The purpose of this Notice is to inform you that personnel of the Department of Environmental Protection ("DEP") have made observations or otherwise obtained information indicating that a violation of law has occurred at the property located at: LOCATION: Duska Center

Based upon an inspection of your site conducted by the Department of Environmental Protection, Bureau of Materials Management and Compliance Assurance, Water Permitting & Enforcement Division ("Department") on September 8, 2008, it appears that you have: a. Failed to stabilize all areas where construction has been suspended for more than seven days or when final grades are reached within three days, and failed to apply temporary seed on areas which have been inactive for more than 30 days (in accordance with the 2002 CT Guidelines for Soil Erosion and Sediment Control) pursuant to Section 6(b)(6)(C)(i)(l) of the General Permit for the Discharge of Stormwater and Dewatering Wastewaters from Construction Activities, issued October 1, 2002 and reissued October 1, 2007 (the general permit). b. Failed to install structural practices (such as earth dike diversions, drainage swales, sediment traps and basins, etc.) to divert flows away from exposed soils, store flows, and otherwise limit runoff and the discharge of pollutants pursuant to Section 6(b)(6)(C)(i)(2) of the general permit. c. Discharged sediment to the waters of the State without a permit in violation of Section 22a-430 of the Connecticut General Statutes. d. Failed to amend the Stormwater Pollution Control Plan as required by Section 6(b)(4) of the general permit.

Additional Comments
Pursuant to La. and Lb. above, you must install and/or repair the silt fencing along the north side of Hart Street, and along the old route 84 east bound on ramp. Additionally, you must repair the check dams in the rip rap channel, sweep the West Street entrance to Hart Street, stabilize the slope where the storm water outfall daylights on the northern side of Hart Street and take any other measures necessary to prevent sediment from reaching the Eight Mile
