Dans ce petit ouvrage, Michel Carpentier (1930-2022) raconte ses trente-six ans de vie dans les institutions européennes et sa contribution de visionnaire au lancement de plusieurs politiques. Michel Carpentier a intégré la Commission d’EURATOM le 14 juillet 1959 à Bruxelles, où il fut désigné responsable du service des achats et des marchés. En 1982, Michel Carpentier, à la demande du Vice-Président Davignon, a pris la direction de la Task Force des Technologies de l’Information, et de la Communication, chargée des programmes européens dans le domaine des technologies avancées, conduisant à une politique révolutionnaire en matière de télécommunications, permettant leur libéralisation et interconnexion au plan européen, et la promotion de la société de l’information. Après sa retraite, en 1995, M. Carpentier a continué ses activités notamment avec la région Aquitaine, où il s’était installé.

She was young, a determined fighter against Nazism in Germany; she was an independent socialist, a tireless writer against hatred and war; and she was an extremely courageous woman. Um 1800 wird die Nachahmung aus dem Zentrum der schönen Künste in deren Peripherie verbannt. Mit der Durchsetzung des Originalitätskonzepts wird die regelgeleitete Imitation klassischer Vorbilder als minderwertige, dilettantische oder epigonale Kunst abgewertet. Dieser theoretische Paradigmenwechsel täuscht darüber hinweg, dass Nachahmung in der literarischen Praxis zentral bleibt. Nicht nur bewegt sich die sogenannte originelle Literatur oft in Bahnen der Übersetzung und Adaption. Daneben gibt es auf dem deutschen und europäischen Buchmarkt eine breite Masse an Texten, die aus ihrer Orientierung an prominenten Vorbildern kein Geheimnis machen. Der Band untersucht die Eigenlogiken unorigineller Texte und sondiert ihre Funktionen für Literaturtheorie und -kritik. Die Beiträge widmen sich Poetologien des Unoriginellen, fragen nach dem Einsatz von ‚Unoriginalität‘ als Beschreibungskategorie und zeigen, dass Originalität auch und vor allem ein Produkt historisch wandelbarer Diskurspraktiken ist.

„Eine Frau muß Geld und ein eigenes Zimmer haben, um schreiben zu können“, lautete die Forderung Virginia Woolfs aus dem Jahr 1929. Der Band setzt sich mit den verschiedenen Formen auseinander, die dieses Thema in den fiktionalen und nichtfiktionalen Texten von Autorinnen des deutschen, österreichischen und spanischen Exils annahm, und untersucht, ob und wie sie sich einen eigenen Raum erschreiben konnten und wie dieser beschaffen war: welche Erfahrungen in die Werke eingingen und wie sie dargestellt wurden, welche Genres vorgezogen wurden und inwiefern sie auch ideologisch fundierten Kriterien unterlagen. Somit versteht sich diese Studie als interkultureller Beitrag zur Erforschung des literarischen, essayistischen und philosophischen Schreibens von Frauen im Exil.
Der Band rekonstruiert den Lebenslauf des aus der Berliner jüdischen Gesellschaft stammenden und 1933 nach Paris und in die USA emigrierten Rudolf Bodländer (1903-1988). Angelpunkte sind bisher z.T. erstmals publizierte Briefe aus der Korrespondenz mit Rainer Maria Rilke, Anton Kippenberg und C.G. Jung. Les auteurs et autrices de cet ouvrage collectif analysent les transformations et érosions subies par les cultures politiques, ainsi que l’hybridation et le renouveau de ces cultures. In the aftermath of World War II, Italy and France saw the consolidation of their principal political cultures. However, from the late 1960s onwards, these cultures encountered profound changes that impacted Western European societies, culminating in the restructuring of both countries’ party systems by the mid-1990s. The authors of this collective work delve into the transformations and erosions experienced by these political cultures, as well as their hybridization and the emergence of new ones.
The book is the result of a collective research work between the members of the team of the project „Over the Atlantic“ (cofounded by the Erasmus + programme). A critical introduction presents the work, the content and the scope of the research, carried out with an interdisciplinary approach. This book consists of three main parts. Dr. Benken’s book is a case study of the life and death of Jan Rodowicz, nom-de-guerre Anoda, who served as a combatant in the Polish pro-independence underground resistance movement during the Second World War. The operations in which Anoda was involved, his conduct during and after the War, especially in the investigation following his arrest by the Communist security service and the mystery shrouding his death while under interrogation, turned him into a symbol for the young people of Poland in those times. His generation was forced to fight for its freedom against two criminal totalitarian systems, the Nazi Germans and the Soviets, paying with their life or health for the ideals they did not want to give up.

The process of the Orthodoxization of memory in Russia started long before the Russian Orthodox Church engaged in the memory politics. It was a grassrooted process initiated by both the living and the dead. By using religious symbols and rituals, various groups of living were restoring their relationship with the forgotten dead of Soviet repressions and war. When the Moscow Patriarchate has returned to active public life and started developing its religious memory infrastructure, the Orthodoxization process got a new up–down dimension. Finally, a turn of the Putin’s regime towards religious commemorative practices caused the disappearance of the boundary between religious and political memory. The bricolage memory, consisting of elements of Orthodox tradition and Soviet memory culture, appeared.

Prêter attention aux interstices urbains conduit à porter un regard neuf sur les dynamiques informelles, les régulations qui procèdent de l’usage, les processus d’institutionnalisation qui se soustraient à l’emprise de l’État. Cet ouvrage se propose donc de réfléchir à la jonction entre interstices et communs. Il réunit des spécialistes de la ville provenant de disciplines différentes (sociologie, géographie, histoire, histoire de l’art, droit, littérature, urbanisme…). La mise en regard de leurs travaux montre que l’interstice et le commun sont des prismes heuristiques pour appréhender les dynamiques urbaines dans l’espace et dans le temps.
The essays that make up this book cover a diverse range of subjects, all broadly on the theme of child refugees from Nazism in Britain. The book’s three sections – on displacement, children in art, and children in education and play – indicate the various topics considered in the study. The authors come from different academic fields – including German and Austrian exile studies, art history, language and literature, and education – so each chapter offers a depth of research as well as adding to the breadth of the overarching theme. Thus far, there has been no study dedicated to examining both the experience of these refugee children and those who worked with them, and yet they and their own children live on, marked in different ways by their experience and making their own mark in British art and literature too.

The book is the last volume of an extensive four-volume monograph devoted to the work of Cyprian Norwid (1821–1883), one of the most outstanding Polish authors. The impact of Norwid’s oeuvre does not fade, as he addresses fundamental and timeless issues, such as the moral and spiritual condition of man or his place in the world and history, and seeks to answer universal questions. The volume includes articles devoted to the analysis of selected sources and inspirations underlying Norwid’s work, as well as comparative texts tracing the manifestations of the commonality of thoughts and views connecting Norwid with the leading writers and artists of different periods. As a result, we received a multi-faceted image of an artist who, on the one hand, was strongly rooted in the tradition and modernity of Western European culture, and on the other, was characterized by great openness and sensitivity to otherness and cultural diversity.

This book compares the school image of the wartime past of the Falange and the Polish Workers’ Party (PPR), created during the turbulent first decade of Francoism in Spain and Communism in Poland. Demonstrating the political usefulness of the Party was crucial to the consolidation of both regimes. The legitimisation of the new regime called for emphasising the Party’s war effort, not only in defeating the enemy but also in its struggle for social issues. For<BR>school-taught history, the early years of both dictatorships marked a period of breaking with prewar educational concepts and introducing and testing new ‘revolutionary’ pedagogical solutions. This book not only explains the<BR>aspirations of political rulers to rebuild the students’ memory, but also contributes to our understanding of the textbook authors’ perception of the recent past. It analyses the meanings of terms specific to mythical stories, such as nation, power, heroes and their deeds, and wartime struggle.
The book explores the key concerns in the United States of America, as well as around the world today, related to the significance of ecology, eco-consciousness and climate change. The chapters by individual authors reflect the topics both from a theoretical and from an ecocritical perspective. In the former case, they analyze effects of the present ecological crises (i.e. climate change and pandemics), the emergence and development of environmental humanities, posthumanism, ecocriticism, ecofeminism, and ecotheology. In the latter case, they offer readings of American literary texts of the 20th and 21st centuries as significant case studies.

The book presents the life of Louis Wolowski (1810–1876). Born into a family of Frankist Jews in Warsaw, Wolowski participated in the Polish insurrection of 1830–1831 and later settled in France. Specializing in political economy, Wolowski became a professor at the prestigious Conservatoire des Arts et Métiers at the age of 29 and a member of the Academy in 1855. In 1852 he founded Crédit Foncier, one of the most important French banks and actively participated in the banking revolution of the second half of the 19th century. He also had a political career. Wolowski served as a deputy and from 1875, a life senator. Representing the liberal center of the French political scene, he played a crucial role in the establishment of the Republic in France.
This book explores three key issues to understand the redefinition of relations between the European Union (EU) and Latin America and the Caribbean (LAC): the international context, foreign policies of EU member states towards Latin America, and crucial topics on the EU-LAC agenda.
At the theoretical level, the book aims to rebalance two debates on EU-LAC relations. Der zeitliche und mediale Rahmen spannt sich von Andreas Gryphius’ Perikopendichtung über Zeitschriften und Kalender sowie das im Mittelpunkt stehende Zeitungswesen des 18. Jahrhunderts bis zum Feuilletonroman des Vormärz. Geographisch liegt der Fokus auf Mitteleuropa, dessen periodisches Pressewesen im behandelten Zeitraum eine wesentliche Ausweitung und Differenzierung erfuhr. Vor allem die Berichterstattung wird im Hinblick auf zentrale Phänomene wie Nachrichtenübermittlung, Aktualität, Periodizität, Beschleunigung und Entschleunigung in ihren materiellen und immateriellen Dimensionen untersucht, aber auch Wissensvermittlung und Räsonnement sowie das Anzeigenwesen und Paratexte kommen ins Blickfeld. Un siècle après la parution de l’opus magnum d’Arthur Moeller van den Bruck (1876-1925), Das dritte Reich, une traduction française de ce textephare de la Révolution conservatrice allemande trouve sa pleine justification. «Bible» des «Jeunes conservateurs», diffusé en près de 150.000 exemplaires, l’ouvrage attira rapidement l’attention de certains nationaux-socialistes avant d’être rejeté par eux pour des raisons qui, de leur point de vue, avaient toute leur légitimité. Etranger à l’idéologie racialiste des partisans d’Hitler, le livre est l’oeuvre d’un conservateur opposé à la République de Weimar et désireux de combattre à tout niveau les idées libérales et démocratiques avec pour objectif de tracer des pistes susceptibles d’ouvrir la voie à un redressement de son pays vaincu dans le cadre d’un «troisième Reich» doté d’un régime autoritaire destiné à advenir à moyen terme et permettant, tel était son espoir, l’épanouissement de toutes les potentialités de la nation germanique.
Der Rückblick auf die Jahre des Ersten Weltkrieges würde unvollständig bleiben, wenn man das Landvolk, das damals noch überall die Bevölkerungsmehrheit ausmachte, nicht berücksichtigen würde. Diesem Thema widmet sich der vorliegende Sammelband, der aufzeigt, wie sehr sich die Lebensumstände der ländlichen Bevölkerung drastisch änderten und eine Fülle von Emotionen aufkommen ließen. Der Schwerpunkt der Beiträge liegt auf dem Alpen-, Donau- und Karpatenraum, doch kommt auch die Westfront (Frankreich/Belgien) zur Sprache.
Medizinische Inhalte waren in der periodischen Presse stets vielfältig vertreten. Aus sozial- und wissenschaftshistorischer Perspektive nimmt das Buch Tages- und Wochenzeitungen ebenso in den Blick wie «klassische» Rezensionsorgane, populäre Gesundheitszeitungen sowie Zeitschriften mit dezidiert wissenschaftlichem Anspruch. Anhand von vier geografisch und zeitlich gestreuten Fallstudien beleuchten die Autor*innen des Sammelbandes unterschiedliche Facetten der deutschsprachigen periodischen Presse Zentraleuropas im langen 19. Jahrhundert. During the war, fallen soldiers were hailed as heroes, but after 1945, the treatment of the deceased and their graves underwent a profound transformation. Im Mittelpunkt des Interesses stehen die polnischen und deutschen Reaktionen auf die großen europäischen Revolutionen: 1789, 1848, 1956 und 1989. Fokussiert werden Themen, die es ermöglichen, die polnisch-deutschen intellektuellen, historischen und künstlerischen Beziehungen durch das Prisma revolutionärer Ereignisse zu betrachten, die die jüngere europäische Geschichte bestimmt haben. Ausgangspunkt ist die Französische Revolution, insofern die unterschiedlichen polnischen und deutschen Reaktionen auf ihren Ausbruch und Verlauf eine wichtige Rolle für die spätere Rezeption und Wahrnehmung von Revolution als Konzept und Mechanismus politischen Wandels in verschiedenen Gesellschaften spielen.

Robert Vipper (1859–1954) war vor dem Ersten Weltkrieg Professor für Universalgeschichte an der Moskauer Universität und hatte sich ebenfalls als Geschichtstheoretiker und Geschichtsdidaktiker einen Namen gemacht. Die Revolution von 1917 änderte die Rahmenbedingungen für Forschung und Lehre, Vipper fiel die Anpassung an die neuen Verhältnisse schwer. Im Jahr 1924 emigrierte er schließlich in die bürgerliche Republik Lettland. Dort startete er eine zweite Karriere als Professor für Neuere Geschichte und Hochschullehrer. Er wirkte an der Formulierung eines nationallettischen historischen Narrativs mit und behielt seine Stellung auch nach dem autoritären Staatsstreich von Kārlis Ulmanis. Nach der Annexion Lettlands durch die Sowjetunion kehrte Vipper 1941 auf ehrenvolle Posten im stalinistischen Wissenschaftssystem zurück. Die hier versammelten Beiträge spüren Wechselwirkungen zwischen Leben und Werk nach und nähern sich Vippers faszinierendem Œuvre aus verschiedenen Perspektiven.
Ao. Univ. Prof. Heinz Noflatscher lehrte bis zu seiner Pensionierung 2019 Geschichte der Neuzeit und Österreichische Geschichte an der Universität Innsbruck. 2024 feiert er seinen 70. Geburtstag. Kulturpessimismus ist eine der Signaturen der Jahrzehnte vom Übergang zum 20. Jahrhundert bis zum Ende der Weimarer Republik. Cette étude porte sur August Haußleiter, élu porte-parole des Grünen en mars 1980, mais dont le parcours est aujourd’hui largement oublié. Sa biographie politique retrace les reconfigurations personnelles, politiques et idéologiques qui ont mené le « grand-père » autoproclamé des Verts du « Troisième Reich », où il était propagandiste de la Wehrmacht, au parti « anti-partis ». Entre ces moments charnières d’une carrière qui court jusqu’à la veille de l’unification allemande, Haußleiter rejoignit l’Union chrétienne-sociale de Bavière, puis l’extrême droite, avant de tenter de se rapprocher de la jeunesse antiautoritaire de 1968. Cette biographie éclaire les évolutions de sa conception politique partiellement fondée sur l’idéologie de la Volksgemeinschaft et examine les ressorts individuels et collectifs de la quête de légitimité politique après le nazisme, dans une démocratie fédérale en reconfiguration permanente.

Cet ouvrage propose une historiographie du discours des Allemandes sur la condition féminine, de la fin du XVIIIe siècle au début du XXe siècle, analysant les efforts produits par les femmes pour faire entendre leur voix dans l’espace public et œuvrer à leur émancipation sociale, économique et politique. Il met l’accent sur les concepts de différence et d’inégalité entre les sexes, envisageant leur évolution des Lumières à la République de Weimar. In 1940, Estonia was first occupied and then annexed by the Soviet Union. The process of Sovietization started immediately and was accompanied by a thorough reconstruction of the economy. This monograph looks in detail at the different stages of economic restructuring of a country to be remodeled according to the Soviet example. Exploitation, violence, and declining living standards formed part of the process under Stalinist rule. Different sectors of the economy, but also the demographic development, are analyzed. By the end of Stalinism, the outcome indicated a disaster.

Who were Romania’s diplomatic representatives in the Balkans during the Second World War? How did they select and forward information? What personal mark did they add to negotiations and diplomatic notes? What was the relationship between the career diplomats and the political authorities in Romania in the context of a dictatorial regime in Bucharest? Patriotism is founded on the natural human need for lasting interpersonal bonds and is thus anchored in personal identity. Throughout Polish history, there has emerged a specific understanding and experience of patriotism. During World War II, the generation that grew up in the interwar period demonstrated the value of patriotism – being able to prioritize the good of the homeland and being ready to die for one’s country. Population movements taking place in past decades, including those reaching the European Union, defy straightforward and simplistic conceptions of drivers, trajectories and forms of migration. Approaching migration journeys as non-linear processes, this book looks into the conditions and legal-policy frameworks at broad spaces of mobility interlinking several origin, transit, destination and host contexts in South/Central/ Western Asia, Eastern/Central/Western Africa, Central and South America, and Europe to provide a more nuanced understanding of mixed migration. It also looks at specific migratory trends towards the European Union before and after the socalled ‘migration crisis’ (2009–2020), while paying particular attention to gender- and sexuality-specific dynamics and patterns.

During the process of European Integration, the European Union (EU) has progressively been established as a model of a “Europe without borders”, in which free movement is guaranteed for its citizens. Cross-border cooperation in EU border regions has largely contributed to the implementation of this model. However, in the context of poly-crisis, where re-bordering is a frequent measure employed by EU Members States, this “Europe without borders” is largely being questioned. This publication collects the different contributions to the Jean Monnet Network “Frontières en mouvement” (Frontem) between 2019 and 2023. They critically assess five models of cross-border cooperation in Europe: the Franco-German model of European integration, the Franco-Belgian model of an open border, the model of an invisible border on the Isle of Ireland, the Danish-German model of minority management and the Hungarian-Romanian model of cooperation for Central Europe. An overall comparison to the US-Canadian border also tests the applicability of these models to other areas in the world.
This book has two research objectives. The main objective is to present the dynamics of the system reform of the Economic and Monetary Union in 2010–2022. The other is to take stock of the reform and to highlight its successes and failures. In this context, the monograph puts forward two research hypotheses. The first hypothesis assumes that the shortcomings in EU primary and secondary law regarding the Economic and Monetary Union and the course of the euro area debt crisis were two main reasons for reforming the EMU, whereby the crisis in question actually forced the European Union and the euro area countries to implement the reform. The book proposes a new category – heterotopia of affect –which builds upon Michel Foucault’s typology. The category refers to changes of the places that accumulate contents of ideological, historical, religious, and national character. The book tells the history of a very Polish edifice as well as its surrounding cultural milieu and the history-creating role of the scientific community. The author focuses on the Staszic Palace whose fate reveals how – at different times in history – it catalyzed activities in search of radical changes in the mental landscape of the Polish community.

Historiography is one of the most systematic accounts of the fate of culture. It is also a record of human—reflexive and reflective metaphors of the world, simultaneously anthropomorphizing and humanizing it. Historical imagination captures the world in its classical form directly, and in its non-classical form indirectly, through the lens of anthropomorphization. This enables the adaptation of the world to the human dimension or, in other words, to be constructed on a human scale. Historiography and historical thinking, especially the traditional forms, are close to the figures of public discourse because they offer meanings commensurate with it. Additionally, they are openly imbued with values, making them susceptible to easy, casual and biased interpretations. Thanks to these features, historical thinking and historiography provide a framework for texpressing currently important values and the common and specific emotions centered around them.

The monograph is the result of research conducted between 2014 and 2018 in historical museums in Central and Eastern Europe. The main goal of the book is to verify the thesis about the existence of supranational collective memory in societies affected by the shared experience of totalitarianism. The analysis of the extensive research material allowed the author to distinguish social practices and types of exhibitions. Historical policies conducted by individual states exhibit features in common, their goal being to accustom people to the difficult past, to shape the positive images of the countries and to create the cultural founding myths of the post-communist states. Historical museum exhibitions become the executors of these ideas by introducing official interpretations of the communist period.
Dieser Band beinhaltet die Beiträge zum 45. Österreichischen Völkerrechtstag. Dabei wird der Bogen von Kernfragen des allgemeinen Völkerrechts vor internationalen Gerichten und Schiedsgerichten hin zu prozessualen und sektoralen Fragen gespannt. Abgerundet wird dies von Berichten aus der Völkerrechtspraxis.
Im Mittelpunkt der Arbeit steht die Frage, welche Auswirkungen das Tarifeinheitsgesetz auf Umstrukturierungsmaßnahmen haben kann und wie mit solchen zu verfahren ist. Dabei baut die Arbeit auf den Grundlagen des Tarifeinheitsrechts und des Betriebsübergangs auf, um in einem zweiten Schritt anhand der gängigen Methodenlehre das abstrakte Verhältnis dieser Rechtsinstitute zueinander zu untersuchen. Daran schließt sich eine fiktive Fallstudie an, die sich ausführlich mit den möglichen Auswirkungen in Praxis beschäftigt. In einem weiteren Schritt werden Gestaltungsmöglichkeiten der beteiligten Arbeitgeber und Gewerkschaften untersucht, bevor in einem letzten Schritt weitere Folgeprobleme aus dem Kollisionsfeld Tarifeinheit und Betriebsübergang aufgeworfen und untersucht werden.
Die Arbeit befasst sich mit dem nationalen Crowdinvesting-Modell als Finanzierungsvariante für Start-ups. Auf Internet-Plattformen kann eine Vielzahl von Kleinanlegern in Start-ups investieren und an deren wirtschaftlichem Erfolg teilhaben. Mangels alternativer Kapitalgeber ermöglicht das Crowdinvesting-Modell Unternehmensfinanzierungen in der Frühphase der Gesellschaften. Die dabei geschlossenen Beteiligungsverträge sind regelmäßig als partiarische Nachrangdarlehen ausgestaltet und beinhalten angenäherte Regelungen zu klassischen Venture-Capital-Vereinbarungen von professionellen Wagniskapitalgebern. Der Autor untersucht den für das nationale Crowdinvesting-Modell relevanten Rechtsrahmen und kommt zum Ergebnis einer fehlenden rechtlichen Vereinbarkeit mit den Investmentvoraussetzungen von professionellen Wagniskapitalgebern bei Anschluss- oder Co-Finanzierungen.

Das Strafrecht als „domaine réservée” der Mitgliedstaaten stellte die europäische Integration vor besondere Herausforderungen. Die im Wesentlichen intergouvernemental ausgestaltete Zusammenarbeit in Strafsachen findet mit dem Vertrag von Lissabon ein Ende, indem dieser Bereich als interne Politik der Europäischen Union in den supranationalen Rechtsrahmen überführt wurde. Die Autorin untersucht, ob dies auch inhaltlich eine endgültige Abwendung von der intergouvernementalen Prägung darstellt und inwieweit der Sensibilität dieser Materie sowie den staatlichen Souveränitätsvorbehalten Rechnung getragen wird. Die Anti Tax Avoidance Directive (ATAD), die Richtlinie zur Bekämpfung missbräuchlicher Steuergestaltungen der Europäischen Union, stellt eine Zäsur im Europäischen Steuerrecht dar. Hatten Richtlinien zuvor größtenteils der steuerlichen Liberalisierung gedient, schreibt die ATAD einen Mindeststandard an Abwehrregeln gegen grenzüberschreitende Steuergestaltungen vor. Die Richtlinie als Instrument wurde somit vom Freund des Steuerzahlers zum Verbündeten der Finanzverwaltungen. Dieser Paradigmenwechsel wirft im Steuerrecht vielfältige neue Probleme auf, die der Autor in diesem Buch untersucht.
Das private Kartellschadensersatzrecht rückte zuletzt in den Fokus der gerichtlichen Praxis und wissenschaftlichen Auseinandersetzung. Die Arbeit befasst sich mit einem der Dreh- und Angelpunkte von Kartellschadensersatzverfahren, der Bindungswirkung vorausgegangener Kartellbeschlüsse der Europäischen Kommission. Der Autor untersucht, welche Beteiligungsrechte den mitgliedstaatlichen Parlamenten aufgrund ihrer demokratischen Rückbindung an den Bürger zustehen. So sind Boote gefüllt mit Menschen, die auf der Suche nach Schutz gefährliche Routen über das Meer auf sich nehmen nicht nur eine Erscheinung im Mittelmeer, sondern auch Australien erlebt dieses Phänomen. In Diskussionen um die europäische Flüchtlingspolitik wurde hinsichtlich des Umgangs mit Flüchtenden auf das in Australien etablierte System verwiesen und überlegt, ein vergleichbares System in der EU zu implementieren. Die vorliegende Dissertation untersucht den Grundsatz der Gläubigergleichbehandlung auf nationaler und europäischer Ebene im Vergleich. Sie stellt die historische Entwicklung, den Zweck sowie Ausprägungen und Durchbrechungen des Grundsatzes in den Fokus. Die Arbeit kommt zu dem Ergebnis, dass der Grundsatz der Gläubigergleichbehandlung auf europäischer Ebene auf den Grundsatz der Gläubigergleichbehandlung nationaler Rechtssordnungen zurückzuführen ist, wobei die Grundsätze dennoch unterschiedliche Aufgaben erfüllen. So stellen nationale Umsetzungen die Verteilungsebene in den Mittelpunkt. Auf europäischer Ebene wird in erster Linie die Teilnahme am Verfahren, die Verteilungsgerechtigkeit innerhalb mehrerer Verfahren sowie der Antidiskriminierungsgedanke innerhalb einer multi-nationalen Gläubigergemeinschaft adressiert.
Die Rechtswahlfreiheit stellt eines der Grundprinzipien des europäischen Kollisionsrechts dar. Für sog. Inlandssachverhalte findet diese in Art. 3 Abs. 3 Rom I-VO ihre Grenze. In diesen Fällen bleiben die Parteien an zwingendes inländisches Recht gebunden. Anlässlich jüngerer Rechtsprechung des Englischen Court of Appeals gilt es, sich näher mit dieser Regelung auseinanderzusetzen, die im Spannungsfeld zwischen dem staatlichem Regulierungsanspruch und der Gestaltungsfreiheit der Parteien steht. Hierbei werden Maßstäbe für die Feststellung eines Inlandssachverhalts entwickelt, die sodann auf in Praxis und Literatur diskutierte Fallbeispiele angewendet werden.
Seit dem Ausbruch der Finanzkrise im Jahr 2008 hat sich die Finanzmarktregulierung mit atemberaubender Geschwindigkeit entwickelt, und eine „Entschleunigung“ der Rechtsentwicklung ist nicht in Sicht. Die Vielzahl der in den letzten Jahren veröffentlichten Rechtsakten lässt sich kaum überblicken. Dies macht es notwendig und lohnenswert, die Rechtsentwicklung wissenschaftlich zu untersuchen und in ihrer Effektivität zu hinterfragen, um nicht zuletzt Anstöße zu rechtspolitischer Weiterentwicklung geben zu können.
In diesem Sinne möchte der Autor mit der vorliegenden Arbeit einen kleinen Teilaspekt aus der vielfältigen Regulierung des Bankaufsichtsrecht herausgreifen und vertieft untersuchen: Interessenkonflikte und Anlegerschutz im Handel mit Finanzinstrumenten in der Kapitalmarktunion.
Dieses Buch erörtert die spezifischen Probleme, die sich aus der Unwirksamkeit gescheiterter Preisanpassungsklauseln im Rahmen von Dauerschuldverhältnissen ergeben. Die Autorin analysiert die geltungserhaltende Reduktion, die Aufspaltung teilunwirksamer Klauseln, die Lückenschließung, die Teilnichtigkeit des Vertrags und die Erstattungsansprüche bei unwirksam vereinbarten Preisanpassungsklauseln anhand des deutschen Rechts sowie unter Berücksichtigung des europäischen Rechts. Anschließend exemplifiziert sie ihre Erkenntnisse am Beispiel langfristiger Energielieferverträge. Feststellend, dass die Lückenschließung nach der sog. Dreijahreslösung des Bundesgerichtshofs unionsrechtswidrig ist, prüft sie abschließend, ob ein Vertragsanpassungsanspruch aufgrund § 313 BGB begründet werden kann.

Geldwäsche ist eine staatenübergreifende Problematik und als solche im Fokus der Europäischen Union. Diese nimmt durch ihre Gesetzgebung zunehmend Einfluss auf die Regelungen zur Geldwäschebekämpfung in den Mitgliedstaaten, zuletzt durch die erste Richtlinie zur strafrechtlichen Bekämpfung der Geldwäsche. Die Umsetzung dieser Richtlinie nahm der deutsche Gesetzgeber Anfang 2021 zum Anlass, den Geldwäschetatbestand im Strafgesetzbuch grundlegend zu reformieren. In diesem Buch wird untersucht, ob durch die vorgenommenen Änderungen hinsichtlich der geldwäschetauglichen Vortaten und der Beibehaltung der Möglichkeit der leichtfertigen Geldwäsche die Geldwäschebekämpfung künftig effektiver sein wird. Zudem untersucht die Autorin, ob die vorgenommenen Änderungen mit dem Grundgesetz vereinbar sind. Für herausgearbeitete Problematiken werden im Anschluss Lösungsansätze aufgezeigt.
Das Buch hat zum Ziel, das Vorkommen der Burgherrschaft (châtellenie französischen Typs) in Deutschland aufzuzeigen und dabei die innere Struktur der Burgherrschaft zu untersuchen. Konkret greift der Autor vier Burgen, nämlich Neuburg, Falkenstein, Hartmannsberg und Hernstein, die im Besitz der Grafen von Falkenstein waren, heraus und versucht, die um diese Burgen akkumulierten Herrschaften als Burgherrschaft (châtellenie) zu begreifen. Dabei wird die innere Struktur jeder Burgherrschaft aufgezeigt.
Die Hauptquelle, auf die sich der Autor bei seiner Analyse stützt, ist der „Codex Falkensteinensis”, der im Sommer 1166 im Kloster Herrenchiemsee in Oberbayern entstand. Die Investitionskontrolle ist ein vergleichsweise neues Regulierungsinstrument, das rasant an Bedeutung gewinnt. Mit der Verordnung (EU) 2019/452 hat die Europäische Union erstmals einen Rahmen für nationale Investitionskontrollen verabschiedet und diese durch eine Rückermächtigung legalisiert. Die Arbeit untersucht die primärrechtlichen Vorgaben für Investitionskontrollen auf nationaler und europäischer Ebene, insbesondere im Hinblick auf die Kompetenzordnung und die Kapitalverkehrsfreiheit. Darüber hinaus werden die materiellen Vorgaben der Verordnung (EU) 2019/452 und der Kooperationsmechanismus zwischen Kommission und Mitgliedstaaten erörtert. Da es sich bei der Verordnung um einen ersten Vorstoß des Unionsgesetzgebers handelt, ist in naher Zukunft mit weiteren Entwicklungen zu rechnen.

Im Rahmen dieser Untersuchung wird der von der Rechtsprechung vor Jahrzehnten entwickelte Begriff des unerlaubten Handeltreibens mit Betäubungsmitteln auf den Prüfstand gestellt, insbesondere werden die erheblichen systematischen Friktionen sowie der nur unzureichend ausgeprägte Rechtsgutsbezug vom Autor eingehend herausgearbeitet. Um diese Strafnorm mit den dogmatischen Grundkonstanten des Strafrechts zu reharmonisieren, wird vom Rechtsgut der staatlichen Drogenverkehrshoheit ausgehend der Begriff des Handeltreibens neu interpretiert. Mit diesem Ansatz wird der bislang überbordende Tatbestand de lege lata wohldosiert heruntergefahren, sodass sowohl die Täterschaft von der Teilnahme als auch die Deliktsverwirklichungsstufen wieder nachvollziehbar voneinander abgegrenzt werden können.
Das zwischen der EU, ihren Mitgliedstaaten und Kanada als Freihandelsabkommen neuen Typs geschlossene CETA etabliert beschlussfassende Ausschussgremien mit weitreichenden Entscheidungsbefugnissen im Bereich der Handelspolitik. Obwohl das Abkommen eine supranationale Wirkung der Beschlüsse seiner Gremien ausschließt, kann ihre Einhaltung durch die EU-Mitgliedstaaten aufgrund anderer Verpflichtungen erforderlich sein. Um der Frage nachzugehen, wie eine ausreichende demokratische Rückbindung von Ausschusssystemen, wie nach dem CETA, gewährleistet werden kann, ohne die Flexibilisierung künftiger Zusammenarbeit der Vertragsparteien aufzuheben, eröffnet der Prinzipal-Agenten-Ansatz eine innovative Perspektive. So zeichnet die vorliegende Studie aus der Sicht der Bundesrepublik Deutschland die über die Landes-, Bundes-, und Unionsebene bis hin zu den nach dem CETA errichteten Vertragsgremien verlaufenden Delegationsketten nach und untersucht Mechanismen zu deren demokratischer Rückbindung.
Unionsrechtswidrige Beihilfen müssen die Mitgliedstaaten zurückfordern. Im Steuerrecht erfolgt dies durch die Nacherhebung der rechtswidrig nicht erhobenen Steuer. Vertrauensschutzgesichtspunkte finden nach bisheriger Praxis faktisch keine Berücksichtigung, auch steuerrechtliche Besonderheiten nicht. Das Problem der Rechtsunsicherheit der Identifizierung einer Steuerbeihilfe wirkt sich einseitig zu Lasten der Steuerpflichtigen aus. Der Mitgliedstaat trägt keine nachteilhaften Konsequenzen für sein rechtsbrüchiges Verhalten, vielmehr kann er sogar davon profitieren. Dies nahm der Autor zum Anlass, den Tatbestand und die Rechtsfolgen des Beihilfenverbots aus steuerrechtlicher Perspektive dogmatisch näher zu durchleuchten, dabei geprägt von der Ausgangsthese, ob eine alternative Rechtsfolge zur Nachbesteuerung aus dem Unionsrecht herzuleiten ist und diese Alternative sogar unionsrechtliche Pflicht sein könnte.

Algorithmen beeinflussen inzwischen nahezu jeden Bereich des täglichen Lebens. Davon umfasst ist im Besonderen die unternehmerische Preissetzung, die sowohl im Online- als auch im Offline-Geschäft zunehmend algorithmisch organisiert wird. Preissetzungsalgorithmen bieten den Unternehmen neue Möglichkeiten der Datensammlung und -auswertung, ermöglichen aber auch einen umfassenden Austausch von Preisdaten mit Wettbewerbern. Diese digitalen Preissetzungssysteme können im Hinblick auf das deutsche und europäische Kartellrecht problematisch sein. In Betracht kommt ein Verstoß gegen das Kartellverbot, wobei unklar ist, ob dieses in der geltenden Form ausreicht, um mit diesen digitalen Formen horizontaler Kollusion angemessen umzugehen. Diese Arbeit beleuchtet die Problematik ausführlich und bewertet verschiedene Konstellationen unter Berücksichtigung von internationalen wettbewerbsbehördlichen und gerichtlichen Entscheidungen.

Es besteht kein Zweifel daran, dass die italienische Rechtssprache durch die Übersetzung der napoleonischen Gesetzbücher geprägt wurde. Das Buch geht diesem Einfluss anhand von Archivquellen nach und zeichnet ein umfassendes Bild der beteiligten Akteure, Prozesse und Produkte. Dabei lassen sich durch erhaltene Berichte und Briefe nicht nur Arbeitsprozesse von der Rekrutierung der Mitarbeiter bis zum Druck der Gesetzbücher verfolgen – im Mittelpunkt der Untersuchung stehen zwei Abschriften des Code de commerce, die in unterschiedlichen Phasen des Übersetzungsprozesses entstanden sind. Diese Abschriften werden in einen Zusammenhang mit Berichten und Briefen gestellt, sodass Korrekturen und Diskussionen der Übersetzungskommission nachvollziehbar werden. Diese Arbeit ist mit dem Preis der Johannes Gutenberg-Universität Mainz 2023 sowie mit dem Premio Gaspara Stampa des Deutschen Italianistikverbands (DIV) für hervorragende Qualifikationsschriften 2024 ausgezeichnet worden.

Die interdisziplinäre Studie verbindet Erkenntnisse aus Sprachwissenschaft, Gedächtnispsychologie und Literaturwissenschaft, um Techniken zu untersuchen, mit denen Erinnerungsprozesse in der NS-Väterliteratur inszeniert werden. Im Zentrum stehen die Parameter Aggregation und Integration. Aggregative Strukturen stellen zentrale Mittel zur authentischen Darstellung der Prozesshaftigkeit eines Erinnerungsabrufs dar. Dabei liegt der Fokus auf grammatischen ‚Randphänomenen‘ wie Satzrand und Nichtsatz, die sich als essenziell für die Inszenierung von Erinnerungsprozessen erweisen. Die Studie erweitert das grammatiktheoretische Konzept insbesondere im Bereich der Nichtsatzklassen. Die methodische Herangehensweise basiert auf der Grammatischen Textanalyse und dem kognitionspsychologischen Cue-Recalled Autobiographical Memory Test, wodurch ein innovativer Zugang zur Analyse von Erinnerung und Sprache entsteht und ein wichtiger Beitrag zur Literaturgrammatik geleistet wird.

Seit 25 Jahren arbeiten 49 Staaten an der Realisierung der Bologna-Erklärung zur Schaffung eines Europäischen Hochschulraums. Das Buch beschreibt die allgemeinen und spezifischen sprachlichen Grundlagen der Slawisierung (Böhmisierung) des ehemals überwiegend deutschsprachigen Gebietes in der Tschechischen Republik nach 1945. Am Beispiel von Braunau/Broumov und Umgebung wird untersucht, welche Rolle die Sprache –auch aus kulturhistorischer Perspektive – für das Zusammenleben und die Verständigung zwischen Menschen (hier: zwischen Deutschen und Tschechen) hatte und hat. Der Fokus liegt dabei auf der dialektalen Entwicklung. Paul-Louis Courier (1772–1825), after being a comparatively discreet critic of Napoleon in his letters, became a scourge of the Restoration Establishment, both secular and clerical, in pamphlets which he published from 1816 onwards. His writings were incendiary enough to attract death threats, two prosecutions, and one term of imprisonment. Unlike other pamphleteers, he was concerned with defending the rights and material security of the humble, particularly the smallholders who had bought land after the Revolution. They struggled to survive because, in addition to the normal hazards of farming, they were burdened by onerous taxation, conscription, and legislation, which restricted their freedoms in order to protect Catholic observance. His writing was distinguished not only by his preferred subject matter, but also by his lucidity of thought and by the economy and elegance of his expression.

The Industrial Revolution accelerated natural resource extraction, profoundly transforming European ecosystems. The present post-industrial scenarios clearly illustrate the deep interrelation between nature and culture, producing spaces known as “Anthropogenic Landscapes.”
This is book explores European industrial heritage, revealing the deep interconnection between human activities and the natural environment, thus redefining the concept of heritage. By integrating political and social perspectives, the book examines the connections between industrial heritage and contemporary environmental crises like climate change and soil and water pollution. It provides readers with the knowledge and tools necessary to interpret, manage, and promote industrial heritage from this specific environmental perspective. Inspired by practical cases in Belgium, Italy, Serbia, and Sweden, it also explores former industrial sites repurposed for cultural and recreational use, offering a comprehensive understanding of industrial heritage in the Anthropocene era.
Mobilities are an essential issue in contemporary societies, which have recently been reexamined as a result of calls for ecological transition, on the one hand, and the impact of the global Covid 19 pandemic, on the other. The original contribution of this book is that it starts from the polysemic meaning of mobility, paying attention to different scales of perception and action, the lived spaces in which mobility occurs, and the “alternative” character of so-called sustainable mobilities and the actors who display or engage in such practices. The concept of mobilities is thus considered in relation to urban spaces and sustainability, based on the analysis of French case studies from a European perspective and using multidisciplinary social sciences approaches.
This treatise on religious studies traces the European tradition of astrology from its oriental beginnings to the present day. The aim is to get a view of the different mythological, philosophical and theological ideas of the cosmos (especially with Platonic and Aristotelian borrowings), which astrology has repeatedly reformulated and carried through all epochs. However, it seems as if astrology had lost its plausibility with the overcoming of the geocentric world view by Copernicus and Kepler and could only continue to exist as an “intellectual regression” (Theodor Adorno). This view is countered by the thesis, founded here, that astrology has been able to survive the changes in world views unscathed because it designs philosophical (holistic) patterns of reasoning into the relationship between cosmos and humans, which in a Platonic sense understand the cosmos as an intelligent and vital organism.
The book is designed as a methodological exercise in cultural studies described as “engaging”, which refers to a specific research approach requiring cooperation and the inclusion of individuals and communities in the research process, using a rich repertoire of humanistic traditions as a tool of social criticism. The key is to treat cultural studies as a workshop in which the researcher changes from a distant observer into a practical person – a public intellectual and craftsman at the same time. The turn from “engaged” to “engaging” research methodologies described in the book is strongly rooted in the tradition of the philosophy of praxis and the theory of social practices, from Aristotle, through Marxist theories, to contemporary participatory action research. The Series “Borders and European Integration” fills in a gap in Social Sciences, as it connects two so far independent research strands: European Studies and Border Studies. Mainly initiated by geographers and originally hosted in the United States, Border Studies primarily deal with the study of borders and borderlands, whereas European Studies analyse the process of European Integration, its actors, institutions and policy fields. Although the idea of a Europe without borders was part of the project of the European Economic Community, the multidimensional role of the border has not been sufficiently taken into account by researchers in European Studies.
