This letter will con�rm that the property located at 30 Emerson Avenue in Toronto quali�es for a laneway house build in the rear portion of the lot, under Toronto’s “Changing Lanes” program.
I visited the property on January 24, 2024 and con�rmed zoning, siting, emergency access and other appropriate quali�cations to certify its eligibility.
The maximum size of a permitted as of right build recessed laneway house build appears to be approximately 592 square feet (over two �oors - lower and upper) The design required for this size would see the laneway house recessed into the existing grade at least 6 feet, and would preclude any level entry or parking inside the unit The entire build would be “living space ” .
It should be noted that current �re/emergency access regulations might require the owner of 30 Emerson Avenue to enter into a “Limiting Distance Agreement” (LDA) with the neighbour at either 28 Emerson Avenue or 32 Emerson Avenue in order to build the laneway house A positive “reciprocity principle” might be in e�ect here, as the owners of 28 and 32 Emerson Avenue also likely need this LDA if they were to build a laneway house on their respective properties. This isn’t certain; a property survey or more information might prove that the required 0 9m (35 5 inch) access path already exists on the south side of the house
The relatively new (2018) Changing Lanes program from the City of Toronto allows qualifying property owners to construct a laneway house “ as of right” on their property, with simple building permit application and no political approval or committee of adjustment approval required. No variances are required and no appeals or “neighbour vetoes” are permitted The city also waives development cost charges
