Editor's Note... I should probably start off with a quick introduction – I’m Melissa and I’m the new Editor of OM! This is the first issue under my reign (which is powered by sunshine and coffee). It’s been packed out as always with great, local businesses offering some fantastic deals to our readers. We live by the clock, and we’re now on British Summer Time! Hopefully we’ve all recovered from that lost hour of sleep and, although we still have a few chilly days ahead, we can start enjoying the longer evenings and the coming warmer weather. The first barbecues of the year tend to get fired up around now, hopefully not under the protection of a giant pub-garden umbrella. Easter may be over but the kids are still on school holidays. Check out our What’s On Guide on page 19 for some ideas to get them away from the chocolate! Also this month we have the Plymouth Half Marathon to look forward to! Celebrates its 40th Birthday! Beacon Blinds is celebrating 40 years in business this year!

he local business, which is the sister company to Beacon Electrical, was started back in 1976 when founder, Chris Higgins, was still working in the Plymouth Dockyard. He began measuring and fitting blinds in the evenings for extra money to help support his very young family and soon realised that this had great potential, so he set out on the path of running his own business. It was a ‘proper’ family business set-up, with his wife, Sue, helping to develop the business into curtains and soft furnishings, while still looking after three young sons. The business, which started in the family home in Beacon Park, was aptly named Beacon Blinds, and soon a small shop was opened nearby in conjunction with the, also newly formed, Beacon Electrical. The reputation for Beacon’s honest and friendly service grew quickly and this has been the mainstay of the business to this day. The red velvet curtains and brownpatterned 70’s style roller blinds are now far gone, and Beacon Blinds has thrived in the larger premises that both Beacon Blinds and Electrical moved into in 1981, on Beacon Park Road.

Plymouth Half Marathon
It’s half marathon time again, when the streets of Plymouth will fill with runners and supporters on the morning of Sunday 17th April.
The course features some long, tough hills, but a few years ago the route was altered slightly to make it faster with more gradual climbs and a few, kinder downhill stretches. The route is a gruelling 13-miles long, something many of us might shake our head at. So what do these runners go through before, during and after the race? We’ve spoken to regular participant, Jim Dwyer, about the ups and downs and the training it takes to be involved in this impressive event... 14 April 2016
PREPARING FOR YOUR WHAT TO WEAR: FIRST RACE? “In your first race you’re going to be nervous beforehand, but look at the weather forecast, the route map and the start information and you’ll feel a lot more at ease when heading out. “With the race – start steady, don’t go sprinting off weaving between runners – you’re only adding distance to your run! Ideally you’ll find a good position for your pace at the start allowing you to get into your stride early on.” You’ll be sent a pack before the race containing your race number and a timechip. This logs your exact running time as you start and finish.

“An absolute MUST for a race is wearing kit you’ve worn before, know is comfortable and won’t cause any discomfort mid-race! If it’s a cold day, a base layer is always a good idea to avoid any chills. “The one thing I wear in races which friends often laugh at, is compression socks, but I swear by them. They keep your lower legs well supported, absorb impact and keep your muscles warm which helps to avoid cramping. “I also wear a GPS watch which gives me my mile pace time and this has been a great aid for me improving my times. I know from experience how fast I can push myself at whatever point in the race and it’s very helpful to get frequent updates on how you’re progressing.” Correctly-fitted running trainers are an absolute must. In Plymouth the best places to head to are specialist stores such as Frank Elford Sports and Tony Pryce Sports. They will discuss your needs and fit you with the right trainers to ensure you have a comfortable running experience.

TRAINING:
“During training I eat a lot of carbohydrate/protein based meals: pasta, brown rice, chicken and tuna. Carbs help with endurance and protein during training helps speed up muscle repair. I always make sure I’m well fuelled going into a run whatever the distance or intensity.”
Jim is currently training for the Edinburgh marathon at the end of May, so the timing of the Plymouth Half falls favourably in his training schedule. He’s already doing 13 mile runs on the weekends!
Although some people don’t like to eat before exercising, the right food can fuel you up. If you’re preparing for a challenge like a marathon, focus on eating well throughout your training, not just before or after a run. “Before a race I always have an early breakfast of porridge with bananas and honey, giving me a good balance of slow releasing energy and an easily digestible meal. I may have a cup of tea to wake me up with a caffeine kick before a race. The last thing you want is something too heavy or anything which might not ‘sit’ comfortably like a fry up or bacon sandwiches before you’re going to run.”
If you’re a beginner, aim to start training as soon as possible after registering for a race, leaving yourself time to gradually build up your distance and stamina. “For a half marathon, if I’m starting from scratch or getting back to ‘race-pace’, I plan for about an 8 week training plan.” In the few days before the race, don’t do a long run. Instead do a few shorter distances to allow your muscles some recovery time.
SUPPORT: There are lots of local running clubs which are a great way to find support and motivation. Gyms and health clubs usually offer these for free to their members, or you could perhaps start your own.

Born into a large family, and growing up in Plymouth, he left school with no qualifications before going into the hospitality business.

chatting about Hollywood movies with Abraham, a key member of the team (and also Chris’ son).
We arrive at his offices, in North Road East, Plymouth, to be greeted with a frenetic atmosphere as staff members busy themselves with legal claims.
It’s a rapport building conversation which instantly puts us at our ease and we feel a great warmth towards the company – it’s perhaps not every day that top legal experts can engage so readily in that all important ability to produce small talk.
The personal injury specialists have a strong track record of success spanning more than 15 years - with Chris at the helm throughout. We are provided with coffees and ushered into the conference room. Tom, the photographer, admires the Van Gogh prints on the walls as he sets about preparing his lenses, camera and flash for the accompanying photoshoot. Chris appears through the door, clutching paperwork, before settling himself in a seat at the head of the table. Shortly afterwards, he is surrounded by his team of loyal staff and Tom starts clicking away with his camera. As he whirls through the digital wizardry of his equipment, OM passes the time by

By his mid-thirties he was running his own cafeteria in the city centre, when he began to get chatting with a regular patron, Arthur Madison, who would come in every Wednesday afternoon. Chris recalls that Arthur was always reading (mainly about history) and soon the two engaged in conversations about careers and degree courses. Arthur had a strong background in academia and, following a number of meetings, he suggested to Chris that he “wouldn’t regret gaining a qualification in either economics or law.” It was a small seed which would eventually blossom into a magnificent tree and benefit thousands of clients. Chris concentrated on catastrophic and brain injury cases, with some cases receiving a pay out of more than one million pounds. With Arthur’s enthusiasm and support, Chris eventually took his law degree at the University of London. Sadly, Arthur has since died and OM asks Chris what he would have made of his protégé’s success. Chris becomes quiet and reflective. “I did get the law degree before he passed

AND ENTREPRENEURS away and he was delighted,” he says softly. “It was a series of meetings which changed my whole life and he would be pleased for me.” “Arthur was always interested in other people and he took positive steps to encourage others he came into contact with to improve their educational standing.” With a background in the hospitality business, it meant Chris had the right people skills to flourish in the legal world, as he says, “If you do well in getting on well with people then you can get on well in business.” Shortly after graduation, Chris had the opportunity to work as a barrister in London but his heart was firmly in Plymouth and so he returned to the city and soon started work with one of the city’s top legal companies.

With two years as a trainee under his belt, Chris found himself at another company heading up a team in its Personal Injuries Claims department. The section rapidly grew from 10 lawyers to 36 and Chris left to set up his own business. “I decided to go it alone as you can provide a more personal service when you are in a smaller company and it allows you to develop in your own manner and provides greater progression in your practice and in your career,” he says. That was 16 years ago. Since then, his business has seen exceptional growth with much of it stemming from the loyalty, hard work and dedication of his family members working in the business, his staff and of course company partner, Alistair Tawse, and his wife Sarah Tawse who is a senior solicitor at the firm.
It’s a busy time for Chris. The company has approximately 500 cases a year (which he says is not a conservative estimate). Outside of running the business, he is also President of the Rotary Club of Plymouth and heavily involved in aiding local charities
- his focus on helping people extending far beyond the walls of his office. “Business is like life, you have to be people focused,” he explains. “It’s not about making money. It’s about running it professionally to provide a good product for the client.” Honesty is a big part of Chris’ mantra and so part of his firm’s work is about not raising client expectations. After all, they cannot guarantee the desired result in every case they examine but he does have tremendous faith in the legal process. “We cannot always get justice, but, it is a fair system and, providing you do not abuse it then you can get a good result.” “I am always very driven and prepared to work hard. I don’t mind spending time with people, even if they do not pursue the claim. My firm has a good reputation locally.” So, it is perhaps not surprising, the key dynamic which Chris believes has ensured the success of the firm has been a happy working atmosphere – something which he believes is vital for any office. His home life is equally well balanced with a family of four children. Three of them are lawyers and one is a pharmacist. It is perhaps his role, as a loving husband and caring father, which are among his greatest qualities as it allows him to readily identify injustices through the eyes of a family man. He can then use his training, and knowledge, to try to put things right. Talking about his family, he says, “We are all very happy as human beings and that is the greatest achievement in life, if

husband, wife and children are all happy. I think we are very fortunate.” As we head towards the end of the interview, OM asks him to sum up his business success in a succinct sentence. “Dedicated, thorough and dynamic,” is his reply. These three words are the crucial ingredients which have assured his ability, together with all of his staff, to help families across Plymouth to gain support and guidance from one of the city’s leading experts in Personal Injury claims. THE FUTURE OF ENTREPRENEURSHIP
at plymouth university Plymouth University is constantly growing and evolving to cater to ever-changing industries, and their Business School is no exception. OM spoke to Dr Emily Beaumont, Discipline Group Leader for Entrepreneurship, about what their innovative, new courses can offer.

e arrived at their colourful Futures Entrepreneurship Centre in Mast House, situated overlooking Sutton Harbour. Plymouth Business School is getting bigger, particularly now they’ve seen the successful launch of the undergraduate Business Enterprise and Entrepreneurship programme; a Two Year Fast Track degree that enables you to study whilst starting or running your own business. Emily told us that, “Even in its first year it’s been so successful, not only in terms of recruitment but in terms of the standard and quality of the students and their work. We’re just so pleased and keen to let everybody know about it.” Some students already have a business plan, or even a business set-up and running when they join the programme, whilst others come with aspirations of being self employed. Whatever stage in their business development they are at, they can bring their business ideas to the programme and apply them within their assessments.

Funding can then help those businesses either start-up or develop further. Emily explained how, “One of the special things about this programme is that it’s designed to support students in setting up and running their own business, and they get the opportunity to pitch for up to £1,500 worth of funding to do this that they don’t have to pay back.”

studying at the moment is a very experienced cocktail bartender who wants to create a business focused on non-alcoholic cocktailmaking parties for under-18s. Another student loves his parttime job working in a restaurant, but he’s on the course because he wants to open his own restaurant. The degrees aim to teach them about the foundations of business and entrepreneurship and how to get it started and running effectively.

Emily says that, “You can have knowledge of the area but if you don’t have the business acumen then you can’t do anything with that knowledge. It’s harnessing that knowledge and getting them to create value from it which is the idea behind the programme.” Some students however, don’t have plans to start their own business, but the course still works for them. “The degree isn’t just for people who want to start their own business.” The degrees also explore intrapreneurship, which is the idea of having those entrepreneurial

capabilities and tendencies but applying them in a large organisation. “We have students who know from day one that they want to be an intrapreneur, someone who promotes creativity and innovation within an existing organisation”. “Employers will look at the programme they’ve studied and see that they are a person who can understand the breadth of their business.” The programme creates employees who can see a business from the owner’s point of view and fully understand what they’re trying to do. For anyone who is unsure on whether they want to spend lots of years studying, they’ll be pleased to hear that this course has been designed as a two-year fasttrack. Not only does this mean that a student would save £9,000 (being the cost of one year’s undergraduate study)

This all goes alongside the academic learning which is provided at the university. “What we’ve built here is the whole package.”
HOTBOX500

s an example of the sort of learning students can expect, on their first day in September they were tasked with the Hotbox500 project. Students are provided with 500 waste products from a local company (this being plastic bubble gum canisters) which would otherwise go to landfill. Students had to repurpose the products for in partnership with the Play Association on Union Street, which meant that the finished piece needed to have community benefit in mind. The team decided to create raised flower-beds using the materials, which would assist elderly people who can’t bend down to do gardening, and would also educate children on growing food. The task was a success – the final product was pitched back to the client who were very pleased with the outcome.

An extra semester in the long summer holidays means that the entire course isn’t condensed into less time, but less time is taken off. For most people this isn’t a problem, as the standard summer for students lasts from June until September! No studying is missed out or rushed.

Although it may seem busy, fitting in a 100-hour placement and going abroad, while also setting up a business and studying, students still have the time and are encouraged to do things outside of their studies.
“We don’t want students to miss out the amazing clubs and societies on offer at University of Plymouth Student’s Union.” It is a full-time degree and students should expect to dedicate a lot of time to their studies, but there is still time to have that all important student life and many already prove that it can be done whilst working part-time, and some even do all of this with children in tow.
Business Enterprise and Entrepreneurship offers mature students the opportunity to get back into education
A work placement and trip abroad is even fitted in to the two-years to enhance study. Then, back at university, real-life consultancy projects called Inspiring Futures give students the opportunity to work on a live brief from a variety of clients, solving problems for them or working on social media strategies, market research, etc. Businesses can get involved in Inspiring Futures for free, receiving a good quality piece of work after liaising with the students involved. It’s proven to be a very professional and effective way of working.
With this full-on schedule you wouldn’t be mistaken for thinking that this course suits the more young and spritely. Most people still consider university as a place for young people, who have finished school and want to develop themselves personally and professionally. Whilst this is true, Business Enterprise and Entrepreneurship also offers mature students the opportunity to get back into education and it’s fast becoming a very viable option for those with families, those who are older, and for those who have been in the workplace for many years.

Also, as put by Emily, “Because of the context of the programme it really fits, because we get students who are really motivated.”
Sophie White, a student on the Business Enterprise and Entrepreneurship, told us: “My experience of Business Enterprise and Entrepreneurship has been incredible. It is led by an enthusiastic, dedicated course leader and supported by a whole team of inspiring, supportive individuals who are happy to help students wherever they can.”

Norman Blandford is the eldest person currently on the course at age 55, and he’s really pleased with his experience so far. “As a returning learner I was naturally anxious as to what kind of experience Plymouth University could offer me. I have been very pleasantly surprised with both the individual tuition and general management of our course. The subjects are relevant, diverse and can be exciting with guest speakers and externally set projects, this course is delivering its promise.” Another reason that the two-year set-up works so well, is because the faculty also offer some great postgraduate Masters degrees. These are oneyear long and cost less than the undergraduate degree (currently £5,400 for 2016/17 for home and EU students), meaning that a student could potentially achieve both an undergraduate and postgraduate qualification in the same time but spending less money than if they were to take the standard three year route. The postgraduate Masters degrees on offer are MSc Entrepreneurship and MSc Entrepreneurship and International Development. These are suitable for those who already have an undergraduate degree, who have an interest in developing an understanding of the factors that inform strong entrepreneurial business decisions or helping a new generation of entrepreneurs transform lives and empower communities. The next steps for Emily and the team now are to continue to develop their courses whilst promoting them to young and old, local and international. Being Plymouth born-and-bred herself, Emily hopes to see more local students on the undergraduate and postgraduate courses in the next academic year. With a strong support-network set up, funding available and plenty to learn, there is no longer a good reason to shun university education. It’s a chance to further skills and knowledge, whilst gaining valuable experience. “It’s all possible.”

The Flexitarian Definition: A person who has a primarily vegetarian diet but occasionally eats meat or fish
M
any of us have started to question our eating habits, and with veggie cookbooks, alternative health foods in the supermarkets and restaurants catering to various diets, a vegetarian or vegan lifestyle is becoming easier to follow. But on announcing a new diet, friends and relatives might still turn their noses up, particularly because cooking a meal for a vegetarian requires a little more thought. It can be difficult to stick to when meat-eating parents invite you over for a roast dinner, when attending a wedding with a meaty set-meal, or if you’re out and about and need something quick to eat on-the-go. So, the flexitarian diet became a “thing”.

It was a term coined in the 90s, but a diet which has become more popular in the last few years. People heard more about it when the McCartneys started their Meat Free Mondays campaign, urging everyone to avoid meat completely at least once a week.

Isn’t this a bit greedy? It could feel wrong to discuss the reasons against eating meat, to happily eat a burger the next day. But this is about reducing our intake, because scoffing down meat with almost every meal isn’t particularly good for us. Those who choose a flexitarian diet may also make sure that any meat they do eat is ethically sourced. But why might a person decide to cut-down on their meat consumption? It’s come to light recently that cattle-rearing for food is having a bigger, negative impact on global warming than modern transport. A lot of farm space is taken up with animals and those animals have to eat. Many crops we see growing in fields don’t go to

A vegetarian is more likely to get their 5-a-day, and they are less likely to suffer from obesity, heart disease, high blood pressure and type II diabetes. Also, diet is estimated to cause approximately 30% of all cancers in developed countries, and statistical evidence has shown a clear association between vegetarianism and a lower risk of some cancers. According to the Vegetarian Society, being a vegetarian is good for the environment, as it takes thousands more litres of water to produce a kilo of beef than to grow the same quantity of grains, vegetables or pulses. Eventually you might be ready to ask yourself - Vegan or Vegetarian? A vegetarian doesn’t eat meat or fish, but a vegan takes this a step further and won’t eat any animal products at all. This includes milk and eggs, and alternatives are used in meals instead. Pescatarian is another diet you may have heard of, which is a person who won’t eat meat, but will eat fish.

Potato and Wild Garlic Soup
From Riverford Organic Farms
We send you out wild garlic leaves but not the flowers, as they’re too delicate to travel. The flowers are very pretty in soups and on salads, so collect a handful if you pass them when they’re out in April and May. This is good served with rye bread or thickly buttered cheese scones. Increase the amount of wild garlic if you dare!
Ingredients • • • • • • •
Serves 4
2 tbsp sunflower or light olive oil 1 large onion, finely diced 600g potatoes, peeled and diced 1.2 litres chicken or vegetable stock 50g wild garlic leaves, shredded, plus a few extra to serve Crème fraîche or double cream, to serve Wild garlic flowers (optional)
Method 1. Heat the oil in a large saucepan. Add the onion and fry on a low heat for 10 minutes, stirring often, until softened without colouring. 2. Add the potatoes and stock. Bring to the boil, reduce the heat and simmer for 20 minutes, or until the potatoes are tender. 3. Add the wild garlic leaves, reserving a few shreds for garnishing the soup. 4. Blend until smooth. Alcohol VS Health? Great Blue Hole, Belize
With spring just around the corner and lighter evenings upon us, the temptation for a glass of your favourite tipple at the end of a long day is too great for most of us to resist. With studies showing that 30% of adults are drinking above the daily limit, does an alcoholic drink in the evening a few times a week really affect your health?
“A
lcohol is metabolised by a normal liver at the rate of about one ounce (one shot, a normal beer, a regular sized glass of wine) every 90 minutes.” Age, sex and weight can all affect this process. Any amount consumed over that doesn’t get processed immediately, and instead saturates your blood until your liver can process the excess alcohol. The body stores protein, fats and carbohydrates, but it cannot store alcohol, so our systems will act to remove it immediately putting all other process on hold including the fat burning process. Alcohol and weight gain usually come hand in hand, with beer bellies and love handles being at the top of people’s weight loss wish lists.
Alcohol has no real nutritional benefits. It’s high in calories and when consumed, it stimulates insulin production, and a spike in insulin levels can lead to an increase in fat storage. A pint of beer contains around 180 calories - around the same as a large slice of pizza; just 2 gin and tonics can have the same calories as those found in a burger.
Drinking five pints a week (the equivalent of 250 pints a year) consumes the same amount of calories as someone who gets through 221 doughnuts in a year. Just 2 pints a day, 4 days a week can add nearly 75,000 extra calories on to your diet in a year! One pound of fat is 3,500 calories meaning just 8 pints a week could lead to a 22lb weight gain in just 12 months. But alcohol leading to weight gain can have an even greater detrimental effect on your body, than just making your jeans a little tighter.
Weight gained by alcohol is usually stored as fat around the abdomen and it’s this area of fat storage that can give you a greater risk of developing type 2 diabetes. 34 April 2016

Those of us that drink most days of the week will also increase our risk of developing liver disease. Over a 10 year period, men who drink over 35 units a week and woman who drink over 28 units a week have a serious risk of developing liver disease. So the ugly truth of the matter is that alcohol isn’t your body’s best friend, and it’s time to think about your health and start making some smarter choices. Make a conscious effort to only drink one night a week, avoid turning to a drink after a bad day at work and go for a walk to clear your head instead. Swap your glass of wine to an apple juice or sparkling water. My top tip is to serve it in a wine glass, the process of drinking it out of your normal glass will actually help you to not notice the change in beverage. When you do have a drink, make smarter choices, swap your regular lager for a shandy, make your wine a spritzer or even try a fruity non-alcoholic cocktail. Try to have one alcoholic drink and then a non alcoholic drink, this will cut your consumption by half.

A new support group, which aims to help people affected by depression, is being run in Plymouth and is already claiming success as scores of people are taking part in its regular meetings. Side by Side is a national scheme designed to examine the effectiveness of group support for people affected by mental illness. Depression Alliance is one of the charities involved in the project which is currently taking place across England. Working alongside Mind and Bipolar UK, with funding from the Big Lottery, Plymouth is one of nine regions selected in the two year study. Organisers in the city are running four group meetings every month with the aim of improving the lives of people experiencing mental health issues. The local groups are run by Duncan Little and Louise Jones from Depression Alliance. “We know that at least one in four people struggle at some time in their lives, so, in the population of Plymouth that could be around 60,000 people. What the groups allow is the chance for local people to meet up with others going through similar issues and chat things through over tea or coffee,” explains Louise.

lthough we know the physical processes that cause pain, the personal experience of pain is unique. It has been found that, while some people suffer tremendous pain from certain back damage others are found to have the same damage but are unaware of it, suffering no symptoms at all. Pain can be perceived as a warning of potential damage, but, according to the British Pain Society, can also be present when no actual harm is being done to the body. Pain is as much an emotional experience as a physical one and it seems that how we interpret the meaning of it can have a huge effect on the level of pain we experience. This is because of the widespread parts of the brain involved in reacting to the messages sent to it from an area of damage. Anyone who has found that their pain is reduced when they find that the cause is as serious as they might have imagined will understand this – worry and anxiety can make pain much worse. Chronic pain is the cause of a number of issues that can lead to depression such as lack of sleep, stress and low selfesteem. For those who find they have to stop working or their hobbies or favourite activities, such as walking, cycling or crafts, this can be very difficult. Of course, before removing pain, we should always be sure we know the cause of it so that that can be treated, but once pain has directed us to a potential problem in the body there really is no further need to suffer with the pain itself.

ontrolling or Coercive Behaviour
By Alexandra Boardman Following on from her previous article, Alexandra Boardman from The Family Law Company looks at further aspects of controlling or coercive behaviour. Part Two I often hear from clients how they spent the early weeks or months of a new relationship telling their partner about their past, only to find that their trust and confidence was turned on its head, and the information became a weapon used by the abuser. When getting to know someone new, we do usually tell them all about ourselves, our likes, our dislikes, our hobbies, our failures and our triumphs. Many of us probably post this information on the internet via our social media sites. For someone with a coercive and manipulative personality, this is like winning the jackpot. It’s amazing what you can learn about someone from the internet. This is a wake-up call to check your profile and see what information is out there about you and how easy it is to access. At the point that you realise that the relationship is not what you want any longer, any coercive and controlling behaviour can really take a nasty turn. It’s not rocket science when you think about it; if you try to take control away from someone who wants to be in control, they won’t like it very much. Their natural reaction will be to find a way to take back that control. How would they do that? They simply use what they know, and exploit their knowledge. Thankfully, due to significant pressure from domestic abuse support services and agencies, the Government has recognised this behaviour and has legislated about it. In December 2015, the Home Office brought in statutory guidance and a framework for the Police and Crown Prosecution Service

regarding controlling or coercive behaviour in an intimate or family relationship. This legislation plugs the gap between stalking (either by someone you know or someone you don’t know) and domestic abuse related offences. The offence of controlling or coercive behaviour is constituted by behaviour on the part of the perpetrator which takes place “repeatedly or continuously”. The victim and the alleged perpetrator must be “personally connected” at the time the behaviour takes place. The behaviour must have had a “serious effect” on the victim. This means that the behaviour has either caused the victim to fear violence will be used against them either on “at least two occasions”, or has had a “substantial adverse effect on the victims’ day to day activities”. The alleged perpetrator must have known that their behaviour would have a serious effect on the victim, or the behaviour must have been such that he or she “ought to have known” it would have that effect. Controlling behaviour: this is a range of acts designed to make a person subordinate and/ or dependent by isolating them from sources of support, exploiting their resources and capacities for a personal gain, depriving them of the means needed for independence, resistance and escape and regulating their everyday behaviour. Coercive behaviour: this refers to a continuing act or a pattern of acts of assault, threats, humiliation and intimidation or other abuse that is used to harm, punish, or frighten their victim. Types of behaviour can include: isolating a person from their friends and family; depriving them of their basic needs; monitoring their time; monitoring a person via online communication tools or using spyware; depriving them of access to support services; repeatedly putting them down, by telling them they are worthless, for example; enforcing rules and activities that humiliate, degrade or dehumanise the victim; forcing the victim to take part in criminal activity; financial abuse including control of finances; threats to kill or hurt; threats to a child; threats to reveal or

publish private information; assaults; criminal damage; rape; preventing a person from having access to transport. This is by no means an exhaustive list. These behaviours can also be present within domestic abuse. Although they are now potentially criminalised, they can also be dealt with via various aspects of family law such as divorce, Children Act proceedings and injunctions. Where these behaviours have been reported it may be that evidence can be obtained and relied upon to meet Legal Aid guidelines if you are seeking Legal Aid when applying for or responding to any family law proceedings. To pre-nup, or not to pre-nup?

ccording to a recent survey, one in ten people wished they had set up a pre-nuptial agreement prior to entering into marriage. In London, this figure was nearly 20%.* Pre-marital agreements, also known as pre-nuptial agreements, are a form of contract into which a couple enters before marriage, attempting to agree how they will deal with their assets in the event of divorce. According to the Office for National Statistics, 42% of marriages in England and Wales end in divorce and it’s estimated that 34% of marriages will end in divorce by the 20th wedding anniversary. For many years these agreements were largely ignored by the courts, but recently they have become increasingly influential in deciding how divorce assets are divided. In 2014 Law Commission recommended that pre-marital agreements should be

considered legally binding, although no steps have yet been taken to make this happen. In the meantime, the court still takes them into consideration. The main reason for not having a prenup was the other partner’s reluctance to agree, people being too nervous to ask, or that it was considered unromantic. Ian Downing, partner in GA Solicitors’ family department, said that there was a clear rise in awareness and enquiries: “Pre-nups can be very effective in limiting the extent of a spouse’s claims on divorce. This is often particularly important to those who have already been through a divorce and want to protect themselves and their family against the risk of another breakdown. “A well prepared pre-nup is not a quick fix, and it is not suitable for all situations. To be effective it has to be well researched, carefully negotiated and well drafted. You will only discover the flaws in your pre-nup at a later date
