stablished over 180 years ago by Torquay entrepreneur William Kitson, Kitsons has merged and evolved from a set of core values and in the last 15 years branched out from Torquay to open modern offices in both Plymouth and Exeter.
In 2011, Family Law partner Tony Hunt joined the Plymouth office. Tony has specialised in divorce, private law Children Act proceedings, ancillary relief applications and cohabite disputes for over 25 years. All Roads Lead To Dartmoor Within minutes the skies morph from bleak and windswept, foggy and damp to bright and crisp. Dartmoor National Park is one of the largest and wildest areas of open county in the South of England. With it’s ancient woodlands, high granite tors and vast tracks of rolling woodland, Dartmoor offers so much to do and see over its vast landscape. It is the perfect place to enjoy wild open spaces, dramatic tors and wooded valleys, rushing rivers and wildlife. These are some of the best places to spend your time in this last month of summer.

Bovey Castle:
This two hour round trip takes you past a dramatic castle and through an oak lined gorge to an ancient stone bridge and traditional pubs. The hike along the river Teign starts at Castle Drogo, a fortress completed in 1930, from here the routes to Fingle Gorge are clearly signed. Walk one way along Hunter’s Path, which traces down the spectacular wooded riverbank, where the kingfishers and woodpeckers dart between shaded pools, and trout, and salmon and otters flourish in the clear water.
What Bovey Castle lacks in heritage - it is actually not a castle at all - it makes up for it in its breadth of facilities and superb views. Set on a private sporting estate, it has an eighteen hole championship golf course, indoor swimming pool, tennis courts, fly fishing lake, croquet lawn, children’s play ground and an archery arena. Huge stone fireplaces ornate panelling and squishy sofas make it one of the most comfortable places in Dartmoor.
Hound Tor:
The Meldon Viaduct was built in 1847 and spans 165 meters over the remains of mineral mines. The views from the viaduct span across to Meldon Dam and reservoir to the South West. The views of this dam almost 50 meters high are as impressive as the original engineering feat. Down the valley is Meldon Pool - the old limestone mine that still has two lime kilns.
The jumble of boulders that make up Hound tor provide one of the most easily accessible and expansive viewpoints in Dartmoor. Supposedly the inspiration for Connon Doyle’s moorland classic, the Hound of Baskervilles, the tor is a gentle half mile walk from it’s carpark along grassy paths and dells. At the top, you can see the rough peaks of several other tors, as well as Wildcombe in the Moor and Bowman’s Nose.
Dartmoor Prison: Once a byword for the most violent crimes, Dartmoor - now Category C - has a museum for the macabre minded, featuring makeshift weapons and confiscated escape gear. Most shocking is a razor mounted on the tip of a toothbrush and vicious knuckle dusters made of 6 inch nails. Most amusing is perhaps the time honoured classic of knotted bed sheets, once used in an escape attempt. 10
Meldon Viaduct:
Lydford Gorge: The combination of unique geology, water and climate change has fashioned the deepest river gorge in the South West, providing a truly breathtaking experience which has been enjoyed since Victorian times. You can explore the gorge with a choice of adventurous walks from one to three miles. With strenuous walking, rugged terrain and vertical drops at Lydford Gorge, this adventure is not for the faint-hearted.

Domestic abuse - the facts?
Alexandra Boardman, a Chartered Legal Executive with The Family Law Company in Plymouth, explores the truth about domestic abuse. What is domestic abuse? Domestic Abuse is defined as: any incident or pattern of incidents of controlling, coercive, threatening behaviour, violence or abuse between those aged 16 or over who are, or have been, intimate partners or family members regardless of gender or sexuality. The abuse can encompass, but is not limited to: • • • • •
psychological physical sexual financial emotional
This seems really vague – why isn’t it just violence? I answer questions like this every day when considering whether someone is being subjected to abusive behaviour. There seems to be an acceptance that violence within a relationship may be domestic abuse, whereas shouting, intimidation, put downs, swearing and threatening behaviour, are not, because they don’t amount to actual physical harm. The definition is wide because often there is not one particular behaviour that causes the harm, but a range of behaviours together that leads to a person feeling frightened. When I was growing up there was no such thing as ‘domestic abuse’. Why is it so important now? Research shows that children exposed to abusive behaviours are significantly affected by what they see and hear, and that where children are caught in the middle of disputes between adults, this can have a detrimental impact on their ability to thrive and achieve. We all learn from the environment in which we live, the way people treat us, what they say to us and how they talk about others. This all affects our perception of the world we live in. It is no different for children. If we provide them with an environment of love, security, fun and boundaries, they will grow up understanding the importance of all of these things. If they grow up in a household of arguments, upset, violence, fear and negativity, they are unlikely to reach their best potential. If domestic abuse is so bad, should the abusive person be excluded from their children’s lives? When deciding what is in a child’s best interest the court considers the needs of the child as paramount. Each 18
family’s circumstances are different and a child may not continue to be at risk of ongoing domestic abuse once the parents have separated. The courts look at various options. Parents may be asked to attend courses such as the ‘Freedom Programme’ for victims of domestic abuse or ‘Building Better Relationships’ for parents who are perceived to have been abusive within their relationship. Both parents may be required to attend a ‘Separated Parents Information Programme’, which helps them understand from a child’s point of view what it is like to be in the middle of disagreements between parents. Other parents may need support through a Children’s Centre, parenting course or one to one therapy with a specialist organisation. How does the court process help parents? The court process gives parents the ability to seek an order they can rely upon and is often the starting point for future arrangements. Often after a relationship has broken down, one parent feels unable to trust the other, especially where the separation has not been amicable. The court hopes that through the process the parents will be able to reach an agreement between themselves for their children. If this is not possible then the court will impose an order. Through this process, the court will also be able to consider the allegations of domestic abuse and consider whether any further investigations or a court determination of the allegations is necessary prior to any final decision or agreement being reached. Is domestic abuse something that happens just between couples? Domestic abuse can take place within the family or wider family dynamic – for example grandchildren towards grandparents and children towards their parents as well as the other way around. The victim must be 16 years or over to make an application to the court in their own right, otherwise, the parent or guardian of the victim needs to make the application. The court can provide protection through various orders including Children Act proceedings or standalone applications, for example for a Non-Molestation order. The type of order necessary will depend on the behaviour being complained about, who the victim is and why they are seeking the protection. Carrot & cream cheese cupcakes Ingriedients
175g light muscovado sugar, 100g wholemeal self-raising flour. 100g self-raising flour, 1 tsp bicarbonate of soda 2 tsp mixed spice, zest 1 orange 2 eggs, 150ml sunflower oil 200g carrots, grated orange coloured sprinkles, to decorate 100g butter, softened 300g soft cheese 100g icing sugar, sifted 1 tsp vanilla extract
Method
1. Heat oven to 180C/160C fan/gas 4 and line a 12-hole
muffin tin with cases. In a large mixing bowl, mix the sugar, flours, bicarbonate of soda, mixed spice and orange zest. Whisk together the eggs and oil, then stir into the dry ingredients with the grated carrot. Divide the mixture between cases and bake for 20-22 mins until a skewer poked in comes out clean. Cool on a wire rack before icing.
2. For the icing, beat the butter until really soft, then beat
in the soft cheese, icing sugar and vanilla. Use a palette or cutlery knife to swirl the icing on top of the cakes, then sprinkle with decorations.

efurnish takes great pride in the work that they do. Their principle aims are to help people on low incomes by providing low cost reusable furniture at discounted prices and reducing the waste in your local community.
What is Refurnish? Refurnish is a Devon charity that collects unwanted furniture, electrical goods and other household items that are in a good, reusable condition and sells them to onto those that appreciate the environmental benefits of reusing household goods that may otherwise go to waste, or simply want to buy at affordable prices. We offer special discounts to pensioners and people who are in receipt of means tested benefits, but you don’t have to be on benefits to buy from our shops - our shops are open to all. All electrical items are functioning and safety tested. We currently only carry out minor repairs of furniture, although we hope to do more in the future. In addition to reducing waste and helping to alleviate poverty by providing low cost goods to people on low incomes, we provide volunteering, training and employment for people who may be unemployed or retired and may have a variety of support needs.

Donating to Refurnish We rely on the sale of donated stock to provide goods that we can sell at low prices, especially to those on low incomes. Donated items should be in clean and serviceable condition. The guiding question to ask yourself is “Would I want to buy this in a second-hand shop?”. At Refurnish we have many shops within the Devon area, including our new Wrangaton branch that has nearly 8,000 square feet of space containing a wide range of household goods. A
s a single parent and in the middle of a recession, Jeanette knew that by setting up a company she was taking a massive gamble. However, Jeanette strongly felt that there was a real need for advocacy services in the South West, as she was aware that there were very few advocates that specialised in later life care issues around to meet that need. As a non-practising solicitor with a background in private client work, she specialises in care of the elderly and vulnerable, assisting clients not only in the South West but around England and Wales with requests, reviews and appeals relating to NHS Continuing Healthcare Funding and Local Authority Social Care Needs Assessments. After a heart breaking personal family experience in the early 1990s, her mission was to make sure that no other family went through the same experience. The main aim of FirstCare is to promote independence in order to prevent and/or delay older or vulnerable people going into a care home, as most people want to remain in their own home in their twilight years. Following the Care Act 2014 coming into force on 1 April 2015, there now exists a legal obligation on Local Authorities to assess service users even if they will be funding their care themselves as they have assets over £23,250. Further, Local Authorities now have a duty to assess the carer’s needs too. Due to budgetary constraints however, Jeanette has noted that these assessments are not being undertaken or do not reflect the person’s care needs. The Local Authority, when carrying out its social care assessments, should refer anyone who has health care needs to the NHS so that they can be assessed to ascertain if they are eligible for NHS Continuing Healthcare funding. This funding is different to social care funding as it is not means tested and free at the point of delivery. As a consequence of people not being aware that they may be eligible for NHS Continuing Healthcare funding, it has been estimated that there are a substantial number of people in England and Wales who are unecessarily paying for care fees, currently residing in both residential and nursing care homes. Care fees can cost from £26,000.00 to £50,000.00 per year and more in some cases where care needs are particularly complex. If they had been fully assessed, they may have been eligible for NHS Continuing Healthcare funding. Jeanette carries out these assessments in terms of not just the funding, but also looking into what else the client may need to ensure their care is correct and appropriate, focussing on person-centred care and a person’s rights as a human being. There are cases in which the NHS will follow an improper discharge procedure when someone is deemed by the
hospital to be ‘bed blocking’. If the patient is sent out too early without a sufficient care package, there is a risk that they may be re-admitted, costing the NHS more money in the long run. Jeanette also attends hospital discharges to ensure that the process is open and transparent. If the person requires ongoing care after discharge, an NHS Continuing Healthcare assessment is carried out prior to discharge so that funding for the appropriate package of care is put in place, ready for when they are discharged. “Putting your care first” The FirstCare team consists of 3 people, including an office and case manager and a benefits adviser, plus consultants that are used depending on their expertise. Jeanette also works with many Independent Financial Advisors and Solicitors as well as taking on direct referrals from clients. Jeanette is also a member of Solicitors for the Elderly and shares their strong ethos which aims to provide expert advice to older people on all aspects of law relating to them, be it Lasting Powers of Attorney, Court of Protection issues, mental capacity, as well as NHS Continuing Healthcare and Local Authority funding issues. With 14 year’s experience advising on elderly care issues, Jeanette is a highly respected Advocate, not only in the South West but across the country. Over the past months she has been busy speaking at seminars around the South West with an independent and privately owned financial services group. In October she will be speaking again at The Law Society on The Care Act and NHS Continuing Healthcare funding.
