Our 15 day ancient history and art tour has been lovingly created by our travel gurus in order to showcase the ingenuity and exquisite craftsmanship of the ancient Chinese peoples. The tour begins in Beijing where you will spend the first few days exploring the historical riches of the city and its surrounding countryside including Tiananmen Square and the Great Wall itself. The second week of the tour takes you to historical Henan Province taking in Xi’an the city is famous for its ancient Terracotta Army. is a trade name of Orientis Ltd, a company registered in England and Wales. Orientis DMC is a Destination Management Company in China supplying Tours and Travel Arrangements. means the Tours, which Orientis DMC is to supply in accordance with these Terms and Conditions. These are specifically defined as Tours to China, Tibet, Hong Kong and Macau and will include air or other transport, tickets, accommodation, car hire, package holiday and other travel services. means (but is not limited) to domestic air transport within China, Tibet, Hong Kong and Macau, tickets, accommodation, car hire, package holiday and other travel services. means the holder of the appropriate licenses required under the legislation of England and Wales to sell flight and holiday packages under the Package Travel Regulations 1992 means an entity whether corporate or individual who will be selling the Tours and Travel Arrangements to Customers. means a corporation or individual who will be purchasing the Tours and Travel Arrangements from the Principals or Agents means a detailed plan of the Tour that will be attached and form part of these Terms and Conditions

Terms of Payment The price for the Tours shall be the price contained in the Itinerary. Once the Principle have confirmed booking by, E-mail, Fax or any other electronic or non-electronic means. Orientis DMC will book the travel components, such as, without limitation to, flights, transportation, and accommodation. The full payment will be payable no later than 30 days prior to the date of departure, unless otherwise agreed. Where a Tour has been confirmed within 30 days of departure, full payment is required immediately on confirmation of the booking. Once the letter of confirmation has been sent to the Principal, the Tour and Travel Arrangements may be amended at the sole and absolute discretion of Orientis DMC. Where Orientis DMC agrees not to charge an amendment fee. All payments should be made directly to the Orientis DMC bank account:

3. Cancellation 3.1 A Tour which has been confirmed by Orientis DMC may be cancelled by the Principal providing Orientis DMC with a signed written notice. 3.2 Unless clause 2.2 above applies, cancellation charges will incur on the following basis:

For Tours that include a cruise on the Yangtze River or a visit to Tibet, cancellation less than 30 days prior to travel will incur a cancellation charge of 100% of the Tour cost. 4.

The Tours The specification for the Tours shall be those set out in the Itinerary and brochures documentation unless varied expressly in the Principal’s order and accepted by Orientis DMC. Illustrations, photographs or descriptions whether in catalogues, brochures, price lists or other documents issued by Orientis DMC are intended as a guide only and shall not be binding on the Orientis DMC.

5. 5.1.1

Limitation of Liability To the maximum extent permitted by law, Orientis DMC accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the Tours and Travel Arrangements. Orientis DMC will not be liable for the failures on the part of the Principal. Orientis DMC will not accept liability where the Principal has failed to convey appropriate safety and risk advice to Customers. Nothing in these terms and conditions excludes or restricts Orientis DMC’s liability for death or personal injury resulting from any negligence or fraud on the part of Orientis DMC. Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

Orientis DMC reserves the right, by giving notice to the Principal at any time before the commencement of the Tour, to increase the price to reflect any increase in the cost to Orientis DMC which is due to any

factor beyond the control of Orientis DMC such as, without limitation, any foreign exchange fluctuation, currency regulation and fuel surcharges. In the case of an increase, Orientis DMC will absorb any amount up to 3% of the Tour price (excluding insurance premiums and amendment charges). If the increase is over 10% of the Tour cost, the Principal will be entitled to cancel the travel arrangements and receive a full refund.

Governing Law and Jurisdiction These terms and conditions shall be governed by the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the English and Welsh courts.
