hile 2014 saw a number of problems affecting Thai tourism, locals and internationals flocked to neighboring Cambodia especially for the New Year festivities. According to Cambodian government figures, the total annual number of visitors reached three million for the first time. Far and away the most popular attraction was Siem Reap and the neighboring Angkor Wat temple sites which accounted for over a third of all visitors. More tourists came to Cambodia by Siem Reap airport than any other air or land entry point. The next most popular venue was the beach resort of Sihanoukville which is now linked to Siem Reap by air. However, tourist arrivals by land crossings from Thailand actually dropped by about five percent in 2014. This is believed to be linked to new regulations by the Thai authorities which appear to restrict re-entry for some foreigners without a prior visa. Ladyboy robbed tourist

A 53-year-old Sri Lankan tourist, Rajaratnam Velautham, got into conversation with a transvestite and his woman friend and agreed to pay them for services to be rendered at his hotel room. At the hotel, the ladyboy suggested the tourist take a shower but used the opportunity to steal the equivalent of

80,000 baht before doing the disappearing act. The ladyboy had left his ID card at the hotel reception and was later traced by conscientious police officers. He confessed to committing the crime alone and said his friend does not have to do anything with it.

Bag snatchers arrested Water bottle jammed brakes

Two Cambodians on a motorbike were hit by a car on Phettrakul Road, Central Pattaya, whose driver was unable to apply his brakes. This was because a plastic water bottle had wedged under the brake pedal without the driver noticing. The car owner Noppasit said he would be personally responsible for the medical bills at Banglamung Hospital and expressed his relief that nobody had died in the highly unusual accident.

Knifing caused by fakes

Police hastened to Central Pattaya after hearing a Russian tourist had knife wounds in his ribcage. The victim Ivan Cherkashin, 22, was drinking coffee in a cafĂŠ when a salesman tried to entice him to buy watches. But the farang realized they were fake timepieces and flatly refused to make any cash offer. This in turn led to a quarrel in which the hawker used a knife to inflict a serious wound. The victim was taken to Pattaya Memorial Hospital but the watch seller fled the scene and is being relentlessly hunted.

Two teen motorbike riders were chased by police and arrested after they snatched a woman’s gold necklace near the Walking Street area. Supawadee Amutsri, 22, told police she and her foreign boyfriend were riding a bike on Beach Road when the attack occurred. Fortunately, police at a checkpoint heard the victim shouting for help and gave chase. The culprits, both aged 17, admitted their crime but said it was their first time and they were not yet clever enough to escape.

Bedroom on fire!

Firefighters rushed to a residence in Soi Kasetsin, Nongprue, after hearing that the upper floor of the house was alight. The owner, Steven Leonard Brewster, was waiting for assistance and said his wife had lit a cigarette in bed and then came downstairs without extinguishing it. He added that he could soon smell burning material and rushed upstairs to find the bed on fire. He and his children managed to throw the bed into the pool but by then the inferno had spread. They continued to battle the smoke and flames until the fire brigade arrived. Nonetheless, the squirting took 20 minutes to bring the problem to an end.

Nong Nooch Pattaya and tourism officials have announced that the famous garden will again be represented at the Chelsea Flower Show which will be held in London from May 19 to 23. Nong

Nooch has won gold medals at the show for five consecutive years and the theme for the 2015 competition will be “Thailand: Land of Buddhism” with an expenditure of 20 million baht.

On a recent visit to Pattaya, the 2014 EuroFormula Open Champion, Thai-born Sandy Stuvik, could not resist a visit to the EasyKart race track where he met 30 teenagers from the Father Ray Children’s Home. While this 19-year-old could be described as one of the fastest teenagers in the world, many of the teenagers he met that day were nervous about sitting in a go-kart and racing around a track. But Sandy met with everyone while they were sitting in their karts, giving words of advice and calming several down.

It seems many of the boys from the Children’s Home took his advice as they sped around the race track, overtaking each other and all hoping to be the one who is announced the fastest around the course. But there was one young man who surprised everyone with how fast he drove. Normally a very shy teenager, give him a crash helmet, sit him in a go-kart and he was like a bat out of hell. - Derek Franklin

crossings when they sought to visit Thailand again after only a short break. In practice, the new regulations were applied mostly to foreigners who were regularly crossing the border over a period of months, and Prime Minister Prayuth Chan-ocha ordered the Thai immigration authorities to be flexible in the interpretation of regulations. Foreign ownership of property is also on the rise in Cambodia. Foreigners can now own units in condominiums or co-owned buildings, excluding ground or underground floors, and providing total foreign ownership does not exceed 70 percent, which contrasts with the 50 percent rule in operation in Thailand. However, Cambodian islands operate under different rules and ownership there by foreigners on a freehold basis is not permitted. Phnom Penh and Siem Reap have recently both witnessed a boom in condominium and apartment building with most foreign buyers coming from ASEAN countries and China. Wealthy Russians are also interested in foreign property purchases in order to park their spare

capital during the Russian economic crisis. However, aliens wishing to work in Cambodia are now finding it more difficult than before. The government is currently resurrecting the long-ignored requirement for a work permit, although defaulters will be fined US$177 for each year of illegal working, rather than deported, in the initial campaign. Separately, Cambodian companies wishing to employ foreigners must notify the Ministry of Labour what skills and positions aliens are required to fill. Currently, there are about 20,000 foreign work permits in circulation, for a one- or two-year period.

They cost US$100 and are generally less bureaucratic than their Thai counterparts. Travel consultants agree that Cambodia’s success in attracting increasing numbers of international visitors has several roots. Although petrol and electricity are more expensive in Cambodia, compared with Thailand, the cost of daily living and entertainment in Cambodian cities is generally much less than in Bangkok or Pattaya. There are fewer restrictions in Cambodia on, for example, the sale and consumption of alcoholic drinks. Cambodia also has the attraction of being a “new” destination for many foreigners since it has

been open for tourism for less than 20 years. On the negative front, Cambodia has a poorer infrastructure than Thailand, especially when it comes to health and educational facilities. There is virtually no public transport in the country and an efficient rail network is still a distant dream. However, enormous Chinese investment in Cambodia can be seen everywhere in the country from the new skyscrapers going up in Phnom Penh to the massive road improvements in parts of the countryside. In return, Cambodia is the key Chinese political ally in the ASEAN consortium of 10 regional countries.

News Coastal Command makes merit

Captain Eaksompong Sornarkard, commander of Air Corporation One, hosted a merit-making ceremony on the 23rd anniversary of the founding of the institution in Rayong.

The main role of the corporation is to protect the air and coastal region. Ten monks took part in the ceremony where scholarships were presented to the children of officials.

The home improvement retail company HomePro has opened its 72nd branch in Thailand in North Pattaya and the fourth in Chonburi province. The store will provide advice and facilities for installation and maintenance of a wide range of

domestic features. The new branch cost 555 million baht and has a total staff of over 200 personnel. HomePro is also involved in charity work and has recently improved restroom facilities at two local schools.

Volunteers fill your tank St u d e n t s a t Pa t t a y a Technical College helped to reduce the stresses of the motoring public by refilling gasoline and checking air pressure in tyres among other automobile safety procedures. The idea was the brainchild of college director Pariwat Tanisaro who wanted both teacher and student volunteers to introduce the new year in a novel and service-minded way. The scheme had the support of Chonburi vice governor Chaowalit Saeng-uthai who presided over the opening ceremony.

New recruits graduate Group Captain Samarn Kanthapong, commander of the recruitment center of the Navy’s Education Department, presided over a ceremony in which 3,846 recruits marked their success in physical, mental and moral training over the past two months. Samarn said the cadets had performed well as they prepared to serve HM The King, the Thai Navy and the country.

The Tourist Police are a special division of the Royal Thai Police. The FTPA assist with carrying out the functions of the Tourist Police including assistance to tourists and local community members, helping to resolve misunderstandings and disputes, offering general advice to tourists and providing services for international events from time to time. We operate primarily in the Walking Street/Beach Road entertainment area, nightly from 9.00 pm to 2.30 am. A 49-year-old Swiss tourist, Henri Selmar Kaspar, was so angry that he had bought a packet of cigarettes, thinking it was ganja, that he quarreled with the stall holder and demanded his money back. But Supphachai Saladaeng was disinclined to refund the 100 baht and hit the farang with a wooden stick which was handily nearby. He said in his own defense that he thought the Swiss man was going to attack him with a stun gun. The incident occurred at Bali Hai pier and police adjourned the matter to the police station in view of the complexity of the case.

Car theft thwarted

A Swedish businessman was struck by a Jet Ski operator as he was walking near Pattaya beach. Fredo Kazenai, 51, observed that the operator was arguing with a tourist and telling him to pay for alleged Jet Ski damage. Kazenai suggested that they should adjourn to the police station for an adjudication, but the operator disliked the idea and struck the Swede. Police arrested the alleged assailant, Chawalit Janthong, 27.

A man who left his car key in the ignition got a nasty shock when he went outside and saw a would-be thief about to drive away. Opat Chonnabut, 35, said he was in his house packing for a trip when he heard the crash of a flower plot near the front door. Neighbors rallied to assist, successfully preventing the theft by the transient who was identified as having a mental problem and a criminal record.

Video clip shows indecent exposure A woman took a video clip of a man behaving in a most rude fashion and police acted upon the information to conduct a search. Thitipatcha Pangklang reported that she was enjoying a meal with friends when a man passed by on a motorbike. He stopped a short distance away and removed an apron which was covering his private parts. Several people became very angry and phoned for the police. Apparently the same man has a history of this kind of thing. He was already arrested by the police. It is felt he may need medical attention.

News Thailand ranked tenth best retirement spot Thailand is celebrating the New Year with good news. The country has just been listed as one of the world’s best places to retire to in 2015 by International Living, a North American-based magazine for retirees. International Living’s latest Annual Global Retirement Index ranked Thailand number 10 with a total score of 84.6. The report combined several real-world insights about buying and renting housing, benefits and discounts, cost of living, fitting in, entertainment, amenities, health care, infrastructure, and climate of each of 25 countries. According to the report, the Kingdom combines the best of authentic Asian cuisine and culture with enough North American influences to help westerners feel at home. Thailand is also named as an outdoor-lover’s paradise, with a rich mosaic of rainforests, exotic wildlife, and breathtaking temples. When it comes to cost, Thailand is

Pattaya celebrates National Children’s Day Umbrella whackers It seems the military authorities are determined to give Pattaya beaches back to the general public. That’s what all the restrictions on umbrellas, deck chairs, sand, eating and massages are about. Of course, the question is whether the vacationing and expat public actually want to have them back. Or were they happier before with the beach concession business owners, warts and all, firmly in charge? Pattaya coup memories A recent informal survey found that most tourists could not give an answer to the question how the May 22 coup has impacted Pattaya. Of those who could give a reply, the most common answers were shutting down the English-speaking radio stations for months on end and preventing people from enjoying the beach under an umbrella every Wednesday. Hmm!

Rear Admiral Wasainsap Jantawarin, commander of the Thai Navy Air Division, arranged a special event on Children’s Day with six types of airplanes for the young visitors to U-Tapao airport. There were also anti-aircraft guns, tanks, a parachute show and a demonstration by trained dogs. About 100 children attended the show with their parents. Children’s Day also featured events at Mike Shopping Mall, Ban Hua Thung and the Father Ray Foundation, where Chonburi health authorities taught children how to properly brush their teeth.

Honest taxi drivers A close adding up on the online and print media reports suggests that, during 2014, almost 400,000 baht was found by taxi drivers in their cabs after the various passengers had departed. The amazing thing is that all this cash was handed in at police stations where it was duly collected by the thankful passengers. Who said that the age of honesty and integrity had passed for good? Illegal downloads The TV program most commonly and illegally downloaded all over the world in 2014 was the HBO drama Game of Thrones. Apparently, over eight million copies were secretly made. But if you thought that the viewing public has sophisticated tastes these days, bear in mind that the second most frequently-downloaded program was the TV series The Walking Dead. Zombies are always upfront these days.

The Interview not here That truly dreadful movie The Interview, which shows the imaginary murder of the North Korean leader, is not apparently available in Pattaya DVD stores, or on the beach come to that. Apparently the word has gone out that it’s too hot a potato to handle. Oddly, it is available quite openly in Phnom Penh and Siem Reap in Cambodia. It’s said the copies there were produced in China, Pyongyang’s supposed ally. Voluntary work permits There’s talk, still unconfirmed, that foreigners working without perks for the local police may soon be able to apply for a one-year voluntary work permit. Apparently, many suitable farang are having trouble finding a one-year visa to stay in Thailand if they are under 50 years old (too young for a retirement visa), not married to a Thai and not studying the Thai language seriously enough to qualify for the famous education visa. Dandelion and burdock Where in Pattaya can you buy that British soft drink which dates back to the Middle Ages (although it was once mead)? Dandelion and burdock is made from the roots of those plants. The answer, of course, is Yorkies, the pork pie specialists out there on Soi Chaiyapruk, Jomtien. Yorkies has a fair range of English specialties and is well worth a visit. But they haven’t stocked English-style piccalilli for some months now. Turn left clarification A reader lets us know that the ambiguous road sign found at some traffic-light junctions “Turn left waiting signal” means you can turn left only when the green signal is showing. There is an even clearer sign in better English on Second Road at the junction with Central Road. But if there is no warning sign at all at the junction, then you can turn left whenever it is safe to do so. For the time being that is! For Mick and me there is always a good reason to visit Mata Hari. So many things make it one of Pattaya’s much loved restaurants: the menu is broad and generous, the kitchen produces the most delicious food, the décor is elegant and pleasing, and the staff welcoming and good at their job. This bastion of good eating is under the baton of the garrulous Louis Noll who continues to pioneer his food philosophy of quality, consistency and value for money. In the kitchen his wife/chef Jackie rules with unswerving commitment

making this gustatory marriage a formidable force that fills these tables nightly. The menu embraces not only the best in European cuisine but also the finest of Thai gastronomy. To raise the curtain on our Mata Hari dining I chose a perennial favourite, oysters Kilpatrick, while Mick plumped for another bestseller, beef carpaccio. There’s a bit of resurgence in the popularity of oysters and whether you choose to slurp them nude or enjoy them cooked, as in the Kilpatrick recipe,

their distinctive flavour shines through. Mine were fat and fleshy, perfectly grilled, topped with a generous portion of shredded bacon and served on a puddle of light Worcestershire sauce. For the first time oyster novice this would be a good introduction into the joy of these delicious bivalves. Across the table all was well as Mick finished the last of his gossamer thin beef scattered with Parmesan and peppery rocket leaves. All of the west’s holy trinity, i.e. foie gras, caviar and the aforementioned oysters are featured on the menu and we have on previous occasions truly indulged. Chef Jackie’s decadent buttery terrine never fails to deliver while Mick never tires of the hearty Dutch smoked eel (B.390). Other appetisers include salmon carpaccio, scallops on creamed spinach and grilled cheese, the famous jamón ibérico, and the constantly popular whitebait fritters (B.290). Main course favourites include the grilled

lamb cutlets with fresh herbs, garlic and olive oil, pan-fried crab crusted red snapper fillets and for meat heads the Australian T-bone, rib eye or fillet and of course the house signature dish of fillet steak “Mata Hari” (with chicken liver pate, mushrooms and green asparagus). Beef stew Dutch style has its fans as does the celebrated slow cooked lamb shank and the lamb kidneys with bacon and mushroom gravy. For our main courses we chose calf’s liver and lamb cutlets. Both were excellent; the liver soft and yielding topped with caramelised onion rings and served with a sublime green peppercorn and wine gravy. The cutlets too surpassed themselves; grilled to precision with just the right amount of seasoning to allow the essence of the lamb to speak for itself, they were delightful. The wine list is far-reaching with excellent vintages from around the world to suit all tastes and pockets. We enjoyed the ménage a trois (a blend of three grapes, i.e. Zinfandel for a juicy character, Merlot for mellowness and Cabernet for backbone), it was an excellent choice. Temperature-controlled cabinets insure that the wine arrives at table in perfect order. Mention must be made at this point of the Thai menu. One of the restaurant's signature dishes is the creamy coconut red curry with either grilled chicken or pork. It is an extreme gourmet treat and one of which the kitchen is justifiably proud. Other gastro Thai influenced dishes include lobster and scallops with shiitake mushrooms and

asparagus in oyster sauce, a mild crab meat curry plus the grilled sliced beef fillet served with fresh herbs, raw vegetables and chili sauce. The curtain could never be brought down at Mata Hari’s without indulging in at least one of the decadent desserts. We have been reliably told that the warm sticky date pudding with homemade ice cream and caramel sauce has brought many a sweet-toothed diner to wipe a tear from his eye (in a good way) while the cheesecake is legendary for its yummy recipe. Mick and I opted to share a dark and white chocolate mousse which propelled us up to chocolate heaven with the first spoonful and sweetly brought down the curtain on our lavish dinner. Mata Hari has carved out a special niche for itself. The ambiance somehow manages to make the occasion special but at the same time retaining a sense of laid back wellbeing. It is a special place on so many levels. It consistently delivers fine food cooked with a light hand and an elegant touch served in chic and calm surroundings by the friendliest and most helpful staff around.

INDIAN BY NATURE Gourmet Neo-Indian Dining Indian by Nature sets the bar for Indian cuisine in the Pattaya/ Jomtien area. Av Khanijou, proprietor and chef, delivers authentic cuisine rooted in geography and history but created with the zeitgeist of the 21st century shining through her unique recipes. Mick and I have been loving her cuisine for years and when invited back to taste her brand new menu we were in the car quicker than you can gulab jamun. The décor is elegantly colonial with many shards from India’s history adorning the restaurant juxtaposing with the chic modern touches. The diaphanous curtains subtlety reflect the colours of the Indian flag while creating an overall ambiance of grace and sophistication. I must mention the staff who are a delightful troop of servers, friendly, happy and efficient, working amiably under the direction of the charming manager, Satish Kumar. Once seated we could hear the creaking wheels of the gin trolley crossing the restaurant towards our table. The great “gin and tonic” originated in British Colonial India as a prophylactic against malaria and has remained a stalwart Indian

tradition ever since. However, Av has taken the household drink to a new level of refinement. Her gins are boutique artisanal bottles bearing the grand names of Copperhead, Hendrick’s, Bulldog and Black Gin, G’Vine amongst others. Savourers can also create their own bespoke gin and tonics with the aid of a gourmet botanical tasting set to add as a distinctive embellishment. The herbs and spices available to sprinkle into your gin are juniper berries, rose pepper, cubeb pepper, cardamom, hibiscus flowers, star anise, liquorice, kumquat, cassia and rose blossoms providing a walk in a very happy valley for all you gin lovers out there. Believe us – it’s such a happy way to “aperitif” your meal by encouraging your appetite and digestive enzymes as is also the practice of an amuse-bouche. Our amuse-bouche for the evening was a delightful Lilliputian cup of corn and mustard soup accompanied by a papadum shaped cup filled with a spicy chicken tikka salad. This was shortly followed by our mixed appetiser of tandoori salmon tikka, a button mushroom khumb-e-khaas (B.90) and a minced chicken sangam

kebab. The button mushrooms had been filled with Indian cottage cheese, herbs and spices and then delicately cooked in the tandoor, while the Norwegian salmon had been marinated in masala, infused with yoghurt and then gently chargrilled. Completing the scrumptious trio was the minced chicken kebab which had been encased around a spiced minced lamb filling before being burnished under the grill. Our wine, which was bravely making good friends with the spicy spread, was a Cote du Rhone, Saint Esprit, Chapoutier at B.1,800. A lemon sorbet refreshed our palate before the big guns of the evening were placed on our table. Chicken zalfrezi (B.300), Bengal prawn curry (B.450), Shahi Kofta which is a traditional Mughlai dish of minced lamb meatballs simmered in chef’s special cream sauce and the best dal tadkewali we have ever eaten. Tempered with cumin, garlic, onion and butter and combined with wonderful curry leaves, it was a lip-smacking bowl of Indian comfort food. We closed with a sweet threesome of desserts: gulab jamun with ice cream and a chocolate swirl consisting of layers of vanilla and chocolate pudding topped with strawberry jelly. Gulab jamun is a milk-solids based dessert rather like small dumplings that have been steeped in a sugar syrup, paired with the vanilla ice cream, they were small orbs of luscious sweetness. Av is a true dessert diva, her confections are legendary and her mouthwatering list is a riot of melty, velvety richness such as her famous rice pudding with almonds, raisins and cardamom, or her coconut crème brûlée, halwa or kulfi. For an extra decadent overload, gulab jamun can even be flambéed at your table with raspberry sauce and Cointreau. There is so much on the menu it is not possible to detail it all but the traditional thalis are a big attraction at Indian by Nature and by way of a gourmet introduction to the a la carte menu. and they come packed with a selection of non-vegetarian or vegetarian dishes. For example the “meaty” version contains a chicken tikka, fried fish in gram flour batter, a lamb rogan josh (spicy lamb curry), a vegetable zalfrezi, dal tadkewali, raita, naan bread and basmati rice, pickles, chutneys and dessert of the day. The vegetarian selection includes palak paneer, paneer tikka, a vegetable zalfrezi and samosas. They are both priced at B.750 and represent a Dal Tadkewali personal Indian buffet of diverse dishes. Thailand Bail Bond What is bail bond? A bail bond is one method used to obtain a temporary release of an alleged offender or accused person awaiting trial on criminal charges from the custody of law enforcement officials, sometimes on condition that a sum of money or other form is lodged to guarantee their appearances in court. In other words, it represents an agreement to appear in court on a scheduled date. What is a bailsman and who can act as one? A bailsman is one who provides bail or security for another. It can be any individual, juristic person, or entity that acts as a surety and pledges money or assets as bail to ensure the future appearances of an alleged offender in court. What is the general rule regarding the right to bail? A suspect or alleged offender is presumed innocent until proven guilty. Anybody charged with a criminal offense shall be admitted to bail as a matter of right, with sufficient sureties as prescribed by law before judgment is passed by the court of an offense not punishable by death or life imprisonment. A written request must be submitted by a bailsman to the investigating officer who will ask for particular documents; the result of the bail review shall be announced within 24 hours. Can an alleged offender who is kept in custody be refused bail? According to Thai Criminal Procedure Code, an order which refuses to grant provisional release shall be issued only when one of the following causes exists: • The alleged offender is likely to escape • The alleged offender tampered with evidence • The alleged offender is likely to cause injury to another person • The person filing for a provisional release or the security offered is not sufficiently credible • The provisional release will obstruct the inquiry of the officials or the trial in court If the grant of a provisional release may endanger a key witness, such witness may file a motion of objection to the court. What is the minimum bail amount required? The minimum bail amount may vary because the amount of bail for each case is set by the presiding judge of each jurisdiction, considering each particular criminal action and related evidence. What are the forms of guarantee when posting bail? In Thailand, there are three guarantee categories when submitting a request for a temporary release:

1. Request for temporary release by using assets (title deeds, bank accounts, etc.) 2. Request for temporary release by using cash 3. Request for temporary release by using the employment status of a public official (Government, police, military, political officials and state enterprise employees may be used as Bail Bondsmen wherein bail rates are set from 60,000 baht up to 800,000 baht depending on one’s position) How are bail requests being considered? In considering a temporary release, the court shall use the following criteria: • Seriousness of the offense • Sufficiency of the existing evidence and the credibility of the witness • Circumstances of the case • Trustworthiness of the person filing the request or the guarantee given • Likelihood of the alleged offender to escape • Likelihood of the alleged offender to create danger caused if released • Likelihood of the alleged offender to destroy evidence or threaten any key witness • Existence or non-existence of an objection by an inquiry official, public prosecutor, plaintiff or witness What are the conditions when a temporary release is granted? Before granting release, the court will issue a receipt for the asset or for the amount of cash posted as a guarantee along with an appointment letter. The bailsman or the person providing guarantee or security shall be compelled to sign a guarantee agreement in which he ensures to bring the suspect or alleged offender to court on the date of the appointment. Failure to do so shall subject the bailsman to penalty as provided for in the contract. When shall the bail bond be returned? The court will order the bail bond returned on the day the judgment is read without the need to submit a request.

The Pensions Revolution Having gone from having to purchase an annuity at a certain age in retirement, to complete access to one’s pension pot in just a few years, we now have the freedom to put all our pension savings on the 2.30 at Newmarket. There is tax method in their madness though, as total withdrawals will incur marginal rate of income tax and then what. We have to invest it somewhere and, perhaps, where we just took it form was perfectly OK. The phrase smoke and mirrors comes to mind. At least for those of us in either a SIPP or a QROPS, the fact is that invested sensibly, with the ability to choose, buy and sell holdings, it is probably better left where it is. As part of his speech to the Conservative Party conference in Birmingham on September 29, Chancellor George Osborne confirmed that the 55 percent lump sum death charge is to be scrapped. The move comes as no surprise as the government set out their plans to address the tax charge in the budget earlier this year. Present Position – Currently lump sum death benefits (from a UK-registered defined contribution pension scheme) passed to any surviving beneficiary incur a punitive 55 percent tax charge where the pension fund is either crystallised or the member is over the age of 75 at the time of death. Alternatively the pension fund may be applied to provide a dependent’s pension for any dependent beneficiaries. The dependent’s pension is taxed at the recipient’s marginal UK income tax rate. Position from April 2015 – The tax treatment of death benefits will depend on whether the pension scheme member was under or over the age of 75 at the time of their death: 1. Member dies before reaching age 75 – Where a member dies in drawdown or has un-crystallised funds, the residual funds may be passed to any nominated beneficiary as a lump sum without tax. Alternatively any nominated beneficiary may inherit the pension fund and receive payments via a flexi access drawdown pension. The drawdown payments will be free of UK income tax. 2. Member dies after reaching age 75 – Any beneficiary may receive the pension fund as a lump sum subject to a flat rate tax charge of 45 percent*. Alternatively any nominated beneficiary may inherit the pension fund and take payments when required. The payments will be subject to UK income tax at the beneficiary’s marginal UK income tax rate. *It is proposed that the flat 45 percent tax rate will be removed from April 2016. Lump sum payments made after April 2016 will be taxed at the receiving beneficiary’s marginal UK income tax rate. How does this impact QROPS? – The Government’s ‘Autumn Statement’ provided welcome clarity on exactly how the new UK pension’s regime will impact QROPS. The new death rules introduce a ‘cliff edge’ scenario for members of UK-registered defined contribution pension schemes. Provided they die before the age of 75 their loved ones inherit the residual fund without UK tax liability, if death occurs after the age of 75 there is the potential for a tax charge of up to 45 percent. The removal of the 55 percent tax charge from April 2015 is good news for UK tax resident QROPS members. Without drastic measures it is not possible to time one’s death. For the non-UK tax resident seeking certainty of tax free death benefits a QROPS is likely to remain the most compelling option. You may want to search the websites of some favorite and well-known home architects and see what plans might work for you and your family. One more excellent source is the collection of ‘design your own home’ CDs on the market. Many not only offer scores of top designs, but also take you through the process of designing your own home via computer graphics. Home Design Step Three: Bring your own set of plans to the table and work with a professional home-design architect. These professionals are accustomed working out home design concepts with their clients. They need your personal input to visualize just what will make your family home special and unique. Just as well, you will appreciate the architect’s many years of experience and insights into the logistics of home design. An experienced home-design architect will know which of your design ideas can actually be integrated into the final plans, and he or she will identify potential problems and offer alternate suggestions tailored to your ideas and expectations. Before appointing an architect, it will be necessary for you to gather as much information as possible about your home design needs and preferences. It would be a good idea to prepare in advance a list of the characteristics and objectives of your home design. This may include some of your own drawings, clippings from magazines, photos of houses you like, lists of required spaces (and dimensions). Such advance planning will prove useful and inspiring for both you and your home design professional. Maybe it’s time for your new Dream Home. Visions of New Pattaya with Cees a Cuijpers

Cees Cuijpers (KC) was born in the Netherlands and his work background has been in the hospitality business and logistics where he specialized in marketing. His first business venture in Thailand was a luxury restaurant in 1997 on the site of the current Pizza Hut on Pattaya’s Beach Road. But that was only the start. In 2003 he joined Town and Country Property Company, a leading real estate outfit in Pattaya, where he quickly expanded the business by heading up the architectural and design department which few other companies were offering at the time. In 2005 Cees partnered with Herman van Gucht and became managing director of Town and Country.

Cees has a profound dislike of “pub and bar lawyers” whose sole interest in life seems to be criticizing Pattaya and its people. He believes that the former stereotype of Pattaya as Sin City is way out of date. “The city has already been transformed by so many five-star hotels, upmarket malls, sports outlets and luxurious facilities, but that’s only a beginning,” he says. “Pattaya really has gone upscale and in 2014 one can see many young Thais, especially from Bangkok, who are an increasingly important segment in the tourist and residential market here. It’s no longer just a question of foreigners vacationing here. There’s a constant buzz throughout the year and Pattaya is being rediscovered as an increasingly high-end resort. The local property market remains popular largely because of Thai domestic interest.” “The old Pattaya,” he says, “is disappearing. The clubs and beer bars are still there, especially in Walking Street area, but they are nothing more than a few rows of pink neon signs.” In other words, Pattaya is expanding massively all the time, but the night entertainment scene is getting smaller by comparison. The Eastern Seaboard region offers the best in location, quality, convenience, luxury and security for all types of investors and end users. The main limitation at the moment, according to Cees, is the area’s inadequate communication infrastructure which has certainly had some improvements of late, notably the highway from Bangkok to Central Pattaya and the recently agreed Sukhumvit tunnel which will eventually facilitate faster thru-traffic. Cees thinks that hi-speed trains linking the Eastern Seaboard with the metropolis are unlikely to be operational before well into the next decade. By that time Pattaya will be linked by an invisible bridge to the Bangkok metropolis. In other words, they will merge. In a community context, Cees has

built up an extensive network with international and domestic contacts. Apart from several consultancybased advisory roles, Cees became chairman of the charity foundation The Lighthouse Club, Pattaya branch, and a key founder of the biggest corporate charity network event Movers and Shakers. On an annual basis, over 3,000 guests frequent the events in Bangkok and Pattaya and around US$40,000 is raised for local charitable causes. Movers and Shakers was founded in 2009, having been inspired by the corporate network of The Lighthouse Club. “M and S attracts business professionals and charity leaders within a variety of sectors with the express aim of expanding business interests in a social atmosphere,” concludes Cees. Cees Cuijpers shares a passion for art, music, culture, watches, architecture, interior design, golf and travelling. He has perfect English but does not spend all his time networking and pursuing business interests. He loves the privacy of his home with his young son and his partner. That diverse clutch of interests likely to be a strong reason for his commercial success. He doesn’t put all his eggs into one basket.

The medium-term future is clear. Pattaya and Bangkok are destined to merge.

(Paul DeCeglie writes) With the English language designated as the lingua franca of the ASEAN region, citizens of Southeast Asia years ago were encouraged to learn to communicate in English. However, a recent survey at one of the nation’s top universities reveals that few students or employees have a working knowledge of English. Some explained that they were too shy to try to speak because their skills are so poor. If that’s true of the best educated in Thailand, what are we to expect from the masses? Wall Street English points out that “Thailand lags far behind major ASEAN countries like Singapore, Malaysia, Philippines, and Indonesia. This indicates that Thais need to improve their English skills to compete with other countries, or many will lose their jobs or find it hard to work when the AEC takes effect.” Yes, English is now being taught to primary school students, and there are any number of websites and language schools

are motivated to take advantage of such opportunities, and how many families here can afford computers, internet service or private schools? Why are the airwaves not rife with TV programs teaching English to audiences young and old? Why are communities throughout Thailand not providing free instruction? A: Second UK passports are normally issued only to businessmen or businesswomen who travel a great deal internationally and may not have time to apply for visas in every case. You would need a detailed letter from your employer explaining why you feel you need one. First retirement visa Q: I have just received my first retirement visa, one year, from Thai immigration. I notice it is for 15 months and not a year. Has a mistake been made here? A: No mistake. When you applied you had only a tourist visa. This had to be converted to a non-immigrant visa for three months. The one-year retirement visa was added, thus making a total of 15 months. This won’t happen next year as you won’t need to convert a tourist visa to start the proceedings.

Snap Judgment Russian squeeze

The latest data, formal and informal, suggests that there were 50 percent fewer Russians in Pattaya over the new year than there were 12 months ago. A senior official of the Thai Hotels Association said, “Pattaya has been like a second home for Russian tourists and long-stay guests for many years. They have been contributing huge income to the country’s economy. But average hotel occupancy in the seaside resort has fallen to 70 percent from around 90 percent last year.” Pattaya has always been the most popular resort in Thailand for Russians. And not only for vacationers. There are said to be over 100,000 Russians in the greater Pattaya area living on one-year visas of one sort and another. Several international schools have a large number of Russian children on roll. In other words, there still are a great many Russians living in Pattaya on an extended basis. They include retirees over the age of 50, Russian men married to Thai women and hundreds more on authorized work permits in the tourist, restaurant and management spheres. Why Pattaya is more popular with Russians than Phuket or other beach resorts in Thailand isn’t altogether clear. It probably has something to do with the fact that charter flights have long flown into U-Tapao as well as the reality that the city is near to Bangkok. Moreover, Pattaya was the first tourist destination in the country in the mid 1990s to have printed signs and restaurant menus in the Russian language. Also, Pattaya is a better deal than Phuket: a bus ride which costs 10 baht in Pattaya might cost the customer several times that in the far south. Of course, the main reason for the Russian decline of late is the fall in the value of the ruble, around 50 percent, which has pushed up the costs of holidays considerably. Other factors are Russia’s economic difficulties at home and western sanctions which include a ban on credit card transactions in parts of Russia, notably the recently-seized Crimea. You have only to speak to Russians in the area of Naklua (Soi 12) commonly known as Little Moscow to know that these problems are very real to vast swathes of the travelling Russian public. One of the paradoxes of the recent fall in international oil prices by roughly one half is that the cost of air tickets has not dropped. This is partly because airlines are guarding against rises in future and partly because they mostly prefer to invest in improvements in business and first class where the biggest profits are to be made. Premium class passengers are already seeing more comfort including larger beds, more privacy and more elaborate entertainment and menus. Of course, you have to pay dearly for these luxuries in the air. So will the Russian market improve? Undoubtedly, once that country’s economic fortunes improve as they surely will if not before 2016. In any case, Thailand’s tourist difficulty is wider than the Russian squeeze. It has faced many challenges in 2014 ranging from the political crisis, the coup, the curfew and then martial law. The number of international tourist arrivals dropped nearly nine percent in the first 11 months of 2014, according to the Tourism Authority of Thailand, to stand at about 21.9 million. But while Russia, and also Western Europe, have seen declines in numbers, Thailand has strong potential markets in China and India. Moreover the formal introduction of the ASEAN Economic Community next year will in the medium term expand dramatically the numbers of intraregional travelers in the 10-nation free trade grouping. These facts have led tourism operators to pin their hopes on a recovery later this year, with the 2015 tourism revenue set at 2.15 trillion baht. Pattaya is in a strong position to take advantage of that potential bonanza.

Dear Agony Ivy, Fear of Heights I am very concerned about my wife’s behavior and want to check with someone sensible whether I have cause for alarm. When I married my Thai wife last year, she instantly demanded that we move to a high-rise condo, in fact the 14th floor, on the argument that mosquitoes don’t fly that high. This seemed sensible and I agreed to pay seven million baht for a beautiful apartment. However, the first thing I noticed was that my wife removed the safety rail on the balcony leading to a long drop. She said this was for repainting which was untrue as I saw the rail some days later lying by the rubbish dump waiting to be collected. Now I am very concerned that she has insisted that we take our meals on the balcony. She used the argument that it is healthier to eat outside in the sun. This is clearly nonsense because we still eat there even when it is pouring with rain. I have also noticed that she polishes the floor on the balcony several times daily and has

not extended to me the use of nonslip shoes which she herself wears all the time. My final problem is that I regularly feel quite ill after drinking my bedtime cocoa which my wife insists I drink to ensure a good night’s sleep. Have I reason to be worried? Worried William

If you catch her trying it on repeatedly in front of the mirror, you will know for sure she is anticipating becoming a widow in the not too distant future. Dear Agony Ivy, Abreast of the problem I do understand you are not Captain Cash of newspaper fame in UK but you really are my last hope. I am a 60-year-old male farang who retired to Thailand last year. You see I am completely alone and it was my lifelong wish to become a woman. Essentially, this meant having female breasts. I did have an operation in Bangkok a few weeks ago but I was very

disappointed indeed when I woke up. The hospital said that I had provided enough money for only one breast, so I now look most ridiculous, with one much bigger than the other, as you can see from the attached nude photograph. Tencent launches WeBank, China’s first private online bank by AJ Chadha

This month, WeChat owner Tencent, officially launched WeBank. It is China’s first private online-only bank and was one of six banks to have received licenses from state regulators last year. The service will begin in full, sometime this spring. Tencent is one of several shareholders and will retain a 30 percent interest in the venture. WeBank was initially capitalized with ¥3 Billion (15.86 billion baht). Tencent’s chief competitors, Alibaba and Baidu were also said to have received licenses in October 2014. Tencent is a big player in China, they have their hands in communication, e-commerce and gaming. The world is increasingly moving online, with e-commerce as well as a large number of entertainment choices, the step into another sector for internet giants is a natural expansion of their conglomerates and will only add to the power they yield. The joint venture led by Tencent, intends to provide loans to small and medium businesses, currently a big driver of economic growth for the country. These businesses provide almost two thirds of the country’s GDP, yet find it difficult to obtain loans from state-owned banks. State-owned banks tend to favor larger and often state-owned groups. Tencent and Alibaba intend to use their vast data to evaluate the risk on all loans. They both hold large amounts of user information and will use that to assess the credit risk of borrowers. WeBank does not intend to have any brick-and-mortar branches and the typical loan will be under ¥1 million (5.28 million baht). At the opening ceremony in Shenzhen, China Premier, Li Keqiang was optimistic about the new service. “We will lower costs for and deliver practical benefits to small clients, while forcing traditional financial institutions to accelerate reforms.” Emphatically stating that “It’s one small step for WeBank, one giant step for financial reform.” Tencent can now capitalize on their WeChat users and tie them up with WeBank with little effort. This inbuilt customer base will help them in adding users to the new venture. With this momentum, it is only a matter of time until the company expands its new service, to other countries in the region.

Youth Focus Avoiding the extremes of excess and deficiency in the classroom by Anthony Lawrence Kelly

Both ancient philosophy and modern science have taught us that balance is fundamental for life to thrive. Aristotle talked of the ‘Golden Mean’; Buddha of the ‘Middle Way’ and you’d be hard pressed to find a rightminded ecologist who supports the idea that disrupting an ecosystem would be beneficial to most preexisting inhabitants. So let us briefly touch on, perhaps fondle, the idea of balance in the classroom. While attending a thoroughly enjoyable and heavily anticipated Christmas Dance Show provided by the school for the parents’ entertainment, held at the impressive Imperial Hotel, Na Jomtien, I was fortunate enough to enjoy the company of a parent of a student in the school.

The conversation touched on, nay caressed, the question of why teachers don’t focus more time on the underachieving portion of the students? If we were to set the higher flying sorts an industrial sized stack of work and let them busy their way through it, we could steal more time to spend with those that aren’t really ‘getting it’. Sounds fair… Well, when parent sends their charges off to school each morning with their lunchbox in hand, there surely will be an abundance of different visions in mind, however, broadly speaking, their expectations will all converge to a similar set of statements about teachers supporting and fostering their child’s potential to grow socially, emotionally and intellectually. From the perspective of a private school, each parent signs up and pays the fees expecting to get ‘their money’s worth’ regardless of what attainment level their child’s cognitive skills abide at that stage in their development. Anyway, enough waffle, here’s the eggs and bacon. It’s a very tricky tightrope balance the needs of those aiming to attain base standards, those aspiring to creep above those standards and those pouncing pumas leaping toward the next level. All children in a classroom require attention and typically the better achievers are not so advanced that they don’t require regular

Promises, promises by Peter Hartnell By mid-January, most of us have made and already broken our New Year’s resolutions. Resolving to make changes to our lives is a popular preoccupation at this time of year throughout the world, so popular that the US government has a website dedicated to supporting people who want to make and to keep their New Year’s resolutions. The website reports that a survey of lists of resolutions had some predictable inclusions – losing weight, giving up smoking and cutting down on alcohol all feature regularly in the top five most popular resolutions. However learning something new or improving skills also regularly appear in the top ten. But a recent study from the University of Bristol involving 3,000 people showed that 88 percent of those who set New

Year’s resolutions fail within a month. The Journal of Clinical Psychology concluded that only 8 percent of those who make resolutions on January 1 manage to keep them and investigated why so few of us succeed. Why? Because keeping a resolution is hard. It is hard because it involves learning new behavior. Yet every day teaching involves trying to get students to act in new ways, to change their behaviors, to take on board new learning. Are there some lessons we might learn from what happens in schools to foster learning that might apply to adults and help them to keep the resolutions they make? We should always remember first of all that schools should not only be concerned with turning out children who are clever. Most schools want to produce wise, caring, independent and autonomous decision makers as leaders for the next generation. Learning is not simply a question of willpower, of overcoming. Learning involves understanding – understanding the problem and understanding ourselves. In 1983, Howard Gardner’s Frames of Mind: the Theory of Multiple Intelligences introduced the idea that traditional types of intelligence, such as IQ, which measure “cleverness” fail to fully explain cognitive ability, learning and behavior change. He introduced the idea of multiple intelligences which included both ‘interpersonal intelligence’ (the capacity to understand the intentions, motivations and desires of other people) and ‘intrapersonal intelligence’ (the capacity to understand oneself, to appreciate one’s feelings, fears and motivations). The term ‘emotional intelligence’ became widely known with the publication of Goleman’s Emotional Intelligence: Why It Can Matter More Than IQ and began to replace intrapersonal intelligence. Emotional intelligence can be defined as the ability to monitor one’s own and other people’s emotions, to discriminate between different emotions and label them appropriately and to use emotional information to guide thinking and behavior. “EI”, as it came to be known, has had a significant impact on theories of learning in schools and is often at the core of SEAL – the social and emotional aspects of learning programme in schools such as our own. The aim of the SEAL programme is to provide schools with an explicit, structured curriculum

One of the key outcomes of successful work to develop social, emotional and behavioral skills is independent and autonomous children who are able to take ownership of their learning and behaviour. Not so this day what with all the industries and schools back in full swing. However, all made the trip in about an hour and check-in went smoothly as the course management allowed a reduced green fee rate for the day. Very much appreciated indeed! On the first tee and playing right on schedule, our groups were around the course unimpeded as other than a couple other 4-balls, the course was empty. Millionaire’s golf as some will say! However it should be noted that our final group must have been enthralled with the excellent condition of the course and the great weather as they somehow lost four holes to the group in front. Guess with no one pushing from behind on an empty course it is easy to doddle along. Needless to say they were put on notice that this was not to happen again. Enjoy the day but please, move along and keep up with the group in front.

Our Community Erawan Group helps conserve marine ecosystem Under the leadership of the Erawan Group PLC, Holiday Inn Pattaya, Mercure Pattaya Ocean Resort and Ibis Hotel Pattaya organized the third ‘Conserve Marine Ecosystem’ event with the aim of conserving the rich marine life in the coastal area of Pattaya Beach. Some 120 volunteers from three hotels participated in this event, planting imitation coral reefs to promote the growth of a healthy marine ecosystem in the Pattaya area as an act of responsible business to the Pattaya city community.

Children’s Day Wipeout The US TV show ‘Wipeout’ is a game show in which contestants compete in what is billed as the world’s largest obstacle course, and, according to TV Week magazine, is the world’s third most popular game show. Shown on screens throughout the world, including Thailand, it has become a firm favorite with the residents of the Father Ray Children’s Home. So imagine their excitement when they were told they would be spending National Children’s Day at Splashdown Waterpark, Pattaya’s very own version of Wipeout, complete with the infamous big red balls. On arrival at Splashdown, which is located on Highway 36, the children were met by John Ray, owner of the park, before listening to a few health and safety rules, and then they were free to go and have fun. First adventure was climbing the world’s tallest inflatable waterslide, which did not look too high, until you reached the top and then had to slide down before flying into the air and landing in the water; screams could be heard echoing across the park.

Most children were eager to run across the red balls, large inflatables which were not as easy to cross as most thought they would be. Other rides included the Big Blue slide, The Zorb Racer, an obstacle course consisting of different sized and shaped inflatables, and the favorite of the teenagers, The Big Blob. Imagine sitting on the end of a very large cushion, and without warning someone jumps on the

other end and for a short time you will experience what it is like to be a bird, until you come crashing back down into the water. Half way through the day there was a downpour, but this did not stop the fun, the children were getting wet anyway. After five hours of fun the children were exhausted, but they all agreed that it was one of the best Children’s Days ever.

Debunking the Myths

Myth: My female cat or dog should have a litter before she is spayed. Fact: The sooner you spay your female, the better her health will be in the future. As long as a kitten or puppy weighs more than two pounds and is at least two months old, he or she can be neutered or spayed. Many veterinarians practice safe early sterilization. The longer a female goes unspayed, the greater the likelihood of developing mammary tumors or uterine infections. In fact, a female spayed before her first heat (six to nine

months of age) has one-seventh the risk of developing mammary cancer as does an intact female.

Myth: Spaying or neutering will alter my pet’s personality. Fact: Regardless of the age when spayed or neutered, your pet will remain a caring, loving and protective companion. Any slight changes will be positive. Neutering will reduce the need to breed, which has a calming effect on many animals. Myth: Companion animals will become fat and lazy if they are neutered. Fact: Absolutely not! Lack of exercise and overfeeding--not neutering--make pets fat and lazy. Your pet will not gain weight if you provide exercise and monitor food intake. Also, sterilized pets tend to live an average of two to three years longer than unsterilized pets. Myth: Sterilization is a dangerous and painful surgery for my pet. Fact: Spaying and neutering are the most common surgeries performed on animals. With a minimal amount of home care, your pet will resume normal behavior in a couple of days. Myth: Letting my pet have a litter will allow my children to witness the miracle of birth. Fact: Countless books and videos are available to teach your children about birth in a responsible manner. Letting your pet produce offspring that you have no intention of keeping is teaching your children irresponsibility. Anyone who has seen an animal euthanized in a shelter for lack of a home knows the truth behind this dangerous myth.

Heatstroke

If your animal is panting heavily, drooling, having trouble breathing, or showing other symptoms of heatstroke, move it to a shady area immediately. Put a cool, wet cloth around its neck and head (not its face). You can also gently spray the animal down with cool water, especially the belly, before transporting it to the vet.

These small kittens were rescued from a local temple. At the moment we are trying to get them a little stronger as they have not had their mom to take care of them. But by the time you see this snippet they should be fit and ready to go.

Tinker

Dexter & Splash

These two bigger cats are around 18 months old, both have been neutered and are very good friends. Ideally we would love someone to take them as a pair so they can keep each other company when you are out and about.

Dueling Dogs? Clashing Cats? If your cat likes to play, you have a happy cat. If not, start looking into why.
