Property Taxes a Little Overwhelming? Think you pay too much property tax? How does your assessment compare to neighborhood property values? Call your Realtor ask them to run a CMA (Comparative Market Analysis). If you’re a client, your realtor won’t usually charge, but please offer to pay for their time. If you think your assessment is wrong, seek help. If the property appears over-assessed, you have options but only within prescribed time frames. Do you want to challenge the assessment yourself or hire an expert. (Full disclosure: my partner Rick specializes in property assessment reductions.) It’s time consuming work, requiring hours visiting and photographing properties, finding comparable’s and planning strategies for reductions. Many articles urge home owners to present their own case because assessors and tax boards are irritated by hired professionals. Not so in the Greater Rochester region. Many tax boards include real estate professionals. Unless you are as well versed on property values as they are, you’ll come out on the short end of the stick. People have regularly asked Rick to salvage their situation. They usually have to wait until next year or if he can help, Rick faces a more difficult situation often resulting in smaller reductions than expected, had he been involved initially. Assessors regularly deal with homeowners complaining about their assessment. Many bring incorrect comparable’s. Some behave belligerently or emotionally, doing little to win their case. Understand assessments are based on statistics. Only by using these statistics when challenging assessments, will you achieve maximum results. Not being properly prepared is like going to battle with one hand tied behind your back. Decided to get help? Using attorneys can be expensive. Retainer fees paid up front, or a per hour charge, either can cost as much or
more of the first years savings - if you win. In Rochester, a few Realtors specialize in assessment reductions. Down-state, whole companies specialize in Tax assessment reductions. Look on-line or ask your Realtor, CPA, Appraiser or Attorney for a referral. Rick regularly gets referrals from these professionals, who are aware of his skill in this area. Property tax assessment reduction specialists should have a success rate between 90-95%. Its good when specialists don’t take all cases since they are not just churning fees. Look for a specialist that earns a fee only when they win. Either way, the home owner is not out any money! Most specialists charge 50% of the first years savings. The rest is “free money” for the taxpayer, since without help, they’d be paying higher taxes. Be wary of services demanding money up front. It’s easy to pocket the cash and then shrugging when no reduction results. If you chose to do this on your own, become familiar with MonroeCounty.gov. Under “Real Property” you’ll find town and city assessment dates, equalization rates, tax tables, contact information, and forms and publications to get you started. Filing deadlines vary, depending on location. City of Rochester deadlines are first. Suburban deadlines come later. Understand how your assessment was done. Do you fall into any special categories, say senior citizen exemptions? Call your assessors office asking if their data®base is available to citizens, this allows you to
search for comparables or get an appraisal for your challenge data. Most appraisers understand what you are trying to achieve and will look for comparable’s to help you. Ask them to explain the comparables so you have a firm understanding of your case and can answer the assessor or board of reviewers questions knowledgeably. In New York State, appraisers are prohibited from representing you in the hearing, but can supply the information needed for your case. Check the assessors information. Is it correct? If not, make that part of your challenge. Check if the square footage, lot size, number of baths or bedrooms is correct. Are nonexistent features attributed to your home? Shed, deck or pool long gone? Is the house condition correct? Is your fixer upper labeled pristine condition? Take photographs of anything bringing value down. Expect the assessor to verify your claims in person. Accompany them through making sure they see the problems. Be certain you’re over-accessed, since this process invites the assessor to inspect your home. If you refuse, most will then assess at the highest value possible. If you improved your property, have the permits in place to prevent trouble! Upon receiving the tax bill, can ask for an informal hearing to either talk on the phone or agree to meet with the assessor to review the assessment. If unsuccessful in the meet-

ing, you have the right to present to the board of review. Provide each board member a copy of your data. If you just bought your home, bring your contract, and be prepared to prove the sale was an arms length transaction. Assessments not an arms length transaction do not have to be reduced. Arms length sales are not foreclosure or short sales, estate sales or sales between relatives or institution to institution sales. Be professional and don’t try emotional appeals such as “I lost my job and can’t pay these taxes”. If not satisfied with the review result then appeal to the Small Claims Supreme Court. Here you should bring a professional even though you can represent yourself. They help you with presentation, providing proper materials and tools to prove your argument. Or, get an attorney to represent you and arm them with pertinent information. The time frame for challenging tax assessments: The Informal. (One on one with the assessor) City deadline:: 2/1/17. Towns: end of April at latest Board of Review. City deadline: 3/17/17 Towns 4th Tuesday of May no later. Verify when the paperwork has to be in, don’t miss this date! Small Claims State Supreme Court (SCAR) Owner occupied 1-3 family homes is within 30 days after the Board of Review decision. All property owners should review their assessments each tax season, ensure they are properly assessed. New York State has the highest property taxes of the nation, you can’t afford not to!

Obviously, fogged and drippy windows are not pleasant to look through, but what about when there is only slight fogging? Does this destroy the insulating qualities of the window and necessitate glass replacement? The table below offers a quantitative comparison of six (6) windows that are approximately 30 inches wide by 48 inches tall. The windows are the same except for the type and quality of glass in them. In the chart, the last number under each type of glass gives an estimate for the annual heating cost to make up for the heat loss through the window. Although the table shows that the annual heating cost associated with each window is quite different, one needs to look at specific
comparisons. For example, if taking a window that has a failed seal and replacing the glass with medium quality glass, the annual heating cost goes from $14 per year to approximately $4.42 per year. This is less than a $10 per year savings. What is the cost of performing this glass replacement? Well, the cost can vary from perhaps $100 to more than $200. This makes the simple payback somewhere between 10 and 20 years. If simply taking a window with a failed seal and “repairing” the window to remove the “fog”, the savings is closer to $5 per year for a procedure that costs less, but still presents a relatively long payback of about 15 years. Of course, the payback will vary based on many factors, but this gives at least one way to make a quantitative comparison.

Fogged insulated glass should be repaired or replaced when the fogging destroys the pleasing appearance of the window. However, when the failed seal is barely discernible, it is difficult to justify repairing or replacing the glass from an energy cost savings standpoint. The failed seal is basically a cosmetic deficiency rather than a significant deficiency in terms of the insulating value of the window. When addressing a failed seal, some window companies can basically wash out the window to restore a clear appearance. Other companies will propose replacing the glass unit and maintaining the existing sash and frame. Still others will propose complete replacement of the window. The right decision depends on the severity of the fogging, the
quality of the existing sash and frame, the available budget and the homeowner’s desire for cosmetic improvements. As always, when considering repair or replacement of windows with failed seals, obtain several quotations from qualified contractors before entering into any contract. We hope that this provides you with valuable information about the impact of fogged windows on the heating cost for homes. According to the Asthma and Allergy Foundation of America, about one in every five adults and children suffer from allergies, including allergic asthma. Many health groups have recommended three simple strategies for effectively reducing indoor air pollution.
1. Control the source of the pollution. Remember to clean regularly, including changing sheets and vacuuming often. Wipe down all surfaces with an appropriate cleaning solution and discard clutter as often as possible. Consider replacing old shower curtains, floor mats and anything on which mold is likely to appear. 2. Adequately ventilate your home. Today’s homes are built more energy efficient to hold air inside avoiding heat loss in the winter and heat gain in the summer. Of course, what’s better for your energy bills isn’t necessarily better for indoor air quality. Opening windows may help circulate in the home. But remember to close them dur-
