• Through representation on the Ministerial Liquor Control Advisory Council AHA (Vic) has successfully advocated for: • the rejection by the State Government of whole of population “one-size fits all” late night venue intervention strategies, and • the continuing exemption of general licenced businesses from the Packaged Liquor Code of Conduct applying to packaged liquor licensees; • Both the State Labor Government and the Coalition Opposition have continued to reject calls to increase the legal drinking age to 21 years and to reduce the permissible maximum blood alcohol content for driving to 0.02%; • Continuing to contribute to the State Government’s and the VCGLR red-tape reduction initiative highlighting priority areas in respect of liquor and gaming regulation; • Consultation with the Minister for Gaming and Liquor Regulation regarding her program for the restructure of the VCGLR including appointment of a new Chair and Chief Executive Officer; • Maintaining effective and productive dialogue with Victoria Police Command and at an operational level in order that matters of concern are identified and addressed in a timely manner e.g. policing at a precinct and venue level, robberies at gaming venues etc; • Consultation with the Office of the Minister for Gaming and Liquor Regulation and the Department of Justice on the potential terms of influence and process for the announced review of the Liquor Control Reform Act 1998; • Actively engaging with and participating in licensee forums and related accords across Victoria; • Closely monitoring liquor licensingrelated developments across Australia and overseas to identify new initiatives and/or interventions by Governments impacting on licensed businesses and/or the sale of liquor; • Continuing discussion with the Department of Justice Directorate of Gaming, Racing and Liquor regarding the

definition of “intoxication” within the Liquor Control Reform Act 1998; • Continuing advocacy in conjunction with AHA National and other Branches to the Federal Government directed to: • Maintaining the existing differential excise in respect of draught beer, and • The restoration of reasonable entertainment expenses as a tax deduction and the removal of FBT on staff business meals. (B) GAMING AND GAMBLING - RELATED • AHA (Vic) lodged a detailed submission in response to the State Government’s Consultation Paper on the Review of Gaming Arrangements in Victoria; The

submission proposes the implementation of a minimum 30 year term for post 2022 gaming machine entitlements based on a rational process for the determination of value and price having regard to an extensive range of risk-related factors;

The

submission also seeks an increase in the allocation of gaming machine entitlements to facilitate greenfield developments in emerging residential communities and the linking of the number of gaming entitlements to the Victorian population 18 years of age and above;

The submission was developed through an extensive member consultation process.

Victorian

Government gaming taxation rates remaining at the February 2016 rate, with certainty on such rates and any related levies at current prevailing rates being given for the term of the entitlements;

The

aggregate valuation of the post2022 entitlements to be based on an independent and objective net present value/discounted cash flow methodology;

The

Government committing to a bona fide negotiation on the price to be paid for the entitlements having regard to the valuation per the net present value/ discounted cash flow methodology and market uncertainties not otherwise included in that valuation, including regulatory risk, market behaviours, technological developments, etc;

The

Government adopting a flexible approach to funding options to be available to those acquiring post2022 entitlements, including a term payment arrangement, facilitation of a securitisation-based funding scheme, upfront payments (including appropriate discounts etc) and an option for entitlement holders to opt into a varied taxation regime based on the State’s recovery of the premium payment;

the possibility of independent MPs and anti-gambling MPs having the balance of power. Fresh in the minds of many publicans was the political deal of 2010 between the independent MP for Dennison, Andrew Wilkie and the then Prime Minister Julia Gillard which paved the way for mandatory pre-commitment, or a compulsory patron licensing regime devised by the antigambling lobby. With this backdrop, AHA branches marshalled together in order to make contact with the respective federal party leaders seeking assurances that minority Government’s should not be formed via anti-gambling deals with independent MPs. The key component of our message was gaming regulation is the province of State Governments who have the regulatory expertise to manage their respective jurisdictions. Earlier in the year when questioned in Parliament, Prime Minister Turnbull is recorded in Hansard as follows: “We recognise that the laws governing gambling are of course within the powers of state and territory parliaments who licence


premises and poker machines. That is why the Commonwealth has abolished the national gambling regulator and restored control of gaming machine regulation to the states. They have that jurisdiction clearly and plainly. We are nonetheless very interested in working with industry, state and territory governments and other key stakeholders to ensure that there are implemented practical solutions that will reduce problem gambling.” Further to this, the Minister for Social Services, Hon Alan Tudge is also recorded in Hansard in March this year as follows: “In relation to mandatory pre commitments, it was something that we had considered in the past, and we had rejected it. In part, that was because in essence it requires a licence to gamble. We know that the other side is serious about this, as are you, but we are not, because we know that most people indeed do gamble responsibly and do not necessarily need to register themselves to put a couple of dollars in a machine. In relation to dollar bets, this was considered by the Productivity Commission. The Productivity Commission did find that 99 per cent of poker

machines today are not technically capable of introducing dollar bets. Consequently, it would cost $1.5 billion to implement.”

With respect of the gambling agenda, the Federal Government is addressing the issue of illegal off-shore wagering providers who offer betting services in Australia as the priority.

Past and present CEOs of AHA (Vic) would also like to express our personal gratitude to the Executive and Council of the Association. The ongoing leadership provided by Peter Burnett AM and his deputies Mark Robertson OAM and David Canny is greatly appreciated. Finally I would like to pay tribute to the dedicated input from the staff of AHA (Vic). This year a Leadership Team was created consisting of Mike Barouche (General Manager), Kimberley Malcolm (Manager - Membership Services) and myself to oversee day-to-day operations. Other senior staff have been co-opted to the Leadership Team on key operational issues as they arise.

We have a young, dynamic team who are looking to do things bigger and better and different to meet the needs of the variety of members we represent. This year AHA (Vic) staff combined to develop a “Team Charter” to encapsulate our agreed values: RESPECT Awareness of the feelings, wishes, or rights of others. OWNERSHIP Being prepared to take responsibility for the goals and objectives of AHA (Vic).

Governance Statement

The Australian Hotels Association (Victoria) is a Branch of the industrially registered Australian Hotels Association, subject to the provisions of the Fair Work (Registered Organisations) Act 2009 and consisting of persons who under, and in accordance with, the provisions of the constitution are members of the Association. The business and affairs of AHA (Vic) are overseen and controlled by the duly elected 83 members Council of the Association. The Council elects an Executive Committee to deal with relevant matters on its behalf, with such Committee reporting back to the Council regularly.

Both the Councillors and Executive Committee members are elected for 2-year terms under the supervision of the Australian Electoral Commission. An AHA (Vic) Council Election will be held in September/October 2016. Eight meetings of the Executive Committee and seven meetings of the Council were held in 2015/16. The Executive Committee comprises members of Council elected to the following honorary office bearer positions i.e. President, Vice President

(Metropolitan), Vice President (Country), Treasurer, and six (6) other Councillors elected to the Executive Committee. The Constitution provides for an Accommodation Division comprised solely of members whose premises offer a minimum of 24 bedrooms to the public, with the Division entitled to elect 6 members to the Council. Two such members are members of the Executive Committee. The Division operates as Tourism Accommodation Australia (Victoria).


The Australian Hotels and Hospitality Association Incorporated (AHHA Inc.) is an incorporated association pursuant to the Associations Incorporation Reform Act 2012. AHA (Vic) contracts AHHA Inc. to provide membership services to AHA (Vic) members and a range of administrative and support services. AHA (Vic) and AHHA Inc. share common Councillors, Executive Committee members and Chief Executive Officer. Members of AHA (Vic) are also members of AHHA Inc. The respective constitutions of AHA (Vic) and AHHA Inc. require that a meeting of members be held annually (the Annual General Meeting).

The purpose of the Annual General Meeting is to: o receive reports and audited financial statements from the Council in respect of the immediately preceeding year, and o consider any other business of which notice has been given in accordance with the constitution. All members are advised of the Annual General Meeting by a notice placed in the member publication “Hotel Today” and are encouraged to attend the meeting. The Council and Executive Committee aim to ensure that members have input to and are informed of all major issues and developments affecting the pub and hotel sector in Victoria and the Association. Information is communicated to members through:

o An Annual Report, including a copy of the Business Plan for the upcoming year, is distributed to all members; o Regular Bulletins detailing latest issues are issued to members by e-mail, fax or hard copy; o “Hotel Today” is distributed to members bi-monthly; o AHA (Vic)/AHHA Inc. website is regularly updated with news concerning or impacting on members www.ahavic.com.au; o An extensive range of seminars, training initiatives and member meetings are conducted for members across Victoria, and o Provision of direct services on workplace relations, legal, liquor licensing, gaming issues etc. to members.

2016 HotelCare Report HotelCare was established in 1999 as an on-going initiative of AHA (Vic) to raise and distribute funds to worthy charities and organisations and to advance the overall interests of the pub and hotel sector in Victoria.

The HotelCare Golf Day held at Victoria Golf Club in December 2015, with the kind assistance and support of the Victorian Liquor Industry Golf Club, Victoria Golf Club and our corporate partners, provides funds to HotelCare beyond the contributions of gaming pubs, with 100% of monies raised directed to charities and worthy causes.

HotelCare is funded on behalf of all AHA (Vic) members through contributions by members with gaming machines.

Since its foundation HotelCare has directly distributed over $4 million to charitable organisations, and through seed funding of the HotelCare Charity Golf Day facilitated the further distribution of over $2 million to various charities and causes.

Within the overall objective of HotelCare to support charitable organisations and to advance the overall interests of pubs and hotels, funds within HotelCare are also utilised to support political parties and current or aspiring members of Parliament who demonstrate a willingness to genuinely consult on relevant policy development and implementation, as well as to fund targeted initiatives in members’ interests. Decisions on HotelCare expenditure up to $5,000 are made by the Chief Executive Officer and reported to the Executive Committee; decisions on expenditure in excess of $5,000 are made by the Executive Committee and reported to the Council.

The AHA (Vic) State Awards for Excellence program was established in the late eighties to recognise pubs in Victoria with service excellence across a range of categories, individual excellence and pubs that are a destination for the local community. These annual awards provide the perfect platform for acknowledging and celebrating the ongoing dedication and significant contribution to building Victoria’s renowned reputation for quality customer service and a first-rate experience in pubs. The winners of the 2015 AHA (Vic) State Awards for Excellence were announced at the annual awards gala dinner held on Monday 16th November at Atlantic Docklands. Finalists were honoured at the ceremony in front of a crowd of more than a thousand hoteliers, industry suppliers and hotel supporters. A highlight of the evening was the awarding of the 2015 Nikakis Award to Bill Bell, for his contribution to “A lifetime in pubs”. This award was established in 1997 in memory of Nick Nikakis, recognising an individual or organisation, who by their sustained performance and commitment serve as an inspiration to all in the industry; Bill clearly encapsulates the principles and significance of this award. Awards like these are important to the industry in creating the benchmark for excellence and recognition of those leading the way. With the awards growing in importance and prominence, it resulted in numerous nominations received across the 36 categories and according to the judges, the standards were amazingly high, resulting in a large number of overall finalists in many of the categories. AHA (Vic) would like to congratulate all finalists and winners of the 2015 AHA (Vic) State Awards for Excellence and their commitment and dedication to making the industry great.

2016 TAA (Vic) Accommodation Awards for Excellence Victoria’s top accommodation hotels were recognised at the 2016 Tourism Accommodation Australia (Victoria) Accommodation Awards for Excellence. The winners were announced at a gala dinner held at the Grand Hyatt Melbourne on Wednesday 15 June 2016. These awards recognise the accomplishments and achievements of Melbourne and Victoria’s 3, 4 and 5 star accommodation providers across the various property and individual categories. Each year the award winners reflect the

investment, contribution and passion to the industry that enables Melbourne and Victorian properties to offer a worldclass and diverse selection of properties that cater well for visitors to the state. The “Outstanding Contribution to the Industry” award recognises a sustained contribution by an hotelier or industry leader who has made a significant contribution to Victoria’s tourism and accommodation industries, this year the awardee was Lord Mayor Robert Doyle. In his 8 years as Lord Mayor of Melbourne, he has been a

spokesman for Melbourne to attract visitors, conferences, events and ultimately growth in our accommodation sector and visitor economy. The industry constantly strives to raise the bar and again this year, the nominated properties, and those honoured at the 2016 TAA (Vic) Accommodation Awards for Excellence, accentuate the quality level of the industry. 2016 AHA National Awards for Excellence The 2016 AHA National Awards for Excellence were held in a glittering ceremony at RACV Royal Pines Resort on the Gold Coast on Monday 19 September. These awards provide the hotel and hospitality industry a fitting platform to recognise venues and service excellence right across Australia. Nominees qualify to nominate for these awards following wins in their respective State or Territory Awards program. With over 460 people in attendance the night kicked off on the stunning lawns of the golf course with guests enjoying roving canapés and street food stalls before they moved into the ballroom to commence the awards. Among the highlights was the induction of Gordon Broderick into the Johnnie Walker Hall of Fame. Mr Broderick has filled the role of Executive Director of the Distilled Spirits Industry Council of Australia since its formation in 1982, and was involved in key industry roles well before that. He has been an influential and positive force in the development of the hospitality and hotel industry throughout Australia, and the announcement was very warmly received by the big crowd. Victoria was well represented with 37 hotels and accommodation providers over the 43 categories which was without a doubt a reflection of the quality of our state’s hospitality industry.
