A LITTLE BIT OF BOTH… By Steve Berube Chairman HCDD and President HROA

A

s some of you know, I am the President of the HROA and the Chairman of the CDD. As both entities have made substantial moves recently, I thought it important to split this space this month and share both with you.

rebuild the parking area into a park-like setting, provide a permanent Buck Lake usage agreement, permit for and carry-out long-delayed repairs to the boathouse and provide a few other incidentals. Though some don’t like it, all in all we achieved a positive outcome.

So, we’ll begin with the CDD and the much-talked-about “land swap” that has been the subject of discussion which included a very thorough and well-detailed report compiled by a resident task force. After an incredible amount of research and many hours devoted to the topic, the task force could not draw a conclusion as to what to do. BUT— their report and survey did point out a few desires which exist in the Community such as a Community Center; the Board has already taken action on this by exploring the hiring of a consultant to document the feasibility of building such a Community Center.

On to the HROA: As you’ve read previously, a major change needed was to the management structure. Each year, the management fee has grown, with First Services Residential charging about $135,000 last year and being budgeted for $139,000 in this fiscal year. Obviously, with TOTAL dues collection of under $130,000 each year, this was unsustainable and had us headed for insolvency. So, despite cutting the on-site management, and changing other management fees, FSR was still too expensive (at $88,000) for my taste. This led to a several-months-long search for replacements and the necessary vetting of those candidates. We analyzed all the offers and eliminated the very cheap as well as the very expensive, settling on 3 companies all of whom made presentations to the Board (and audience) at the last meeting. One, the most expensive of the three (FSR) was fairly easy to eliminate. The other two were very close in presentation and price, but after extensive conversation, the choice of the Board (and the audience) was unanimous. Association Solutions of Kissimmee was the winner and is owned by Mark (and his lovely wife) Hills who happen to be Harmony residents. Though it didn’t matter much, Mark’s price was the lowest of the 3 finalists; it is also notable that Mark recently won the management contract at The Lakes over-55 community as well.

Back to the land swap which involves some acreage near the entrance to Buck Lake that extends eastward towards The Estates entrance. In general, it was the site of the previous Harmony Community School. In short, the Developer needed about .75 acre to gain the space needed to build 12 premium homes on 55 x 135 foot lots. Said .75 acre is CDD land which does not carry a debt assessment. In return for that .75 acre, the Developer would give us 1.5 acres of land which contains both the parking lot for, and the entrance to, Buck Lake. The catch here is that this land DOES carry CDD debt assessments. Interestingly, though the difference is about .75 acre, the real change is 1.09 acres of “developable” land so that becomes the land area subject to assessment. After all the background calculations were done, the value of those assessments over the life of the bonds is right around $50,000 which the Developer agreed to pay. In addition, they are paying all the costs involved in the land swap including surveys, deed transfers and other related costs. They will also surround the new neighborhood with a landscaping buffer wall,

So, in one swipe, we saved nearly $80,000 on budgeted money. Our aim is to both increase funding for the Social Committee (did anyone say snow in December??) and at the very least, hold the line on near-future dues increases. All in all, a very good outcome. A

s we start to come out of the Winter season and we’re focusing in on our landscaping as it begins to green up again, I thought it would be useful to bring your attention to a subject I referenced several months ago regarding lawn clippings: Lawn Clippings: When mowing your lawn please mow in such a manner that the grass clippings are blown onto your yard and not the street. The comments below come from PennState Extension: When lawn clippings, fertilizers, soil, leaves, or animal wastes, are picked up by storm water runoff, they are carried directly to our local streams and lakes. All of these materials including grass clippings contain phosphorus. According to the U.S. EPA, phosphorus is one of the most troublesome pollutants in storm water runoff and it is considered the primary cause of water quality problems in our lakes, ponds and streams. Grass clippings contribute nutrients such as nitrogen and phosphorous, which cause unwanted and uncontrolled growth of algae and aquatic weeds in the waterways. Increased algae growth is observed as green algae blooms or “scums” on lakes and ponds. Too much algae is harmful to a lake system. It blocks sunlight and prevents other plants from growing. When it dies and decays, it also takes much needed oxygen away from fish. Limiting phosphorus reduces algae blooms. According to the Northeast Wisconsin Stormwater Coalition, one bushel of fresh grass clippings can contain 0.1 pounds of phosphorus which if it ends up in lakes or ponds is enough to produce 30 to 50 pounds of algae. When mowing your yard, make certain that you do not blow grass clippings into the street. When mowing, make the first few passes with the lawnmower blowing the grass clippings into the lawn not the street. If there are grass clippings on the street or sidewalk, use a broom or leaf blower to blow them back 8 Harmony Life Magazine | February

into the lawn. Do not use a hose to wash them into the street or storm drains. Keeping your leaves and lawn clippings out of the streets and gutters will have significant benefits for your local lake or stream. You can reduce the amount of phosphorus entering a lake or stream. Dogs dogs dogs: Owners failing to pick up after their dogs is the most common pet related complaint I receive. A distant second is dogs not being on a leash. So please, when walking your dog, pick up the droppings. Your neighbors will love you for it. Also, dogs must be on a leash when outside your home, except within the confines of your fencedin back yard. While you may have a wellbehaved pet that would never hurt a soul, people encountering them don’t know that and it causes needless fright. Violations: I spend several days each month touring the community on the lookout for violations. Below are some of the most common culprits: By far, the most common violation I encounter is related to landscaping. That could include dead sod, weed-infested turf and/or shrub beds. Another common violation is a home in need of exterior cleaning and/or painting. If you have green mold on the outside of your house, please clean it. If you wipe your fingers across the paint on your house and it leaves a chalky residue, it’s time to paint. Take a look at your mailbox. If it’s faded, rusty, broken, missing its door, etc., replace it. Remember, replace like-for-like. The new mailbox must be the same design and color as the one it’s replacing. Sidewalks and driveways: Generally speaking, you are responsible for cleaning the sidewalks on your property. If they are black or green with mold/mildew, it’s time to clean them. As well as looking bad, they can also

be very slippery when wet. Cleaning them keeps them pretty and safe. One caveat for non-professional cleanings: I often-time find what I refer to as the “tiger-stripe” appearance when cleaning is done by narrow, highpressure cleaners. You will see alternating dark and light stripes from the use of such equipment. I’ve also seen the smooth surface of a sidewalk blasted away by too much pressure being used. Once the paved surface is damaged like this, it will get dirty faster. Closing comments on violations: The letters I send are the means with which we try to maintain a high standard of appearance in the community. They are not meant to harass you, as they have occasionally been characterized. The first letter allows two weeks to cure the violation. If you find that you need a bit more time, contact me in writing with a request for additional time. I’m happy to accommodate reasonable requests. The Board’s desire is to keep the community looking nice, not to bludgeon you with continuing notices. Please note also that the photo included with the notice may not show all areas needing attention. It may have a picture of dead sod between the sidewalk and the street whereas there may be other areas in the yard that also have dead sod. Look beyond just the photo in the letter; read the verbiage that accompanies the photo. It’s fairly descriptive in what needs to be done. Final note: This will be my final month as the manager of Harmony Residential Owners Association. It has been my pleasure to be your manager for nearly two years now and I will miss the community. I have met a number of homeowners during my tenure and I have truly enjoyed many of the friendships I’ve made and I wish them and the community all the best in the future. ID YOU KNOW that Harmony was designed to promote the peaceful coexistence of human and animal residents within the community while striking a balance between the preservation, use and enjoyment of Harmony’s natural areas? Underlying these objectives are the values of fostering a respect for the land, the protection of wildlife and the sensible use and enjoyment of Harmony’s abundant natural and manmade amenities by its residents.

If you bring a large dog into the Small Dog Park off Primrose Willow, please be sure your dog can play appropriately (not bulldozing smaller dogs), otherwise use the Large Dog Park. Please be considerate of other people and dogs who were there when you arrived, as not all dogs want to interact at the same level of interaction and spirit. For example, if you have a rather active or boisterous dog, not all dogs, or people, welcome that level of activity and curiosity.

Among Harmony’s many wonderful features are the guidelines for companion animals, and more specifically, the amenities for dog owners. With miles of walking trails, three dog parks (Central Bark near the Town Center, and the Small and Large Dog Parks), and many doggy-pots conveniently located around the community, Harmony is a dog-lover’s dream. At the dog parks, there is some general etiquette:

Before entering a park, always ask any owners of dogs you aren’t familiar with whether their dog is friendly to other dogs. If the answer is no, it is best to wait until the dog using the park leaves. The owner should be kind enough to not make you wait too long, but if you’ve just gotten there, don’t feel obligated to leave immediately. Even dogs that are not good with other dogs have a right to use the dog parks.

If you are in the park with your dog, when a dog is entering make sure that your dog is not near the gate. Entering the dog park can be a tense moment for many dogs, not only those entering, but those already in the park. Letting your dog hang out by the entrance when other dogs are entering can invite a dog fight. Did you know that Osceola County issues stiff fines to owners of loose dogs and owners that do not pick up after their dogs? Nobody wants to step in or smell dog waste, or find a “present” on their lawns or in their flower beds. Thank goodness we have so many doggy pots to make it convenient to clean up after our dogs. n



Rental Income and the Tax Consequences to Consider By Jason Flowers CPA, CFA, CFP, EA, CTFA

A

irbnb offers travelers the ability to book rooms from “hosts� in over 190 countries. As of February 2016 there were over 170,000 listings in the US alone. Becoming a host and renting your home or portion of your home through Airbnb (or on your own) creates some unique tax issues. Let’s explore some possible scenarios you might encounter as an Airbnb host. Renting One Unit of Your Duplex Home: Let’s consider one scenario where you rent out one unit of a Duplex you own and live in the other. Expenses exclusively related to the unit you rent are deductible in full. On the other hand, expenses such as your utilities, mortgage interest and property taxes must be prorated between the two units. In our example, if property taxes for the entire Duplex were $5,000 we would allocate 1/2 of this expense to the rental activity on the Schedule E with the remaining 1/2 to be reported on a Schedule A as an itemized deduction assuming you have the one unit rented for the entire year or at a minimum made available for rent (i.e. listed for rent on Airbnb).

Real estate activities are typically considered a “passive activity.â€? Losses from one passive activity may offset income from other passive activities, but not income from non-passive activities. One valuable exception is when you own at least 10% of the property you rent and make management decisions (or arranged for others to make management decisions) on the property. The exception allows you to be considered as someone who “actively participatesâ€? in the rental activity.

Subletting a Room You Rent in a 2-Bedroom Apartment: In another scenario, let’s assume you do not own the property, but are merely trying to earn some extra income via a short-term sublet of your bedroom in a 2-bedroom apartment. This is common amongst college kids going home for the summer whereby they rent their room to help offset their own rental costs while they are away.

In this scenario, let’s assume your rental income is $24,000 (i.e. $2,000/month x 12 months) and your deductible expenses total $26,000. Without income from other passive activities you would be limited to deducting $24,000 of the expenses against the passive income of $24,000. However, if you are considered to “actively participateâ€? per the requirements above, you would be allowed to deduct the additional $2,000 of expenses against non-passive income such as wages.
