Legal noise Adequate competition depends on innovation, productivity and welfare. This is what the Chair of the Australian Competition & Consumer Commission (ACCC), Rod Sims, recently spoke about at a Competition Law and Economics Workshop hosted by his organisation and the University of South Australia. He reckons there are challenges in competition law and policy that must be confronted and solved if the market economy is to work for all Australians. Sims points to three main competition issues: merger law reform; the need to prove the future in competition cases; and the role of new regulation for digital platforms. He said merger control is critical to protecting and promoting competition and should be consistent with international best practice if the nation is serious about protecting competition. The ‘substantial lessening of competition’ test in merger cases, according to Sims, typically requires the ACCC to prove what is likely to happen in the future (think Minority Report and pre-crime), rather than consider overall interference to the competitive process caused by a key player by its closest competitor or by other anti-competitive behaviour. The problem, Sims, explained, is this test is being confined to what is currently known and provable about future developments. To complicate matters, the ACCC is considering the need for sector-specific
regulation to address competition and consumer concerns in digital platform markets as part of a five year digital platform services inquiry. At the time of writing, the ACCC is investigating potential competition issues arising from Qube’s completed acquisition of the Newcastle Agri Terminal. In September, the ACCC said it was not provided sufficient time or information to assess the competitive impact of the transaction. The potential concerns, raised by market participants, are based on the vertically integrated position that Qube will hold in the supply chain for bulk grain export through the Port of Newcastle and incentive for Qube to discriminate against rivals. Sims said it was worrying that a major vertically integrated player (Qube) paid $90 million for key infrastructure used for export of agricultural products without first obtaining ACCC’s view on whether the proposed acquisition would likely to have the effect of substantially lessening competition. What is the consequence of this action? The key parties, in this instance, Qube and the former owners of the Newcastle Agri Terminal, are exposed to potential legal action by the ACCC.

Robert Smedley says, “This is one of the single biggest things the government and industry can do to reduce carbon emissions in a long-haul country like Australia, and it could be done right now.” Earlier this year, Truck Industry Council (TIC) and the Australian Road Research Board (ARRB) engaged in pavement wear testing on new ultra-wide tyres (super singles). TIC stated that test results would provide the scientific evidence required to develop a case for increasing mass limits for heavy trucks and trailer axles fitted with wide-base single tyres. Robert Smedley worked closely with Chris Loose in getting the funding proposal to happen, as part of this, Smedley’s provided data to support the safety benefits that were used in the submission for the funding.
