Led by a prancing turkey, nearly 200 runners and walkers in the “Thanks for Giving” 5K circled the neighborhoods around the Middle School of Plainville and raised around half the money needed to reinstate the school’s spring sports program.
“Really proud of our community. That’s the best thing about our community – when there’s a need, people come together,” said Superintendent of Schools Steven LePage, who ran with a No. 1 on his bib, denoting that he was the first person to register for the Saturday, Nov. 9 fundraiser. LePage estimated that the funds generated via the
race will cover around $7,000 of the $12,000 needed to run the spring season at the middle school — which includes track, baseball and softball. “I can pretty much guarantee you we’re going to have spring sports after this event,” the superintendent said, adding that he’ll find See Race, A8
Republicans maintained control of the Town Council, while Democrats won a sizable majority on the Board of Education in last week’s municipal election.
Gnazzo added that six of the seven incoming councilors are incumbents and have experience working together and reaching compromises.
Katherine Pugliese, who received the most votes among Republican council candidates, believes voters responded to the party’s efforts to contain expenses.
“I think we work pretty well across the council. We might have a different plan to get there, but we really are trying to do the best for Plainville,” he said.
“I think the voters approve of the financial plan,” she said. “We have always been fiscally conservative ...”
Democrats secured a 6 to 3 majority on the Board of Education.
Republicans won four seats on the council, to the Democrats’ three. The overall top two vote-getters were Democrats Jesse Gnazzo, with 1,973, and Christopher Wazorko, who received 1,868. Pugliese had 1,831 votes, followed by Democrat Rosemary Morante and Republicans Deborah Tompkins, David Underwood and Ty Cox. “I'm really not a guy with a political agenda — I'm here

Plainville’s Transfer Station will close for the winter Saturday, Dec. 7, at 3 p.m. Questions can be referred to 860-793-0221 ext. 208.
The Memorial Wall is located on the main floor of the Plainville Municipal Center adjacent to the Town Clerk’s Office. Visitors may view the wall during normal business hours.

Veteran BOE member honored Plainville Board of Education member Foster White has earned the Connecticut Association of Boards of Education “Certified Board of Education Member” designation, Superintendent of Schools Steven LePage reports. In order to achieve this designation, White earned the required 20 credits in the areas of board relations, policy, curriculum, school finance, school law, labor relations and board operations. White’s CABE honor was recognized at the Oct. 15 Board of Education. In a congratulatory letter from CABE, it was noted that White’s attendance at numerous CABE /CAPSS Conventions, CABE workshops and programs, and other events, resulted in the accrual of a wide variety of skills, knowledge and abilities, noting that his commitment to public education

Connecticut Domestic Asset Protection Trusts On June 24, 2019, Connecticut enacted HB 7104, adopting the Uniform Trust Act. One important provision of the act was the “Connecticut Qualified Dispositions in Trust Act,” permitting the establishment of self-settled domestic asset protection trusts (DAPTs), which provide spendthrift creditor protection to the settlors. As of the effective date of Jan. 1, 2020, Connecticut will become the 19th state to have DAPT-enabling legislation. The other 18 states are Alaska, Delaware, Hawaii, Indiana, Michigan, Mississippi, Missouri, Nevada, New Hampshire, Ohio, Oklahoma, Rhode Island, South Dakota, Tennessee, Utah, Virginia, West Virginia and Wyoming.

The Connecticut DAPT must have a “qualified trustee,” which is either an individual residing in Connecticut or an entity authorized by Connecticut law to act as a trustee. Qualified trustees must: 1. maintain or arrange for the custody of the property in the trust, 2. maintain records of the trust on an exclusive or nonexclusive basis, 3. prepare or arrange for the preparation of all tax returns, and 4. materially participate in the administration of the trust. The act addresses the consequences if a non-Connecticut court seeks to assert jurisdiction over a Connecticut DAPT or apply the law of a state other than Connecticut. The act provides that if a court declines to apply Connecticut law in determining the effect of a spendthrift provision in a Connecticut DAPT, the trustee must immediately resign and thereafter can transfer the trust property only to another trustee. The only claims of creditors that can be enforced against the assets in a Connecticut DAPT are:

The Connecticut DAPT law is similar to the statutes of the other states that permit DAPTs. Either the owner of property or the holder of general power of appointment can transfer assets to a Connecticut DAPT. The transfer of assets to the Connecticut DAPT must be a “qualified disposition.” To be a qualified disposition, the Connecticut DAPT must be irrevocable; have a “qualified trustee” as one of the trustees; incorporate Connecticut law to govern the validity, construction and administration of the Connecticut DAPT; and have a spendthrift clause.

Spring sports were selected to give the district time to look for cost savings or ways of raising money to fund the programs. Sara Limmer, one of the parents who organized the “Thanks for Giving” race, said the turnout blew away expectations. A cross section of the town came together to support the student-athletes, she said, including players on teams not impacted by the cuts and members of the BOE and Town Council. MSP’s principal, Matthew Guarino, ran in the kid’s fun run in a turkey costume, not letting a single child cross the finish line before him. “Hopefully we all learned a lesson to support what needs to be supported,” Limmer said.

youngsters get through what can be a trying time in life. “You build all those bonds early,” Acey said. “They can last through high school.” MSP track team member Penley Giola, an eighth grader, said it would be “completely horrible” not to compete this spring. “It’s important to me to keep running because my mom just got out of surgery, and she’s already run eight marathons,” she said. “So I’m doing this to support her.” Andrew Sargis, a senior at PHS, said he and his track teammates were concerned that younger students wouldn’t have the same opportunities that they had. This inspired the high school athletes to participate in the “Thanks for Giving” race. “We tried to get a big amount so we could support the middle school,” Sargis said. “I got worried right away that some of the middle schoolers might not do high schools sports, especially track.” LePage said the number of students who participated Saturday shows the strength of the school community; when programs they cherish became threatened, they leapt into action. “I’m really proud to be a superintendent in this town,” he said. “It’s a great community.”
