Places of Interest If you have always thought that Goa is all about the beaches, wine and fun‌ then think again! Of the endless things Goa is renowned for, forts form a vital part. A succession of invasions by the Portuguese, Mughals and Indians has left Goa with a plethora of forts for tourists to cherish. But these grandiose structures not only speak of the past...........

N
ew Year is just around the corner waiting to enter into your life with new hope and expectations. People from all around the world enter into Goa to celebrate the New Year. Streets are filled with the tourist everywhere. Some of the happening places in Goa are so densely filled with tourist that it hardly allow the movement of traffic slickly, but still everybody seems to be happy as they are in the mood of celebration. Even the people with sombre faces seen smiling and excusing others for minor things which in normal circumstances they would bash on, how many times you have experienced such a thing, I am sure many a times but more when the year is coming to an end. Why that ending of old year and beginning of New Year brings such a joy on our face? Whilst if you see every day is a new day! The reason is perhaps we all of us wait for the reason to celebrate happiness. We all need some reason to celebrate our contentment, it does not matter how old we are, who we are and where we come from, at this point of time everybody comes to the resolution and capitulate to the moment of happiness. Imagine if we celebrate every day as new day then we don't really have to wait for the New Year to come. Don't you think? Think about it. The power of common man should never be taken for the granted. It is proved by the AAP (Aam Admi Party) in New Delhi assembly elections by defeating the stalwarts of the political pastime. The common men have shown that they will not tolerate hierarchy anymore. This is the sign of new revolution taking shape in a very systematic manner and it is not very far-off that one day India will become the corruption free and in true senses the government of people (Aam Admi) will come. Though we have travelled far from the day of independence but the real independence is not yet attained. We are still ruled by the bunch of people with the power of money and muscle power, in this system a common man have no say, it is just the power game and only those who have power rules the rest. I am looking forward for Sun of real independence to rise. Nigerian outburst in Goa was shocking to everybody including the government, because we do not know what is happening under our nose. Nigerians as alleged of staying in Goa with fake visa and doing illegal business, they come to Goa under student visa and there is no existing system whereby to keep check on such foreign national activities in the state. When one of their countrymen murdered in Goa by some local gang as alleged the crowd of more than 200 Nigerians came out on the street to hold everybody ransom. They blocked the entire traffic of north Goa in presence of the police, although the performance of the Goa Police was commendable as they managed to clear the blockage and also dealt with culprits. The rest of the story you can read in out in Focus column and please give your suggestions on it. Nothing comes for free in this world, please keep in mind when you receive the message or email from somebody claiming that they are looking for the next kin, or your number is chosen for the big money, or your profile on social networking site have been appreciated by someone, it is a trap. We all claim to be very smart and intelligent but somehow all of us get into the trap set by these scavengers. This is the case of 419ERS from west of Africa. Thousands of people world over get into the trap of these rouges and losses millions of rupees, but yet we run after the illusion and do not learn the lesson, the article on E-Scam will be surely be the eye opener. We have started two new sections in our magazine from this issue onwards that is, Happening and Kids corner, I will look forward for your comments and contribution into this section. Till next time happy reading ……………………. Editor Rajesh Ghadge

Festivals in Goa have diverse allure compared to any part of India. Some of the festivals of international standard like Carnival occur only in Goa. The reason behind this is obviously is the western culture existed in Goa for centuries. Among all the festivals Carnival takes place in the Month of February in Goa. It is exclusive and unique to Goa, and was introduced by the Portuguese who ruled over Goa for over 500 years. The festival brings out the best of the vibrant culture of Goa. The eclectic cultural mix that the Portuguese and local strains create makes Goa unique, a state different from the rest of the states in India. Goa Carnival is now inseparable from the heritage of the state. The word 'carnival' is said to be derived from the Latin 'Carne', meaning meat, and 'Vale', which translates to 'good-bye'. Some also link the word to 'Carnislevamen' or 'the pleasures of meat', focusing on the enjoyment of meat during the festivities, before the

abstinence that follows during Lent. Another hypothesis suggests that the word came from 'Carrus Navalis', the horse-drawn, boat-shaped carriage that was paraded during the Roman festival Saturnalia, in honor of Saturn. It carried men and women in fancy dresses, wearing masks, and singing obscene songs. It is possible that the present-day concept of a carnival emerged from this parade. Although, the three-day festival is primarily celebrated by Christians, it has also absorbed Hindu tradition revelry, western dance forms, and turned into a pageantry of sorts. Though it started as a celebration enjoyed only by the local population, it has today crossed the state frontiers and attracts thousands of people from all over the country. The origins and nature of the carnival can be traced to the hedonistic feasts of ancient Rome and Greece. These carnivals started in the Spanish and Portuguese colonies, and gradually became known for their singing, dancing and drinking. Carnival is presided over by King Momo, who on the opening day orders his subjects to party. The float parades are organized in association with the State Tourism Department every year. The float parade in Panaji is be led by a special float hosting King Momo, a specially decorated float, which declares the decree to eat, drink and merry. Carnival is meant to be a feasting-drinking-merrymaking time just before the austere 40 days of Lent. Huge parades are organized throughout the state with bands, dances and floats out all night on the streets, and grand balls held in the evenings. The carnival concludes with the famous red-and-black dance held by the Clube National in Panjim on the final day.

Carnival is not celebrated anywhere else in India and was in decline even in Goa in the last few y e a r s o f Portuguese rule. Its revival w i t h t h e liberation of Goa, and a boost to its tourism was therefore welcome. From being almost on the brink of decline, this three day festival of gay abandon and riotous revelry now attracts thousands of tourists to Goa from all over India every year! The Goa Carnival, 2014 will be celebrated from 09th Feb to 12th Feb. The festivities and celebrations that continue for three days gift Goa a new life... so jazzy, so lively! So… Don't miss…..the vibrant musical parades and lavish floats which are the major highlights of the carnival……. Mingle in the riot of colours... Come to Goa and be a part of the festival of fun, - the Goa Carnival. …….

O
ctober 31st is the day when suddenly out of the blue hundreds of Nigerian comes on the road and attack on police van holds the entire traffic on the highway, shouting bad words at the people of Goa. It was sudden and nobody knew what exactly is happening. It was perhaps the first time that such huge mob of foreign national coming out on the road in the protest of the murder of their fellow countryman. Why this happened? What was the reason behind this outbreak? Is this really happened out of the blue or there was reason behind this? The solid reason which was holding on to erupt one day this way? Nigerians like many other foreign nationals' lives in different parts of India, but Goa is having maximum number of them staying here on student visa. This is happening for long while govt. and police wakes up only after the episode takes place and then the blame game starts, everybody blaming other for not keeping the check on illegal immigrants, allowing them to do drug peddling in Goa. This kind of reactions shows the weaknesses of our existing system and involvement of public servants and politician in the nexus. In this case there were various perspective involved, one was the human right as the foreign national staying in India, second was the drug business in the name of student visa, third was the nexus between Nigerians and locals for flourishing the drug trade in Goa. According to the sources the murder took place due to the business rivalry due to

the drug trade. Not required to mention that locals were involved in the same. This entire episode started with tussle between two groups and took a color of foreign affairs, involving home ministry to deport the Nigerians from Goa and Nigerian nation to warn Indians of taking action against Indian staying in Nigeria. The story is very big and people from the high places are involved in this. As a part of our limitation we may not be able to reveal lots of things in here but we are surely trying to provide you with exiting information to reason out the issue. The story became international, ALJAZEERA published the following contents with video on its online channel The Stream “Is the murder of a Nigerian man in India's Goa state linked to racism or gang violence? India-Nigeria tensions are on the rise after Goan authorities blamed the incident on infighting between rival drug gangs and ordered police to expel undocumented Nigerians. Nigerian expats, however, say racism is at play. With nearly 50,000 Nigerians living in India and one million Indians in Nigeria, what impact will this incident have on both communities?. Its easy to make out the impact of the murder of one foreign national in Goa. After the murder and Nigerian attack on police the issue became public and the blame game started by opposition parties by bringing the Home Ministry under siege by pressuring them to take action against the people involved in the drug trade. As it always happens in India the ruling party started blaming previous government for

flourishing drug trade in Goa while opposition started blaming ruling party for supporting the flourished business of drug trade in Goa. In the bargain the main issue of tackling murder of Nigerian disappeared, police caught some accused and deported few Nigerians from Goa. In fact the main issue was not never here to deport the Nigerians but to stop these types of illegalities in the state of Goa, because not only Nigerians but many foreign nationals including Russians & Israelis. In one of the incident of the news published (News Extracts Panaji, Nov 12 (IANS)) The Nationalist Congress Party (NCP) and the Congress have both demanded a judicial probe into Goa's drug mafia, which the opposition has claimed is linked to government ministers. Addressing a press conference, NCP vice president Trajano D'Mello said that links to ministers in the Bharatiya Janata Party (BJP) were surfacing in media reports and only an impartial judicial probe will help unearth the political nexus to the drug mafia in Goa. "We join the Congress demand for a judicial probe. Let us unearth the drug mafia once and for all," Trajano said. Leader of opposition Pratapsing Rane has claimed that if the drug rule in Goa was not combated, then the state could go the way of Mexico and Columbia. "A judicial probe will be ideal because clearly there is a nexus between the police and the drug dealers," Rane said. Meanwhile CM Mr. Manohar Parriakr assured the media that the proper action will be taken in the Nigerian murder case and the culprits will be arrested. Due to the stiff pressure from the opposition parties Goa police acted swift in the case and arrested people involved in the Nigerian national murder case. The news published in the Indian express has confirmed the arrest of accused Praveen Manohar Mandrekar and another accused Surendra Pol. Superintendent of Police (North) Priyanka Kashyap confirmed this report, she also mentioned that Mandrekar was a gang leader of a group of eight people, who brutally killed the Nigerian. The arrest of accused involved and the deporting of Nigerians is not the solution of the matter here. Our government need to go to the bottom of this drug nexus and find out the guilty behind this and punish them. Is the murder of the Nigerian is the only alarm police and government received on propelling drug trade in Goa? Does government or police need more such incidents to take action against the drug nexus in Goa? Intelligence agencies are not aware of this nexus and drug trade? Does our appointed representatives have better job to do then pulling each other's legs? Question are many and in the bargain we have only our society to lose everything cause finally drugs sold by Nigerians or Locals will be consumed by our future generation and we will have nothing left accept drug addicts and HIV positives‌‌.

Due to the revolution in the internet virtual world, people from all across the world interacting with each other like neighbors, Social networking sites across the world has increased the possibilities of connecting the world in a friendship band. It all started with personal computer but now it is sitting on your palmtop (mobile phones and PDAs) having unlimited possibilities of communication. With the platform like IOS, Android & Windows mobile handsets have superseded the personal computers and Laptops. In this world of virtual illusions everybody lives day and night in fact many a times we forget which is our real world and what is illusion. We all eat drink and sleep in the virtual world. Due to the convenience of communication media everybody using it as a medium to reach to the maximum people, some use it for good and others for Bad. Innocent individuals are not aware of the predators sitting o the other side of the terminal and are planning to take advantages of the situation. There are various angles and expressions are there for this type of situation but in this section we are talking only about the Cyber Scam which involves the financial frauds against the innocent people which infamously known as 419ers scam. In Nigeria, "419", refers to the article of the Nigerian Criminal Code (part of Chapter 38: "Obtaining property by false pretences; Cheating") dealing with fraud In Nigeria. They have various modus operandi depending on victim and situation they make plans and implement the same in very systematic manner. In first one they use the platform of internet to make money by sending email purportedly sent to a selected recipient but actually sent to many, making an offer that would allegedly result in a large payoff for the victim. More recently, scammers have also used fake but plausible-seeming accounts on social networks to make contact with potential victims. The email's subject line often says something like "From the desk of so and so Your assistance is needed", and so on. The

details vary, but the usual story is that a person, often a government or bank employee, knows of a large amount of unclaimed money or gold which he cannot access directly, usually because he has no right to it. Such people, who may be real but impersonated people or fictitious characters played by the con artist, could include, for example, the wife or son of a deposed African leader or dictator who has amassed a stolen fortune, or a bank employee who knows of a terminally ill wealthy person with no relatives or a wealthy foreigner who deposited money in the bank just before dying in a plane crash (leaving no will or known next of kin) Although the vast majority of recipients do not respond to these emails, a very small percentage do, enough to make the fraud worthwhile, as many millions of messages can be sent daily. Once the victim's confidence has been earned, the scammer then introduces a delay or monetary hurdle that prevents the deal from occurring as planned, such as "To transmit the money, we need to bribe a bank official. Could you help us with a loan?" or "For you to be a party to the transaction, you must have holdings at a Nigerian bank of $100,000 or more" or similar. This is the money being stolen from the victim; the victim willingly transfers the money, usually through some irreversible channel such as a wire transfer, and the scammer receives and pockets it. More delays and additional costs are added, always keeping the promise of an imminent large transfer alive, convincing the victim that the money the victim is currently paying is covered several times over by the payoff. The implication that these payments will be used for "white-collar" crime such as bribery, and even that the money they are being promised is being stolen from a government or royal/wealthy family, often prevents the victim from telling others about the "transaction", as it would involve admitting that they intended to be complicit in an international crime. The essential fact in all advance-fee fraud operations is that the promised money transfer to the victim never happens, because the money does not exist. The perpetrators rely on the fact that, by the time the victim realizes this (often only after being confronted by a third party who has noticed the transactions or conversation and recognized the scam), the victim may have sent thousands of dollars of their own money, and sometimes thousands or millions more that has been borrowed or stolen, to the scammer via an untraceable and/or irreversible means such as wire transfer.[13] The scammer disappears, and the victim is left on the hook for the money sent to the scammer. Another technique used in this is called the Romance Scam in this the con artist (posed as an attractive female in more cases) approaches the victim (male victim in most of the cases) on an online dating service, an Instant messenger, or a social networking site. The scammer claims an interest in the victim, and posts pictures of an attractive person. The scammer uses this communication to gain confidence, then asks for money. The con artist may claim to be interested in meeting the victim, but needs cash to book a plane, buy a bus ticket, rent a hotel room, pay for personal-travel costs such as gasoline or a vehicle rental, or to cover other expenses. In other cases, they claim they're trapped in a foreign country and need assistance to return, to escape imprisonment by corrupt local officials, to pay for medical expenses due to an illness contracted abroad, and so on. The scammer may also use the confidence gained by 15 DEC. - 15 FEB. 2014

the romance angle to introduce some variant of the original Nigerian Letter scheme, such as saying they need to get money or valuables out of the country and offer to share the wealth, making the request for help in leaving the country even more attractive to the victim. In a newer version of the scam, the con artist claims to have 'information' about the fidelity of a person's significant other, which they will share for a fee. This information is garnered through social networking sites by using search parameters such as 'In a relationship' or 'Married'. Anonymous emails are first sent to attempt to verify receipt, and then a new web based email account is sent along with directions on how to retrieve the information. In one such case a scam from Malaysia involves a woman alleging to be half American and half Asian with a father who is American but has died. After communication begins the target is immediately asked for money to pay for her sick mother's hospital bills. Also, requests are ERS M M made to help her get back SAC M O ER FR to America. In every case T T E LE L these scammers never have SAMP a webcam so you can't verify that they are the one truly in the picture they have sent, and offers to send a camera to them by postal mail (instead of money to buy it) are met with hostility. Domestic scams often involve meeting someone on an online. The scammer initiates contact with their target who is out of the area and requests money for bus fare. One "woman" scamming had money sent to a generic name like Joseph Hancock alleging she could not collect the money due to losing her international passport. After sending the money the victim is given bad news that they were robbed on the way to the bus stop by two men and the victim feels compelled to send more money. The person never visits their victim and is willing to chat with their victim through a chat client as long as their victim is still willing to send more money. The idea of publishing of this article is to save innocent people from getting conned by these types of rogues they are not in Nigeria but now many are there in India and waiting to hound you, so be careful and believe only in God‌‌

Amboli lies in the Sahayadri Hills of Western India, one of the world's "Eco Hot-Spots" and it therefore abounds in a variety of fairly unique flora and fauna. The hilltop Amboli gives a fine bird's-eye view of the Konkan coast. Colonel Westrop developed Amboli as a hill station after the opening of the Ghat Road from the coastal town of Vengurla, now in southern Maharashtra, to Belgaum.

If you have always thought that Goa is all about the beaches, wine and fun‌ then think again! Of the endless things Goa is renowned for, forts form a vital part. A succession of invasions by the Portuguese, Mughals and Indians has left Goa with a plethora of forts for tourists to cherish. But these grandiose structures not only speak of the past, they demand a fun loving environment too. The pleasure of scaling the heights of a fort in Goa that overlooks the Arabian Sea and experiencing the most breath taking view is only possible if you take out the time to visit these forts. One such important fort is the chapora fort built on the Chapora River. The Chapora fort is located at a distance of just 10 km from Mapusa on the banks of the Chapora River in north Goa.

The most prominent landmark near the fort is the Anjuna beach, which is visited by thousands of tourists throughout the year. Built by king Adil shah of Bijapur, the magnificent Chapora fort stands majestically on the banks of the Chapora River. The Chapora fort holds an important place in the Goan and Portuguese history. Before the fort itself became nothing more than ruins it changed hands through several occasions between the Portuguese and the Marathas. A few scattered Muslim headstones & massive walls is all that is left of this fort. Deserted in the 19th century, although the views from up and down the coast from the weed infested ramparts are still superb. The fort was originally built to drive away plunders and raiders who came to establish their hold in the region. During the Portuguese rule the fort was rebuilt in a grand style with beautiful architecture and antique ware embellishing its interiors and exteriors. The latest addition to be added to the fort was a red bastion made of laterite, which was built by the Portuguese during the 17th century in place of an already existing structure. The fort also had a series of underground tunnels built to help evacuate the residents in case of any emergency. The ruined structure commands a panoramic view of the adjoining vagator, ozran and Anjuna beaches. The top of the fort offers a mystical aura and offers a mesmerizing view of the sun setting behind the shimmering waters. Some of the walls still have canon marks that remind us all of the violent past.

The Game of Law - II Frivolous Proceedings
by Rajesh Ghadge
I
n the last issue we have had an overview about the law structure & formation of in India and also about how the court functions and how the cases are piling on in the Indian courts. In India major reason of increase in litigations especially in the lower courts is mainly due to the financial deceit or motor vehicle related. Banks and financial institutions lend money either as personal loan, vehicle loan or credit cards without any guarantor or surety just by taking the PDCs from the clients. This leads to dishonouring of payments by habitual offenders in turn banks and institutions take a help of law to recover the money. In the case of motor vehicle, the increase in number of accidents and violation of traffic law is rampant in this day and age with more of people getting easy license to drive the vehicles. This also leads to increase the extra burden of courts. Recently government had convened the Lok Adalats in all over India basis to settle the matter pending for long time in the court of law amicably. Lok Adalat is a system of alternative dispute resolution developed in India. It roughly means "People's court". India has had a long history of resolving disputes through the mediation of village elders. The system of Lok Adalats is an improvement and is based on the principles of Mahatma Gandhi. Lok Adalat is a non-adversarial system, whereby mock courts (called Lok Adalats) are held by the State Authority, District Authority, Supreme Court Legal Services Committee, High Court Legal Services Committee, or Taluk Legal Services Committee. They are held periodically for exercising such jurisdiction as they determine. These are usually presided over by retired judges, social activists, or other members of the legal profession. The Lok Adalats can deal with all Civil Cases, Matrimonial Disputes, Land Disputes, Partition/Property Disputes, Labour Disputes etc., and compoundable criminal Cases. It has received a huge response on all India bases, but the result was just the tip of the iceberg. The only people who were tired of the litigations by fighting for long time had participated into it and only the civil, matrimonial, labour, and some compoundable criminal cases have been settled. But still according to the sources the figure was huge around 28 lac cases on national level have been settled amicably. If government keeps experimenting such kind of exercise on regular basis then perhaps major chunk of the litigation will be wiped out from the courts of India, This will bring down the load on our legal system and people will get

justice faster. The law system in India I also becoming expensive day by day and that is also the issue of major concern as not everybody can afford the expensive law system specially if the matters are concerned with the disputes arising out of petty reasons one such example is the case of “Cases that raise eyebrows” (courtesy Hetal Vyas, TNN Sep 17, 2011, 02.40am IST, Bangalore) Soumya, 23, an employee of a software company, went to a beauty salon to trim her eyebrows. The beautician made a mistake — she removed a bunch of hair from one end of her eyebrow. She apologized to Soumya, but the angry client straightaway called up her lawyer friend and asked her to prepare a legal notice. She wanted to move the consumer court against the salon and "teach them a lesson". This is just one example of the kind of cases coming to consumer courts every day. In Soumya's case, her lawyer advised her not to go to court as it would only be a waste of time and the compensation she was likely to get would be far less than what she would be spending on legal expenses. But Sowmya was stubborn and chose to seek compensation in a consumer court for 'product defect' or 'service deficiency'. In 1986, the Centre had conceived the idea of consumer courts as an alternative for consumers to get dedicated and speedy justice instead of going to civil courts, where legal procedures are known to drag on for years together. More and more cases are being filed in consumer courts for two reasons: one, the consumer is aware of his/her rights and wants to teach the manufacturer or service provider a lesson. Two, one doesn't require a lawyer to argue a case in a consumer court. A person who knows the law can get an order from the consumer court. An officer with the State Consumer Forum, on condition of anonymity, said: "Most of the time, senior citizens file frivolous cases for petty reasons. In most cases, the complainant is not granted compensation and ends up paying more on legal expenses. Filing frivolous cases increases the burden on the judiciary." This is just one example of increasing the burden on our law system by filling frivolous cases on the pretext of teaching lessons to the opposite party. There are thousands of such cases are pending in the lower courts of India related to Property, Matrimonial, Petty Accidents, Theft, Cheque bouncing, Consumer disputes & Labour related. The law system will keep getting burdened till the time these types of cases does not decline. Recently The Supreme Court made an example out of Chennai Port Trust (CPT) for what it termed the mindless frittering away of public money through frivolous litigation by public servants insensitive to the rights of citizens and the valuable time of overburdened courts. The CPT had taken 10 years to reject the plea for compassionate employment by the widow of an employee who died in harness even when it had favourably considered similar requests made later. And when the widow won her rights from the single judge bench of the Madras High Court, the CPT carried appeals before the division bench of the HC and then to the Supreme Court. A bench of Justices G S Singhvi, S K Singh and C Nagappan directed the CPT to pay Rs 1 lakh to the widow of the peon "for indulging in frivolous litigation" and directed the public sector undertaking to employ her with a pay scale she would have got in 2005 and revise it to the present level. The court said for the last two decades, there had been a "spurt in frivolous litigation indulged in by public authorities leading to wastage of public money and valuable time of the courts, which could have been used meaningfully". The reason behind such frivolous litigation was mainly because "these officers are not made responsible personally and are not made to pay from their pocket", the bench said. The court asked the CPT to comply with the order in four weeks and file compliance report before the Madras HC in six weeks. (Reference courtesy The Times of India) Expressing concern over the prevailing delay in disposal of civil cases, the Supreme Court has streamlined the procedures to be followed by trial courts as well to curb frivolous litigation. A Bench of Justices Dalveer Bhandari and Deepak Verma, dealing with a civil appeal filed by Ramrameshwari Devi and others, said: “The courts have to

ensure that there is no incentive to uncalled-for litigation. It is a matter of common experience that the court's otherwise scarce and valuable time is consumed or more appropriately wasted in a large number of uncalled-for cases.” Quoting a study, the Bench said: “Ninety per cent of our court time and resources are consumed in attending to uncalled-for litigation, which is created only because our current procedures and practices hold out an incentive to the wrongdoer. Those involved receive less than full justice and there are many more in the country, in fact, a greater number than those involved who suffer injustice because they have little access to justice, in fact, lack of awareness and confidence in the justice system.” Giving an example of the problem, the Bench said: “It is a matter of common knowledge that lakhs of flats and houses are kept locked for years, particularly in big cities, because the owners are not certain that even after the expiry of the lease or licence period, the house, flat or the apartment would be vacated. It takes decades for the final determination of the controversy and wrongdoers are never adequately punished. Pragmatic approach of the courts would partly solve the housing problem.” Writing the judgment, Justice Bhandari said: “The main question which arises for our consideration is whether the prevailing delay in civil litigation can be curbed. The existing system can be drastically changed or improved if the following steps are taken by the trial courts while dealing with the civil trials.” As civil litigation was largely based on documents, it would be the bounden duty and obligation of the trial judge to carefully scrutinise, check and verify the pleadings and documents filed by the parties, the Bench said. The court should resort to discovery and production of documents and interrogatories at the earliest according to the object of the Civil Procedure Code. Imposition of actual, realistic or proper costs and/or ordering prosecution would go a long way in controlling the tendency on the litigants to introduce false pleadings and forged and fabricated documents. Imposition of heavy costs would also control unnecessary adjournments. “In appropriate cases, the courts may consider ordering prosecution; otherwise it may not be possible to maintain the purity and sanctity of judicial proceedings.” The Bench said: “Courts have to be extremely careful in granting ad-interim ex-parte injunction. If injunction has been granted on the basis of false pleadings or forged documents, then the concerned court must impose costs, grant realistic or actual mesne profits and/or order prosecution. This must be done to discourage the dishonest and unscrupulous litigants from abusing the judicial system. In substance, we have to remove the incentive or profit for the wrongdoer.” The Bench said: “No doubt, it would take some time for the courts, litigants and the advocates to follow these steps, but once it is observed across the country, then the prevailing system of adjudication of civil courts is bound to improve.” (Reference courtesy Supreme Court judgements) Looking forward to see that efforts of the Supreme Court alongside the Junior courts in India will surely be able to curb the frivolous cases in Indian court of Law to decrease the excessive burden from the court. : JAI HO : Salman Khan, Tabbu, Suniel Shetty, Danny Denzopa, Daisy Shah, Sana Khan, Mohnish Behl, Mahesh Manjrekar : Sohail Khan : Action : NOT RATED YET
Jai, role is played by none other than Mr. Salman Khan, the Arnold Schwarzenegger of Indian film industry he played the role of an upright common man is fighting a solitary war against corruption and injustice.(as usual demand from Indian viewers) Honest and incorruptible, he has made it his mission to help as many people as he can. His mantra is quite simple - help somebody and then request that person to lend a helping hand to somebody else thus forming an ever growing circle of people helping each other. (this formula seems to be very new in the storyline) In a strange twist of fate, he finds himself pitted against a powerful politician and his vile family. Jai who is an ex army officer, will not shy away from a battle, however bloody it may get and firmly believes that you do not have to wear an uniform to serve your country. As the politician unleashes his violent goons on brave heart Jai, Geeta, Jai's sister, realises the horrific consequences this can have on her brother and the rest of their family. She persuades a reluctant Jai to make peace with the politician. But when this leads to humiliation being heaped on him, Jai loses his cool and declares all out war. It is an unequal war - on side stand the politician with his numerous henchmen and on one side is Jai - alone. But unknown to him, a silent revolution is taking place. The voiceless public, he has helped in the past, is gathering force. It finally has a voice and this voice cannot...will not be silenced. Because Jai Ho is the resounding sound of victory...Jai Ho is the warrior cry of someone determined to win at all cost..thoguh still time is there for this movie to hit the box office but one thing is damn sure that the new twists in the story and image of Salman Khan will surely make this movie a blockbuster. The movie is produced & Directed by Mr. Sohail Khan along with Mr. Sunil Lulla under the reputed banner of Eros International and surely promises lots of entertainment. The music scored by Sajid – Wajid duo. There are lots of promising things are shouldering this movie and full entertainment is assure……releasing in the end of Jan 2014 in the theatre near you………….

Music Review Film Director Composers Singers
Music on Rating
: YAARIYAN : Divya Khosla Kumar : Pritam (Guest Composer), Mithoon, Yo Yo Honey Singh, Arko Pravo Mukerjee : Yo Yo Honey Singh, Benny Dayal, Shefali Alvares, Mohammed Irfan, Gajendra Verma, Neha Kakkar, Shafqat Amanat Ali, Arijit Singh, Monali Thakur, K K, Vishal Dadlani, Tulsi Kumar, Anupam Amod : EROS Music : ****
Indeed a very special film for T-Series' head honcho, Bhushan Kumar, YAARIYAN, marks the debut directorial venture of his beautiful wife, ex actress turned director, the versatile Divya Khosla Kumar. Naturally expectation are high from the host of top music directors like Pritam (guest composer), Mithoon, Yo Yo Honey Singh, Arko Pravo Mukerjee and Anupam Amod to come up with an album that does justice to the consistently high quality melodious and chartbusting music that is synonym with T-Series! YAARIYAN stars fresh young faces and is obviously youth oriented. So let's plug on and hear for ourselves what they have for us! Beach, sun & sand and friends, the perfect setting for an all out youthful, zesty and highly rhythmic celebration/party number, the hip hop ''Sunny Sunny'' rendered superbly by Yo Yo Honey Singh and Neha Kakkar. The buddy bonhomie track will surely catch on like fire. Poignant, melodic and heart touching, the soulful ''Baarish'' sung by Mohammad Irfan and Gajendra Verma is a gem of a number and hats off to Mithoon for composing as well as penning down the number. Yo Yo Honey Singh leads the pack with his super hit rap along with Benny Dayal and Shefali Alvares in the youthful pyjama party song, ''ABCD'', composed by guest composer Pritam that has the potential to become an anthem for all college going students and young gen. The highlight of the track is the easily identifiable and apt lyrics that would be loved by the young gen. A chartbuster in every sense! The mood is blissful as one encounters Arko Pravo Mukerjee's, ''Allah Waariyan'', the sad separation number, longing for the beloved is portrayed effectively through pure unadulterated melody and all Hindustani musical arrangements. Shafqat Amanat Ali sails through the number with ease and elan. ''Meri Maa'' is a novel tribute to mother, soft rock style! And it is unique indeed as the emotional quotient is easily palpable/ascertainable without any high drama and is aided by some lovely lyrics that are so simple yet so very effective. KK sings like a rock star in concert, just perfect! ''Mujhe Ishq Se'' by Tulsi Kumar and Gajendra Verma is almost an unplugged version of ''Baarish'' with minimal music arrangements (lovely piano and guitar) in the background. The album ends with the ''Yaariyan'' mashup by Kiran Kamath, and as is the norm it is a combination or potpourri of all the songs of the album. Summing up, the album of YAARIYAN is a musical delight, the sort one expected from the house of T-Series. All the music directors have done a very good job and have composed songs in keeping with the script and narrative. ''Baarish'', ''Allah Waariyan'' are our picks although ''ABCD'' and ''Sunny Sunny'' are sure shot chartbusters. The music will surely climb the charts and aid first time director Divya Khosla Kumar and her team in ensuring a decent opening when YAARIYAN releases all over on 10th January.
