My daughter, Amy, started the guide with her husband and continues to manage this and the Portland/Vancouver edition. I was previously an advertiser in the guide and I am looking forward to working with her on the second edition. I hope that my experience as a nurse, family caregiver, and 10 years as an administrator for senior housing will assist me in growing this guide to be the most comprehensive resource available for seniors, people with disabilities, and their families. Care for Advanced Parkinson’s Disease Parkinson’s is a chronic, progressive neurological illness. Frequently changes and decline occur at such a slow pace that families are caught unprepared when their loved one loses their ability to live independently. Symptoms of advanced Parkinson’s include tremor, stiffness, slowness and difficulty with fine movements, impaired balance, soft speech, reduced facial expression, drooling, “freezing” while moving and sleep disturbances. It is important to stress that Parkinson’s is not a mental disease, although roughly 1/3 will eventually develop dementia.

Medication is the most effective treatment for Parkinson’s. Symptoms differ in each person so dosage and timing tend to be geared to the individual patient. Medication must be given on time according to the schedule that has worked well for the family and has been set by the treating physician.  Medication timing is the most important way to minimize symptoms.  Know which medication should be given with meals and which on an empty stomach  Dressing and eating could be scheduled around medication timing

Balance and Posture Exercise (especially stretching) is essential therapy and easiest to initiate when your loved one is rested, but watch for “freezing”, a sudden inability to move, especially when walking or getting out of a chair.

 If freezing occurs, do not push/move your family member, but use visual or auditory cues to initiate movement  Avoid prolonged standing and to use appropriate walking aids  Patient should be encouraged to keep hands free when walking, to pause before getting up, and to avoid pivot turns

Eating A failure to swallow properly can lead to choking which is a symptom of swallowing problems. To allow optimum nutritional intake, be sure the Parkinson’s medication has been given time to take effect before a meal.  Patient should sit in an upright position when eating, and may need reminded to swallow  Consult a dietician for easy-to-swallow foods containing enough fluid and fiber  Encourage a rest period before meals

Other Tips  Allow time to do activities without being rushed and allow frequent rests  An occupational therapist can provide practical tips to make routine easier  Medication given on time and early enough may allow patients to be more mobile and responsive  Parkinson’s is a progressive disease. It is a given that care needs will need to be reevaluated over time

Telephone Assistance Programs help Oregonians In 1987, Oregon Legislature passed a law assuring adequate and affordable telephone service is available to all Oregonians. Based on that legislation, the Public Utility Commission of Oregon implemented these three programs:

Telecommunication Devices Access Program (TDAP) Loans adaptive telephone equipment at no cost and with no income restrictions to eligible Oregonians who have a severe hearing, severe speech, vision, cognitive or mobility impairment and cannot benefit from the use of a standard telephone. To receive the equipment, qualifying customers must complete and sign Section A of the application available in English and Spanish. The appropriate licensed physician, audiologist, speech-language pathologist or rehabilitation counselor must complete Section B certifying that the person requires adaptive equipment to use the telephone.

Oregon Telephone Assistance Program (OTAP) —Link-Up America Oregonians who receive one of these benefits may receive up to a $13.50 reduction in their monthly bill for local residential telephone service:  Food Stamps  Temporary Assistance to Needy Families (TANF)  Supplemental Security Income  State Medical Programs or Medicaid

The Link-Up America Program helps qualified individuals by paying for one-half (up to $30) of the line connection charges for new residential telephone service. Many residential telephone and cellular companies participate in OTAP. Customers can complete or download applications online. Application are available in Spanish, Russian and Vietnamese.

Oregon Telecommunications Relay Service (OTRS) As required by the Americans with Disabilities Act (ADA) is a telephone service that is available for all Oregonians and provides telecommunications access that is functionally equivalent for persons with and without hearing or speech disabilities to communicate via the telephone. There are several forms of the OTRS available depending on the needs of the user including Captioned Telephone Service, Voice Carry Over, Hearing Carry Over, Speech to Speech Relay Service, Shared Non-English Language Relay Services and Text-to-Voice TTY-based Relay Service. Home Health Definitions: Hospice is a comprehensive program of care to patients and families facing a life threatening illness. Hospice emphasizes palliative rather than curative treatment. The dying are comforted. Professional medical care is given, and sophisticated symptom relief provided. Very few Home Health Agencies are also licensed for Hospice care.

In-Home Care/Personal Care is care related to activities of daily living, including: mobility, eating, toileting, bathing and personal hygiene, dressing and grooming or cognition support. These services are usually provided on a private pay basis and do not require a physician’s order.

Registry Services refer, but do not employ, independent caregivers. Clients control all aspects of the arrangement, including compensation, directly with their caregivers. Registries may include free non-profit listing services or companies that require training, bonding and insurance of their caregivers. Clients are charged a referral fee.

Respite Care is short-term or temporary. It is designed to give families a break from the stress of daily caregiving. Respite care can be for a few hours, overnight, or for days. The amount of care changes with the needs of the family and the ill or disabled person.

24-hour care is “round the clock treatment” in a home environment. The care may be shared by multiple caregivers or by a single caregiver. Skilled Nursing is a higher level of care where services are preformed by a licensed Registered Nurse or Licensed Practical Nurse. Skilled Nursing includes, but is not limited to patient assessments, performance of prescribed medical treatments, administration of prescribed medications, education for the patient and the caregiver (if available) related to the disease process, treatment, health measures and medication management. Skilled Nurses provide medical care as prescribed by physician.

Social Worker refers to a clinical social worker whose purpose in health care is to enhance, promote, maintain, and restore the best possible social abilities of the patient or family. Services provided may be preventive, developmental, or remedial in nature.

Home Health Aides provide support services such as personal care which do not require a licensed nurse. Medicare does not cover home health aides unless the person is also receiving skilled nursing care or other therapy. Certified Nursing Assistants (CNAs) provide personal care such as bathing, dressing, transporting and other essential activities.

Intravenous Therapy is any medical treatments/medications that need to be introduced to the body via a patient’s veins. Numerous IV Therapies can be provided inhome under supervision of a MD. Some of these include: inter-infective/antibiotic therapies, hydration therapy, pain management, chemotherapy and central line care and maintenance.

Cardiac Care refers to services including patient assessment, specific diet information, and management of the disease process, medication management and education. Cardiac rehabilitation is a program designed to help a person with heart disease return to health. Cardiac rehabilitation may consist of exercise, modifying risk factors to prevent further heart damage, or psychological rehabilitation.

Care & Health Category

Diabetic Management refers to services including patient assessment, diet information, management of the disease process, medication management and education on all of the above. Services are provided by a Registered Nurse under the supervision of an M.D. Some agencies may employ certified diabetic nurse instructors or cardiac care specialty RN’s.

Psychiatric Services refers to the agencies ability to offer services related to psychiatric support with the prevention, diagnosis, and treatment of mental illness. Services may include counseling or administering of medications. Therapy Services (ST, PT, OT, RT) Speech Therapy (ST) refers to services to assess and treat speech and swallowing disorders. Speech therapy can treat speech, language, cognitive skills or swallowing. A Therapist provides individually designed treatment programs to maximize communication and swallowing. Physical Therapy (PT) refers to services for the treatment and the rehabilitation process where a physical therapist will often stretch, strengthen, facilitate muscles, challenge balance, test coordination abilities, teach home exercise programs and enhance basic mobility skills. Exercise techniques are only part of the special skills used by therapists to treat patients to help lessen disability, pain and improve overall function and quality of life. Occupational Therapy, (OT) refers to services to assess and treat patients to improve their ability to perform tasks in their daily living and working environments. Therapists also help them to develop, recover, or maintain daily living and work skills. Occupational therapists help clients not only to improve their basic motor functions and reasoning abilities, but also to compensate for permanent loss of function. The goal is to help patients become as independent, productive, and satisfied as possible. Respiratory Therapy (RT) refers to services for care of patients with deficiencies and abnormalities associated with the cardiopulmonary system. It may include the therapeutic use of medical gases and their equipment, environmental control systems, humidification, aerosols, ventilator support, bronchi pulmonary drainage and exercise, respiratory rehabilitation, assistance with cardiopulmonary resuscitation, and maintenance of natural, artificial, and mechanical airways.

In-Home Monitoring Technology Empowers Elderly Most of us take self-reliance for granted, and it’s something we can’t imagine losing. Staff members work with clients and their families to develop a care plan based on three monitoring programs: Family Support–Offers unlimited access, allowing individuals to be monitored by family, via computer, from anywhere in the world. “Drop-in” Support–A Rest Assured caregiver periodically checks the individual’s whereabouts, monitors medication and dietary intake, etc. Active Support–Provides for continuous, remote care if Drop-in Support is not enough.

Experience of older workers in today’s workforce Older workers have so much to offer as members of today’s workforce. While they possess the work ethic, loyalty and life experience necessary to be assets to any workplace, what they often lack is opportunity. The Easter Seals Oregon Senior Community Service Employment Program (SCSEP) is a Department of Labor grant designed to help mature workers re-enter the workforce. The goal of the program is to assist participants to gain the skills necessary to obtain permanent employment, while helping seniors achieve economic independence and an improved lifestyle. Many seniors have challenges to overcome before they find employment. Some of these include stereotypes related to age as well as issues regarding transportation, housing, work experience, disability, income, self-esteem, language, health and education. Easter Seals SCSEP helps participants rise above these obstacles by providing opportunities to enhance existing skills, train for a new career, and find a rewarding job. To qualify for the program, participants must be low-income, 55+, unemployed and be willing and able to look for work. Seniors are assigned to a Program Coordinator who develops an Individual Employment Plan, places them in a Host Agency training site and enrolls them in Job Club. The program assists them in acquiring knowledge regarding the job market as well as learning how to write resumes, cover letters, apply for jobs on-line and discover their strengths and

weaknesses in relation to an identified career focus. Participants are also enrolled in computer classes to enhance their technology skills to be competitive in the labor market. As one SCSEP participant stated, “I had worked most of my life, but was laid off several years ago. I have been unable to find work due to my inability to understand and operate computers. Now I am gaining the opportunity to learn how to use the computer to enhance my job search and improve my skills in this area”. The SCSEP program holds monthly orientations to explain the program and set up intake appointments for those who qualify. Participants then enter into an assessment phase designed to take a “snapshot” of basic skills, computer abilities and vocational options. The participant is placed at a training site and reassessed at regular intervals to ensure they are making progress. Medicare Coverage Changes & Schedule Medicare coverage changes every year. How can a person with Medicare keep up with it all?

unless you receive a written notice that your plan is ending its service in Oregon.

First: what kind of coverage do you have? Is it from work? A public benefit (Oregon Health Plan)? A private company? Pull out your insurance cards and look at them. Focus on what is happening to the insurance you have right now (unless you plan to compare and change plans).

Because these plans change each year, it is important to compare plans to see if one may serve you better by looking at Cost, Coverage and Convenience.

Here is a schedule of what to look for.

October: Save the Mail! Before October 31st, Medicare Advantage and Part D plans must send written notice of the changes they will make to your coverage. This Annual Notice of Change shows whether the drugs you take are still covered, whether your doctor is covered, and whether certain costs (such as co pays for lab work, x-rays or dialysis) will change. Some insurance plans may send next year’s insurance cards in this mailing. Reading this information carefully in October can help you avoid unpleasant surprises in January, when the new plans take effect. Be careful not to mistake this mailing for advertisements–many people throw everything away in frustration. Save your October mail about Medicare, and sort it carefully. Plans that are ending their service in Oregon must also send you a written notice. It will contain complete instructions about what your rights are, and what you need to do to get new coverage.

November 15th–December 31st:

The Fall Annual Enrollment Period. You can add, drop, or switch Part C (Medicare Advantage) plans, and/or Part D (Drug Coverage) plans. You can also decide to stay with the plan you have because it works best for you. You are not required to change plans

Cost: What is the monthly premium cost? What deductibles must you meet before the plan starts paying? How well does it cover the drugs you take, and how much do you have to pay? What co pays are you responsible to pay for hospital, lab work, doctor visits? Coverage: Does this plan cover your preferred doctors and hospitals? What health care services do you use most? Do you need home oxygen, regular blood tests or surgery this year? Are you very healthy but want to have your blood pressure checked? How well does the plan cover these services? For drugs, are there expensive drugs without generic equivalents that you must take? Check to see how well they are covered. Does the plan’s “formulary” (list of covered drugs) match well with your needs? Convenience: Does your current pharmacy (or one near you) accept this plan? Is there a mail-order option to receive a 90-day supply of drugs by mail? How do you compare these things? Grab a list of your current medications, your Medicare card, and any other health insurance cards you have, go to www. medicare.gov, and click, “compare plans”. If you do not own a computer, is there one at a family member’s house, a library or senior center you can use? Important: You must be enrolled in Part D (drug coverage) by December 31st.

Medicare can be confusing. If you’re not sure how to proceed, there is help!

During these three months, you can change your Medicare Advantage plan to get equivalent coverage from a different plan. As long as you already enrolled in Part D before December 31st, you may also be able to change drug coverage. This period can be very useful for people who find that their current coverage is inadequate, or a new plan might work better for them.

SHIBA (Senior Health Insurance Benefits Assistance) has well-trained volunteers to help you compare health plans. This help is unbiased, free of charge, and available in your local area. In Marion, Polk and Yamhill Counties, you can reach the SHIBA program by calling 1-800-469-8772. For assistance in other areas of Oregon, the state SHIBA Hotline is 1-800-722-4134. In addition, 1-800-MEDICARE (633-4227) is open 24 hours a day, 363 days per year.

January through March is the Medicare General Enrollment Period. People who are late in signing up for Original Medicare (Part A or Part B) can sign up now, so their coverage will take effect in July.

The Oregon Long Term Care Partnership Program–A Successful Alliance between Business and Government Oregon implemented the Long Term Care Partnership Program effective January 1, 2008. Prior to the Partnership Program, families had to spend their life savings to pay for a family member requiring long term care before qualifying for Medicaid, impoverishing the remaining spouse or family. The Partnership Program protects the assets of long term care policyholders equal to the benefit dollars received. Let’s look at an example:

The state has several requirements for policy plan design that must be followed to qualify as a Partnership Policy.

You purchase a three year long term care insurance policy with a total benefit value of $150,000 and 5% compound inflation protection at age 60. At age 75, you have a stroke and need care. You utilize the benefits of the policy for your care, which has grown to $300,000 due to the inflation protection. As you need more care, you can protect an additional $300,000 of your assets and still qualify for Medicaid benefits because of the Partnership Program, as long as you meet the Medicaid income and other requirements. Under the “Granny law”, you can continue receiving care from your chosen care provider as long as they accept Medicaid.

Must contain the following required inflation protection:

This means that your spouse or family can retain the $300,000 in assets you protected by purchasing the policy, as well as $300,000 worth of benefits that you received from your policy. That is a total benefit to you and your family of $600,000.

The insurance company must submit their policy to the state for approval as a Partnership Policy The policy must be a tax–qualified plan, which requires that a medical professional must certify that you will need care for a minimum of 90 days to receive benefits

 Age 18–60: 3% or 5% compound inflation  Age 61–75: Must include some type of inflation benefit, but it need not be compound annual inflation  Age 76 and older: No inflation required, but inflation can be chosen

Aid and Attendance pension The Aid and Attendance pension benefit may be available to wartime veterans and surviving spouses who have in-home care or who live in nursing-homes or assistedliving facilities. Although this is not a new program, not everyone is aware of his or her potential eligibility. “Veterans have earned this benefit by their service to our nation,” said Secretary of Veterans Affairs Jim Nicholson. “We want to ensure that every veteran or surviving spouse who qualifies has the chance to apply.” Many elderly veterans and surviving spouses whose incomes are above the congressionally mandated legal limit for a VA pension may still be eligible for the special monthly Aid and Attendance benefit if they have large medical expenses, including nursing home expenses, for which they do not receive reimbursement. To qualify, claimants must be incapable of self support and in need of regular personal assistance. The basic criteria for the Aid and Attendance benefit include, but not limited to the inability to feed oneself, to dress and undress without assistance, or to take care of one’s own bodily needs. People who are bedridden or need help to adjust special prosthetic or orthopedic devices may also be eligible, as well as those who have a physical or mental injury or illness that requires regular assistance to protect them from hazards or dangers in their daily environment.

For a wartime veteran or surviving spouse to qualify, the veteran must have served at least 90 days of active military service, one day of which was during a period of war, and be discharged under conditions other than dishonorable. Wartime veterans who entered active duty on or after September 8, 1980, (October 16, 1981, for officers) must have completed at least 24 continuous months of military service or the period for which they were ordered to active duty. If all requirements are met, VA determines eligibility for the Aid and Attendance benefit by adjusting for un-reimbursed medical expenses from the veteran’s or surviving spouse’s total household income. If the remaining amount falls below the annual income threshold for the Aid and Attendance benefit, VA pays the difference between the claimant’s income and the Aid and Attendance threshold. The Aid and Attendance income threshold for a veteran without dependents is now $19,736 annually. The threshold increases to $23,396 if a veteran has one dependent, and by $2020 for each additional dependent. The annual Aid and Attendance threshold for a surviving spouse alone is $12,681. This threshold increases to $15,128 if there is one dependent child, and by $2020 for each additional child. Housing Definitions: Adult Day Care Programs offer a protective setting during the day, for those who cannot be left alone due to health care and social needs. The structured program within a community setting offers: socialization, planned activities, care services, companionship and meals. Adult Day Care provides daytime respite for the caregiver who typically works, needs time for other responsibilities, to simply to take a break. Some programs are designed for older adults with dementia and/or physical limitations. Programs through senior housing communities that are listed in this guide must be able accept non-residents to be included. Adult Care Home or Family Care Home are private residences that provides a home-like setting, and serves 5 or less residents. The caregiver may perform several functions, such as personal care, housekeeping and activities and group meals. There are three levels of Adult Foster Care Home licenses. The classification system is based on level of care the Adult Foster Home may provide to residents who live in the home as well as the experience and training of the providers and their ability to assist residents with: personal hygiene, mobility, eating, dressing, toileting, and behavior management. Residents may require very light assistance or may be dependent with several care needs; it is best to ask individual locations for their specific policies and license. Assisted Living Communities are State-regulated rental properties where six or more residents may reside. Care assistance is available, including: medication management, bathing, dressing, toileting and eating. Apartments must be fully self-contained private living units with a lockable door, private bathroom, and kitchenette facilities. The fee schedule is regular monthly rent along with additional fees for specific services and amenities. Assisted living communities are best suited for individuals who want to remain as independent as possible and who are able to direct their own care. CCRCs (Continuing Care Retirement Communities) are communities that include a continuum of care from independent living, assisted living, residential care and skilled nursing services all on one campus, allowing individuals to live within the same community as their needs progress through the spectrum of care. They typically offer the full selection of amenities associated with retirement living. An endowment fee in addition to a monthly maintenance fee can be expected.

Independent Living Communities provide residents an independent living setting without the burden of home ownership. Typically, residency is established on a monthly rental basis. Residents live in fully equipped private apartments or cottages from studios to large two-bedroom units that may be rental-assisted or market-rate depending on the community. Amenities and hospitality services such as housekeeping, linen service, transportation and social and recreational activities may be included, provided for an additional charge, or may not be available at all. These communities do not provide assistance with activities of daily living or personal care.

Housing Category

Memory Care or Dementia Communities offer or provide care for residents with Alzheimer’s disease or other dementia in a home like environment. These communities, must receive an endorsement and is governed by additional regulations that are specifically intended to support individuals with dementia, including: a secure building that alerts staff if a resident has exited, a secure outdoor area that provides outdoor freedom safely, interior finishes that are non-glare and well lit, and visual contrasts between floors, walls and doorways. Alzheimer’s units must also have programs, which include: gross motor, self care, social, craft, sensory enhancement and outdoor activities. Rehabilitation & Therapy is treatment for an injury, illness, or pain with the goal of restoring function, including nursing and therapy services. Rehab is ordered by a physician and services are provided by nurses and physical, occupational, and speech therapists. Examples include working with a physical therapist to help you walk and with an occupational therapist to help you get dressed. Residential Care Facilities provide housing and supportive services for six or more people who do not require 24 hour nursing care. Pricing can vary greatly depending on the level of care provided and the size and amenities of each apartment. Accommodations are typically in a home like setting and may range from a shared bedroom with common bathroom, to private apartments with kitchenette and private bathroom. Monthly fees vary greatly based on unit amenities and care services. Many residential care facilities specialize in caring for individuals with Alzheimer’s or dementia. Respite Care is short term relief for family caregivers to take a break from the caregiving responsibilities and allows for a healthier and better quality of life for both the caregiver and care receiver.. Respite services include: companionship, personal care, recreational activities and security. Respite care can be provided as short stay or for a longer period that allows the family caregiver to go on vacation or a business trip. Longer duration respite care is generally found at select senior housing communities although some Companion services may provide this service in the home. Skilled Nursing Facility (SNF) or Nursing Homes are Statelicensed facilities that provide a safe, therapeutic environment for individuals who require rehabilitative care or can no longer live independently due to functional or cognitive impairment. Nursing Homes offer 24-hour skilled nursing care and medical services by registered nurses and support professionals. This is the highest level of care that can be provided that is not hospitalization. Additionally, nursing facilities offer residents planned social, recreational and spiritual activities. Nursing facilities are most appropriate for people who need 24-hour medical oversight and a protective/structured setting. Most residents must share their room, but residents are allowed to bring personal items to encourage a more home-like atmosphere. Choosing A Community A good match between a community anda resident’s needs depends as much on the philosophy and services as it does on the quality of care. The following suggestions can help you get started in your search for a safe, comfortable and appropriate assisted living community:  What are your future needs and how will the community meet those needs?  Is the community close to family and friends? Are there any shopping centers or other businesses nearby (within walking distance)?  Visit each community more than once, sometimes unannounced.  Visit at meal times, sample the food, and observe the quality.  Observe interactions among residents and staff and ask questions.  Ask about social, recreational, and spiritual activities.  Ask about the type and frequency of staff trainings.  Review state licensing reports.

These steps should also be considered:  Contact your state’s long-term care ombudsman to see if any complaints have recently been filed against the assisted living community you are interested in. In many states, the ombudsman checks on conditions at assisted living units and nursing homes.

Food For Better Thought What you eat and drink and how that may affect the health of your brain. If good eating and nutrition are important to you, recent research related to food and brain health will get you excited. Cold water fish such as salmon, mackerel, sardines, herring, and lake trout are rich in omega-3 fatty acids which is not only good for your heart and blood vessels but very good for the brain. Nuts are a good source of omega-3 fatty acids as well, especially walnuts and almonds. Brain cell injury can occur through oxidative stress which is part of the normal metabolic process. However, dietary antioxidants can antagonize this process. Some studies suggest a protective effect of antioxidants on cognitive decline. Foods rich in antioxidants include cranberries, blueberries, strawberries, red onions, pomegranates, prunes, broccoli, grapes, and others. No benefit has been demonstrated from antioxidants in pill form. It seems prudent that we consume wholesome foods rich in antioxidants.

Foods rich in vitamin C and E include vegetables and fruits such as citrus. Folic acid found in dark green vegetable, chickpeas, pinto beans, and sunflower seeds is important because deficiency may be associated with dementia. Although a multivitamin is reasonable, megadoses of vitamins are not recommended unless prescribed for a known deficiency since excess doses can actually be harmful. Being hooked on that morning cup of Javamay be a good thing. A recent study published in The Journal of Alzheimer’s disease showed that individuals who drank 3-5 cups of coffee in midlife had a 65% lower risk for dementia later in life compared to those who drank little or no coffee. Research in animals suggests a protective effect of caffeine on brain cells. We should weigh benefits against risks; if your doctor has suggested you avoid caffeine, continue to follow that advice.

Fruit and vegetable juices are a good source for beneficial nutrients. A study conducted at the University of South Florida concluded that those who consume fruit and/or vegetable juices more than three times a week were significantly less likely to develop dementia than those who consumed such juices less than once per week.

Although good nutrition is important, no less important to brain health is regular physical activity, social engagement, and good emotional health. Chronic stress and depression are now recognized as risk factors for stroke and dementia. So keep a positive attitude and good sense of humor. Stay connected with family and friends. Become a lifelong learner. Finally, start a regular physical activity program because something else we know to be true—“Move it or lose it!”

Most of us will get adequate amounts of vitamins in a well-balanced diet. Vitamin C and vitamin E are potent antioxidants.

Estate Planning Estate planning is really caring for your loved ones, seeing that they are provided for, and making sure your property is distributed according to your wishes. This can be accomplished a variety of ways, including wills and/or living trusts.

Durable Power of Attorney A person can appoint someone else to manage his financial affairs if he is unable to do so. This Durable Power of Attorney is a preferred way of providing for the proper management of one’s financial affairs in the event of incapacity.

Advance Directive for Health Care

A person can give health care instructions to his physician and name a person to make decisions, such as hospital selection, doctors or type of medical treatment. This is called an Advance Directive for Health Care. This document also allows a person to give specific instructions about life support measures if he is unable to make those decisions for himself.

Guardianship & Conservatorship If a person becomes incapacitated and has done no advance planning, the only legal means by which even a family member can take care of that person is to petition the court for the appointment of a guardian and conservator. This process is an ongoing and court controlled proceeding that is time consuming and expensive. It is the least desirable way of property and personal management.

Why Use A Trust? To keep affairs private. Trusts avoid probate, guardianships and conservatorships. Probates are public record. Avoid or minimize estate taxes. In case of illness, incapacity or death, all financial and business matters will be taken care of by your successor trustee according to the instructions that you have put into the trust’s language. There is no need for a court appointed Conservator. People create charitable trusts to transfer highly appreciated assets into a trust where there is no capital gain taxed to them when it is sold, and they can receive the income from the trust for their lives. At the end of their lives, the trust goes to their designated charity named in the trust. Create a trust to hold and manage funds for a disabled family member. For example a grandchild may have disability and you want to provide for them for their lifetime. The trust can be written so that the trustee takes care of their needs. If they are on SSI, a special needs trust can be created so that it does not disqualify them from those benefits.

Education Trusts. You can leave funds for your grandchildren’s education. The trust spells out the criteria for them to receive funds to pay for college education and states when the balance of the trust will be paid to them. Trusts are sometimes created to hold your children’s inheritance until a time you state it will be paid out to them. The trust can pay them income monthly, and distribute a certain percentage every few years or pay out all at once when they reach a certain age. You determine the terms stated in your trust. Oregon Celebrates 150 Years 2009 marks the year Oregon celebrates 150 years of statehood. We commemorate our Sesquicentennial on February 14 with events planned through the State Fair in September. Oregon 150, a volunteer board is planning this important birthday— and we want you to join the party.

Share Your Story Oregon is a state of diverse and interesting people. We come from different backgrounds and different faiths; we come from cities, ranches, and mountains. We each have our own Oregon story, and we hope you’ll share yours so we can get to know each other. For our 150th birthday, Oregon 150 is collecting and sharing “Oregon Stories”. Plan for the Bash What’s a birthday party without kids? Our three Youth Legacy Projects will bring tomorrow’s leaders together today and invite them to envision the changes they hope to see in Oregon over the next 50 years. Oregon’s youth are helping sustainably design and rehabilitate five local parks around Oregon, focusing on rediscovering nature and recreation with Oregon Parks and Recreation. And embedded throughout the entire state education system are curricula, projects, and activities focusing on the Sesquicentennial, linking youth to Oregon’s history and culture.

Oregon!” (originally commissioned for Oregon’s 100th birthday in 1959) is being updated and re-enacted by Pink Martini in a series of signature performances throughout the state.
