Casual Workers

There is often an increase in casual workers during the summer months, particularly in frequented holiday destinations. It is important that employers are providing correct employment agreements which accurately record the casual nature of the employment relationship. If there is an expectation that casual employees accept work when it is offered, then it will not meet the definition of a casual employment relationship. Likewise, if employees have an expectation that work will be offered.

Tighter restrictions on payment of holiday pay with casual employees’ wages is also anticipated as part of the Holiday Act changes. It is expected that only employees who carry out strictly casual work can be paid in this way. Employers will also be required to review the employment status of casual every 13 weeks to ensure the employee is still engaged in genuine casual work. This is a habit employers with casual employees should be adopting now.

Challenging Economic Times

With the Reserve Bank Governor announcing a deliberately engineered recession to bring down inflation, businesses will need to prepare for challenging economic times.

Now is the time to be checking compliance with wage and leave obligations to ensure staff have been paid correctly and high leave balances are being managed. Employment agreements should also be reviewed to ensure staff have clear, current written terms of employment.

Planning ahead also includes reviewing recruitment plans, training and budgets for the coming year, along with overtime costs and assessing where efficiencies can be gained.

Any restructuring must be carried out in accordance with employment agreement terms and good faith obligations. Care must also be taken when setting out the business rationale for a restructure proposal.

With interest rate hikes and the forever increasing inflation rates people are feeling the pinch. Looking for an alternative income source is necessary for some. Renting out your holiday home or main family home is a great way to make some extra money for your household. There are a few things that you should consider before letting out your property for this purpose which include the following;

Council requirements

Check your District Plan for permitted activities in your zone. The local council will usually regulate short-term visitor accommodation activities and these obligations do differ from council to council.

Making your home available to family and/or friends at no charge, and letting your property longterm, are not activities regulated by your local council but if you are letting your house on a frequent basis, it is possible that a resource consent will be required. For smaller-scale or infrequent activities, you may only need to notify your local council of your activities.

Land Covenants

Once you have established that your Council does not restrict short-term visitor accommodation it is important to check your title. It has become increasingly common for Land Covenants to be registered on titles preventing you from renting your property for short-term accommodation.

Contractual matters

If you engage a provider such as Airbnb to connect you with visitors, you should check carefully the terms of your contract. You need to be clear on your rights and obligations, as well as those of your provider.

Health and Safety

If you engage other people to look after the maintenance of your holiday house, it’s likely that your holiday house will need to comply with the Health and Safety at Work Act 2015. As someone who is responsible for a ‘workplace’ you must take all reasonably practicable steps to ensure that no workplace hazard causes harm to ‘workers’ such as gardeners, cleaners and tradespeople.

It’s also important for you to identify those parts of your property that may pose a possible hazard/risk to your visitors (such as swimming pools, fireplaces and balconies).

By taking practical steps to address any potential hazards, you can ensure that your visitors have a safe and enjoyable stay.

Bank approval

Your bank may have a security interest in your property. If so, the terms of your mortgage documentation will specify certain activities for which the consent of the bank will be required. One of these potential activities may include the letting of your property for short-term visitor accommodation.

Insurance

It’s always good practice to notify your insurer of your visitor accommodation activities. This will ensure that your insurance policy can be adjusted whilst your property is being let.

Tax

There are likely to be tax implications if you’re letting out your house. We recommend that you contact your accountant/financial adviser to discuss your tax situation. The short-term letting of private homes as visitor accommodation can benefit both homeowners and visitors alike. It is, however, important that as homeowners you are aware of, and take steps in respect of, the types of obligations we have highlighted above. If you are considering renting your home whether it be for short or long term rental we recommend that you speak with you lawyer to ensure that you fully understand the risks and requirements set out above. In 2019, 2020 and 2021 there was massive campaign in New Zealand to “Shop Local” around Christmas time that appears to have died off but we support and encourage the premise.

Our local businesses are vital to the recovery and on-going resilience of the economy.

During last year’s Covid-19 restrictions our small business owners showed initiative, hard work and resilience to keep afloat. It feels lika lifetime ago, but in reality it was only a year ago that we were waiting for a date that the Auckland and Waikato trading restrictions would lift. Many businesses faced an uncertain summer with the Vaccine Passes introduced – many lost good staff and were unable to open. Many faced caps on numbers on site and were unable top operate with a full contingent of staff.

We are currently free from the restrictions we faced this time last year, but many businesses were hit hard and are still facing challenges this year, that are a flow on effect from Covid Lockdowns and borders being closed. We need to give our businesses as much support as possible

Local businesses create jobs that help us pay rent, mortgages and keep food on the table. They provide us goods and services which means we don’t have to spend hours (and petrol!) driving somewhere else for what we need.

They help our local shopping centres feel like vibrant hubs for our community, where we meet friends, pick up a coffee and get some fresh food for our fridges at home.

Shopping local brings us all greater benefit. It’s about more than the product or service you buy. It’s about keeping the money you spend in the local economy and keeping it working in the town to help us all.

Local businesses are often generous sponsors of local events, clubs and charities. These businesses pay salaries to local staff and keep money in the towns and regions but they also work on growing and developing staff, teaching them skills and enabling them to grow as people.

Let’s support local this festive season and into the summer.
