Purpose
Who Does It Affect?
Reduce Emissions of High Global Warming Potential (GWP) Refrigerants Refrigerant Handlers: Any person who recycles, recovers, reclaims, disposes or sells high Global Warming Potential refrigerant Owners / Operators: Anybody who installs, repairs, maintains, services, relocates or disposes A/C systems
Registration Requirement All Refrigeration systems with a Full Charge Greater Than or Equal to 2,000 Pounds.
• Must Register with Executive Officer March 1st, 2012 All Refrigeration systems with Full Charge 200 – 2,000 Pounds
• Must Register with Executive Officer March 1st, 2014 Registration Requirements
All Refrigeration systems with Full Charge 50 - 200 Pounds
• Must Register with Executive Officer March 1st, 2016
Registration Information (Includes Change of Ownership)
• Name of Operator, Operator Federal Tax ID Number, NAICS Business Type Code, SIC Code, •
Details of Facility, & Facility Contact Information Refrigeration System Info for each unit: ID Number, Equipment Type, Manufacturer, Model/Yr, Description, Serial Num, Physical location, Temp. Classification, Charge, type of refrigerant used
• Initial Implementation Fee Upon Registration (systems 200 lbs or more of GWP)
Implementation Fees (some exemptions apply)
Leak Detection & Monitoring Requirements As of Jan. 1, 2011 (Charge > 2,000 lbs)
• Annual Implementation Fee (systems 200 lbs or Greater of GWP) *Amounts based on refrigeration system with largest full charge operating at facility, for fee criteria look up “Section 95384: Summary of Requirements to Pay Implementation Fees.” If System is enclosed within Building or Structure (includes components such as compressor, evaporator, & condenser). • Monthly Leak Inspection • Install an Automatic Leak Detection System If System does not operate within enclosed building/structure • Quarterly Leak Inspection (every 3-monthes) • Install an Automatic Leak Detection System Calibration and Maintenance If System is 200 – 2,000 pounds, Quarterly Leak Inspection Copyright © 2012, Polar Technology www.refrigerantauthority.com
If System is 20 – 200 pounds, Annual Leak Inspection *Inspection Always Required when Additional Refrigerant is Added *Leak needs to be repaired by Cert. Tech within 14 days after being discovered *If leak is Unsuccessfully Repairable or system is Retired, operator/owner must prepare ‘Retrofit or Retirement Plan as provided in section 95386(g).”
Handler Certification Requirements
No person shall install, service, repair, modify, or dispose of any A/C system that may cause release of high GWP refrigerants, unless they have EPA tech certification and they recover, recycle, or reclaim the refrigerant using certified recovery/recycling equipment & processes approved by U.S. EPA. No person shall sell, distribute, offer for sale any high GWP refrigerants unless: • Buyer is a certified tech or Buyer is authorized rep of a certified tech
• Refrigerant is sold only for eventual resale to certified tech or A/C manufacturers
Facility Stationary Refrigeration Report (Annual Report) Each Report must provide information for previous calendar year (Charge > 200 lbs) • General: System ID #’s, Equipment Type, Manufacturer, Model/Description/Yr, Serial Number, Physical Location, Temp. Classification, Full Charge, Refrigerant type, Initial installation date
Reporting Requirements (Charge > 200 lbs)
• Leak Report: Date Detected, Service Date/Repair Date, Cause of Leak, Description of repair, dates of initial tests, follow up dates, total additional refrigerant charge, purpose of additional charge, name of Cert. Tech (ID, certification).
• Refrigerant Purchase & Use: Total weight (lbs) of each GWP purchased in calendar year, Amounts charged into each system in calendar year, weight in lbs of stored refrigerant by calendar year, total weight of shipped refrigerant by owner/operator for reclamation and destruction during calendar year.
Owner/Operator required to maintain the following records for each A/C System
Recordkeeping Requirements (Charge > 50 lbs) Maintain Records for a min of 5 yrs
• Registration information require by section 95383 • Documentation of all leak systems, annual audits and calibrations required by 95385 • Retrofit or Retirement Plans required by section 95387 • All Reports required by 95388 • Application for exemptions, if applicable • Invoices for all refrigerant purchases • Records of all shipments of refrigerants for reclamation/destruction (with contacts, refrigerant types, weights and shipping details)
• Records of all refrigeration systems component data, measurements, calculations, and assumptions used to determine the full charge.
Recordkeeping

amount of a high-GWP refrigerant. (Includes: Reclamation or Destruction) Annual Report for previous calendar year. (Statewide Annual Aggregate Data)
Include: Name, Address, Contact of refrigerant distributor or wholesaler.
• Total Statewide Annual Aggregate weight in lbs. Requirements For Refrigerant Distributors, Wholesalers & Reclaimers
of each type of refrigerant purchased or received for the purpose of resale or delivery (for any purpose other than reclamation or destruction)
• Total Statewide Annual Aggregate weight in lbs of each type of refrigerant sold or distributed, excluding all sales to a facility outside of California or to a refrigerant distributor or wholesaler for resale.
• Total Statewide Annual Aggregate weight in pounds of refrigerant that was shipped to certified reclaimer
• Name/Address/Contact of all refrigerant distributor wholesaler facilities under the operational control of the distributor/wholesaler
Recordkeeping Requirements for Refrigerant Distributor, Wholesalers, & Reclaimers Maintain Records for a min of 5 yrs
A Refrigerant Distributor or Wholesaler
• Annual Report Submitted pursuant to section 95392 • Invoices of all GWP refrigerants received through sale or transfer and all GWP refrigerants distributed through sale and transfer. (Indicating: name of purchaser, date of sale, quantity, and the type of refrigerant purchased, sold or transferred.)
• Distributor or wholesaler selling GWP refrigerant to purchaser that is an employer of a certified tech (must have written document as proof of relationship)
