Think Yourself Happy By Barbara Burgess

Whatever we may believe we want; a new car, a beautiful home, a luxury holiday or a loving partner, what we really want and what we believe these things will give us is…Happiness.

B

ut what if Happiness was already your way of being in the world? What if you were just happy, without a reason? Studies have shown that we all have a set level of happiness and acquiring the things we think will make us happy, will actually only raise our level of happiness temporarily. We soon adapt to these new good things and our happiness level reverts to the previous level. In fact, once the basic needs are met, it doesn’t seem to make much difference to your overall happiness whether you are poorer or wealthier.

“Studies have shown that we all have a set level of happiness and acquiring the things we think will make us happy” You might now be thinking that there is no hope of becoming happier, but recent brain research has provided a key that can help unlock your potential for greater happiness neuroplasticity. The previously long held ‘truth’ that your mind is a construct of your brain and past experiences has been turned upside-down because they have discovered that your mind creates your brain structure and by thinking differently, you can actually

change your brain. The process of increasing your happiness is actually quite simple, even though the practice is not so easy. First you need to look at your past and future; if you hold on to negative emotions about the past such as anger or sorrow, that part of your life will continue to affect you into the future. If you feel emotions like fear or worry about the future those feeling will colour everything you do in the present.

“Being happy makes you more creative, more productive and more successful with relationships so bring the Joy into your life” The first step then is to let go of the past (easier said than done?) which requires looking at it from a different point of view; in NLP we call this ‘reframing’. Consider, for instance; ‘Because this happened in my past I am now a more ………… person’ or ‘… I learnt to do/be………….’ The more positives you are able to find in a situation the more you can feel gratitude for even the worst experiences.

“Another secret to happiness is Contribution” Negative feelings about the future exist completely in your imagination. The only foundation you can have for those ideas come from past experiences. Clearly there are certain things that are highly likely to happen – if you get to work late for the tenth time you are reasonably likely to lose your job but perhaps you would be better finding a job that you like enough to get there on time! And the Present? The first secret here is to actually be present. When we are happiest we are not thinking

Please mention Oracle Magazine when responding to adverts

about what we look like, what others think of us or what we are going to do later; we are engrossed in the activity of now, whether that is work or play. Another secret to happiness is Contribution. Helping other people makes us feel good about ourselves, more empathic and more useful and less self-absorbed. Studies with sufferers of Depression found that when they got them helping other people their depression lifted quicker. Being happy makes you more creative, more productive and more successful with relationships so bring the Joy into your life.

Super foods

Food, if chosen well, can improve our mood, focus, energy, skin and metabolism. There are some such foods, branded as Super Foods, that are nutrient powerhouses, packing large doses of antioxidants, polyphenols, vitamins and minerals. Eating them reduces risk of chronic disease, increases likelihood of a prolonged life and people who eat more of them are healthier and happier. We’ve picked for you the big dogs of the Superfood family, so dig in to find out more… By Nimra Imran

Tomatoes

These red orbs contain lycopene, an antioxidant rarely found in a majority of foods. Studies suggest that it could prevent certain cancers and lowers the level of cholesterol. Plus, tomatoes contain high amounts of potassium, fibre and vitamin C. Why not try making your own Salsa recipe wich is quick and easy! All you need is one clove of garlic, one medium onion, 3 large tomatoes, juice of one lime, one tablespoon of freshly chopped corriander, half a teaspoon of chili powder, three pinches of salt and pepper and half a teaspoon of cumin. Make sure that the galric and onions are finely chopped. Then all you need to do is mix the ingredients together and enjoy your freshly made salsa!

that cause aging cells damage). The antioxidant in these berries may also protect against cancer and reduce the effects of age related conditions such as Alzheimer’s disease or dementia. Start your day right with a hearty breakfast of greek yoghurt with a handful of blueberries, drizzled with some delicious honey and nuts of your choice!

Kale

Kale contains a type of phytonutrient that appears to lessen the occurrence of a wide variety of cancers, including breast and ovarian cancer. Though scientists are still studying why this happens, they believe that phytonutrients in Kale trigger the liver to produce more enzymes that neutralise potentially cancer causing substances. An excellent way to incorporate Kale into your diet is by eating Kale chips, which are incredibly quick and easy to make, and taste amazing! You will need one bunch of kale, washed and dried, two table spoons of olive oil and salt to add flavour.

Blueberries

These berries are full of phytonutrients that neutralise free radicals (agents

10 May 2015

Preheat your oven to 300 degrees and remove the center stems of the kale bunch. Then either cut or tear up the leaves. Toss the kale and olive oil together in a large bowl and sprinkle with salt. Spread the kale chips out on a baking sheet. Bake at 300 degrees for fifteen minutes or until crisp and enjoy!

Black Beans

A cup of black beans packs 15 grams of protein which is excellent for your health, with none of the artery clogging saturated fat found in meat. Plus, they’re full of heart healthy fibres and antioxidants and energy boosting iron. Making your own black bean sauce at home has never been easier! You will need the following ingredients: two table spoons of vegetbale oil, 180g tin of salted black beans (drained and rinsed), four cloves of garlic (finely chopped), 200ml Vegetable Stock, two table spoons of Dark Soy Sauce, two tea spoons of sugar, two to three tea spoons of Cornflour. In a small pan, heat the oil and add in the beans and the garlic. Cook gently for about a minute and mix togehter the remaning ingredients in a jug, then add to the pan. Bring up to the boil, stirring throughout. Once thickened, the sauce is

to the Rescue ready to use, or allow to cool in order to bottle and refridgerate for future use.

Broccoli

Cruciferous vegetables like broccoli contain phytonutrients that may suppress the growth of tumors and reduce the risk of cancer. One cup of this veggie powerhouse will supply you with your daily dose of immunity boosting Vitamin C and a large percentage of folic acid. If you’re going to add brocolli to your meals, I recommend using tender stem brocolli, which has a much swetter taste.

chia seeds

Chia seeds deliver a massive amount of nutrients with very few calories attached. They are tiny black seeds from the plant Salvia Hispanica, which is related to the mint. There is strong evidence to suggest that they can reduce blood pressure and are the richest plant source of Omega 3, the vital fats that protecy against the inflamation. On the plus side, they are easier to digest than flax seeds, and dont need to be ground up! Why not try making your own chia seed pudding with blueberries. You will need one cups of chia seeds, one packet of blueberries and some vanilla extract, along with three cups of almond milk.

Then blend them all toegether, leave it to cool and set and enjoy your delicious chia seed pudding!

Cacao Cacao has over 300 nutritional compounds and is one of the richest sources of antioxidants of any food on the planet. Raw cacao is made by cold-pressing unroasted cocoa beans. The process keeps the living enzymes

in the cocoa and removes the fat (cacao butter). While cacao looks the same as cocoa, it has a few significant differences. Cocoa powder is raw cacao that’s been roasted at high temperatures. Raw cacao lowers insulin resistance and protects your nervous system. Cacao is high in resveratrol; a potent antioxidant also found in red wine, known for its ability to cross your blood-brain barrier to help protect your nervous system. It also sheilds the nerve cells from damage, while reducing the risk of cardivascular disease. The antioxidcants found in cacao help to maintain healthy levels of Nitric Acid Oxide (NO) in the body. Although NO has heart benefiting qualities, such as relaxing blood vessels and reducing blood pressure, it also produces toxins. The antioxidants in cacao neutralises these toxins, protecting your heart and preventing against disease. Best of all Cacao also boosts your mood! It increases levels of certain neurotransmitters that promot a sense of well-being. And the same brain chemical that is released when we experience deep feelings of love – phenylethylamine – is found in chocolate. It is rich in minerals: Magnesium, iron, potassium, calcium, zinc, copper and manganese. When naturally fermented the cacao beans create a smooth, rich

Please mention Oracle Magazine when responding to adverts

chocolate falvour.

Oats

Full of fibre, oats are a rich source of magnesium, potassium and phytonutrients. They contain a special type of fibre that helps to lower cholesterol and prevent heart diseases. Magnesium works to regulate blood-sugar levels, and research suggests that eating wholegrain oats may reduce the risk of type 2 diabetes. We reccomend soaking your oats over night in almond milk and making them in a saucepan for them to be fluffier. Then pour into a bowl with a hanfdul of fruit of your choice such as blueberries or strawberries, a great boost for your day ahead.

Salmon

Salmon contains omega 3 fatty acids, which the body cannot produce by itself. These fatty acids reduce inflammation, improve circulation, increase the ratio of good to bad cholesterol, and may slash the risk of cancer. Salmon is a rich source of selenium, which helps prevent cell damage, and several B vitamins. Drizzle the salmon in lemon juice and marinate with parsely and oregano or any herbs and sprices of your choice. Then, wrap the salmon in tin foil and bake until ready. Dig in with some boiled rice or a hearty salad.

Getting Better A

lmost all of us will experience an injury at some point in our lives. Only then do we realise how significantly an injury can interrupt our daily routine and activities. Some injuries can be very obvious. Other injuries are less so. In a car accident, traumatic forces can cause the head to stretch the neck muscles beyond their normal range. This often results in a muscle strain or muscle tear, which can be extremely painful and debilitating. Injuries can prevent us from exercising, playing, sleeping and working. At Chris Kallis Solicitors, we recognise that the most important focus after an injury should be on recovery and rehabilitation. The earlier a patient is able to start safe and appropriate exercise, the better the opportunity to return to work or sports as soon as possible. It is generally accepted that there are three basic phases to getting yourself back to where you were prior to the injury: (i) the acute post-injury phase, (ii) the recovery period, and (iii) the functional phase. The period in the first days after the injury is the ‘acute’ phase. Seriously injured people will be treated by medical experts in hospital. For those with minor injuries, it can be just as important to get checked out by the GP, who may make an early diagnosis of a more serious injury underlying the initial symptoms. Once the swelling starts to go down or the pain subsides, the injured person moves into the ‘recovery’ period, during which it is important to start to regain range of movement and strength. Too often the tendency is to stop exercising once an injury occurs. But muscle power diminishes rapidly when muscles are not used. Advice from a rehabilitation expert, such as a physiotherapist or chiropractor may be important to guide safe and appropriate exercise at this stage. The ‘functional’ phase is the last stage and the time to start regaining full exercise capacity. This involves gradually testing the injured area as it is worked up to the previous level of fitness. Preventing repeat injury is an important component of the functional phase. Unfortunately, doing inappropriate exercises or too much exercise can actually cause more tissue damage and delay healing. Further input from a physiotherapist or chiropractor is likely to be required at this stage, to ensure recovery without setback. Some people may move through these phases relatively quickly but those with severe injuries can take months in each phase. Brain injuries are different. Early rehabilitation seems to be essential for how well a patient recovers after a severe brain injury. Unlike most other cells in the body, brain cells do not regenerate when they are destroyed. However, this does not mean that recovery cannot occur. The brain is flexible and is able to reorganise itself to an extent, in order to regain lost function. Rehabilitation from an

occupational therapist specialising in acquired brain injury aims to help the brain learn alternative ways of working in order to minimise the long-term impact. Rehabilitation also helps the patient and the family to cope successfully with any remaining disabilities. At Chris Kallis Solicitors, we place a strong emphasis on obtaining rehabilitation advice and support from the start. Provided the Defendant insurer accepts responsibility for your accident, we will arrange for you to be seen by expert medical consultants, physiotherapists, chiropractors, occupational therapists and psychologists, to make sure you are on the right road to recovery. If the Defendant does not accept responsibility, we will fight your case to ensure you achieve a just outcome.

If you have suffered an injury after an accident, contact Chris Kallis Solicitors to arrange a meeting to discuss your claim, without any obligation. Telephone 01752 225060 or email: info@chriskallis.co.uk It might seem a bit old fashioned, but actually it’s still the most direct way to seek advice. It makes sense to know who is dealing with your case. You can even pop into our office and speak to us about it, if you’d rather see us faceto-face over a cup of tea.

GIRL POWER Our history is riddled with great, heroic tales of men winning wars and slaying dragons. But from time to time, there have been women who have shone out as being equally powerful as the men in their time, some of whom have even gone on to shape the future of the world as we know it.

By Nimra Imran Eleanor Roosevelt: Born into wealth, she married Franklin Roosevelt, and soon became involved in his political life. This union would shape the American politics for generations to come. Eleanor was an instrumental part of her husband’s campaigning, especially after his attack of polio. This activity was widely mocked in the press when she continued to speak out on social matters as the First Lady, a position previously involving only being a hostess at the White House. Eleanor followed her own political agenda as well as supporting her husband. She was a strong and outspoken supporter of African American rights. After President Franklin’s death, Eleanor served on the UN Commission of Human Rights. She continued to serve the causes she believed in until her death in 1962. While she held no elected office, she was a wide reaching social reformer who is still often quoted.

crystallography allows the structures of molecules to be resolved by the diffraction of x-rays. For her work on resolving the structures of biological molecules, Professor Hodgkin was awarded the Nobel Prize for chemistry in 1964. Today there are over 75,000 published protein structures that are involved in the aid of drug design. Protein biochemistry would be unthinkable today without the insight of X-ray crystallography.

Emmeline Pankhurst: From a young age Emmeline was politically aware and understood that she was treated differently from her brothers. She married Richard Pankhurst, a lawyer who advocated freedom of speech, education reform and women’s suffrage. Their home became a centre for radical politics and Emmeline founded the Women’s Franchise League.

X-ray imaging. After the awarding of her Nobel Prizes she became a famous face of science, and used her influence to get funding for research into radioactivity. When the First World War came she purified the radium needed for X-ray machines and drove the trucks to the front lines herself. Unfortunately, her long years of work with radioactive elements, before the dangers of ionizing radiation were discovered, weakened her health and caused her death, in 1934. Her daughter, Irène, continued to work on radioactivity, and was, herself, awarded the Nobel Prize in chemistry, alongside her own husband, in 1935.

The WFL disbanded after a year and Emmeline focused on supporting her husband’s political ambitions. After Richard’s death in 1897, Emmeline founded the Women’s Social and Political Union. Without her efforts, and of those who followed her, women might not have gained the vote.

Marie Currie: Dorothy Hodgkin: Dorothy Hodgkin is not a well-known name outside the realms of science, but her work revolutionised biology. X-ray

A New Way of Cooking Chocolate “A New Way of Cooking with Chocolate” is the brand new cookbook from Hotel Chocolat, with recipes from their chocolatiers’ kitchen and award-winning restaurants in London, Leeds and Saint Lucia. With stunning food photography and more than 100 individual recipes, the cookbook reveals a glimpse into the inner workings of this dynamic British brand along with inventive new dishes and much-loved classics. Split into nine chapters, the book includes energy-boosting breakfasts, innovative savoury starters and mains, to-die-for desserts and an array of cocktails. From a simple supper for two to a Saint Lucian style “Jump Up” dinner party, the cookbook will equip readers with the know-how and confidence to introduce cocoa cuisine into their kitchen. People have adored cocoa for more than 3,000 years, but it was only in the last 500 that we started getting sweet on it. Long before anyone added a grain of sugar, cacao beans were loved for their deep, savoury richness. They were roasted, shelled and eaten like nuts, and crushed for use as an infusion, garnish and subtle spice. Readers will discover how to use the whole bean, from the shell to the nibs, from cocoa powder to chocolate bar. There are also step-by-step instructions on how to roast your own cocoa beans at home and make chocolate entirely from scratch. Uniquely, each recipe has a “Cocoa Factor” to indicate the depth of flavour as well as the cocoa percentage and region that will best suit the dish. Colourful anecdotes and stories are weaved throughout the book, taking the reader on a vibrant chocolate journey from pod to plate.

Liquidation In A Nutshell As a licensed Insolvency Practitioner, the main part of my work revolves around advising Directors on the insolvency options for their companies when facing financial difficulty and then holding their hands through the most appropriate insolvency procedure. Liquidation is one of the most common insolvency procedures used when a company is insolvent with no prospect of recovery or rescue. A company can go into liquidation in two ways - either being forced to compulsorily by the Court or voluntarily using an Insolvency Practitioner like me. The voluntary procedure is known as a Creditors Voluntary Liquidation (“CVL”). Directors call meetings of the shareholders and creditors to place the company into liquidation and appoint a

Liquidator. The company ceases to trade and the employees are made redundant. Once appointed as Liquidator I take control over the Company. I help the employees claim any money due. I safeguard and sell the company’s assets and deal with any leases.

I also investigate what went wrong and file a report on the Directors’ conduct with the Insolvency Service. At the end of the liquidation process if there are funds available I pay the proceeds to creditors in a certain priority. As a business declines the pressure increases on all concerned and the Directors end up facing more and more problems; can they pay the staff this month, should they be ordering goods they can’t quite pay for, how quickly will HM Revenue and Customs send in bailiffs etc.? Liquidation is not a happy ending but it can take a great deal of stress off the owners of a business. No one plans to fail but it happens.

All around us, with every passing second, changes are occurring in our world as the global scale of human activity pushes against and often exceeds nature’s capacity to support life. The drastic shifts in our climate, oil peaks, shortage of fresh water, waste overload, and rapid biodiversity loss are just a few of the many signs that humans are exceeding the planet’s resource limits. The rate at which we are consuming these resources leads to suggest that we may not be

decades. In light of the complex nature of the issues facing our world today, many people have taken it onto themselves to reduce their carbon footprint and create more awareness about the understanding of sustainability, clarifying the changes that lie ahead, outlining the steps needed to achieve true sustainability and inspiring people to follow their lead and act.

By Nimra Imran

SMART LIVING A simple step that many have taken to reduce their carbon footprint is by improving their way of living; quite simply redesigning their homes, teeming with sustainable appliances and creative foolproof ways of saving energy.

Z HOME

Developed at Ghent University in Belgium, The E Cube aims to create an affordable zero energy housing option. The home can be customized from its initial starter kit to suit the individuals needs such as time, budget and taste. A docile house that is great fun and a brilliant investment, its kind to the environment and immense fun to assemble. Next up is Z home, located in Issaquah, Washington. A ten unit housing development project, it has set out to prove that homes which use zero net energy and sixty percent less water end up emitting zero net carbon 36 May 2015

emissions and have a greater margin of cleaner indoor air. Using only low toxicity building materials where possible and scalable to mainstream home production, this house is leading

the way to eco friendly living. The development offers eight hundred to seventeen hundred square feet townhouses. The homes include highly insulated walls, double panned windows and ground

source heat pump, efficient lighting and appliances and an energy feedback monitor amongst other things. Most interestingly, the development features a rainwater collection and pumping system, working in tandem with water condensing toilets and efficient shower heads in order to reduce the consumption of water.

Z6 HOUSE

Similar in name, the Z 6 Home is not much different to the Z house, only on a higher level of sustainability. This house, based in California, is all about innovation and convenient sustainable design. In fact, the name itself is based on the philosophy of achieving zero level across key areas: waste, energy, carbon emissions, water and ignorance. Essentially, the Z6 Home is a combination of every sustainable method of construction, and the result is not only zero waste home, but a stylish looking CROSSWAY HOUSE

one too. The building makes heavy use of solar power and is responsible for around seventy percent of its energy use. Though other luxuries such as solar powered water is used for heaters and heated floorboards, the Z6 home makes the best use of the available natural resources. This next dwelling, brings us a little closer to home. This unique home in the English countryside of Staplehurst, Kent has taken a page from architecture history and mixed it with state-of-the-art design to create a one-of-a-kind

house. Designed by Architect Richard Hawke, the home’s arched roof is a timbrel vault, an arch that follows a parabola rather than circle. The result is that the roof requires no added support and reduces material use. Contrasting with the 14th century roof technology is a host of high tech materials and equipment that helped the Crossway House become the first certified Passive House in England. The home’s 20-meter roof span was built using timbrel vault construction, a classical building technique that has been largely forgotten since the onset of modern high-strength materials. The roof features a layer of 26,000 locally handmade clay tiles mortared together to make a supporting web. A green roof was applied on top to help regulate the home’s interior temperature, and the home’s rounded shape reduces exterior surface area which in turn saves energy. And last but not least, we have our Dome Space, the future of

Please mention Oracle Magazine when responding to adverts

sustainable living. The house can rotate away from the sun in the summer to cool down and towards the sun in the winters to keep things cosy. Optional integrated solar panels to store energy are available as well as several possible ecological options for better energy efficiency. Integrated within the design are anti-cyclonic properties; it’s aerodynamic form has proven that the house resists without any damage to winds of up to twenty miles an hour. In addition to that the seismic rays that would make a ten story building collapse turns around the ring gear of fixation without finding any perpendicularity. Resistance to seismic rays of upto under 8 on the Richter scale. Every Domespace is erected over an electromagnetic belts that work as a ‘silencer block’, like a piece of rubber that cushions all vibrations. Arches are solidly anchored to a steel ring gear itself fixed to a pedestal made of reinforced concrete. May 2015 37

YOUR MORTGAGE & PROTECTION SPECIALISTS With 35 years of financial planning experience behind her, together with numerous awards, then it is perhaps not surprising that Tricia Kennedy’s company, Mortgages4Plymouth, is the number one choice for people looking to buy a home. Tricia is part of a five strong team based on Peverell Park Road, Plymouth. Part of her success has been in the company’s attention to the personal touch that sees her happily taking calls from clients in the evenings. Plus, if the client prefers to meet outside of office hours, then Tricia is happy to arrange an appointment for them in the evening. “I think it is fairly unique for someone in our line of work to be available on the mobile, seven days a week, until nine in the evening,” says Tricia. And, with Plymouth’s close links to the Royal Navy, then Tricia believes that offering this type of flexible approach to working hours is important for military families. “The military do a great job and we understand the difficulties that military personnel may have to get in touch with a broker as their working hours may mean that they are only available to talk at weekends and evenings.” “We are proud to be part of the ‘Forces’ Help to Buy’ scheme and also to be able to provide military personnel with flexible meeting hours as I feel we should give them as much help and support as we can. It is an honour to help people in the armed forces,” says Tricia. And it is not just helping military personnel that have helped to earn Tricia and her team national recognition. Since Mortgages4Plymouth was launched in 2000 then the company has seen hundreds of people write thank you letters and cards. The business has a wide portfolio of services that it can provide for clients – with help and advice available for mortgages and insurance, including cover for death, critical illness and income protection schemes.

When it comes down to mortgages then the team has an excellent reputation for being able to cut through the jargon involved to be able to simplify some of the terms used – it is a skill honed during Tricia’s original training as a teacher. There is even a “jargon busting” guide on its website! Tricia says it is a good time to look at mortgages as rates are very low at the moment and house prices are set to carrying on rising as the demand for housing continues to grow. And of course, you may also want to consider a Buy To Let mortgage as an alternative to paying into a pension, or to top up retirement funds. Having spent 25 years advising on pensions and seeing the returns, a buy to let is a fantastic investment, with both property growth and rental income which continues to grow. “I sold pensions for 20 years so know what pensions provide and I feel that a ‘Buy to Let’ portfolio is valuable as rental income grows and so lenders feel confident in that market – which means that rates go down.” It is perhaps not surprising that given the team’s combined experience of around 80 years in the industry then they are naturally respected nationwide - and even top financial experts seek their advice. And their service doesn’t just stop with ensuring you’re satisfied. When you do business with Mortgages4Plymouth then the company is happy to provide a free Will service which Tricia says can save massive pitfalls for the 70% of people who haven’t planned ahead in event of their death. Mortgages4Plymouth are also happy to

Please mention Oracle Magazine when responding to adverts

help people who may have only recently gone self employed as the team can match mortgages for clients with just one year’s worth of accounts – so helping you onto the property ladder faster. The friendly and experienced team is happy to provide a no obligation, face to face initial appointment, to help you move further on the property ladder or to discuss the government backed “Help to Buy” scheme for new homes. And, of course, no office would be complete without the office dog. The sixth member of the team is Miss Ellie, a two and a half year old French bulldog. Not only is Miss Ellie an intrinsic part of the Mortgages4Plymouth family but everyone always find her charm irresistible and she certainly lives up to the French bulldog’s reputation of being known for their comical talent! “She is our meet and greeter who often takes on the role of office childminder and is always very entertaining for us all,” says Tricia.

Q

& A: International and EU Law and Children.

By Alexandra Boardman Alexandra Boardman is a Chartered Legal Executive with The Family Law Company. Alexandra primarily deals with domestic abuse related proceedings including injunctions, occupation orders, transfers of tenancy and child contact. She also handles children cases with an international element. Q: I am married to an EU National. Our marriage has recently broken down and I have moved out of the house. What advice can you give me about spending time with my children? A: If you are still on good terms after separating then it is always preferable to reach an amicable agreement about how much time your children will spend with you both. If it is proving difficult to resolve the arrangements, we recommend that you seek the assistance of a trained Mediator who may be able to help you reach an agreement. Alternatively, you can seek independent legal advice. Legal advice alongside mediation may be appropriate, especially in complex circumstances such as where there are elements of European or International Law. Q: Is it important to formalise arrangements? A: If an agreement has already been reached on the amount of time your child will spend with each parent, we recommend this is put in writing and signed by both parents. Then, if there is any future disagreement about the arrangements, you can rely upon this document to evidence the agreement. A formal agreement can be drawn up either by a Mediator or through a family lawyer if you prefer.

jurisdiction, whether the child will remain here or whether it is intended that the child will travel with the EU National. Q: I am not from an EU member country, does this make a difference? A: If neither parent is British or has the right to live in the UK but has travelled here for work, for example, and the other parent has accompanied them on a Spousal Visa, this will be a more complex situation to advise on. Issues include whether the non-EU partner’s home country is a Member, Non-Member Contracting State or not a signatory to the Hague Convention. If your ex-partner is refusing to allow you access to your children, you will need to take legal advice. In this instance it will be very important to establish what the other parent’s plans are in the short, medium and long term in relation to the care of the child - if you are concerned that the child may be taken abroad without your consent, we recommend that you seek legal advice urgently. Q: Should I apply to the court for an

Q: What happens if my spouse decides to return to their home country? A: The advice we give in this instance depends on the circumstances surrounding your spouse’s desire to return to their home country. Issues include where the child was born, how long the child has lived in our

order? A: The court only needs to become involved in the arrangements for a child if the parents cannot agree what is in the child’s best interests, or there are other significant issues. If one parent intends to leave the jurisdiction with the child, it may be an opportune time

for either parent to ask the court to consider what is in the child’s best interests, especially where parents disagree which country the child should reside in. Such an order can be enforced if the other parent does not comply with the provisions for the child to spend time with the non-resident parent. An application would also be appropriate if there is a risk that one parent will, without the consent of the other, remove the child from this jurisdiction potentially preventing any future contact between the child and the other parent. Q: What if I decide to return to my home country (A non EU member state)? A: If one parent decides to leave this jurisdiction with or without the child, that parent will benefit from either a written agreement or preferably a court order setting out the parameters for the time the child will spend with each parent. The parents can rely upon that agreement or order in the future if there is difficultly implementing the parameters.
