ACE IRRIGATION AND MFG. CO. ACE/EATON METALS

Ace Irrigation and Mfg. Co. produces quality products for water control. With over 68 years of experience serving agricultural customers, the company offers a wide variety of irrigation parts. In 1981, Ace purchased the corrugated metal pipe division of Ea ton Metals of Omaha and moved it to Kearney, Nebraska. The company has since served various municipalities and public service organizations, providing corrugated metal pipe from 6 inches to 12 feet in diameter for use in water management projects.

STATEMENT OF TRADE RULES & REGULATIONS

Technical and Engineering Information

All such data, as furnished by the company, its employees, or its agents for the consideration of its customers, is based on information from material suppliers and other sources which are believed to be correct. Under no condition does ACE warrant the absolute accuracy of the data. If there is doubt, the user is cautioned to satisfy himself. PRICES AND TRADE DISCOUNTS ARE SUBJECT TO CHANGE WITHOUT NOTICE.

Acceptance of Orders

ACE accepts those orders which it acknowledges in writing to the purchaser subject to Acts of God and man over which the company has no control, and otherwise subject to the terms, conditions and policy regulations set forth herein.

Credit Approval

Necessary before shipment of any order on open accounts. Our Credit Department will not release for shipment any order to a delinquent account. A completed resale certificate must be on file before shipment.

Shipment of Goods

The Company is not liable for delay in shipment occasioned by conditions beyond our control. Unloading is the responsibility of the purchaser. Damages in transit are chargeable to the carrier by the legal owner.

Freight Charges

Current freight charges will apply.

Return of Materials

Subject to written approval of our Sales Service Department beforehand; new, unused, undamaged and resalable merchandise may be returned for credit. No Returns after 90 days unless okayed with the General Manager. Fifteen percent (15%) will be deducted for restocking. Return freight must be prepaid.

Policy Adjustments

Only offers of the company are authorized to make adjustments to claims against the company.

Product Warranty

See our “Standard Warranty.” Our warranty does not cover items manufactured by other companies.

Minimum Charge

A minimum charge of $10.00 will be made on all invoices.

POLICY TERMS AND CONDITIONS OF SALE, WARRANTY OF EQUIPMENT

Prices

All prices are subject to change at any time and all shipments will be invoiced at the price in effect at the time of shipment. Prices are for products distributed by Ace Irrigation’s standard design and materials, there will be no deduction for the omission of any feature. Any request for variations in material or design must be referred to Ace Irrigation for special pricing.

Terms

Cash on delivery, unless otherwise determined at the time the order is placed. Net 30 days. There will be 1% per month service charge on all accounts over 30 days past due.

Warranty

The warranty that is made by Ace Irrigation & Manufacturing Company with the respect of any product is to replace, F.O.B., Ace Irrigation, Kearney Industrial Site, Kearney, Nebraska. Parts must be in the possession of the original purchaser and has been properly used for the purpose sold, provided that Ace Irrigation has been notified immediately upon discovery of any claimed defect and that the defective part shall be returned, freight prepaid, to Ace Irrigation at said company’s request. Ace Irrigation shall not be subject to any other or further liability; no claims for labor or for consequential damages will be allowed; and the buyer shall indemnify and protect Ace Irrigation against loss or damage (other than the cost of replacement or repair as aforesaid), reoperation or repair on any product or part. Ace Irrigation does not accept responsibility for the effect of corrosion, erosion, electrolysis or graphitization upon any product or part. Items not manufactured by warranty of the original manufacturer and Ace Irrigation assumes no additional warranty or implied. No warranty of any type will be extended to pipe which has been subject to suction pressures.

Taxes

The dealer shall reimburse Ace Irrigation for any sales, use, occupation, excise or similar taxes arising out of the sale upon receipt of Ace Irrigation invoices for the amount of the tax, or shall provide Ace Irrigation with a tax exemption certificate to the appropriate tax authorities.

Return of Equipment

No equipment shall be returned without written authorization and shipping instructions first having been obtained from Ace Irrigation. Any items returned must be returned freight prepaid, and will be subject to 15% restocking charge. The return ticket must show the invoice number and date on which each item was purchased. Items of special manufacture are not returnable.

Special Offers

Fittings of special shapes and sizes can be manufactured to customer ’s specifications by contacting our sales department for price and delivery information. Special order items may only be canceled prior to the start of production. We reserve the right to refuse return of special order items. Returned items will be subject to a restocking fee.

Cancellation

No orders may be cancelled by the dealer except upon written notice to Ace Irrigation & Manufacturing Company and upon payment to Ace Irrigation of all costs, arising out of, or in connection with the order.

Does Your Soil Easily Corrode Steel Pipe?

You’re not alone. Fortunately, HARCO Fittings provides a number of plastic pipe fittings that are resistant to corrosion.

Z-Pipe, Z-Drop, In-Dive, Out-Dive, Offset...

Aptly named, the Z-Drop is a great replacement for the standard steel pipe that is commonly used to tie in a pivot from an underground mainline. Certain soil conditions are very corrosive to steel, and thus their lifespan is signicantly shortened. A UV resistant HDPE Z-Drop is a perfect fit for these types of installations.

We stock these fittings in our warehouse with a standard 48” centerline, 2”AV/3”PRV outlets on top, and a 2” MIPT drain outlet on the bottom. All sizes are comprised of heavy duty DR11 HDPE.

In the Agriculture Irrigation industry, the steel pipe that connects an underground mainline pipe to a center pivot irrigation system is commonly called a Z-Drop or Z-Pipe. Standard Z-Drops are made of steel pipe but due to corrosive soils the life span of steel pipe can be significantly reduced. We offer a UV resistant HDPE Z-Drop as an alternative. Our HDPE Z-Drops are specifically for agricultural center pivot irrigation systems. Please speak with your local Ag distributor for more information.

The HDPE Z-Drops included in this price list are not designed for golf or commercial applications. For golf or commercial applications, please contact your local irrigation distributor with your specific requirements.

Conditions of Sale

RETURNS: All returned merchandise must have authorization from Harco Fittings LLC. Returned merchandise will only be accepted within one (1) year of the date of invoice. Merchandise must be in new and marketable condition. Freight charges on authorized returns must be prepaid and a restocking charge will be made except for returns resulting from shipping errors on our part or material proven to be defective.

CLAIMS: All claims for damage or shortage in transit shall be handled with the carrier by the consignee.

LIMITED GUARANTEE: Harco Fittings LLC (Seller) guarantees to credit against invoice price or, at its option, to furnish, but not to install, replacement parts of like kind, F.O.B. Seller’s manufacturing plant of origin, any item of its manufacture proved to be defective in material or workmanship within one (1) year from date of shipment provided Buyer (or Purchaser) gives immediate written notice of such alleged defect and, if required, returns defective item to Seller’s Lynchburg, Virginia plant freight prepaid. Items or components not of Seller’s manufacture are not included in the foregoing guarantee but are subject only to any warranty of their respective manufacturers. Seller shall not be liable for the cost of any repairs or work done or materials used by the Buyer because of defective or non-conforming items, unless authorized in writing by Seller. IN NO EVENT SHALL SELLER BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY BREACH OF THIS GUARANTEE unless applicable federal or state law forbids exclusion of incidental or consequential damages.
