Your rights as a lodger Let me start by saying that you must always obtain the permission of the owner or real estate agent before taking on a flat mate, lodger or boarder. So let’s look at who is a boarder?
By Sarah Freeman If you do not obtain permission, and the owner or property manager discovers an unauthorised person living in the property, then they may have cause to send you a letter of breach and terminate your tenancy. It is illegal to sub-let the property at any time without the owner or agent’s permission. However, if you seek permission, most agencies will be only too happy to discuss this with the lease holder. They will then likely ask the prospective fl at mate, lodger or boarder to fi l out an application form (just as you did) so they can carry out checks for worthiness and call the owner to inform them and gain consent. The Property Manager or owner should then send you a letter to say they either give or deny permission. If you are given permission, I would highly recommend you do a property condition report of the room or at least take dated photos and charge the ingoing occupant a small bond. I would also recommend that you make an agreement in writing stating rent payments and any other outgoings that are to be shared by the new occupant as well as notice for vacating the property. As the lease holder you will be responsible for any damage that occurs while the property is in your name irrespective of who did the damage.
A boarder is someone who receives meals in addition to being a lodger.
Does the agreement refer to a tenancy, renter or boarder?
There may be an issue as to whether the amount of food a person receives is enough for the person to be classified as a boarder.
Does the owner provide the tenant any linen, food or other services?
It has been said that board lies somewhere between an early morning cup of tea and a full bed and breakfast.

Now let’s look at who is a flat mate? A fl at mate is generally someone who agrees to pay an equal share of the rent and utilities, will carry out their share of the housekeeping duties and either pay an equal share of house food or purchase their own. A fl at mate is generally regarded as someone who has an equal voice in how the household is run but this person is not the leaseholder so therefore not bound to the same compliance of the lease or Residential Tenancies Act.

It is useful to note, however, that the definitions of lodger, boarder and flat mate are not definitive and applying them to a person’s situation can often be difficult.

In attempting to determine whether or not a person is a lodger or a boarder, here are some useful questions to ask:
Is the tenant subject to any rules while at the premises?

Does the person have a key to the front door?
Generally speaking, a lodger is someone who occupies part of the premises but whose occupation or residency is still under the control of the owner.
It can be diffi cult to determine whether a person is a boarder or a lodger.
Is the person expected to pay the same amount of bond as a tenant?
Further, it is important to remember that, even if the food received is insufficient for the person to be classified as a boarder, they may still be a lodger and therefore not covered by the Act.
Can the tenant come and go as they please?
Even when the owner does not live at the premises, the occupier or resident may still be classifi ed as a lodger if the owner retains control of the outer door of the building, or if they provide other services such as cleaning the room or making the bed.
What is the character of the premises, and the purpose for which occupation is made available?
Are the premises registered as a boarding house with the local council?
However, the question to ask is probably whether the food being received is trifling enough in value or in amount to be negligible or whether it constitutes a significant cost.
This is an important distinction – so you should know who is a lodger?
For example, the owner may live at the premises.

BOC opens new Karratha plant BOC, a Member of the Linde Group, has announced the official launch of its state of the art Air Separation Unit (ASU) facility in Karratha, Western Australia, enhancing energy security of the State’s northwest. The ASU plant marks the next step in BOC’s regional capital works program following the completion of bulk gas storage and distribution facilities and the 2011 refurbishment of a Gas and Gear retail outlet in the Karratha’s Light Industrial Area. BOC’s ASU plant allows the gas and engineering company to deliver a reliable supply of nitrogen, oxygen and medical gases to industry and the
community in the North West region. BOC managing director South Pacific, Colin Isaac, said the opening of the ASU plant was a milestone in BOC’s 75-year history of providing gas-related expertise and products to the North West. “We are delighted to have successfully delivered this major project, which will supply products vital to the rapid expansion of the resources industry in northern WA,” he said. “BOC is investing more than $100 million in capital works in Karratha and the ASU project is a key element in the production and supply of essential industrial and medical gases.” New technology has allowed BOC to take a greener approach at its Karratha gas production facility, which
has the capacity to generate up to 60 tonnes of nitrogen per day. Using less than half the energy of traditional plants, the high-tech ASU is air cooled, the use of water consumption for cooling purposes. Local production has also reduced the reliance on interstate transport to deliver critical gas products to the area. Mr Isaac said this will enable BOC to deliver a cost-effective supply of industrial and medical gas to its growing customer base in the Pilbara region. “The Karratha ASU and distribution facilities will form an integral part of BOC’s Australian operations, and its ability to meet growing energy requirements locally and across the Pacific region,” Mr Isaac said.

Time to clean your water softener/filter Recent tests conducted by the Shire’s Environmental Health Service has shown low levels of bacteria in water samples from the kitchen sink, hand basin and shower of two houses in Karratha. It is believed that this may have been caused by the use of residential sized water softeners/filter systems, which remove chlorine prior to it entering the house, or where a hot water unit has been switched off for a period of time. Chris Adams, Chief Executive Officer of the Shire said that normally any bacteria from the environment that may contaminate household taps and showerheads are killed off by chlorine in the water supply. However, water softeners and similar devices remove the chlorine from the water making it susceptible to contamination by bacteria such as Legionella that may enter the tap or showerhead from the outside. “Leaving water standing in hot water units that have been switched off will also allow the chlorine to dissipate away which can let bacteria grow” said Mr Adams. To help minimise the growth of any bacteria in your household taps and showerheads, the Shire’s Environmental Health Service recommends the following: •
Regularly empty and scrub out water softeners and filters to remove any scale, sludge or films that may contaminate your water supply.

Keep your hot water systems permanently at a temperature above 55 degrees.

If your house has been empty for more than a week flush the taps and showers before using the water.

How much can you afford to borrow? Many homebuyers don’t understand basic lending details, including how much they can borrow, until they actually apply for a loan. This is not ideal because an informed homebuyer is in a much better position to make an offer. Until about ten years ago the general ‘rule of thumb’ for buying a home was that you could borrow about three times your gross household income. So, if a couple were making $130,000 between them each year, a lender might loan up to $390,000. However, this measure doesn’t apply terribly well today with house prices having grown so much. If you are applying for a joint home loan with another person including your spouse or partner you must take into consideration their existing earnings and debts. Remember; both of you are legally liable for repaying the loan. The key to a smooth start with a home loan really rests with the deposit. If you don’t have a ready deposit, it’s wise to start a regular savings program in preparation for home ownership. Most lenders require recent evidence of three
months of genuine savings before approving a loan. If the deposit is a gift then the lender will normally require it to be in the borrowers bank account for three months. Talk to your financial institution about this. Most prefer a deposit of around 10 per cent the purchase price, but this has become unrealistic. Deposits of 5 per cent are now more common. Banks are keen to lend, but following the GFC they are also more thorough about checking your capacity to service the loan and giving consideration to any other debts you may have.
