for hospital stays and doctor’s appointments, but she did it all with determination. By the time she was ten year old she was using an electric wheelchair – that gave her freedom. We knew Kaslo was the place for us when Mr. Dunnet, Rachael’s teacher at JV Humphries, had the school build a ramp for her. After graduation she went to the Shriners Hospital in Spokane for hip and knee replacements. Once she recovered from her surgeries, we passed her wheelchair on to Mr. MacKenzie, in hopes it would give him some freedom. Rachael then went to Mount Royal College in Calgary. During that time she had surgery to replace both elbows, shoulders and one ankle. It’s hard to believe it only took her five years to graduate from college with degrees in broadcasting and journalism. Now living in Kelowna, Rachael does as much volunteer work for the Arthritis Centre as she can. She formed a support group and started a team called the YAWA’s, Young Adults With Arthritis. I am their mascot, and am asking for your help in raising money here in Kaslo, where she did most of her growing up. This years Walk For Arthritis is Sunday, June 7 in Kelowna. This will be my fourth year participating in a fun time, with food at the end of the walk! For more information on how to donate please go to walkforarthritis.ca donations to team YAWA or you may contact me at 250-353-2632. Thank you, Susan Stark
