Landlord’s Role Smoke Detectors: Smoke detectors are still the most important tool to prevent fires. Most residential fires start in the kitchen, and most kitchen fires smolder and put off lots of smoke for several minutes prior to flaming and catching the room on fire. So having working smoke detectors is essential for catching and preventing fires from getting worse. Landlords should check smoke detectors and make sure detectors are working at least every six months. Remember, tenants are highly likely to disable the one in the kitchen. So have several others throughout the house that can act as redundancy and

UAA Tradeshow a Resounding Success
Fire Prevention Strategies aving a fire in your rental property is every landlord’s nightmare. Yet they occur daily. In fact, there is a kitchen fire reported in the United States every 4.5 minutes. As many as ten times as many more fires are not reported, but do serious smoke and other damage to kitchens. Since landlords are not the people who are using that kitchen, it’s important that landlords and tenants both play a role in preventing kitchen fires.

T
he Utah Apartment Association Fair Housing Education Conference & Trade Show was held on April 29, 2015 at the South Towne Expo Center This annual gathering is the largest meeting of landlords, property managers, apartment supervisors and others connected with the rental housing industry and broke new records this year with nearly 1,400 attendees. There were 117 exhibitors. “This year we had record breaking attendance with attendees from every corner of the state,” said RileeJo Stone, UAA Events Coordinator. “It was a huge success!” Dozens of volunteers helped make sure that the event ran smoothly. Father Son Team Highlight Their Amazing Race
D
avid and Connor are a father-son team from Utah who have an inspiring story of how they overcame challenges, including cancer, to compete in the 22nd season of the popular CBS reality program The Amazing Race. While he and Conner were in the lead, David tore his Achilles tendon. Doctors told him he had a three day window to have surgery or he would never walk the same again. They stayed in the race as long as possible, but had to drop out while in the lead. This heart break was only temporary, however, because as fan favorites they were invited back for

Connor shared another story about their meticulous preparation. “My dad got one of those big wall maps of the world and put pins in the map on all the places that they had been to in previous seasons so he could identify where they hadn’t been and study those places as much as we could. And it worked because some of the places we ended up going he had extensively studied so we were able to have a good head start in the knowledge of how to move around,” he said. Conner said they didn’t know what gear to bring, the show just says “bring what you think you might need”, so they tried and experimented with lots of gear, and protein bars, etc. “At one point I swear my parent’s bedroom looked like an REI because of all the gear we were trying out,” he said. David and Connor told stories about their travels around the world and their amazing experiences. They showed clips from the show and
the Amazing Race All-Stars for season 24, which they won. As speakers they highlighted the lessons that they learned from participating in the Amazing Race. They talked about how they prepared for running the race by carefully studying every single episode of all the previous seasons. They hiked and ran and went to the gym every day and got themselves in the best shape they could. But because they didn’t know exactly how to prepare, they also did some pretty unique things. “We knew that we were going to be put into physical situations that were pretty unpredictable and uncomfortable. Ask The Attorney: 3 Day Pay or Quit Notice By Jeremy Shorts Esq. Dear Attorney, Q: I served a 3 Day Pay or Quit notice. I just want them out and don’t want them to pay. Do I have to
accept the payment or can I just tell them to leave? A: Unfortunately, if your tenant is served with a 3 Day Notice to Pay or Quit and they come to you within the 3 days with the full amount owed, you do have to accept the payment. If they only come to you with partial payment, you can reject that
and continue with the eviction process. One question to ask is whether or not your tenant is on a month to month agreement, or if there is still more than a month left on your lease term. If they are on a month to month agreement, in addition to the 3 Day Notice to Pay or Quit, you should serve them with a No Cause Notice to Vacate by the end of the rental pe-

In addition to the large number of vendors in the exhibit hall we had numerous classes available to those who attended the trade show. There was something there for everybody. Twenty-two classes, ranging in topic
from Bedbugs to Fair Housing Enforcement to Tax Strategies to Air Conditioning were offered at the conference. Nationally renowned speakers Lisa Trosien and Bill Nye presented several classes, and numerous opportunities for Real Estate Continuing Education were given. “The feedback we received on the speakers and presentations was resoundingly positive,” said Jean Smith, 2015 UAA Trade Show chair. A Record Breaking and Award Winning Year Cheri Goss, Board Chair, Utah Apartment Association
T
his month I will have the privilege of receiving another award for the UAA at the National Apartment Association’s Education Conference and Trade Show. Last year I picked up the award for Best Government Affairs program. Out of almost 170 apartment associations in the country, UAA won the award for government affairs. This year the UAA has been
awarded the NAA Paragon award for Membership Development. In 2014 we grew 27% in unit count and now are on the cusp of representing 100,000 units and breaking into the top 20 of apartment associations in the country. That is saying a lot since just three states (California, Florida and Texas) have almost 15 metro areas larger than the entire state of Utah. It would be easy for me, as UAA President this year to simply pat myself or the staff on the back, but the real credit for our incredible growth goes to you. Each of you, UAA mem-

Each of you, by your professionalism and the integrity you show in operating your business are an advertisement for the UAA. I attribute most of our growth to your excellence and example. We have all this year to grow even more. We want to break the 100,000 unit count. We also have a goal to grow our associate membership to 300 vendors and suppliers. So thank you for your help in making 2014 a record breaking and award winning year. I am going to ask for your help in 2015 in reaching our goal, and I'm going to do so by asking you to do the following: 1. Invite three peers (other rental property owners, property managers, etc.) to become a UAA member. 2. Invite two of the companies that support your business (like you carpet guy, attorney, plumber, etc.) to become a member of the UAA and not only support your industry but get in front of other prospects to help grow their busi-
ness. 3. Call or email our great staff and give them one referral. They work hard to grow our membership and reach the goals we set for them. Let's all give them support by sending them a name of someone we think could benefit from joining the UAA.
If each of us will do these things, I'm confident we will not only reach our goals but will exceed them. Thanks in advance for your continued role in building and growing our great association. Fire Prevention ...continued from front page be a backup. Inspections: Besides smoke detectors, there are other things landlords should look for when inspecting. One is the aluminum foil wrapping many tenants put on the drip pan and rim to make cleaning easier. These collect grease and other flammable materials and we recommend you don’t allow them and make the tenants remove them for that reason when you find them. Check that tenants don’t have flammable materials like stacks of bills or a roll of paper towels close to the stove top. Many fires start because of that kind of accidental carelessness. One of the most important things to check during inspections is the placement of outdoor barbecues. Make sure they are never next to a building or under an overhang. Unattended barbecues start lots of fire s and do significant damage to building every day. While you are outside, make sure addresses are properly marked so fire departments can find your place if they need to. Be sure that even at night the numbers are lit and clearly visible. We recommend permanent lighting on the building numbers, florescent numbers painted on the curb and florescent numbers on mailboxes. Another thing we recommend you check is the closest fire hydrant. Make sure its accessible and check with the city to make sure it is propRental Housing Journal Utah • MAY 2015
erly maintained and has water to it. You’d be surprised how many places that could be saved by the fire department aren’t because of hydrant problems, many of these occurring inside apartment communities because the hydrant system is not properly tested and maintained. Tenant’s Role Tenants should be aware the number one cause of fires is unattended food left on the stove and burners being left on after cooking. Talk to your tenants about this and emphasize your concern for their safety and the need to be vigilant. Talk to tenants about not disabling smoke detectors. That is their first line of defense. Even if codes do not require it consider putting the proper fire extinguisher in the kitchen and teach them how to use it. Being vigilant about preventing fires can save you money and the inconvenience and heartache that can come with a fire. But it can also reduce your risk and liability. Landlords who aren’t vigilant can be liable in court to tenants and other who may become damaged in fires. By following these tips you can reduce your risk and liability and increase the odds that fires only happen to other people, and not you.

been asked many times to represent tenants in cases against other attorneys and says he would consider that a conflict of interest. “I think you have to pick a side,” he says, “and it’s pretty clear that I have.” “Kirk Cullimore has built the largest landlord representation in the state of Utah,” says Steve Randall, 2014 UAA President. Kirk’s practice does close to 300 evictions and month, and has hundreds of property management companies who pay him an annual fee to do all their representation, including collections. He has also expanded into Arizona. “Kirk has saved my company tens of thousands of dollars a year now for almost 20 years,” says Keith Nielson, with Pentalon Management, which owns and manages multiple apartment communities totaling almost 2,000 units. “Before Kirk came to us we paid by the hour, or per eviction for legal fees,” says Keith. “That’s how attorneys traditionally charge. But Kirk is an entrepreneur first and an attorney second and he figured out a way he could make money from tenants and debtors and not have to charge the landlords as much. He singlehandedly changed the business model for the large apartments and now represents about 90% of the large complexes and management groups in Utah,” says Keith.
