STAYING ON TOP Recently, when talking about the lifespan of an organization, someone remarked: “sometimes getting to the top is easier than staying there.” I agree. Just think about how hard it is for championship teams to repeat; or how challenging it is for incredible corporate brands to maintain a dominant market share. Staying on top requires not only an unending pursuit of excellence, but also a deep desire for relevance. As organizations, if RAR and CVR MLS are to continue to matter to our members, we must continuously learn, grow, respond, retool, reinvent, innovate, even take chances. Staying on top is what this year is all about. In April we’ll celebrate our Top Producers. Our theme for October’s REALTORfest is “Achieving Peak Performance.” Throughout the year, we will offer timely educational programs that keep members abreast of legislative and regulatory changes affecting their businesses. To ensure that the REALTOR® policy agenda comes out on top and that the private property rights of our clients are well protected, our government affairs staff is working hard at both the state and local levels, especially in the City of Richmond where we will be making endorsements in the School Board, City Council, and Mayoral elections. I hope you will join me in contributing to RPAC and making the REALTOR® voice heard at the polls.

Ensuring that the REALTOR® value proposition is “top of mind” for consumers is the goal of this year’s highly innovative marketing campaign which utilizes a series of vintage travel posters to tout the region and promote REALTORS® as the expert local guides. To learn more about the campaign, be sure to read the article on page 6. When it comes to CVR MLS, “staying on top” means keeping abreast of the latest industry initiatives and technology offerings. The number of technology products designed to integrate with the MLS and/ or support the daily work of REALTORS® can be overwhelming. The role of CVR MLS is to vet these products, determine which ones having staying power and great utility, and then bring those products into our market. One product slated for review in 2016 is a new home search app for agents and their clients. And the recent establishment of the Commonwealth MLS Cooperative—a shared MLS platform that includes the listings of three MLSs—is our response to members’ desire to practice across a much wider geography without needing to belong to multiple MLSs. CENTRAL VIRGINIA REGIONAL MLS PROMOTES THE LOCAL REGION AND REALTOR® EXPERTISE WITH A SERIES OF NEW POSTERS As part of its annual REALTOR® brand-strengthening marketing campaign, the Central Virginia Regional Multiple Listing Service has teamed up with local creative agency Punch to develop a series of modernized vintage travel posters, each highlighting a specific attraction or locality of the Richmond or Tri-Cities region. Headlines of these posters encourage the public to establish residency in these regions – mimicking those of retro airline posters, which encouraged regional tourism. The tagline on each poster is: “Realtors® are the expert local guides.” By completion of the campaign in November 2016, nine pieces of original artwork will be released to the public and made available to download free at the campaign website WeAreTheR.com.

Last December, , CVR MLS debuted a special edition holiday poster, containing the headline: “Come Home to Richmond for the Holidays.” The artwork depicted some of the most popular Richmond holiday traditions, including “Gardenfest of Lights” at Lewis Ginter Botanical Gardens, the “Tacky Lights Tour,” “It’s a Wonderful Life” at the Byrd Theater, and “Court End Christmas” at the Valentine. The first round of three posters released to the public in March included illustrations of the region’s strong arts culture, burgeoning craft beer industry, and plentiful outdoor recreational amenities. Three more original posters will be released and made available to the public for free download on June 1, with two new posters and a re-release of the holiday poster completing the series of nine in September.
“We look forward to sharing this beautiful artwork with the public, which highlights the many cultural amenities of our region,” said John Brockwell, 2016 President of the Central Virginia Regional MLS. “Recently, there has been an unprecedented swell of regional pride in the Richmond area. We really want to bolster that sense of pride, while reinforcing the message to consumers that Realtors are their expert local guides,” he added. “We aren’t just selling homes – we’re selling the features and quality of life within the region where the homes are located. We’re often actively involved in civic and government affairs, so we have extensive local knowledge and foresight. That’s an invaluable resource when buying and selling a home,” Brockwell concluded.

BOARD OF DIRECTORS Office and Years in Real Estate: I have been a licensed agent since February of 1992, and started my career as a new homes agent for East West Realty. Currently, I am the managing Broker for Long & Foster Harbour Pointe, South Boston, and Victoria. Designations: Broker and Mom Summary of Experience at RAR: I started on the Programs Committee when I first got into the business, and actually helped plan the first Realtorfest. I have also served—and currently am serving—on the Education Committee.

How did you get involved in real estate? I was a Head Start home visitor for Chesterfield County and had to supplement my income with bartending to make ends meet. While bartending at Brandermill Country Club, one of my regular golfers, who was the sales manager for East West Realty, thought I would be great in Real Estate. He told me to take the class and they would hire me to be a new homes agent for Woodlake. I did, and the rest is history. Favorite Richmond tradition: The Church Hill Irish Festival Favorite vacation spot: My favorite spot would have to be Ocracoke Island. Hobbies/activities outside the office: I love to attend Virginia Tech Football games with my Hokie friends. I also have a fabulous group of girlfriends that get together for book clubs, pool days, wine tours and girls weekends.

DRONE PHOTOGRAPHY IN REAL ESTATE Kate Mahan Professional Development Administrator, RAR
Drones are everywhere – literally: flying over stadiums, crashing into buildings and pools, and delivering packages to homes. Drones have also flown into the news and, at times, controversy. According to the Federal Aviation Administration, two types of Drones or UAS (unmanned aircraft systems) operations are: 1. Model Aircraft – non-commercial, hobby or recreational purposes only. 2. Civil – commercial or business purposes, or compensation.

Effective December 21, 2015, all drone owners must register with the FAA’s Unmanned Aircraft System registry before flying outdoors. People who previously operated their UAS had to be registered by February 19. People who do not register can face severe fines, up to $27,500. This includes any model aircraft weighing more than .55 pounds, but less than 55 pounds. The registration fee is only $5 and registration is valid for three years. Visit www.faa.gov/uas/ for more information. Use of drone photography to promote the sale of real estate falls under the commercial category of UAS operation. What that means for real estate agents is that registering a commercial drone is a little more complicated than registering a model aircraft. Commercial registration requires completion of a Section 333 waiver from the FAA, accompanied by twenty hours of training, to learn how to fly. Section 333 exemption comes with a long list of rules and requirements. Currently, the FAA is receiving such a high volume of Section 333 petitions that the process is experiencing delays.

Several companies have begun to offer services to help applicants through the Section 333 exemption filing process. Such services may cost anywhere from $300 – $1500. “The hi-def and high resolution motion and video give buyers the feeling of being there.” – Robert Hager, Fathom Realty Realtors® not wanting to invest time and money in a commercial UAS can utilize the services of professional photographers who have already completed the registration process. Most Realtors® recognize the value of using drone photography when listing a home. Drone photography gives buyers a full visual of the entire home and the surrounding land and features. “The first perception of the high quality photos is what gets buyers through the door,” says Rob Burnham, a professional photographer who has been offering drone photography to real estate agents for over a year. Burnham acknowledges that the FAA regulations have an upside and a downside. The upside is safety and accountability for drone operators. The downside is the somewhat tedious registration process, including obtaining a pilot’s license and having to file flight plans. Prices for professional drone photographs average around $150-$175 per session. Robert Hager, of Fathom Realty in Richmond, regularly uses drones for his listings. “The hi-def and high resolution motion and video give buyers the feeling of being there,” says Hager. For Hager and many Central Virginia Realtors®, drones are another tool in the toolbox to promote and sell homes. “Using drone photography impresses sellers and excites buyers.” Jill Eades, owner and principal broker of More Choice Properties in Glen Allen, finds the aerial photography especially helpful for her rural buyers. “I tell them they can use the Google Earth or map option on listings, but the aerials catch their attention and they usually see something quickly they are looking for – for example, a horse barn, pond, open pasture, etc.”

Does the FAA have the authority to require registration of UAS used by modelers and hobbyists? Yes. By statute all aircraft are required to register. Congress has defined “aircraft” to include UAS, regardless of whether they are operated by modelers and hobbyists.
What is the penalty for failing to register? The FAA states that failure to register an aircraft may result in regulatory and criminal sanctions. The FAA may assess civil penalties up to $27,500. Criminal penalties include fines of up to $250,000 and/or imprisonment for up to three years.
Will an operator be required to have proof of registration while operating the UAS? Yes. You will be required to have your FAA registration certificate in your possession when operating your unmanned aircraft.
Why do I need to register? Federal law requires aircraft registration. Registration helps the FAA ensure safety – for you, others on the ground, and manned aircraft. UAS pose new security and privacy challenges, and must be traceable in the event of an incident. It will also help enable the return of your UAS, should it be lost.
Where can I find information about operating my UAS safely? You can find safety and operating guidance at faa.gov/uas/model_aircraft. The unmanned aircraft systems website contains important safety guidance, as well as other facts and information.
Who is required to register on the new online UAS registration website? Only individual recreational or hobby users who meet U.S. citizenship requirements are able to register their unmanned aircraft using this new streamlined web-based process. This new, faster and easier system will be available for other UAS owners soon.
If I’m just flying it for fun in my yard, do I have to register it? Yes, if the UAS weight is within the stated weights for registration.
Does the requirement apply to UAS that I owned and operated before the registration process existed? Yes. Owners who purchased their UAS prior to Dec. 21, 2015 will have 60 days to register.
Is there a minimum age requirement? Yes. You must be 13 years of age or older before you are permitted to register an unmanned aircraft. If the owner is less than 13 years of age, then a person who is at least 13 years of age must register the unmanned aircraft.
If I own multiple drones, do I have to register them all? No. You may register once and apply the same registration number to all your UAS.

DEMYSTIFYING THE RPAC ENDORSEMENT PROCESS Jo Gehlbach, Government Affairs Coordinator, RAR
When fundraising for the Richmond REALTORS® Political Action Committee (RPAC), staff and RPAC supporters often hear the same concern from those politely declining to give: “RPAC only endorses Republicans” or “RPAC only endorses Democrats,” based on the potential donor’s political affiliation. This couldn’t be further from the truth, and here’s why: Candidate endorsement decisions are ultimately made by the RPAC Trustees. The Trustees are an intentionally bi-partisan group consisting of nine RAR members. The Richmond RPAC Trustees make endorsements in local races at the jurisdictional level (Board of Supervisors and City Council) and at the state level for House of Delegates and State Senate districts that fall within RAR’s territory. At the beginning of each election cycle – which is every year in Virginia – candidates for the offices that are on the ballot in November are invited to submit responses to a questionnaire and to come in for an interview with the Trustees. Both the questionnaire and the questions asked during the interview focus solely

on the real estate industry. Candidates must submit a questionnaire and participate in an interview to be eligible for RPAC’s endorsement. Following the interview, the Trustees participate in a robust discussion about each candidate’s policy positions, past experience, and electability. Once an endorsement decision has been made, the Trustees decide the level of financial support RPAC should provide. Depending on the race, this can range from $250 to $1000. That said, the Trustees can also decide to withhold an endorsement, if none of the candidates’ positions on real estate matters are deemed satisfactory.

It takes four years for the entire Virginia election cycle to come full circle. In other words, we re-elect the same offices every four years. Let’s consider the 2015 election cycle, where all of the members of the Virginia Senate and House of Delegates were on the ballot. A total of 14 House and 6 Senate seats fall into RAR’s territory. Out of those 20 seats, 14 (70%) of them are currently held by Republicans and 6 by Democrats (30%). RPAC’s campaign contributions almost perfectly mirror those proportions. In 2015, Richmond RPAC contributed 26% of its total funds set aside for state races to Democrats and 74% to Republicans. The 8% discrepancy that leans towards Republican members can be explained by two simple facts: the Republican majority in both chambers and the competitiveness of each district.

Because the Republicans hold the majority in the House and Senate, they hold positions of power on key committees that REALTOR® bills pass through. For example, Delegate Chris Peace (R) is Vice Chair of the General Laws Committee. All but one of our house bills passed through that committee during the 2016 General Assembly Session. RPAC plays a key role here by helping to forge relationships between RAR’s government affairs staff and the General Assembly member and their staff. That way, when a bill that affects the real estate industry makes it onto a Senator or Delegate’s desk, RAR staff is only a phone call or email away to answer questions or concerns regarding the legislation. When we look at the party preferences of the constituents in each of the twenty House and Senate Districts, only one is truly competitive: Senate District 10. In 19 of the 20 districts, the eventual winner of the seat was either unopposed or won by a margin of more than 17 percentage points – not what any political scientist would call a close contest. In fact, in all the districts but the 10th Senate, the opposing party won no more than one out of seven of the last statewide races, when vote tallies are confined to that particular district. For example, in House District 69 (currently held by Del. Betsy Carr, a Democrat), a statewide Republican candidate has never received a majority of the votes in the last seven statewide races. The point here is that even if all of these contests were challenged, only the 10th Senate District would be competitive, and a Republican will win the election in 13 of the 19 districts – if for no other reason than the fact that a Democratic candidate simply isn’t viable, given the constituent make up. This is part of the reason why Republicans receive a higher proportion of funding from the REALTOR® Political Action Committee.

In conclusion, RPAC is not only a non-partisan political action committee that gives to candidates of both parties, but the endorsement process is intentionally set up to be unbiased, fair, and equal. The RPAC Trustees are composed of RAR members from both sides of the aisle and make endorsement decisions based on the candidate’s policy positions on real estate matters, their past experience, and their electability. Campaign contributions are based on the make-up of a particular district, as well as the candidates’ seniority and influence on policy decisions that affect the real estate industry.
