She was only five years old when she came here in May 2022, after travelling alone from her home country Ukraine. Her parents had to remain in Ukraine when their country was invaded, so Anastasia’s aunt was in Canada to greet her and provide comfort when Anastasia arrived. Although she’s adjusting well to her new life, it’s hard to imagine how overwhelming all of these new expe riences must be as she transitions into life Theabroad.summer sun was beating down when Anastasia first set foot on the pitch as a new player for the Abbots ford Soccer Association. It was her first time playing organized soccer, and her first time playing with children who used a different language. Anastasia’s first practice was challenging in more ways than one: not only did she have to learn a new language and meet new friends, but she also had to overcome her fears of playing the game. The coaches tried their best to communicate with Anastasia, but they found that it wasn’t always easy; they needed help from Anastasia’s aunt, who spoke WhenUkrainian.her aunt shared their family’s story with the coaches, they learned how far she had come from Ukraine— and how much she needed to have something positive to focus on. They decided that cultivating an environ ment where Anastasia felt safe and included was critical so that she would be able to learn and grow within their team. During the first practice, Anastasia was overwhelmed and had a lot of anxiety in the new athletic environment; she froze on the field and couldn’t even take a step forward. But by the time she got to play in a game against the parents, her sense of competition flour ished and she began running after the ball and trying to tackle it away from the parents. Her smile and laughter was contagious and everyone including other young players rejoiced when she started playing more. A month later, Anastasia had complet ed all four camps the club offered and she had made a complete turn around. She was kicking the ball, dribbling on her own, and she scored many goals.

Amazingly, Anastasia began trying to speak English to other players and coaches as well, which showed her English skill had grown as well.

People in B.C. now have an easier way to access their health records with the launch of the Health Gate way mobile app. “More than 1.2 million people in B.C. use the Health Gateway website, and now we are making it easier and more convenient for people to securely ac cess their health records by launching the mobile app,” said Adrian Dix, Minister of Health. “Through the app, people can quickly view information about their health at any time, helping them stay on top of their health and wellness needs.” Health Gateway is a new, secure app version of the Health Gateway web site that anyone can download from the Apple App Store or Google Play for Android mobile devices for free. Users will need to use their BC Ser vices Card app to register and log in. People can use the Health Gateway app to easily access and view: prescription medications; lab results, including blood tests and COVID-19 test results; health visits, including the date of the visit and the provider’s name; and immunization records, including CO VID-19 proofs of vaccination, such as the BC Vaccine Card and Federal Vaccine Proof.

The Province and Doctors of BC continue to collaborate to achieve a new physician master agreement and a new compensation model for longitudinal family physicians, both of which are expected to be an nounced in the fall. While dis cussions are underway, general agreements have been reached on key components of the new payment model, including the time spent by family physicians providing primary care services, patient encounters, complexity and attachment.

“This is an important first step to help doctors keep their practices open for patients over a four-month period until we have a longer-term solution to the very real problems in primary care,” said Dr. Ramneek Dosanjh, president of Doctors of BC. “There is still hard work ahead of us to achieve a new payment model that recognizes the pressures of rising business costs and that recognizes the value of family physicians and the time and complexity of providing longitudinal patient care. We want to ensure that everyone has a family doctor who can provide them with the quality care they need and deserve.”

The Ministry of Health is also developing measures to sup port and improve access to primary care, including improv ing recruitment and retention of health-care providers and providing additional resources to increase training capacity.

Approximately 3,480 family doc tors who have their own practices and 1,100 family doctors working in walk-in clinics are expected to re ceive funding. That represents more than 70% of family doctors working in the “Familyprovince.doctors are the foundation of our primary care system, and support ing family practice clinics is at the core of our province’s primary care strategy and the commitment it makes to patients,” said Dix. “Working with Doctors of BC, family doctors and other partners, we will build upon and strengthen primary care services for patients, taking the short- and long-term actions required to ensure certainty and confidence.”

ing their ability to provide patient care, and we’ve been working closely with Doctors of BC to find solutions. This interim stabilization funding to family doctors is a key action in sup porting their care to patients as we work to finalize a long-term solution this fall.” The funding comprises $75 million from the Ministry of Health and $43 million from the General Practices Services Committee, a collaborative committee co-chaired by the Ministry of Health and Doctors of BC that was established through the physician master agreement. This short-term funding will be for four months, from Oct. 1, 2022 to Jan. 31, 2023, and will support family doctors and medical clinics with their operational business costs. It is part of a multi-phased ap proach to help protect and improve B.C.’s health-care system.

The funding is available to family doctors who provide ongoing ser vices to their patients and who pay overhead costs. As well, primary care clinics, including walk-in clinics, that commit to remaining open and maintaining consistent clinic hours can apply for funding on behalf of the clinic and doctors working in it.

The Province’s year-end Public Ac counts show B.C. had a strong fiscal result last year, bolstered by a fasterthan-expected economic recovery as government made record investments to support British Columbians. Despite unprecedented spending to support people and businesses, B.C. ended the 2021-22 fiscal year with a $1.3-billion surplus as the province’s economy outperformed both publicand private-sector forecasts.

The improvement from last year’s forecasts can be attributed to a reopen ing economy where more people were able to participate, which resulted in increased taxation revenue; one-time federal contributions for COVID-19 and disaster events; higher natural resource revenues; and higher net earnings from self-supported Crown “Thesecorporations.numbers show that the ac tions taken by British Columbians to protect each other and that our unprecedented investments to sup port people were the right decisions,” said Robinson. “While others might have chosen cuts and austerity, our investments in people have helped our economy rebound faster than anyone in the public or private sec tor predicted. Looking ahead, the Province will keep using this eco nomic strength to support British Columbians, including bringing in new measures in September to help those who are struggling the most with global inflation.”

The budget for the 2021-22 fiscal year was prepared during the first winter of the pandemic, at a time when COVID-19 vaccines were not yet widely available, gather ings were limited and restaurants were closing. The BC Vaccine Card was nine months away and conversations about global infla tion had not yet begun.

B.C.’s economy recovered faster than expected in 2021-22

“Last year was an incredibly chal lenging year for British Columbians with the pandemic, coupled with devastating climate disasters,” said Selina Robinson, Minister of Finance. “Through the challenges we’ve faced together, we’ve made record invest ments to ensure targeted supports were available to those who needed them most and to continue building the services and infrastructure people count on.”

Spending to support people increased by $3.5 billion over the record levels from fiscal year 2020-21, as govern ment continued to make investments in people, businesses and communi ties to help ensure a strong, peoplefirst economic recovery. Public Accounts for the previous fiscal year are a vital part of ensur ing transparency and accountability within government’s finances. InOverturned?theLecase, Mr. Justice N. Smith struck down the regulation capping disbursements, finding it unconsti tutional and of no force or effect on other legal grounds. In doing so, Judge Smith pointed out some trou bling things about the cap:

• Even identical injuries requiring the same disburse ments for expert evidence can produce widely varying awards or settlements. For example, two plaintiffs with identical injuries may each receive an award that includes an amount for past and/or fu ture loss of earning capacity. A plain tiff with higher pre-accident income will receive a higher total award. So, for example, a plaintiff who was a highly paid professional may receive a total award large enough to recover all or most of their disbursements on the 6% formula, while a plaintiff with the same injuries who worked at minimum wage may only recover a small portion.

Plaintiffs are frequently required to obtain evidence of medi cal and other experts to prove their claim, which can be costly.

Why Was The Cap On Disbursements

The disputed regulation applied only to actions for personal injuries arising from BC motor vehicle ac cidents. It created a “disbursement limit” or “cap” equal to 6% of the total damages awarded by the court or paid in settlement before trial. The law clearly operated to the benefit of ICBC. BC courts were critical of this, noting that the “thinly veiled purpose of this legislation is to improve the finances of ICBC by reducing the quantity of expert evidence in motor vehicle accident liability claims and to thus both reduce litigation costs and produce lower damage awards whether by way of settlement or at Cappingtrial.”

Plaintiffs would be forced to decide that they simply can’t afford to proceed with a portion of their claim or to present the evidence the court requires to consider an award under a particular head of damages. Successful personal injury plaintiffs are entitled to recover damages as well as disbursements incurred to advance their case. A new law that at tempted to put a cap on disbursements in ICBC claims was recently struck down by the BC court in Le v. British Columbia (Attorney General), 2022 BCSC 1146, representing a major win for car accident victims.

• The total amount of an award or settlement may differ between similarly-injured plaintiffs based solely on age. A plaintiff who is nearing retirement age will receive a ing capacity, and therefore a smaller total award, than a younger plaintiff dictable at the time the costs for expert reports and/or testimony are incurred. Plaintiffs and their counsel therefore will not know what amount ing the 6% limit.
