Do you really need Title Insurance? What to know before you say “no”

You have a new home. One day you come home to find a legal notice that someone is claiming rights to your property. Your property had a proper title search and was sold free and clear of all encumbrances… How can this happen?! Extremely upset (understatement of the year!), you pick up your phone calling the attorney that handled your closing. His first reaction will be “I am glad I encouraged you to buy the Fee Title Insurance Policy!”   What are we talking about? Welcome to the world of title insurance. Poorly understood, even seasoned Realtors are willing to admit they are shaky on what title insurance does and why you as a buyer might need it. This form of insurance is not well understood except by those that deal directly with it; that being attorneys, title examiners and others that deal with the behind-the-scenes workings on getting a property to close. This is a topic Realtors will refer (with relish) to attorneys, when asked about it.   What is title insurance exactly? Title insurance is insurance that protects the owner and the mortgage holder (if there is one) against defects in title to that property. There are generally two types of policies which buyers should know; owner’s (fee - a legal term dating back to medieval times) and lender’s (mortgagee - aka the bank) title insurance. Lenders require a title insurance policy be purchased at the time of closing to protect their interest in the property, covering only the outstanding loan amount. Many home buyers mistakenly assume this insurance protects them too, when it actually does not! If a claim on the property is made and won, the bank is paid through their policy, but the buyer loses all equity and monies already invested into the property.   During the home buying process, it is mandated by law that the buyer be offered the opportunity to buy an owner’s (fee) title insurance policy only if they are obligated to buy the mortgage title insurance. Buyers in this position are supposed to be made aware what these insurances are and what they cover

during the buying process and at least once will be expected to sign a document attesting to the fact they were informed. Additionally if a buyer buys both the fee and mortgagee insurance at the same time, they will get a discount on the mortgagee insurance! Not all attorneys recommend that buyers purchase Fee Policies and as a result they only quickly cover the details as required by law, leading the buyer to think it is not necessary to buy a policy to protect themselves. In fact, when I was a fledgling real estate sales person, I remember this topic being covered in a class. We were told that in most cases, this is an unnecessary fee for the buyer. But, as I matured into the profession, I see now that I would never buy a property without this insurance because of the low cost and high potential value.  Title insurance is unique in that it protects against past events, not future events like your home owners insurance policy does. For example, you take out homeowners insurance to cover possibilities such as (future) fire destroying your home and with it, your investment. Title insurance covers what may have already happened, but that you and others involved with your closing may not be aware of. There is a large gamut of possibilities that could affect your ownership in the property you bought. There may have been a failure to notify all creditors in a prior foreclosure action, gaps in chain of title, forged deeds, wills that were not probated, mortgages that were not discharged and many other legalities which can and ® do fill legal books! James A. Marino, Esq., a

Rochester real estate attorney, also noted “in this day and age of identity theft and internet fraud, the claim being made on the property may not even be valid, but a title insurance policy will cover the attorney fees and legal costs of defending such claims.” Further, he stated that “In a large number of cases, it’s the attorney fees and costs that are financially and emotionally destructive rather than the claim itself.”   Consider the following example of how valuable title insurance can be. Let’s say an uncle gives a quit-claim deed to his home to a nephew, and the deed is never recorded. Subsequently, the uncle dies without a will and the nephew is not aware of his death. Probate is initiated and the property is disbursed to the presumed hairs. The home is given to the heirs since there was no knowledge of the deed to the nephew. The heirs sell the home and eventually the nephew finds out. He actually has claim to the property that will need to be settled in court.  Now is when title insurance comes into play. Let’s say the buyer bought the property with a mortgage and the mortgage company required title insurance, so a mortgagee policy was bought. (Here is where home buyers normally come into trouble.) The buyers did not know or understand that the mortgagee policy covers only the mortgage holder’s losses. Like most buyers, they assume that this policy protects them, but it does NOT. Fortunately the buyers in this story have an attorney that highly recommends they purchase what is known as a Fee Title Insurance Policy. Besides recommending the Fee Title Insurance Policy, the attorney also makes the buyers aware that there is a Fair Market Value Rider available. This is purchased at the same time as the “Fee Title Insurance Policy” and covers home value increases over time. (If you do buy the “Fee Title Insurance Policy” I highly recommend you include a Fair Market Value Rider.) While Fee Title Insurance is mandated by some attorneys, especially when 10% or more is put down on the property,

not all attorneys mandate this additional rider. Luckily the buyers in this story buy the additional rider.   So, having lived in this home for ten years, they are stunned to learn that the nephew had a legitimate claim on the property. A court battle ensues, costing thousands in attorney fees, but the buyers are covered due to having bought both forms of title insurance. Unfortunately for them, the court decides that indeed, the nephew did own the home and that it was improperly sold. The nephew, suddenly having a nostalgic bent towards his uncle, decides he absolutely MUST live in the home and the buyers now must leave.   The buyers mortgage company is paid the moneys they were insured for. And because the buyers bought the Fee Title Insurance Policy, they are also covered and paid the money they put down on the property. Since they bought the Fair Market Value Rider too, they are also covered for their equity in the property. Had they not bought the Fee Title Insurance Policy, they would have lost their down payment and closing costs. Having bought the Fair Market Value Rider, the buyers capitalize on the large increase in value over the ten years they lived in the property. Keep in mind that Fair Market Value Riders only cover increases in value due to market increases (inflation), and not improvements to the property, so the cost of any improvements can not be recouped. Overall, the buyers financial damage is kept to a minimum and they are able to recoup quickly.   Perhaps you currently don’t have the Fee Title Insurance Policy or Fair Market Value Rider. It’s not too late. You can get these insurances as long as you are not currently experiencing a challenge to your ownership of title to a property. If you are unsure, contact your attorney and ask them to review your documents. If you find you are not covered, ask if they will sell it to you through their vendor or give you a recommendation on who to contact to set it up. Lastly, you can look online for title insurance companies, there are quite a few ready to work on your behalf. Be aware you have the right to buy your own title insurance prior to closing, and do not have to procure it through the closing attorney. You might be surprised in the difference in price if you do comparative shopping. Remember, to be fore-warned is to be protected, as long as you take action!

How to Get the Home You Want 1. Get Ready

Talk to your mortgage professional about your financial situation and credit history to determine your loan options. It’s important to know how much house you can afford based on your down payment and income. A strong letter of pre-approval can really add to your bargaining power. If you must sell your current home to afford a new one, consider putting it on the market before starting your search. You can often negotiate a better deal on a purchase if your property is under contract or you already have the cash in hand.

2. Shop Smart

Expect to pay more for a showplace; if you consider a fixer-upper, judge structural deficiencies more harshly than cosmetic flaws. It can be costly to replace major components or to change the layout, but redecorating with flooring, fixtures or paint is relatively easy and sometimes offers instant equity potential. Location is key. Even if the site seems perfect for you at the present time, think about whether it will appeal to a large pool of buyers if you should decide to sell in the future.

3. Go For It!

To write a winning offer without overpaying, look at the prices for comparable sales. Consider whether the property is in a high-demand area or if there is plenty of competition. September 22nd is the first day of fall, however you shouldn’t wait until then to start preparing your home for the fall market. If you’re thinking about selling your home, the fall time is the second best time of the year to sell, with the spring market being the first. This time of year is an ideal time to be able to prepare your home for selling and locating a new home before the holiday season begins. Here are a few tips for attracting home buyers in the fall:

Maintain the exterior of your home.

This will include raking the leaves, cleaning out the gutters and trimming the bushes and shrubs. It is important to keep your yard, walkways and gutters free

of leaves and debris. Trim trees to prevent any unexpected wind from knocking down branches, which could potentially damage your home or visitors. Also, be sure you have a good doormat, so visitors can wipe their feet and not traipse mud and water through the house.

Clean the interior of your home.

It is important before showing your home to declutter each room. Clean out the fireplace, dress the windows, check the HVAC and make sure all lights are working properly, this will not only make your home appear larger but it will also be more inviting to potential buyers. Above all, make sure your entryway and the rest of the house is clear of large objects and toys that make your home appear

Prepare your home for showings.

This will include making sure your home is tidy; garbage has been taken out, animals are crated or removed from your home, floors are vacuumed and swept, beds are made, and bathroom is clean. Make sure your home smells good as well, unfortunately many potential buyers are scared away from a home due to foul order. Fall is the perfect time to light pumpkin spice or apple cinnamon candles or bake an apple pie. This will create a warm and cozy atmosphere. Preparing your home to list on the market can seem overwhelming but if you create a list of items that need to be done and follow our tips it can be a seamless process.

Spring is the time of year when everything begins to grow again. After the spring flowers fade away, the green of your yard takes over. There is nothing like a well-landscaped and manicured yard to attract buyers to look closer when considering a property. The care taken with the exterior landscaping is often an indicator to the overall care and condition of a house. A beautifully landscaped yard usually indicates a diligent homeowner with a well-maintained home. Conversely, a sloppy yard often indicates a poorly maintained home. Many owners of older stone, brick and stucco homes love the look of vines and ivy growing up one of the walls or up the chimney of the house.

It reminds them of stately university buildings or churches. Unfortunately, these plants can do lasting harm. Ivy will hold moisture against the house, leading to rot of the wood siding, trim and windows. The ivy will penetrate small cracks in the brick and masonry walls. Freeze-thaw cycles then cause additional damage. Some types of ivy secrete an enzyme that attacks older lime-based mortar used in older structures (pre-1920); causing the mortar to disintegrate. Vines can even work their way between materials and into walls, causing damage to window frames and interior plaster. Also, thick vines and ivy will attract wildlife and pests, including birds, wood boring inspects, and more.

What should be done if a house has a thick growth of ivy or vines? First, cut off the base of the growth and allow the vines to die for several weeks (perhaps over the winter). Then, remove the dead vines as carefully as you can from the building. There might be damage that requires repair. If so, a qualified mason or repair person should perform the work, to match existing materials as much as possible. Next, remove any accessible stumps and roots. If there is remaining residue and tendrils from the ivy, you should paint over them or leave them alone to wear off and fall off over upcoming months or years. Usually, it is best not to power wash or otherwise remove them, since this could cause further damage.

Although vines and ivy might look good on some buildings, the potential harm and damage it can cause is significant. The cosmetic advantage is usually not worth the cost of potentially rebuilding a chimney, pointing a brick wall, or replacing rotted windows.
