Welcome to the Hawke’s Bay Property Guide

As we roll into Autumn, the median sales price in Hawke’s Bay continues to perform well and is showing no sign of slowing down. The reported median sale price is now $704,000 which has jumped 36.4% over the last year, and although it is important to realise that the median is across all price ranges and can be skewed somewhat depending on the volume of sales in any particular price range, the market certainly has had a significant increase across the board and this is driven by the substantial demand for residential property.

There are multiple factors still contributing to buyer demand, be that low interest rates, low returns on term deposits in the banks, or lack of supply to actually purchase. There is no doubt that prices are moving quickly and at the current level of houses selling and the number available for sale, just the demand continues to outstrip supply. Add our amazing weather and relaxed lifestyle and there is no doubt Hawke’s Bay is appealing to a wider audience.

The market will slow down from time to time but while there is such a demand, in my opinion it is unlikely that prices will go backwards any time soon. We are seeing a lot of people taking advantage of the market to trade up to something newer, larger or just more attractive to them. Rural market commentary

As we head into Autumn 2021, our rural and lifestyle market continues to see year-on-year gains. In Hawke’s Bay, the lifestyle market alone equals $320m in value from 385 sales over the 12 months leading to January 2021, of which 25% is more aligned to the residential market being less than one hectare in size. The rural market (20ha+), excluding horticulture, operates on much thinner volumes generating $153m in value from 63 sales. Typically, monthly rural sales range from 6-12 sales a month. A pronounced wealth effect in town now plays into what people are prepared to pay for lifestyle holdings and more space. Our view is that this wealth effect will fuel interest in small

rural holdings for those wanting more land. These smaller farms under 40ha have not seen the same level of lift being further out from town. Comparatively, these smaller farms offer good value where the focus is on true country life, a good local school, and you still get to keep your job in town too, for those who have an ambition of farm ownership. Amendments to the Residential Tenancies Act

In February this year significant changes across the Residential Tenancies Act came into law. Since the initial inception of the Act in 1986, the bulk of the amendments coming out in February will bring about the largest change the industry has seen in over thirty years. There is confusion across the industry that stems from the fact that as we transition from the original law to the new version, depending on the circumstance both the old and new rules still apply.

2. If a periodic tenancy commenced before the 11th of February 2021, what notice period does a tenant need to provide to end the tenancy? The new rules apply for tenants, and the notice period required is 28 days.

For example; If a tenant is on a fixed term tenancy that started before the 11th of February, the old rules apply. Therefore, as an example, if the owner did not want to renew the fixed term tenancy, they don’t have to and the tenant will need to vacate the property.

3. If a fixed-term tenancy commenced before the 11th of February, do the old or new rules apply when it comes to the renewal of the fixed term? As the tenancy commenced before the 11th of February 2021, the old rules apply. The owner is not required to renew the tenancy.

Here is a brief overview of some of the common questions we have received. Fir further information, talk to your local Property Brokers property manager in Hawkes Bay. 1. If an owner issues 63-days’ notice, as they wish to move into the property, how long do they need to stay in the property? Owners that provide 63 days notice to move back into their property need to remain in the property for no less than 90 days.

4. If an owner wants to list a property and there is a fixed-term or periodic tenancy in place that commenced before the 11th of February, do the new or old rules apply? In this instance, the owner can list the property on the market at any time. They do not need to wait until the tenant vacates the property.

5. If a property is sold with a fixed term tenancy in place, and the purchaser wants vacant possession when do we need to provide 90 days notice? You need to advise the tenant at least 90 days before the vacate date for the fixed term. The clock starts ticking as soon as the notice is severed. (If you serve the notice 80 days before the end of the fixed term, then it will end 10 days after the end date). 6. If an owner wants to grant an extension to a fixed-term tenancy that commenced before the 11th of February, will the old or new rules apply, when the extension of the fixed-term ends? It is a renewal, and therefore, the new rules will apply. (The tenants can choose to remain in the property at the end of the fixed-term tenancy.) 7. Can a Trust or a Company be considered as a landlord and serve notice to a tenant? A trust is considered to be an owner and can provide 63 days notice but not a company.


8. If a tenancy is assigned after the 1st of July 2021, does the property need to meet the HHS and is this considered to be a new tenancy? This is considered to be a variation, and it would not trigger the requirement for the owner to meet HHS within 90 days of the assignment. 9. If a fixed-term tenancy that commenced before the 11th of February defaults to a periodic tenancy after the 1st of July 2021, is the owner required to meet the HHS within 90days of the change in tenancy type? This is a variation to the agreement, and the owner would not be required to complete any HHS requirements as it is a ‘variation of the tenancy.’

10. If an owner issues 90 days notice and lists the property for sale after the tenant vacates and the property does not sell, can they (A) relist the property for rent and (B) is there a timeframe that they must wait for before rerenting the property? If the property was listed for sale through a Real Estate Agency and was not sold, no matter the method of sale; the property could be relisted for rent. When a property is listed for sale; most owners have a contractual obligation for a finite period with the agency. Once this has lapsed, then the owner can decide on the best way forward, which may include re-renting the property.

11. If an owner wants to sell the property empty, and issues a 90-day notice to the tenant; can the property be listed during the 90-day period? The property cannot be listed on the market until after the 90-day period ends, or until the tenant vacates – which could be earlier.
