TEN HOMESTEAD TRAPS FOR THE UNWARY Florida provides its residents very generous homestead protections and exemptions, but also restricts the ability to transfer the homestead. As a result, it is very important to understand these protections, how to apply for exemptions, common mistakes that can result in your loss of these benefits, and how you may be limited in your ability to transfer your homestead. In order for your home to be considered your “homestead” you must both own and reside in the home as your permanent residence. Ownership of the home can include both legal title and equitable title (e.g. owning the property individually or in a trust for your benefit). If your home qualifies as your “homestead” then three different types of benefits and limitations will apply, relating to: (1) real estate taxes; (2) creditor protection; and (3) limits on the ability to transfer your homestead. The following is a list of Ten Common Mistakes Relating to Florida Homestead. 1. Failure to “Homestead” the property before December 31st If you purchased your dream home and it is your primary residence, then you must get your ducks in a row by December 31st. This means that you must complete the purchase of the home not later than the last day of the year, it must be your primary residence on that date, and all documentation evidencing Florida domicile must be dated on or before December 31st. Homestead protection does not require U.S. citizenship; all that is required is that the property is the individual’s primary residence. However, individuals who are not U.S. citizens must be resident aliens and possess a Green Card. 2. Failure to Apply for Exemption by March 1st You must physically apply for the homestead property tax exemption between January 1st and March 1st at your local property appraiser’s office. Failure to apply by March 1st will result in not obtaining a reduction in assessed value of up to $50,000. It will also result in your disqualification from the 3% “Save Our Homes” valuation cap. 3. Failing to Apply for All Exemptions for Which You Qualify In addition to the standard homestead exemption, Florida also provides additional exemptions for surviving widows and widowers, disabled individuals, disabled veterans, individuals who are blind, and senior citizens with low incomes. The deadline for applying for these exemptions is also March 1st. 4. Married Couples Failing to Apply for Exemptions Together Both spouses should sign the application for exemption. If one spouse dies and the surviving spouse did not sign the original homestead application then the homestead exemption may be lost unless further application is made by the surviving spouse. The loss of exemption may apply to not only the reduction in the assessed value but also the 3% “Save Our Homes” cap. In addition, although regaining the standard exemption may be easy, the loss of the 3% cap could be more difficult to correct resulting in revaluation of your property and considerably more tax liability. 5. Couples with Multiple Homes Generally, a husband and wife may only have one homestead and obtain only one exemption. As a result, if a husband and wife each own a residence, they must choose one homestead. The penalty for maintaining two competing homesteads can be severe unless each of you is able to meet all of requirements for the homestead exemption with respect to the separate properties.

6. Adding Family Members to the Deed It is common to hear that someone has advised a Florida homeowner to add their children to the deed in order to avoid probate. Be aware that while this technique may reduce the likelihood of a Florida probate, unless the child is also residing in the home as their primary residence, it also will result in a reduction in the homestead exemption and can eliminate or destroy the homestead protection from creditors. As a result, you should carefully consider the legal and financial affects before placing your homestead in joint names with your children. 7. Renting the Homestead If you own your homestead and decide to rent it to others while you are up north for the summer, you could easily lose your homestead protections. Generally, only incidental rental of a property is allowed without homestead being considered abandoned and with that, loss of the Florida homestead protections. 8. Renovations or Improvements to Homestead Any change, addition, or improvement to the homestead can affect the homestead valuation and “Save Our Homes” exemption. This is true unless the change is due to repairs resulting from a casualty loss and other requirements are met. 9. Failure to Obtain Long-Term Lease (99-year lease) after QPRT Expires If you place your homestead in a Qualified Personal Residence Trust, in order to the maintain homestead protection and exemption after the expiration of the retained interest, you must maintain an equitable interest in the property. This means you must plan ahead with a long-term lease designed to qualify as an equitable interest in the property. 10. Failure to Obtain Homestead Waiver There are Florida constitutional and statutory prohibitions against transferring your homestead away from your spouse or minor children. As a result, devising your homestead to a trust for the benefit of your spouse is not likely effective unless there is a valid waiver of spousal homestead rights. However, even with a valid homestead waiver, if you are survived by a minor child, the devise may still be ineffective. Because of the various Florida constitutional and statutory issues associated with Florida homestead, any transfers of the homestead or use of the homestead for estate planning should only be entered into after consultation with your legal advisors.

Sound Investvement There are lots of reasons why you might want to invest in real estate. The stock market is currently strong, but with potential volatility across different sectors, here are some really good reasons to allocate some market profits into sound real estate markets.

Real estate has a high tangible asset value. Tangible assets are physical things — like property, computers, and equipment — that are worth money. Real estate, especially, will always have some kind of monetary value. Compare this to investing in stocks where, if the market crashes, it is possible that something you paid $500 for could suddenly be worth $0. With real estate — land and real property — your investment will always be worth something.

Appreciation. Real estate tends to appreciate in value over time. Not only will the building or home itself likely grow in value, but the actual land that it’s built on will also usually be worth more over the years. In some markets, it’s not uncommon for the land to be worth more than the house that stands on it — or for the land value to continue to rise even without a house on it. A couple from Northern Ohio, bought a piece of land for $10,000 in the 1980s, a lakefront lot in a small undeveloped community. They had intended to build on it and make it a summer home, but never did. Over the years, houses went up all around their lot, and the community grew. Now the lot — still empty — is worth right around $1 million. It will be part of their legacy to their children.

You can improve your property value. One of the best things about real estate is that you can improve a property if you want — add amenities like a pool, or improve it with an updated kitchen or bath. You can then either rent it out or sell it for more than you paid for it. Since real estate is a tangible asset, any improvements you make to it will increase its value. Some things that bring the biggest return for your money are garage door replacements, kitchen remodels, and deck additions.

Build equity. If you invest in actual houses, your equity in the home should increase the longer you own it. Equity is the portion of the home you own outright — as opposed to the part a bank may own if you have some kind of loan or financing. As you pay off your loan, you generally build more equity in a property (the exception could be if the market takes a severe downturn, but downturns are generally temporary, so if you can hold on to the property until the market stabilizes, your ability to build equity should resume). Also, as the value of the property appreciates through the years, the house becomes worth more, adding to your equity.

Real estate may offer better returns than the stock market. In Florida, “Real estate has been appreciating at 6% to 8% a year. Compare that to a money market investment of 1% or 2%, and real estate offers a much better return.” Nationally, singlefamily homes offer yearly returns of 9% — a yield that’s tough to come by with stock investments.

You can rent out a home, offer a lease-option agreement (rent-to-own), or invest in a REIT or a crowdfunding app. Whatever your level of commitment, you can probably find a way to invest in real estate. A REIT is a real estate investment trust. Individuals can invest in the trust that, in turn, usually owns and manages a large number of real estate investments that produce income — things like shopping malls, hotels, and resorts.

Diversify your portfolio. This is another way to lower some of your risk, especially if you’re investing lots of dollars in other opportunities. Most experts recommend diversifying your portfolio so you won’t lose everything in one fell swoop if the market where you’ve most heavily invested happens to go south. Real estate is an excellent place to park some of your money — a place much safer than many other investments. Ever hear the term, “safe as houses”? There’s a reason people use it.

Some real estate crowdfunding apps include Fundrise, Crowdstreet, and Roofstock. The U.S. Securities and Exchange Commission places limits on much you can invest annually in any crowdfunded offering. This limit depends on your annual income and your net worth. For instance, if either your annual income or your net worth is less than $107,000, you can invest either $2,200 or 5% of your income or net worth (the lower of the two) in crowdfunding. Yes, this is confusing — what the SEC is saying is that if you meet the income or net worth limit ($107,000) you can invest either 5% of your income or your net worth (whichever of the two is lowest), or $2,200. Once you understand what those two figures are, you may invest whichever is higher. For example: if your annual income is $95,000 and your net worth is $65,000, 5% of those (respectively) would be: $4,750 and $3,250. Therefore, $3,250 is the amount you use to compare with the $2,200 amount. Because $3,250 is greater than $2,200, that’s the maximum amount you’re allowed to invest in real estate in a given year.

Unique tax benefits. If you own your own house, you can deduct mortgage interest. State and local property taxes are also usually deductible. For investment properties, you can often deduct operating expenses and costs, insurance, property taxes, and maintenance.Capital gain taxes (the taxes you pay if you sell investment properties, or your own home within certain limitations) are 15% to 20%, typically lower than your personal tax bracket, which can be a huge advantage over other types of investments.If you use the money from a sale of one property to buy another property, you can defer your capital gains. This means you aren’t taxed at all on that money because it went directly toward the purchase of another property. Make sure you report to the IRS that this is what you’ve done, or they’ll send you a letter asking why you haven’t paid taxes on a property sale.

Real estate doesn’t have to tie up a lot of cash. In many instances, you can put down as little as 10% on a property, then essentially use the bank’s money to grow your investment. Lending is becoming more accessible and friendly to buyers, according to a Florida real estate agent. More so than what it was after the housing crisis. They seem to be lessening constraints, and local banks are lending more to builders and doing more in house portfolio loans — so there is just a better environment than ten years ago.

CirCulation • Shelf life • CoSt and Value In today’s real estate market, there are so many decisions to be made regarding the proper allocation of marketing funds for agents in the top brackets of their respective markets. The web has received significant interest for both prospective buyers in their searches and the listing agents’ concerns to obtain web traffic. What is there to say about print advertising? Many of the top agents feel the need for both print and web in some balance, often only slightly preferring one or the other. An agent that does too much of one and not enough of the other, may be at a competitive disadvantage to their competitors! Print advertising has been and still is the most tangible means of marketing directed to prospective buyers. Regardless of demographic, buyers still want to have something that they can pick up and keep for the purpose of educating themselves on the market, as well as the provision of a means to locate properties by specific area. With this in mind, there are several factors and criterion that are important to analyze before choosing specific marketing mediums to allocate advertising dollars. One: Circulation Does a publication provide distribution to a specific market or target market that the agent is seeking? Or does it provide blanket or somewhat random distribution, playing a numbers game hoping to attract a percentage of readers? Both have benefits, but through experience, the higher-end markets typically are more successful with targeted marketing as to eliminate “wasted” publications that get into the hands of non-qualified buyers. On the other hand, the blanket distribution may appear to reach more prospects but of various different purchasing abilities. This type usually serves a better purpose for properties at or below the median price point in a specific market. Also with regards to circulation, is the publication readily available to acquire? Is there a cost factor for the prospective buyer to receive the publication? Two: Shelf Life Generally speaking, the shelf life of a publication is directly proportional to the quality and content of that publication. Readers are most likely to pick up and retain a publication that demonstrates quality aesthetics as well as the inclusion of the proper content as it relates to the type of market that the publication caters to. The more expensive the look and the feel, the more likely it will be that the reader will not throw the magazine away! Furthermore, when the publication offers helpful,

pleasing or informational content , it will be more likely to remain in the hands of the prospect as she may cycle back periodically for that very reason. Three: Cost and Value Having mentioned the first two criterion for assessing the utility of a marketing publication, cost and value are perhaps the most essential factor in an agent’s decision making process? As far as cost, every agent typically has an allotted budget for marketing. When putting advertising dollars into print, it is essential that the publication is priced competitively, if not aggressively versus the alternative options. However, cost alone should not be the defining factor of the decision as Value for those advertising dollars is the quintessential element. Value is provided when the cost factor falls below the perceived and received benefits of the publication. For instance, is the dollar cost figure compatible with the home owner’s property being marketed in a tangible fashion which is pleasing to that seller? Keeping sellers content is an ongoing task of the real estate listing agent. Making the correct choices for the dollar cost outlay is continuously a challenge. Does the cost factor substantiate the concept of the agent being focal to the public in the designated circulation points of the publication. This is an extremely important to the top agent, as the perception of the agent being everywhere in the consumers mind, translates to the conception that she is! Name recognition is one of the most valuable assets to the top agent and should be assessed in the dollar cost of choosing a specific publication. Will that publication put the agent in the “right light” in the eyes of the consumers? Finally, the ever important phone call from the magazine!! This is the icing on the cake but surely should never be the expected standard. Much of this depends upon the audience that the publication reaches through its circulation. This is the direct benefit of print advertising as the previous two are the indirect benefits, and much more attainable and expected. Conclusion I have always believed and have shared with my top agents that regardless of web marketing, they need to allocate some substantial marketing dollars to print advertising.
