President’s Message

I am pleased to present the 167th Annual Report of the Australian Hotels Association – Victorian Branch. As is tradition, each year the preparation of the association’s annual report provides opportunity to assess our performance delivery to members over the past 12 months. The overarching objective of the AHA (Vic) is to effectively contribute to the establishment and maintenance of an economic and social environment that fosters the business success of members and Victorian pubs and hotels generally. We exist to protect and promote the interests of publicans. Following the election of the Daniel Andrews’ Government in November 2014, this year a key task for AHA (Vic) was to reinforce the credentials of our industry to ensure political and economic certainty and stability for our membership. At our annual cocktail function held in February this year we hosted the newly elected Premier of Victoria, Hon Daniel Andrews, key Ministers including Minister Jane Garrett who has responsibility for the hotel industry, as well as a large number of Government MPs. Daniel Andrews has been a great friend of the AHA (Vic) for many years and we were delighted to welcome him back to the

AHA (Vic) offices in his capacity as our new Premier. Hon Matthew Guy, Hon Peter Walsh and a number of their caucus MPs were also present representing the Opposition parties. We took the opportunity to thank them for their ongoing support of the AHA (Vic) and our industry. In regard to other priorities of AHA (Vic), our recent summary of performance 2015 documentation provided to the Executive and Council of the Association highlighted the following priorities: • Effectively responding to the continuing business challenges being faced by members due to the volatility of economic conditions, increasing costs and the variability of overall consumer demand; • Actively pursuing members’ workplace relations-related interests in respect of both venue-based issues resolution and contributing to the AHA National agenda for reform to the Hospitality Industry (General) Award through the four-yearly Fair Work Commission review of Modern Awards; • Working with AHA National and other AHA Branches to position Tourism Accommodation Australia (TAA) as the “one voice” representing accommodation hotel interests to Governments across Australia, and


• Achieving real outcomes for members through successful negotiation with the Coalition State Government up to November 2014 and the Labor State Government for the balance of 2014/15 including: o The continuing implementation of an overall “cultural change” process to address concerns regarding excessive consumption of alcohol and, when required, targeted venuebased interventions rather than the implementation of “one size fits all” venue-based restrictions e.g. “lockouts”, reduced trading hours, restricted liquor sales after midnight etc., as currently being implemented in other Australian jurisdictions; o Notwithstanding the November 2014 change of State Government, continuing to advance the case for the extension of the term of gaming machine entitlements on a bipartisan political basis; o Following an extensive period of advocacy, obtaining an unequivocal advice from the Victorian Commission for Gambling and Liquor Regulation that supply of liquor into on-street drink/dining areas by a General Licensee is enabled through their off premises sale and supply entitlement rather than requiring an additional VCGLR approval;

o Receiving a commitment from the Labor State Government to a period of effective consultation prior to any additional restrictions on smoking impacting on licensed businesses; o In consultation with all stakeholders satisfying the State Government of the need for significant “red-tape” reduction by the State Government in respect of live music on licensed premises, liquor licensing and gaming regulation;

What we have achieved as an association in the past 12 months would not have been possible if it wasn’t for the united front from all concerned. I would like to take this opportunity to express my appreciation to members of the AHA (Vic) Executive and Council for their input. I also take this opportunity to thank our CEO Brian Kearney for his management and leadership of the AHA (Vic) administration team. Cheers,

o Successfully advocating for approval and implementation of Keno jackpot pooling across Victoria and NSW, and o Re-enforcing to the new Labor State Government the need for a range of Government-directed initiatives that will simulate responsible innovation and growth in the licensed hospitality sector.

Chief Executive Officer’s Report

It is an unavoidable truism that “the only constant in life is change”. Victoria’s licensed hospitality industry operators, and in particular publicans and hoteliers, well-know the challenges and opportunities that change brings – change in regulatory schemes & laws, changes in customer expectations & demands, changes in the economic & social environments etc. The pace of change is quickening and the potential and actual “disruption” to tried and true business models is challenging the status quo like never before. The introduction to Australia of Uber (2012) and AirBnb (2012) in particular has driven the rapid emergence of the so-called “sharing economy” in which the sharing of human and physical resources by different people and organisations via digital platforms has become the underlying philosophy of new and often radically different business models. Increasingly the product and service offerings within the “sharing economy” are being adopted by mainstream consumers, often with significant business impacts on the traditional providers of such products and services. In the world of licensed hospitality, innovations such as AirBnb, on-line menu-based meal home-delivery services, on-line gaming and gambling are but the tip of the iceberg as the relentless “sharing economy” seeks out opportunities to add convenience and value to the customer experience. It is difficult, sometimes impossible, to see the “sharing economy” tsunami that will dramatically disrupt your business until it is upon you. Is the “sharing economy” the enemy at the gate or is it a game-changing opportunity to successfully exploit into the future? Businesses utilising “sharing economy” platforms are often able to avoid or disregard the high-cost Government regulatory schemes that control traditional businesses and thereby obtain significant cost and service advantages. AHA through Tourism Accommodation Australia (TAA) is particularly concerned that the explosion in unregulated AirBnb-based accommodation providers is putting guests’ safety at risk, threatening accommodation sector jobs and not contributing to the nation’s tax base.

An increasing number of AirBnb providers are multi-venue corporate property owners who are exploiting and corrupting the peer to peer philosophy. A basic level of regulation of the accommodation property sector is required to protect both the consumers and the overall economy’s interests. The AirBnb and Uber phenomena starkly highlight the community’s thirst for, and responsiveness to, innovation in product offerings and service delivery models. The highly regulated licensed hospitality industry is controlled, if not strait-jacketed, by a raft of laws that constrain rather than enable responsible licensed hospitality businesses. The future of Victoria’s licensed hospitality industry will be driven by innovationinnovation by business operators and innovation by lawmakers. The opportunity to aggressively and responsibly innovate must be available to all publicans and hoteliers. Proper regard must always be had to minimising the misuse and abuse of alcohol, effectively addressing problem gambling, ensuring food safety etc; however there is a balance to be struck. Government law and regulation applying to the licensed hospitality industry must not be solely driven by and focused on

the reckless drinker, problem gambler or the recalcitrant alcohol server or food provider; but rather, whilst providing essential and effective safety nets to protect those at risk of harm to themselves and others, it must actively encourage innovation and growth to the benefit of the overwhelmingly responsible community. The existing onerous and costly regulatory requirements upon licensed hospitality operators are stifling innovation and limiting their capacity to both engage and compete with emerging “sharing economy” based enterprises. Governments should adopt active policies of facilitating responsible innovation and growth within Victoria’s and Australia’s licensed hospitality industry. Following on from the AHA (Vic) 2014-18 Policy Agenda canvassed with both Labor and the Liberal/Nationals Coalition prior to the November 2014 State Election, commitments are now being sought from the Daniel Andrews-led Labor Government to an active policy facilitating responsible innovation and growth within Victoria’s pub and hotel sector. With such commitments to be based upon: • continuing “red tape” reduction, with a resultant reduction in the costs of doing business,

• stimulation of licensed hospitality business activity, • reducing business uncertainty, particularly in regard to sovereign risk, and • promoting investment and employment. It is both pleasing and promising that following engagement and consultation across the first half of 2015, the State Government announced in August 2015 its intentions to: • implement significant reform in the Government’s tourism-related agenda through the creation of Visit Victoria; • review gaming machine arrangements in Victoria to allow the Government to make decisions on the post-2022 arrangements well before the expiry of existing entitlements, and to • review the Liquor Control Reform Act 1998 to ensure that Victoria’s liquor laws are effectively balancing their diverse objectives. The review of these fundamental building blocks of Victoria’s licensed hospitality industry provides a real opportunity to establish a regulatory framework that will drive responsible innovation and growth into the future.

LIQUOR LICENSING Successive Victorian Governments have opted not to follow the “one size fits all” approach of the New South Wales and more recently Queensland Governments in responding to perceived community concerns regarding the consequences of excessive alcohol consumption, particularly after midnight. Rather, in Victoria, targeted law and enforcement directed to perpetrators as well as recalcitrant licensed operators is addressing issues of concern at their source, whilst not unreasonably disrupting responsible licensees and community members in delivering and enjoying the late-night experience.

The 1am curfew applying to the grant of new late night venues in Melbourne and inner metropolitan local government areas was recently extended by the Victorian Government for a further 2 year period; however, importantly, increased flexibility has been given to the Victorian Commission for Gambling and Liquor Regulation in granting exemptions from the curfew. This measured and sensible amendment is a real recognition that “one size fits all” interventions are neither effective nor warranted in addressing issues of concern. Whilst some vocal lobbyists within the health and welfare sector are increasingly stridently arguing that industry-based organisations such as AHA (Vic) should be

excluded from Government alcohol policy development forums, such narrow and self-serving attitudes are being rejected by the Government on the basis that consultation and engagement with all stakeholders is essential if the law is to be sound, effective and pragmatic. Minister for Liquor and Gaming, the Hon Jane Garrett MP, has moved quickly since the election of the Daniel Andrewsled Labor Government to give effect to policy commitments regarding the structure and operations of the VCGLR. We welcome newly appointed Chair, Dr Bruce Cohen and congratulate Ms Catherine Myers on her confirmation as Chief Executive Officer of the VCGLR.


SUCCESSIVE VICTORIAN GOVERNMENTS HAVE OPTED NOT TO FOLLOW THE “ONE SIZE FITS ALL” APPROACH OF THE NEW SOUTH WALES AND MORE RECENTLY QUEENSLAND GOVERNMENTS IN RESPONDING TO PERCEIVED COMMUNITY CONCERNS

GAMING Across 2014/15 AHA (Vic) gaming priorities have been directed to: • working with the Victorian Government on the implementation of State-wide networked voluntary pre-commitment to be fully functional from December 2015; • gaining a commitment from the Andrews’ Government to a review of the current 10 year term of gaming machine entitlements, and • canvassing the Government on the need to facilitate responsible innovation and growth within Victoria’s venue-based gaming sector e.g. implementation of ticket-in/ticket-out technology, increasing existing cash-payout restrictions etc.

o In consultation with all stakeholders satisfying the State Government of the need for significant “red-tape” reduction by the State Government in respect of live music on licensed premises, liquor licensing and gaming regulation;

o Successfully advocating for approval and implementation of Keno jackpot pooling across Victoria and NSW, and

o Re-enforcing to the new Labor State Government the need for a range of Government-directed initiatives that will stimulate responsible innovation and growth in the licensed hospitality sector.

1. Continuing initiatives to deliver outcomes to members’ advantage: A. LIQUOR-RELATED 1 In the face of draconian venue-based interventions impacting on publicans in the CBD Sydney, Kings Cross and regional NSW, and as announced for the implementation in Queensland, AHA (Vic) has maintained a constructive and on-going dialogue with successive Victorian Governments in respect of safety in and around licensed premises and entertainment precincts. Both the previous Coalition State Government and the current Labor State Government have rejected restrictions such as “lock-outs”, reduced trading hours, restrictions on liquor sales etc., other than on highly targeted basis by the VCGLR where warranted as a consequence of prosecution proceedings.


AHA (Vic) Executive Committee

2 In response to amendments to the Liquor-Control Reform Act in September 2014 which subsequently cast doubt on the utilisation of the off-premises sales entitlement of General Licensees to supply liquor into adjacent on-street areas without an additional licensing permission, persistent advocacy resulted in the VCGLR unequivocally confirming the off-premises supply entitlements of General Licensees. 3 Following the release by the Commonwealth Government of its discussion paper on taxation reform, AHA (Vic) in conjunction with AHA National and other Branches has lodged a submission advocating for:

• The maintenance of the existing differential excise in respect of draught beer;

• Provision of an equivalent excise differential in respect of bulk wine and spirits supplied and consumed on-premises, and

• The restoration of reasonable entertainment expenses as a tax deduction and the removal of FBT on staff business meals.

4 Through representation on the Liquor Control Advisory Council, AHA (Vic) has successfully advocated for increased flexibility being available to the VCGLR to grant exemptions from

the 1am curfew applying to affected licensed businesses in CBD and inner metropolitan local government areas. 5 Both the Coalition Opposition and the Labor State Government have continued to reject calls to increase the minimum drinking age to 21 years and to reduce the permissible maximum blood alcohol content for driving to 0.02%

9 Maintaining effective and productive dialogue with Victoria Police Command and at an operational level in order that matters of concern may be identified and addressed in a timely manner e.g. policing at a pub-level, and robberies of gaming venues etc. 10 Working with the VCGLR on the content and delivery of the late Night Management Training Course.

6 Contributing to the State Government’s and the VCGLR’s red-tape reduction initiative, with significant reform achieved in a range of liquor-licensingrelated administrative requirements, including the conduct of underage/ all age events on licensed premises, licence application processing etc.

11 Closely monitoring liquor licensingrelated developments across Australia and overseas to identify any new initiatives and/or interventions by Governments impacting on licensed businesses and/ or the sale of liquor.

7 Through membership of the Ministerial Live Music Taskforce contributing to the State Government’s decision to implement a review by the EPA of sound limitations (SEPP N2) applying to licensed businesses and the adoption of “agent of change” provisions within planning and liquor licensing decisionmaking.

B. GAMING AND GAMBLING-RELATED

8 Consultation with the Minister for Liquor and Gambling Regulation and with the Commissioner and CEO of the VCGLR upon the Minister’s re-prioritisation and increase in the number and frequency of Liquor and gaming compliance inspections in regional Victoria.

1 Continuing to work closely with the Victorian Department of Justice and Intralot Gaming Services to ensure that appropriate and reasonable regard is had to gaming venue interests in the specification and roll-out of the Victorian voluntary pre-commitment system from December 2015, including participation in the Victorian Government Pre-commitment Implementation Industry Advisory Group. 2 Prior to the November 2014 State Election continuing to work with the Inter-departmental Advisory

Committee established by the then Coalition State Government to progress the consideration of the extension of the gaming machine entitlement term, including responding in detail to the Government Issues Paper- “Review of the Gaming Machine Entitlement Term”. From December 2014 discussions with the Labor State Government have commenced and are being progressed regarding the term extension. 3 Continuing to provide best practice VCGLR approved self-exclusion and Responsible Gambling Code services to gaming venues across Victoria. 4 Maintaining close and confidential contact with Victoria Police in their efforts to address armed robberies of gaming venues, including the conduct of seminars for gaming members. 5 Actively responding to the then Coalition State Government’s decision to re-allocate 128 (64 pub/ 64 club) unallocated or forfeited gaming entitlements to Crown Casino, resulting in the pool of entitlements available to pubs and clubs being reduced from 27,500 to 27,372 (13686 pubs/ 13686 clubs). 6 Actively canvassing the State Government to implement gamingrelated initiatives that will promote responsible innovation and growth, including ticket-in/ ticket-out or equivalent technology and an increase in the current $1,000 cheque limit for pay-outs to at least $2,500. 7 Advocating the State Government in regard to the implementation of a regulatory regime related to gaming-related loyalty schemes that responsibly optimises the benefits to venues. 8 Successfully lobbying the State Government to achieve the pooling of Victorian and NSW Keno jackpots. 9 Ensuring appropriate regard is had to PubTAB retail wagering interests in the continuing negotiations between the Victorian Racing Industry and Tabcorp in regard to racing vision into the future.

C. WORKPLACE RELATIONS 1 Continuing to provide high quality venue-based workplace relations issue resolution & claim management services.

2. Membership of Government Boards and Committees and Working Parties relevant to AHA (Vic) interests, including:

D. GENERAL MATTERS 1 Continuing consultation with the Victorian Government in response to the campaign of the health sector to extend smoking restrictions to outdoor drinking and dining areas of licensed businesses. 2 Continuing engagement with the Taxi Services Commission as the Government’s taxi reform agenda is rolled-out to ensure full regard is had to the interests of accommodation hotels and late night venues. 3 Continuing advocacy contributing to State Government’s 2015 Budget decision to increase major event funding and approving the extension of the Melbourne Exhibition and Convention Centre.

5. Provision of a range of services to Victoria’s accommodation hotels through Tourism Accommodation Australia (Victoria), including:

• Conduct of monthly General Managers’ meetings addressing key issues and providing networking opportunities;

• Presentation to General Managers’ meetings by tourism and industry stakeholders e.g. Minister for Tourism, CEO Grand Prix Corp. etc.;

• Conduct of regular “Board Room” meetings with key tourism leaders;

• Lobbying the Victorian Government on issues impacting on accommodation hotels e.g. taxi reform initiative etc.;

deliver increased occupancy to accommodation hotels;

• Conduct of a Melbourne yield seminar, and

• Presentation of the TAA (Vic) State Awards for Excellence.

6. Successful conduct of a range of activities and events AHA (Vic) State Awards for Excellence, TAA (Vic) Accommodation Awards, Annual General Meeting Luncheon, the annual “Melbourne Cup Experience”, Council Christmas Dinner, Ladies Lunches, HotelCare Charity Golf Day, Council Lunches etc.

7. Continuing pursuit of performance and efficiency opportunities within AHA (Vic) administration including:

• Issue of the “Check-In” newsletter providing timely updates and outcomes from General Managers’ meetings;

• Continuing growth in membership and related income;

• Regular corporate briefing seminars to ensure the Corporate Partners are kept ahead of key issues and their implications for the suppliers of products and services to the hotel industry;

• Regular Member E-mails and Bulletins alerting members to issues and opportunities.

Governance Statement

The Australian Hotels Association (Victoria) is a Branch of the industrially registered Australian Hotels Association, subject to the provisions of the Fair Work (Registered Organisations) Act 2009 and consisting of persons who under, and in accordance with, the provisions of the constitution are members of the Association.

The business and affairs of AHA (Vic) are overseen and controlled by the duly elected 83 members Council of the Association. The Council elects an Executive Committee to deal with relevant matters on its behalf, with such Committee reporting back to the Council regularly. Both the Councillors and Executive Committee members are elected for 2-year terms under the supervision of the Australian Electoral Commission. An election was conducted in September/ October 2014. Eight meetings of the Executive Committee and seven meetings of the Council were held in 2014/15. The Executive Committee comprises members of Council elected to the following honorary office bearer positions i.e. President, Vice President (Metropolitan), Vice President (Country), Treasurer, and six (6) other Councillors elected to the Executive Committee. The Constitution provides for an Accommodation Division comprised solely of members whose premises offer a minimum of 24 bedrooms to the public, with the Division entitled to elect 6 members to the Council. Two such members are members of the Executive Committee. The Division operates as Tourism Accommodation Australia (Victoria).

The Australian Hotels and Hospitality Association Incorporated (AHHA Inc.) is an incorporated association pursuant to the Associations Incorporation Reform Act 2012. AHA (Vic) contracts AHHA Inc. to provide membership services to AHA (Vic) members and a range of administrative and support services. AHA (Vic) and AHHA Inc. share common Councillors, Executive Committee members and Chief Executive Officer. Members of AHA (Vic) are also members of AHHA Inc. The respective constitutions of AHA (Vic) and AHHA Inc. require that a meeting of members be held annually (the Annual General Meeting). The purpose of the Annual General Meeting is to:

• receive reports and audited financial statements from the Council in respect of the immediately preceeding year, and

• consider any other business of which notice has been given in accordance with the constitution.

All members are advised of the Annual General Meeting by a notice placed in the member publication “Hotel Today” and are encouraged to attend the meeting.


The Council and Executive Committee aim to ensure that members have input to and are informed of all major issues and developments affecting the pub and hotel sector in Victoria and the Association. Information is communicated to members through:

• An Annual Report, including a copy of the Business Plan for the upcoming year, is distributed to all members;

• Regular Bulletins detailing latest issues are issued to members by e-mail, fax or hard copy;

• “Hotel Today” is distributed to members bi-monthly;

• AHA (Vic)/AHHA Inc. website is regularly updated with news concerning or impacting on members www.ahavic.com.au;

• An extensive range of seminars, training initiatives and member meetings are conducted for members across Victoria, and

• Provision of direct services on workplace relations, legal, liquor licensing, gaming issues etc. to members.

2015 HotelCare Report

HotelCare was established in 1999 as an on-going initiative of AHA (Vic) to raise and distribute funds to worthy charities and organisations and to advance the overall interests of the pub and hotel sector in Victoria.

HotelCare is funded on behalf of all AHA (Vic) members through contributions by members with gaming machines. Since its foundation HotelCare has directly distributed almost $4 million to charitable organisations, and through seed funding of the HotelCare Charity Golf Day facilitated the further distribution of over $2 million to various charities and causes. The HotelCare Golf Day held at Victoria Golf Club in December 2014, with the kind assistance and support of the Victorian

Liquor Industry Golf Club, Victoria Golf Club and our corporate partners, provides funds to HotelCare beyond the contributions of gaming pubs, with 100% of monies raised directed to charities and worthy causes. Within the overall objective of HotelCare to support charitable organisations and to advance the overall interests of pubs and hotels, funds within HotelCare are also utilised to support political parties and current or aspiring members of Parliament who demonstrate a willingness

The 2014 Australian Hotels Association (Vic) State Awards for Excellence was held on Monday 17 November at Atlantic in the Docklands. With more than 1,000 people in attendance, the marquee event attracted hoteliers and their staff, senior government ministers, key industry suppliers and decision makers, as well as our valued commercial partners. All had gathered to celebrate the diversity and quality of hospitality offered by Victoria’s finest pubs and hotels. The Masters of Ceremonies for the night, Hamish McLachlan and Ian Cover, hosted a fun filled night which included

an on-screen live feed from Twitter and Instagram featuring photos and Tweets from our social media savvy guests in the room. The night was finished up with a choice of three after party rooms for guests. A highlight of the evening was the awarding of the 2014 Nikakis Benchmark Award to Paul O’Brien from Red Rock Leisure. Paul was joined on stage by his family for the presentation.

The final awards for the evening were the hotly contested Overall Hotel of the Year, Country and Metropolitan. These were taken out by Steeples in Mornington and Malvern Hotel, Toorak. AHA (Vic) recognises and congratulates all finalists and winners for their ongoing dedication and significant contribution to building Victoria’s renowned reputation for industry excellence
