Our last issue was incredibly difficult to produce as the person trusted with final design and layout just dropped the ball and disappeared. Not professional by any means but the show must go on, and it did. We (Giovanni & Christian Lunardi and I) spend some serious time discussing where the magazine is going. At times it is difficult to incorporate these ideas with individuals who don’t want to integrate themselves into our inner circle. This issue is the beginning of REAL’s seventh year and the 48th issue that Giovanni shot the cover story photography and Christian designed the story’s layout. This issue also marks another milestone: This issue was entirely designed and laid out by Christian Lunardi. Coming to this point took time. Christian has a great eye for detail and I enjoy our “what ifs” in front of his dual 27 inch monitors. Why don’t we try red? What if we altered this page’s layout? Let’s change the border from black to rich black. Can we make this home more visibly interesting? That photo looks dark and needs pushed. Our back and forth volleys will never actually end. And that’s a good thing. We now have a designer that cares about REAL as much as I do. And our sponsors and you the readers will benefit from it.

Fashion Color Report This fall colors will transcend time and place with a diverse color palette. They take us on an adventure to various vantage points from past and present. You will see untypical colors – more reflective of the imagination and ingenuity, which makes for an artful collection of colors not bound by the usual hues for fall. There is a feminine mystique that is reflected throughout the fall color pallet, inspired by the increasing need for women to create an individual imprint.
Let’s raise our glass to one of my favorite fall colors Sangria, an exotic red that evokes a sense of faraway destinations. Also look for Aurora Red, a more sophisticated shade that adds verve & spark.

These reds are followed by two extremes of the purple family that intrigue the eye and inspire the imagination. Mauve Mist, a romantic and elegant purple shade, reminds us of the deco era and stimulates a sense of feminity and empowerment while Radiant Orchid, a captivating and adaptable shade, enchants the complete spectrum. It is recommended that you pair with Cypress, a majestic and powerful green. Indicative of its name the shade has towering presence and serves as a stunning perennial. Another color you’ll want to wear this fall is Bright Cobalt. With its slightly green undertone it offers a subtle twist on the traditional cobalt blue, which unifies this season’s blues. Likewise Royal Blue, which is both evocative and dignified, provides more complexity and excitement than versatility. Try pairing Bright Cobalt with Sangria and Cypress, or Royal Blue with Mauve Mist and Aluminum, a futuristic stainless steel shade that serves as a complex neutral. Let’s not forget to include Cognac in your fall color palette, whose name alone leads to glamourous illusions. This classy and cultured brown takes a typical

autumnal color to a sumptuous realm, making the shade unexpectedly ideal for evening wear. Adding a ray of sunlight and warmth this fall is optimistic Misted Yellow. fixture within the communities of Sarasota and Manatee Counties, Purmort & Martin Insurance Agency is in the business of providing individuals and independent business owners with the information and professional consultation they require to protect their assets. A native of Sarasota, Jamie Purmort is a fourth-generation insurance professional. While he grew up in the business, he didn’t launch his career after earning a Political Science degree from Lenoir Rhyne College. Instead, he served his country in the United States Marine Corps. When his active duty ended, Jamie accepted his father’s suggestion that he leverage his talents and experience in the insurance industry. There was an immediate connection. “I saw that I had the opportunity to help others, to protect them and to assist them in making the decisions that would best position them for ongoing success,” he recalls. “I was hooked.” In 2003 Jamie was deployed to Iraq and served as a part of Operation Iraqi Freedom. Upon his return in 2004, he and professional partner Russ Bobbitt acquired the agency. Russ Bobbitt’s insurance career spans
23 years in the Sarasota market. Upon his graduation from the University of South Florida, Russ spent five years as a claims adjuster at RISCORP, a Sarasota based Worker’s Compensation carrier. While at RISCORP, he handled selfinsured accounts for some of the largest public and private employers in Florida. He left the carrier side of insurance in 1997, when he became an Agent for Purmort, Martin, and Mercier Insurance Agency. In 2004, he became a partner in Purmort & Martin Insurance Agency. Russ has been a Florida licensed property and casualty agent since 1996 and also holds licenses in life, health, and surplus lines. In addition to his licenses, Russ also earned the advanced designations of Accredited Advisor of Insurance (AAI), Certified Worker’s Compensation Advisor (CWCA), and the Construction Risk Insurance Specialist (CRIS) designation. Russ has served on a number of boards in the area and is wrapping up his Chairmanship of the Gulf Coast Builders Exchange (GCBX), in February. While Purmort & Martin established itself early on as a solid insurance resource, the agency has become increasingly known as a business built upon the unique wants and needs of its discerning clientele. “Our ability to tailor our services to high-net worth individuals has set us apart in our industry,” remarks Jamie. “We recognized that this was an underserved market, and have evolved to provide a concierge level of care to our clientele.”

The Bagni di Lucca Art Festival in Ponte a Serraglio, Italy is born for the love of art. It creates a haven for artists to fully express themselves through the making, exhibiting or performing of their work to the enrichment of the local community and a wider audience. A revival of the former glory of Bagni di Lucca featured Pavel Kapic and Alyssia Lazin, seasonal Sarasota residents. Kapic and Lazin, husband and wife, combined their art as a painter and a photographer to create a body of work titled Confluence. The work embodies an interdisciplinary approach that shifts the traditional boundaries. Lazin’s photographs, printed on watercolor paper, are the inspiration and the initial imagery for Kapic’s mixed media painting. The result is Confluence - converging, meeting, flowing together.

AN EAR FOR MUSIC Medicine Raised in the center city of Philadelphia, Herbert Silverstein was the number one son in the family. His father, a Neuro-Psychiatrist and Professor at Temple University, had big ideas for the boy. On Herb’s tenth birthday, his father informed him that he was going to be a doctor. Herb recalls, “In those days you did what you were told. And back then doctors were revered.” That being said, Herb’s future was slated to become a Neuro-Surgeon because, as his father had shared, “A surgeon can do more than a neurologist.” During his internship, Herb discovered that he really didn’t like the role. It was depressing. He was frustrated. “The tools and procedures then were nowhere near the same that we have today.” When Herb first saw an operating microscope, his future changed. Keeping within the realm of becoming a doctor, he decided to specialize in Otolaryngology, the science of the ear, nose and throat (ENT). The field was exciting. The operating microscope was just beginning, and its use opened so many more doors. Research was hot and one of Herb’s greatest passions.

fter graduating from Temple Medical School, Herb went to Harvard University to continue his training, ultimately spending eight years in Boston, teaching, doing research and clinical Otology (ear surgery). A stint in the Army landed him in Hawaii whetting his appetite for the tropical climate. After Harvard, Herb got a job at the University of Pennsylvania as assistant professor where he taught, had a clinical practice and ran a research lab. Twelve- hour days lead to burnout at the early age of thirty-eight. He decided to retire. He had an already retired cousin on Bird Key. In 1973, Herb packed his old car with his one suitcase and an empty wallet and headed to Sarasota. Retirement lasted only as long as the road trip. Sun, sand and beautiful weather could not stop his innate desire to continue his research and patient care. However, shortly after his arrival, the three ENT docs in town
informed him that he was neither needed nor wanted. Against all odds, he hung a shingle. Herb shares, “I was just having a ball down here. Up north, I had become so frustrated and discouraged dealing with the university inefficiency. Getting anything done was difficult.� Sarasota was to change that. Shortly after starting his ENT practice, he met Neurosurgeon Dr. Horace Norrell. What started as a friendship turned into a serious collaboration and the resulting development of the specialized field of Neurotology (Neurology and Otology). The two produced five annual International Symposiums on the Ear and Skull Base, held in Sarasota. As they say the rest is history. Internationally renowned, the good doctor has written over 245 scientific papers, composed eight books on ear surgery, written

numerous chapters in text books, and developed many innovative surgical instruments and procedures. He also began a Clinical Fellowship, postgraduate program in 1983 which has thus far trained 41 board certified Otolaryngologists in Neurotology, many of whom have gone on to universities around the country. Thanks to his research, beneficial procedures like the Vestibular Neurectomy are used to relieve the vertigo of Meniere’s disease. For those with Otosclerosis, the laser STAMP is used to restore hearing - without the need for a prosthesis. Herb designed a facial nerve monitor that is used during ear surgery to locate and protect that tiny winding nerve. For cases of sudden deafness and Meniere’s disease, he developed the MicroWick™ that delivers essential medication to the inner ear immediately. Herb pioneered minimally invasive ear surgery, the use of endoscopes and the laser in ear surgery. Recently he developed a minimally invasive procedure to help people with Hyperacusis (noise intolerance) tolerate loud sounds. Among his many honors and accolades are the Howard P. House Award for Excellence in Ear Surgery and the Prosper Meniere Society Gold Medal Honor Award. Herb is one of a group of Otologists in America to be elected to the Best Doctors in the U.S.A. repeatedly since 1979. In 2002, he received the prestigious Presidential Citation from the American Academy of Otolaryngology. He served as President of the Otosclerosis Study Group in 2005, and in 2006 received the Award of Merit from the American Otological Society. Locally, March 9th was declared Herbert Silverstein Day by the City of Sarasota. We all have heard of both the Mayo and the Cleveland Clinics The Silverstein Institute carries the same international notoriety in the field of Otology. What started in 1979 as a small practice in a small town has developed into the Silverstein Institute which is comprised of four divisions; Florida Ear & Sinus Center, Medical Hearing Systems, Premier Facial Plastic Surgery and the Ear Research Foundation, housed in a 30,000 square foot facility.

Music Music ran in Herb’s family. His mother played piano and an uncle played violin in the Philadelphia Orchestra. At age five, Herb began taking piano lessons, eventually studying classical music until age 15. That was when the medical profession, along with the persuasion of his father, won out over the artistical musician. Never dissuaded, during the time before college Herb followed his passion and frequented the jazz clubs in Philadelphia and New York. However, while in college Herb eschewed the piano for the drums, and joined a jazz band. After college and ensconced in his medical studies, the twelve- hour work days left no time for music. That love had to wither for his career. Coincidentally, the emergence of rock and roll put jazz into a steady decline. All was not lost. In the 1970’s, Chick Corea and Herbie Hancock introduced Fusion/Jazz. Jazz had returned to the States. Knowing of Herb’s jazz love, one of his sons brought him a record of Chick Corea’s –“Return to Forever”. That is just what Herb did. His musical flame was reignited, and at age forty-eight,
he re-entered the world of music thus beginning his long running affair with Jazz - forever. The entry was slow. He had to start at the beginning with painful piano lessons. Leaning back Herb reflects, “Starting again was tough. I had to re-learn how to read music. It was one note at a time.” Ten years later, Herb recorded his first CD, “For your Ears Only”.w To this day Herb continues to take lessons. Now the master Jazz pianist has recorded 12 CDs, written 58 original songs (48 recorded) and produced 1 concert DVD. His 12th CD, “Monday Morning”, featured an all-star cast: Herb; piano, Marty Morell; drums, Jeff Rupert; tenor sax, Richard Drexler; bass, and LaRue Nickelson; guitar. Ken Franckling of Jazz Notes has rated “Wish You Were Here” from the “Monday Morning” album, one of the 10 best Jazz recordings in 2014. Lucky album 13, untitled and in the works, is slated to contain the unrecorded 10 tracks. And let’s not forget his book, “Jazz Harmony & Improvisation” written with Richard Drexler.

Herb’s passion for Jazz rivals that of the MD. Herb offers, “There is a connection between jazz music and ear surgery. Both are difficult to master. Both are meticulous, require manual dexterity and improvisation. Both are timeconsuming and require lots of patience.” Music is his passion. Life Meeting with Herb one quickly notices one man in love with life. When you remove medicine and music the athlete emerges. Investing in himself keeps the creativity flowing and the body young. A little- known fact is Herb played tournament tennis until his love for jazz displaced it due to time constraints. Scuba diving and underwater photography played a part in his younger years. Now Herb is an avid biker. You’ll see Herb the biker leave the Silverstein Institute for a ride most days across the Ringling Bridge. Additionally, Herb rides the Legacy Trail several times a week. You’ll also find Herb on the elliptical machine every day and hitting the weights three times a week. Add in some swimming and you have one fit individual. Herb enjoys travels out west where he hikes, climbs and skis. “I love Aspen. It has a lot in common with Sarasota.” Regarding Sarasota he offers, “When I came down to Sarasota in 1973 it was a clean place with great weather, a small town quietness and the ability to do a lot of things.” Herb continues, “Now I see Sarasota like New York, a big city. I disappear to quiet Manasota Key with my buddy, Australian cattle dog Zorro, each weekend to enjoy the beach, bay, water, sunsets, my Piano and let’s not forget my trains.” Herb started building model trains as a young child and continued collecting and building till age 14 or 15 when girls garnered his interest. Now, as an adult, what started out as an 8’ x 10’ oval has grown. The HO gauge model railway
grew to take up the basement of his Manasota Key Home. It overflowed from there into the garage requiring the home to be remodeled to accommodate the railway. With his wife Beth they spent 25 years building a large layout which can be seen on You Tube as the “B and H Railway”. “When I was young, building trains and train layouts, I knew I would become a surgeon. I was always doing intricate things with my hands and so continue to this day. Maybe we need to add conductor to his list of credentials. “All Aboard!”

Does Title Insurance Really Protect a Property Owner from Zoning Issues? By William Henry, PhD
T
itle Insurance is a policy to protect and/or indemnify against loss or damage resulting from defects in the title and deed to the property. What does Title insurance cover? The basic title insurance policy that is not “overly endorsed” includes the following: 1) Representation as to the actual owners of the property, 2) Representation that the property is free of encumbrances, i.e. other mortgage liens, mechanics liens, and potential claims that have not been recorded, and 3) Representation that there is access to the property that will allow the current use to continue in operation. Potential purchasers of property in Florida are often mistakenly led to believe that the title insurance purchased warrants that the zoning and land use entitlements in place conform to the existing or intended use. For instance, unbeknownst to the seller and/or his agent, a property zoned multi-family residential may be in the process of undergoing a government initiated land use change. Local planning officials could be planning a change which would affect the entitlements to build additional improvements or to rebuild after a catastrophic fire or storm. These land use ‘updates’ to an approved area comprehensive land use plan are routinely undertaken by local government land planning agencies to change the approved comprehensive long range plan. This was enacted by the State legislature some years ago to prevent urban sprawl and corrupt local officials from giving in to special real state investment interests. More specifically it was enacted to discourage development beyond the ‘urban service area’. In other words government is loathe to pay for sewer and roads into the hinterlands if redevelopment can be incentive-ized closer to the urban core.
States without the sensitive ecology of Florida with extensive coasts and wetlands are less likely to experience this kind of government intervention. Therefore they pose less risk that the zoning code by modified and limit some types of building development. According to some title insurance representatives, there isn’t a week that goes by that a financial institution or potential real estate purchaser doesn’t request that a title insurance policy be underwritten in Florida to provide coverage for zoning conformance. When they are told that the title insurance provider cannot, they often request that an attorney provide an opinion letter as a substitute that the bank and/or investors can look to. Attorneys specializing in providing these letters of conformance are reluctant to do so without charging large fees to offset potential liabilities and charges for professional liability insurance. Thus ‘overly endorsed’ title insurance policies in Florida may include coverage for other potential encumbrances such as, mezzanine loan securitization. This extra endorsement insures that the proceeds from a sale (equity) inure to the benefit of a mezzanine lender. This is tantamount to a second mortgage whose lien is never recovered on the property— but again they will not include zoning conformance insurance. We as planners and land use specialists have been asked on many occasions to write informed professional opinions concerning land use and zoning conformance. These opinions are based upon a number of factors which include not only the current designated land use and designated zoning categories in question, but also covenants and restrictions and the potential for waivers from the approved land use. In short, government staff now has inordinate

authority to recommend that waivers be granted to an applicant in order to facilitate desired projects. Desired development in today’s government oriented mass transit environment could include density bonuses, setback waivers, parking allowances, and other measures to grant ‘relief ’ to potential developers. Opposed to this are often neighborhood interests and other stakeholders who believe that these waivers constitute a threat to neighborhood “cohesiveness”. The zoning battles that ensue in front of elected official governing municipal and county boards are often costly drawn out affairs where both parties really lose. RGA has specialized in conducting research into specific properties that are being transferred. Opinion letters include the above and also some projections of the likelihood of political and neighborhood opposition. As a former unelected public official for over 20 years in Hillsborough County as well as the former Chairman of the Hillsborough County/ City of Tampa Planning Commission, I have been asked to opine on matters that include much of the above. Something Old, Something New … . . . Something Borrowed, Something Blue . . . We are all familiar with this old English rhyme which gives advice to brides, but what does this have to do with real estate? In today’s real estate market, many areas have few homes being offered for sale. As the availability of resale properties tightens we are seeing a surge in interest in newly constructed homes, and I thought it might be useful to examine the pros and cons of older homes versus their new-build cousins. When purchasing a home, a buyer will consider what is important to them. These factors may include: Location Florida is a coastal state, and early settlers took full advantage of premium waterfront settings for their homes to enjoy spectacular views and cooling breezes. Many homes in prime locations were built some time ago, and land for new waterfront construction, or close to town centers and attractions may be limited. Large numbers of newly constructed homes are more commonly located some distance from beaches and other attractions, where land is more readily available at lower prices. Our international buyers often arrive feeling that they wish to buy a home close to the beach, but then reconsider when they see how much more they can get for their money in a newer home which may be a short drive from the beach. Rules or No Rules Much new construction in our state takes place in deed restricted subdivisions, where builders can enjoy some economies of scale. If a buyer wants to have complete freedom over what they
can and cannot do on their property, buying a home in a non-deed restricted area may be a better fit, but they will have fewer new homes to choose from. For international purchasers who wish to rent their vacation property when they are not using it themselves, new construction on the Gulf Coast may not be an option, as most new deed restricted communities do not allow short term rentals. Cost of the Home It is very difficult to make a direct comparison between the purchase price of a new home versus a resale home. Buyers may find that new homes are being built on small lots as our land values increase, and this may be a consideration. Construction costs when building a home from scratch will typically be lower than the costs to modify/improve an existing structure. Ongoing Costs In addition to the purchase price of a home, buyers consider the ongoing costs of that home too. New homes are built to more exacting standards for energy efficiency, and this should result in lower utility bills. More of our new subdivisions use non-potable water for their sprinkler systems and often include this benefit as part of the HOA fees. The benefits of a builder warranty on a newly constructed home should not to be under-estimated. Nothing is more disturbing to a buyer enjoying their newly purchased Florida home than to find themselves having to make major repairs. These unexpected costs can be mitigated by the purchase of a home warranty for the older home, but nothing gives the same peace of mind as an all encompassing builder warranty.

On the other hand, new homes can come with additional ongoing costs too. Many of our new homes attract Community Development District (CDD) fees. These fees can be significant, depending upon the size and location of the home. Something Borrowed? Mortgage rates remain very low, so financing a purchase can be an attractive option. However, lenders may be more “fussy” about the condition of an older home before they agree to grant a mortgage secured upon it. Many builders have partnerships with mortgage companies and may offer preferential terms when a buyer uses one of those companies – always ask the builder representative about financing incentives. Loans for non-Americans are becoming more widely available too, which has boosted the number of homes being sold to overseas buyers. We often work with buyers from other countries who arrive and wish to pay cash for a property. When they do not find their dream home within their cash budget, many of them will take a small mortgage so they can purchase a more expensive home that better meets their expectations. As for something blue, my hope is that purchase of a home will not leave the buyer feeling blue!
