WHAT IS – AND ISN’T – HEALTH AND SAFETY As health and safety consultants, one of the issues that we face on a regular basis is a popular perception of “health and safety” as something that is petty and unnecessary. Because Health and Safety itself is such a wide area, and many aspects are based on individual judgment, officials in some areas have introduced rulings which appear to be spurious – and it’s felt that these incidents are giving true health and safety a bad name.

Petty Rulings Officials at the Health and Safety Executive have set up a Myth Busters Challenge Panel to investigate and counter this problem. The panel received over 300 complaints about rulings and decisions which had been made in the name of health and safety but which were felt to be petty or even bizarre. One perfect example being when a customer was buying some shoes, and refused the shoe box offered by the assistant.

However, the assistant told them that “their health and safety man says we have to make the customers have a box”. The panel ruled that this is a clear case of the health and safety excuse being trotted out to cover up a desire to get customers to take the shoes in boxes to avoid the shop having to dispose of the boxes themselves. This is not a health and safety issue but poor communication and poor customer service. When examined closely, however, it is sometimes possible to see the logic behind these rulings. In one case schoolchildren were told to wear long sleeves and hats in the playground during hot weather to protect them from sunburn, rather than use sun cream. A school spokesman said the move was for health and safety reasons. Some

children may be allergic to certain ingredients used in these products, and many schools believe that it is necessary to take steps to prevent an accidental allergic reaction. As a result, schools have often ruled that sun cream should not be brought onto school premises, instead asking that parents apply a long-lasting sun cream before sending their child to school, which makes much more sense.

Real Rulings Health and safety rules are intended to prevent injuries which can threaten health or even life. It can be argued that if people are accustomed to hearing “health and safety” as the reasoning for strange rules over shoe boxes, they will come to regard all health and safety regulations as petty, which could lead to neglect and injury. The Health and Safety at Work Act was introduced in 1974, and laid down the responsibilities of employers and employees alike to

ensure the health and safety of persons at work. For employers, the general duty is laid out in Section 2 of the Act as follows: “It shall be the duty of every employer to ensure; so far as is reasonably practicable, the health, safety and welfare at work of all his/her employees.” The key phrasing here is “so far as is reasonably practicable”. It must be acknowledged that it is not possible to eliminate all risks entirely – and that the process of eliminating one risk can, in some cases, lead to other risks – as in the case of the sun cream, where eliminating the risk of an allergic reaction can lead to an increased risk of sun burn.
