ACHIEVING PEAK PERFORMANCE “Achieving Peak Performance”—it’s the theme of this year’s REALTORfest, which will be here (October 18!) before we know it. I’ve been reflecting a good bit on this theme, and it strikes me that—with the exception of athletics—it can be difficult to define “peak performance,” to know if and when we have achieved it. But there are moments in our professional lives when we know we’ve nailed it, just as surely as a gymnast nails her dismount and earns a 10. A detailed, highly polished listing presentation that wows a seller; keeping a difficult deal from going south during the inspection phase; handing the keys to first-time home buyers, who are beaming with pride at their accomplishment—all are examples of what “peak performance” might look like for a REALTOR®.

Now, a cynic might suggest that these are life’s little experiences and there is nothing exceptional about them. But I beg to differ. Because a life lived at the peak is only accomplished through the daily disciplines of humility and hard work. At its most basic level, humility is the acknowledgment that we do not live life in isolation; we need the help of others, if we are to accomplish most anything— certainly great things. And as far as hard work is concerned, I’ve always viewed it as the outward expression of how much we care—about our families, our vocation, our civic endeavors.

We make each decision based on the best interests of our members, the real estate professionals we are privileged to serve.

We welcome constructive feedback and see it as an opportunity for growth and innovation.

We approach the future with a positive attitude, excited about the possibilities for progress and service that it presents.

We are a credible, reliable, and consistent partner in collaborative efforts to enhance our community’s collective quality of life.

Bob Holsworth is one of the leading political analysts in Virginia. He has appeared on almost all the major American television networks and on the BBC. Bob is also the regular political analyst for WTVR in Richmond. The author of five books and numerous articles on public policy and American politics, he was the Founding Director of both the Center for Public Policy and the Wilder School of Government and Public Affairs at VCU. Lee Downey, “Richmond Renaissance”

How did you get involved in real estate? I’ve wanted to go into real estate since I was a kid. My mom and stepdad are the owners of ERA Woody Hogg & Associates, so I’ve grown up around it pretty much all of my life.

Lee Downey is the Deputy Chief Administrative Officer for Economic Development & Planning for the City of Richmond. In this position, he oversees the departments of Economic and Community Development, Planning and Development Review, and the Office of Minority Business Development. Prior to his appointment to this position, Lee was Director of the newly formed Economic and Community Development Department. The agency was conceived to facilitate a comprehensive approach to economic growth, combining both traditional economic development and neighborhood revitalization. Lee holds a Bachelor of City Planning degree and a Masters of Planning degree from the University of Virginia.

Dr. Dana Tyrone Bedden “State of the City Schools” Address On January 13, 2014, Dr. Bedden was appointed as superintendent of Richmond Public Schools (RPS). In his first year, he reorganized the district’s central office and assembled a talented team of senior leaders to serve the citizens of Richmond. Currently, the team is working to establish a multiyear academic improvement plan as well as a facilities modernization plan. Efforts are underway to implement a systems-thinking approach and performance metrics to guide improvements within the school district.

Thomas Kranz, “State of the City Schools” Address Tommy Kranz has served as the district’s Assistant Superintendent of Support Services since May 12, 2014. Kranz, who is a certified public accountant, also holds a Bachelor of Science degree in Accounting from the University of New Orleans. Previously, he served as the Chief Financial Officer at Hamilton County Schools in Chattanooga, TN, and as the Chief of Educational Support Services at Okaloosa County Schools in Fort Walton Beach, FL.

In May of this year, the 2016 RAR Leadership Development Academy completed a unique and diverse 6-month leadership program. Participation in the LDA program is limited to 15 individuals who are selected based upon their applications, previous business experience, community engagement, and involvement in association activities. This year’s program included:

Working with professional leadership coaches, program participants engaged in group and one-on-one sessions, designed to identify and develop each participant’s individual leadership style.

RAR served as a host site for the 2016 Leadercast Simulcast—the world’s largest one-day annual leadership event. With other attendees from around the globe, the participants heard from nationally recognized speakers, who shared their unique leadership perspectives and discussed how visionary leaders have the ability to see a preferred future, operate in the present, and utilize the resources around them to create a clear path to a new destination.

In the mayoral race, what was once an extraordinarily crowded field has dwindled down to eight. The first fundraising numbers came out on June 1st and consequently, the field is down to about five viable candidates as I file this report in early July; City Councilman Jon Baliles (1st District); former Executive Director of Venture Richmond, Jack Berry; former Delegate Joe Morrissey (D-74th); City Council President Michelle Mosby (9th District); and former Secretary of the Commonwealth, Levar Stoney. The fairly crowded field makes for an interesting horserace in and of itself; but gets really complicated when we take the City’s unique runoff voting system into account. In order to win the mayoral race outright, one candidate needs to win the majority of votes in five of the nine voter districts. If no candidate accomplishes this, the two candidates with the most votes face off in a runoff election, and must again attempt to win five of the nine districts. The winner of that contest then becomes the mayor.

RICHMOND’S 2016 ELECTIONS Jo Gehlbach, Government Affairs Coordinator, Richmond Association of REALTORS®

It would be a huge mistake to underestimate the significance of the elections taking place in the City of Richmond this year. While the national showdown between Donald Trump and Hillary Clinton snags headlines, the reality is that Richmond’s elections will have a much larger and immediate effect on you and your business. Richmond residents will be electing a new mayor, a new City Council, and a new School Board. Whoever is elected determines the direction of City Hall and Richmond Public Schools for at least the next four years, which in turn determines the direction the Richmond metro region heads. So goes the City, so goes the region.

On the City Council side of the ledger, four of the nine members are either running for higher office or stepping down. This means City Council will have several fresh faces in January. The Richmond REALTORS® Political Action Committee (RPAC) held interviews with candidates for the open seats, as well as in the 5th District at the end of June (Councilman Parker Agelasto had not been previously endorsed by RPAC). The RPAC Trustees are made of up of your colleagues, and they make their endorsement decisions after reviewing a questionnaire submitted by the candidate and conducting a thorough interview. Endorsements are based solely on real estate related issues and are entirely non-partisan. And finally, on the School Board, only four of the current members are running for reelection. As a result, the majority of the Board will be new in January, regardless of election outcomes. Richmond Public Schools are facing significant challenges related to school facilities. The next School Board must make

difficult decisions to remedy crumbling buildings and under capacity classrooms. It is no secret that school quality has a direct impact on the real estate market and your business; therefore, the RPAC Trustees will be endorsing candidates in all nine School Board races. Your clients do not buy a house until they have first bought into the community’s quality of life. This fall’s City elections will have a tremendous impact on communities throughout the Richmond region, so all of us have a stake in the outcomes. If you cannot vote in Richmond, you can still volunteer/contribute and encourage friends and family who live in the City to vote. 2016 GENERAL ASSEMBLY RECAP Jo Gehlbach, Government Affairs Coordinator, Richmond Association of REALTORS® Three REALTOR® proposed bills passed through the General Assembly this year, and two of those become effective on July 1, 2016. The third bill, pertaining to the licensure of home inspectors, will take effect on July 1, 2017. HB 684

HB 741

House Bill 684 pertains to the Condominium and Property Owners’ Association Acts, and makes the following changes regarding the rental of a privately owned unit: 1.

Associations can no longer prohibit the owner of a unit from renting it or evict the owner’s tenant; however, if an association’s governing documents include a rental cap, this bill does not override that.

2.

Associations may not charge any fees in excess of $50 or charge any kind of deposit, security or otherwise.

3.

The law requires the association to recognize the owner authorized agent, without needing the power of attorney, as long as the agent is licensed by the Real Estate Board.

4.

The law conforms the Property Owners’ Association Act and the Condominium Owners’ Association Acts, as they relate to the provision of electronic disclosure documents and the charges associated to those documents.

5.

HB 684 sets out specific definitions of delivery, receipt of delivery, and authorized agent in order to eliminate any confusion regarding the disclosure packet delivery.

House Bill 567 deals with the Real Estate Board and agency law: 1.

This bill authorizes the Real Estate Board to grant exemptions, waive, or reduce the number of continuing education classes, in cases of certified illness or undue hardship.

2.

As it relates to the agency statute, the bill clarifies that a written brokerage agreement is not required before showing a residential property to potential buyers or tenants, but must be signed before conversations of substance regarding a property take place.

3.

On the commercial side, it removes the brokerage disclosure requirement entirely.

House Bill 741 and its Senate counterpart, SB 509, require all home inspectors to be licensed by the state. Currently, home inspectors are certified on a voluntary basis. Again, this bill does not take effect until July 1, 2017.
