INTRODUCTION

LOCATION

Upper Racetrack Retreat is located on the southern fringe of Powell County along the western edge of the picturesque Lower Flint Creek Valley, less than a two-hour drive from Missoula, Montana. The property is seasonally accessed via Bowman Road/Racetrack Campground Road, west of Galen, Montana. A short USFS road provides access to the property’s southern side, where a large bench provides an ideal building site overlooking the creek bottom.

GETTING THERE

Butte, Missoula, or Helena airports best serve Upper Racetrack Retreat.

The Bert Mooney Airport is in the Summit Valley of Butte, about 40 miles away. It consists of two runways capable of handling small or large passenger aircrafts and Boeing 757 on a regular frequency. Skywest Airlines, the Delta Connection, serves Butte with non-stop flights to Salt Lake City, Utah. Horizon Air, the Northwest / Alaska Airlines Connection, serves Butte with direct flights to Seattle, Washington.

Approximately 108 miles away, Missoula International Airport offers direct flights to nine major US markets, connecting flights to thousands of cities worldwide. Direct flights include Chicago, Denver, Minneapolis, Salt Lake City, Seattle, Los Angeles, Phoenix, San Francisco, and Las Vegas. Minutemen Aviation caters to private aircraft while Missoula International Airport accommodates United, Delta, Horizon, and Allegiant Airlines.

AREA ATTRACTIONS

The town of Butte is full of rich, historic architecture and is the closest urban area to the property. It has lots of shopping and dining options, a commercial airport, Montana Tech University, St. James Hospital.

The property is located about one hour from the town of Philipsburg, Montana, which has become a destination for outdoor enthusiasts, shoppers, sightseers, fishermen, and hunters. Once a booming mining town, Philipsburg is now home to many shops, including the famous Sweet Palace and Sapphire Gallery, as well as cozy cafes, saloons, comfortable lodging, a great fly shop, and the historic Philipsburg Opera House. Philipsburg is a picture in time and was recently chosen by the National Trust for Historic Preservation as one of America’s Dozen Distinctive Destinations. A quick visit to this bustling small town is truly endearing, giving the visitor a real sense of old west-style hospitality and community.

South of Philipsburg lies the winding Flint Creek Grade, which leads to the year-round outdoor recreational destination of Georgetown Lake. Georgetown Lake is a popular area for boating, jet skiing, fishing, hiking, camping, and windsurfing in the summer, and skiing, snowmobiling, ice-fishing, and hunting in the fall and winter. feet in elevation between the Flint Creek Range to the north and the Anaconda Mountains. The 160,000± acre Anaconda-Pintler Wilderness Area is just south of Georgetown Lake, providing true wilderness opportunities, mountain lakes, small stream fishing, and excellent big game hunting. Just off the shores of Georgetown Lake is the Discovery Basin Ski Area. Discovery offers legitimate big mountain alpine skiing in a small town “mom and pop” style venue and a nice set of Nordic ski trails.

Just about 100 minutes away is the university town of Missoula, Montana. Missoula is the cultural, educational, and recreational epicenter of Western Montana. Dubbed ‘Missoula’ from the Salish Indian word meaning “near the cold, chilling waters,” Missoula lies in a fertile mountain valley setting and is commonly referred to as the ‘Garden City’ due to its prime soils and seasonal lush green landscape. Missoula is home to the University of Montana, hailed by Rolling Stone magazine as the “Most scenic campus in America” and noted by Outside Magazine as “among the top 10 colleges nationally for combining academic quality and outdoor recreation.” Missoula has been honored as “one of the best mountain towns in the nation” by National Geographic Adventure magazine. Forbes magazine named Missoula one of America’s “best small places for business.” The best shopping, dining, and entertainment options are found in Missoula and Butte.

RECREATION

F ly F ishing

Racetrack Creek originates in the Flint Creek Range, and it flows for nearly 23 miles before connecting with the Clark Fork River. The property offers on-site fishing for small to midsized trout; species include brook, brown, rainbow, and cutthroat trout.

This area is home to some of the finest flyfishing destinations in the west, including the Clark Fork River, The Big Hole River, Flint Creek, and the world-famous Rock Creek. These streams offer a combination of cold water and quality features that hold large populations of cutthroats, rainbows, browns, brookies, and the increasingly rare bull trout. The dry fly-fishing opportunities, particularly on the 50 mile stretch of Rock Creek, bring eager fishermen throughout the spring, summer, and fall months. In addition, the incredible Big Hole River is only an hour southerly drive from the property.

Georgetown Lake is a popular summertime fishing destination and one of the best opportunities for ice fishing in Montana. The lake supports good populations of Kokanee salmon, Westslope cutthroat trout, brook trout, and rainbow trout.

There are also numerous opportunities to be had in the mountains near the property. The AnacondaPintler Mountains are within short and easy driving distance, and a multitude of pristine small mountain lakes are just up the road from the property.

This area of Montana is known for its excellent hunting and endless outdoor recreation. The Upper Racetrack Retreat is located on the western edge of the Lower Flint Creek Valley between the John Long Mountains and the Flint Creek Range, amid thousands of acres of easily accessible national forest.

The property is host to a wide variety of wildlife and is inhabited by elk, deer, and moose, translating to excellent big game hunting on and around the property.

The property lies in the following hunting districts: 213 for deer, elk, moose, and mountain lion with black bear falling under Unit 216 and wolf in 210. Hunting for upland birds such as grouse and Merriman turkey are also available during general seasons. Finally, waterfowl hunting can be spectacular as a variety of transient game birds utilize the area on their Pacific Flyway migration.

Georgetown Lake provides excellent opportunities for boating, jet skiing, fishing, hiking, camping, windsurfing, skiing, snowmobiling, and ice-fishing. WATER WATER RIGHTS

Nearly 0.75 miles of Racetrack Creek flows through the property. The creek braids on the property, creating a notable wetland area within the property boundaries.

All appurtenant water rights will transfer. Water rights are available from the office of Fay Ranches upon request.

A water right is the right to use water, both surface and subsurface. In Montana, water rights are the rights to use the water of and not ownership of the water itself. Water rights may not automatically transfer with land.

All water in Montana is property of the state of Montana for the use of the people of Montana. The actual ownership of water rights in Montana may not be known as many water rights are still the subject of a statewide adjudication process. The transfer of water rights is recorded with the State’s Department of Natural Resources and Conservation, and the transfer of any right may or may not warrant that right until the adjudication process is completed.

MINERAL RIGHTS

All mineral rights appurtenant to the property and owned by the Seller will convey to the Buyer at closing. Mineral rights are not guaranteed. It is suggested that the Buyer conduct a mineral search with a title company.

RELATIONSHIPS IN REAL ESTATE

As required by Montana law, a broker or salesperson shall disclose the existence and nature of relevant agency or other relationships to the parties to a real estate transaction. The various relationships and description of duties are as follows:

1. SELLER AGENT

A “Seller Agent” is obligated to the Seller to:

Act solely in the best interests of the seller; Obey promptly and efficiently all lawful instructions of the seller; Disclose all relevant and material information that concerns the real estate transaction and that is known to the seller agent and not known or discoverable by the seller unless the information is subject to confidentiality arising from a prior or existing agency relationship on the part of the seller agent; Safeguard the seller’s confidences; Exercise reasonable care, skill, and diligence in pursuing the seller’s objectives and in complying with the terms established in the listing agreement; Fully account to the seller for any funds or property of the seller that comes into the seller agent’s possession; and Comply with all applicable federal and state laws, rules, and regulations. Montana law permits a real estate agent, after providing written disclosure to a seller and obtaining a seller’s written consent, to represent multiple sellers of property and to list properties for sale that may compete with the seller’s property, without breaching any obligation to the seller.

A “Seller Agent” is obligated to the Buyer to:

2. BUYER AGENT (cont)

A “Buyer Agent” is obligated to the Seller to:

Disclose any adverse material facts that are known to the buyer agent and that concern the ability of the buyer to perform on any purchase offer; Disclose to the seller or the seller agent when the buyer agent has no personal knowledge of the veracity of information regarding adverse material facts that concern the property; Act in good faith with a seller and a seller agent; and Comply with all applicable federal and state laws, rules and regulations.

3. DUAL AGENCY If a seller agent is also representing a buyer, or a buyer agent is also representing a seller with regard to a property, then a dual agency relationship may be established. In a dual agency relationship, the dual agent is equally obligated to both the seller and the buyer. These obligations may prohibit the dual agent from advocating exclusively on behalf of the seller or buyer and may limit the depth and degree of representation that you receive. A broker or a salesperson may not act as a dual agent without the signed, written consent of both the seller and the buyer.

A “Dual Agent” is obligated to a Seller in the same manner as a seller agent and is obligated to a Buyer in the same manner as a buyer agent, except

a dual agent:

Has a duty to disclose to a buyer or seller any adverse material facts that are known to the dual agent regardless of any confidentiality considerations; and May not disclose the following information without the written consent of the person to whom the information is confidential; The fact that the buyer is willing to pay more than the offered purchase price; The fact that the seller is willing to accept less than the purchase price that the seller is asking for the property; Factors motivating either party to buy or sell; and Any information that a party indicates in writing to the dual agent is to be kept confidential.

4. STATUTORY BROKER

A “Statutory Broker” is not the agent of the Buyer or Seller but nevertheless is obligated to them to: Disclose to: i. a buyer or buyer agent any adverse material facts that concern the property and that are known to the statutory broker, except that the statutory broker is not required to inspect the property or verify any statements made by the seller; and ii. a seller or a seller agent any adverse material facts that are known to the statutory broker and that concern the ability of the buyer to perform on any purchase offer; Exercise reasonable care, skill, and diligence in putting together a real estate transaction, and Comply with all applicable federal and state laws, rules and regulations.

5. IN-HOUSE SELLER AGENT DESIGNATE Created when the agency holds both the listing on a property from the seller and a buyer broker agreement with the buyer, an in-house seller agent designate is a broker or salesperson employed by or associated as an independent contractor with a broker and designated by the broker as the exclusive agent for a seller for a designated transaction and who may not be considered to be acting for other than the seller with respect to the designated transaction.

6. IN-HOUSE BUYER AGENT DESIGNATE

Created when the agency holds both the listing on a property from the seller and a buyer broker agreement with the buyer, an in-house buyer agent designate is a broker or salesperson employed by or associated as an independent contractor with a broker and designated by the broker as the exclusive agent for a buyer for a designated transaction and who may not be considered to be acting for other than the buyer with respect to the designated transaction.
