2013 UAA Economic Conference to be Held September 10th SALT LAKE CITY • OGDEN • PROVO
The 2013 UAA Economic Conference will be held on Tuesday, September 10th, at the Salt Lake Board of Realtors building located at 230 W Towne Ridge Dr. in Sandy from 9 AM to noon. Each year this conference features information on the state of the multifamily/real estate industry. Experts provide current data, projections and market trends to help attendees budget for the coming year and adjust to challenges and opportunities. This year the line-up features local favorite and director of the University of Utah Bureau of Economic and Business research at the U of U, James
UAA Annual Golf Tournament a Success The Utah Apartment Association’s annual Golf Tournament was held this year at Stone Bridge Golf Course. With gorgeous weather, a quiet course, and a delicious luncheon afterwards the day was a great opportunity for networking and building relationships. The 144 golfers took to the greens to meet with our 19 sponsor companies that were at each hole with treats, water, and other fun promotional products. The

presenting sponsor was Utah Disaster Kleenup. Held each July at a different golf course, the Golf Tournament provides a good opportunity to renew and establish relationships between rental industry decision makers and service providers. UAA Launches Annual PAC Fundraising Drive The Utah Apartment Association announces its annual fall PAC (Political Action Committee) fundraising drive, which supports our government affairs efforts and advocacy. This year, our goal is to raise $70,000 between August 15th and December 31. Last year the UAA raised a total of $77,000. By year end our total goal is $85,000. “Our PAC goal is one of our most important objectives each year,” said Steve Randall, 2013 UAA President. “Those funds help us invest in relationships and crafting good public policy,” he said. The money helps fund our lobbyists, allow us to contribute to the campaigns of private property friendly elected officials and candidates and work to correct or improve certain laws. In the 2013 legislature, the UAA achieved one of our biggest victories to date - the time owners are required to hold abandoned property left behind by tenants was reduced from 30 days to 15. This is a significant cost savings for many owners, and will likely lead to units being off the market for shorter period which will lead to higher income for owners. In the next 120 days expect to be asked to contribute what you can to
protect and defend you industry. Many thanks to those of you who are regular contributors. The UAA suggests the following levels: Large Management Company or Attorney - $1,000 Apartment Community or small management company - $500 Individuals or company that own a good number of rental units - $250 Someone with around 10 units - $100 Anyone with one or two units - $50

In addition, Craig will discuss market trends such as concessions, building, operations and more. During the last hour, attendees will receive updates on local and state legislative affairs from several speakers. The featured speaker of the hour will be Fred Tayco, Director of State and Local Government Affairs for the National Apartment Association in Washington DC. Fred will discuss the current trend in Washington of the Obama administration to go around congress and deal with issues through the administrative
agencies. This includes issues with the EPA, OSHA, HUD and other agencies who are implementing new regulations that affect our industry. He will also discuss upcoming tax reform and how that will affect rental housing. At the conclusion of the conference, attendees will receive the key market data and research, condensed in a one page summary to help them set their 2014 budget and address challenges and opportunities. COLORADO Carbon Monoxide detectors required in all rental units and owners are responsible for their maintenance and have liability if they do not work. This bill was passed in 2009 while the UAA helped pass a bill in Utah that instead put the expense and liability on the tenants, not the owner. ARIZONA Most cities charge sales tax on all rents. Not only does this tax push rents lower by making tax a cost of housing, it requires monitoring and collection by all property managers. Many property managers have an
additional full time person to deal with collection and handling of sales taxes on rent. CALIFORNIA Sex offenders are a protected class. In some municipalities there are as many as 7 additional protected classes, creating more potential for lawsuits. In California, it is also not legal to deny tenants because they are sex offenders and are on the sex offense registry. INDIANA Many municipalities charge $100 a unit for an annual inspection. Collecting millions of $ off the backs of property managers. In Utah, the UAA helped pass legislation that prohibits cities from charging fees to inspect rental units. Last year, the UAA helped ban all inspections except complaint based.

Executive Director's Report By L. Paul Smith, Executive Director Utah Apartment Association After 11 years at the UAA, I still get writer’s block each month when I get ready to write the Director’s Message. It’s not because there isn’t a lot to say. It is because prioritizing what is most important for the rental housing to hear isn’t easy. As you will notice, there are a lot of repetitive themes in this message. Things like there is value in membership, the
need to donate to the Political Action Committee (PAC), the great contribution volunteer leaders and members make to making this organizing better, etc. But this month I wanted to just say thank you and express my feeling about what having the opportunity to serve you are Executive Director of the UAA has meant to me. I hope I can continue to earn your ongoing trust, as I plan to stay in this position as long as I can.

Over 11 years ago when I had the opportunity to interview for the position, I immediately sensed the opportunity it would be. I could feel the need for someone with passion and energy to be able to work side by side with the many people who work so hard to give back to others and to their profession though this association. I have been able to rub shoulders with some of the most decent, smartest, and best people I would ever have been able to imagine. My job involves a lot of travel, both in Utah and out of state. In Utah, I average over 30,000 miles a year visiting members, city councils and government leaders, conducting meetings and outreach, and getting to visit properties and landlords all over this great state. Out of Utah I go regularly to Washington DC to meet with members of congress and coordinate with staff from the National Apartment Association. I also attend many training meetings where I learn best practices and management techniques for trade associations, or where I learn specific challenges, opportunities and information about rental housing and the best practices we can teach our members here in Utah, and how we can best operate
UAA. The experiences I have while doing these things are tremendous, and have been a great blessing to me and my family. Lastly, the relationships I have made with volunteers leaders of the UAA and you the members have greatly enriched my life. I can’t tell you how fulfilling it is when great members regularly thank us for what we do for them and tell us what a difference the UAA makes for them. The friendships and personal relationships I have acquired working here are some of the things I treasure most in the world. I thank each of you for the opportunities I continue to have and pledge to work hard to continue to serve you, improve the advocacy education and benefits the UAA provides. I look forward to making more friends and continuing to cultivate the valued friendships I already have. Thanks again. Paul Smith

President's Message By Steve Randall, President 2013 Utah Apartment Association I recently attended a great meeting at UAA about Fair Housing Testers. There is a new program being run by the Disability law center that consists of testers visiting or calling on prospective apartments. As I sat there and the DLC shared all their tricks of the trade (ie. How they test, who tests, when they test, what they look for) I could hardly believe we have such a good relationship with this group that, some might argue, is trying to trip us up and get us in trouble. But we do. And that kind of thing is
good for our business because most fair housing violations come from inept/incompetent or untrained behaviors, not intent to discriminate. You will notice in the next issue of the Landlord Times, the UAA and DLC have partnered on an article to discuss the testing methods and results so far so that we can all learn how to be fair to renters and stay out of trouble. I hope you will read it and take head. At the same time, I hope you will consider that these kinds of relationships only come through investment and building good relationships. One of the biggest ways you can help us
to make contributions to the UAA PAC. I am a yearly contributor and a big believer in what we can accomplish as an industry with this money. I encourage you to make a significant investment this year. For big management companies and landlord attorneys the suggested contribution is $1,000 a year and many people give that much. For an apartment community or small management company, we ask $500 a year. If you own a considerable number of individual units, maybe you can afford $250 a year. Own ten or so? Maybe $100 would be appropriate. If you only own a unit or two, $50 is what we suggest.
