After all, we go to great lengths to extract impure raw materials, invest large amounts of energy in purifying and processing them and turning them into useful products. The problem is, we then have the habit of taking those purified materials – the polyethylene in a plastic milk bottle for instance, or the copper in a phone charger – and mixing them up with a whole lot of other stuff when we throw them away. The Myth of the ‘Better Mousetrap’ By Scott Bywater

Ever heard this saying... "If a man can make a better mousetrap than his neighbour... the world will make a beaten path to his door. It was a quote from a wise guy: Ralph Waldo Emerson. But it was also... WRONG! In 1928, a guy called Chester M. Woolworth took this concept and created a better mousetrap. It sold for 12c -- 7c more than the older, less effective mousetrap. Think about it: why would you want a better mousetrap? If it works, it works. And you end up throwing them out anyway. But as a result of this quote which has sunken deep into our psyches, thousands of people are looking for that miraculous way to grow wealth by coming up with a super-special product. My advice is: By all means do your best to create a great product or service for your prospects. But don’t make that your sole focus. I've spoken with plenty of people who have great products and services – but they couldn't make any ‘real’ money because... Their marketing was terrible! Their ads couldn’t sell! It’s not easy being green – avoiding misleading green marketing

In our last legal update, Melbourne based intellectual property lawyer, Sharon Givoni provided some useful insight on how to legally protect your brands in the plastics industry. Making ‘green’ claims on packaging is another area which is often misunderstood.

In 2009, Sanyo Air-conditioning Manufacturing Singapore Pty Ltd, claimed that its Eco-air conditioners were ‘environmentally friendly’. But the products contained an ozone depleting substance. ACCC took Sanyo to the Federal Court, and it ordered that the statements were misleading.

TIP: The use of words like ‘environmentally friendly’, ‘green’ or ‘eco-friendly’ which have loose meanings may be risky.

TIP: Qualify your statements. Substantiate claims

In March 2011, the Federal Court determined that Goody Environment Pty Ltd made false representations, claiming that its bags were ‘biodegradable and compostable’and in accordance with the Australian Standards.The ACCC found that the bags actually did not meet the Australian Standards as to biodegradability, disintegration and concentration of toxic or hazardous substances.

TIP: It is important to test your claims, and ensure they are accurate and precise at all given times. Continuous control systems should be in place when making green claim. Consumers often do not always analyse product packaging when it comes to ‘fast moving’ consumer goods such as groceries or perishables. It is best to make extensive enquiries from your suppliers and monitor changes that might make a statement that was once true, misleading, especially if the circumstances change. This is largely because of the ever-changing nature of the recycling facilities, the various interpretations the consumer may gain and the geographical challenges that affect the viability of claims. Therefore, in this area, plastic companies should err on the side of caution. Remember, the consequences are not just limited to legal implications, but can also give rise to negative publicity. When making any green, consider the following: What is the overall impression you are giving to the consumer? Is it correct in all respects? Is it appropriate to geographical area in which the product could be sold? If the claim is on product packaging, is the product itself recyclable? Is it made from recycled material? Is the representation open to a number of interpretations? Are they all correct? APPMA 2012 Annual Scholarship Submissions close Friday 11th of May

The Australian Packaging and Processing Machinery Association (APPMA), in conjunction with the Australian Institute of Packaging (AIP), are pleased to announce that submissions are due on Friday the 11th of May for the fourth annual scholarship program which will enable a packaging engineer the opportunity to complete a Diploma in Packaging Technology. The APPMA is Australia’s national organisation, representing the packaging and processing machinery industry. The APPMA are seeking a packaging engineer that is looking to further their education by offering them a scholarship to enrol in the Diploma in Packaging Technology. According to Mr Mark Dingley, Chairman of the APPMA, “The Diploma in Packaging Technology is a Level 5 qualification which is internationally recognised for those wishing to pursue a career in the packaging industry or for those who are already in the industry and who wish to extend their knowledge and expertise. It has been offered by the AIP continuously since 1980 and has an exemplary record of successful students,” “The Diploma prepares students to take responsibility for packaging operations at any level through the supply chain. The qualification is comprehensive, and provides an opportunity to study the principles of packaging, packaging materials and packaging processes,” Mr Dingley said. There are two broad target groups for the scholarship: 1. People currently employed in parts of the packaging industry who want to broaden their knowledge and understanding and take on greater levels of responsibility. Due to the diverse nature of the packaging and related industries, it is difficult to define this target group in terms of precise job functions. 2. People who are currently employed in the industry, who may be following courses in associate subject areas such as packaging design, food science/technology, materials science/engineering and logistics will find that this programme broadens the scope of their studies. In designing the course, the principles of constructive alignment have been employed, i.e. the intended learning outcomes, which reflect the requirements of industry, clarify the course objectives. 3. Pierre Pienaar, FAIP, National President of the AIP, added that the Institute is grateful that associations like the APPMA recognise the importance of education and training and are contributing to the growth of the packaging industry as a whole in Australia. “The APPMA annual scholarship program is now in its fourth year and the AIP encourages all packaging engineers to register for the 2012 scholarship,” Mr Pienaar said. NatureWorks and BioAmber Form Joint Venture to Commercialize New Bio-Polymers Two industry-leading companies join forces to expand the range of low carbonfootprint, high-performance, bio-based polymers

NatureWorks, the bio-plastics market leader with its commercial range of Ingeo™ biopolymers, and BioAmber, a next-generation chemicals company and a market leader in the commercialization of bio-succinic acid, have announced the creation of AmberWorks, a joint venture to bring new performance bio-based polymer compositions to market. The joint venture builds on the natural synergy that exists between NatureWorks and BioAmber. Beyond its Ingeo PLA technology platform, NatureWorks brings to the joint venture a global commercial presence, established customer relationships, developed applications across a breadth of industries and deep experience in commercializing new-to-the-world polymers. BioAmber owns PLA/ PBS compounding intellectual property and applies award-winning biotechnology and chemical processing to produce renewable chemicals. These renewable chemicals deliver high-performance, low-carbon-footprint building blocks that are cost competitive with their petrochemical equivalents. The joint venture combines the best of both companies into an entity tasked with developing a new family of bio-based compounded polymer solutions. With the formation of the joint venture, NatureWorks plans to commercialize a new family of compounded Ingeo resin grades, and is immediately offering samples of developmental grades aimed at thermoforming and injection-molding processes.
