In 2015 we launched the Certified Rental Building Program (CRB) for larger owner and managers with multi-unit residential portfolios (apartments). The program has been well-received and continues to grow. I encourage all owners and managers of apartment buildings to seriously consider participating in the CRB program. I also strongly encourage you to read the article entitled Bringing “Military Precision” to Rental Housing Management, found within this issue of The Key, if you have any doubts about the value of the CRB program.

CHAIR’S MESSAGE Jason Middleton, Chair, LandlordBC LandlordBC’s profile as an advocate for a strong and vital rental housing industry has never been more pronounced. It is a tribute to our board, the organization and our membership that LandlordBC’s position as the de-facto voice of the industry is understood and appreciated by all levels of government, the media and all rental housing stakeholders.

With this comes increased responsibility and, in particular, an even greater commitment to professionalizing the rental housing industry.

In January, 2017 we successfully launched our second quality assurance program, the Landlord Registry. There are myriads of smaller landlords out there who operate with one suite in their home or have invested in a rental property. We knew that we needed a quality assurance program for them as well and, with that goal in mind, we created the Landlord Registry targeting the landlords themselves.

LandlordBC’s mission is to professionalize the rental industry and provide renters with an assurance of quality when renting their next home.

Our research shows that too many of them don’t treat their rental property like a business and they lack knowledge of the Residential Tenancy Act. This leaves them open to having a tenant take legal action against them which costs money and time. We’ve always said that a membership and registration with LandlordBC is like an insurance policy. With the recent launch of the Landlord Registry, that “insurance policy” has now been extended to the broader rental housing industry across B.C.

We know better than most that it’s a landlords’ market right now.

However, if LandlordBC can influence anything related to this current market status it would be that all landlords operate their business in a responsible manner and (of course) according to the Residential Tenancy Act. No more contravening the RTA when it comes to fixed term tenancies with a vacate clause. No more indiscriminate “renovictions” without proper consideration for the displaced tenants. No more gouging renters or generally acting unethically to maximize profits. What’s important to remember is that safe and secure housing has a massive bearing on families’ lives. When people are impacted by a tight rental housing market it induces stress that carries into all aspects of life. Despite the tight market conditions it is imperative that people act with integrity.

MY RENTAL HOUSING ‘INFLUENCE’ WISH LIST

WE WANT LANDLORDS TO GET REGISTERED

In February I was included in a section of Victoria-based Boulevard Magazine called The Influencers. I often say I have a face for radio, but their photographer worked wonders with the raw materials I provided and it’s flattering to be included. However, it made me think.

If in my position I do perchance have influence, what is it I’m trying to lead my organization to achieve?

Our Landlord Registry launched in January and we are already having a positive response. Our goal with the registry is to professionalize the industry by making it easy for landlords to educate themselves.

The flip side of the registry is that renters have an opportunity to vet their potential landlords to see if they are registered, meaning they know the basics of the Residential Tenancy Act.

There is no doubt that housing in B.C. is a hot topic. You can’t go to a dinner party without someone bringing it up…well and Trump — but that’s an aside. I challenged myself to come up with the three main aspects of rental housing in B.C. that I hope my organization can influence.

It is our view that getting registered in the Landlord Registry is the minimum standard for participation in our industry and we expect all landlords, property managers and building managers to get registered. We are especially targeting the secondary market (in case you’re confused, that means owners/landlords of basement suites, single family homes and condos). The basics taught by the registry are designed to reduce conflicts between landlords and renters and ensure a thriving rental housing market. Furthermore, your participation in the registry will show that you respect the broader industry and all the professional and responsible landlords that provide homes for British Columbians.

WE WANT MORE PURPOSE-BUILT RENTAL HOUSING CONSTRUCTED IN THE PROVINCE The only way out of the current market situation is to increase the supply of purpose-built rental housing throughout the province.

This is the long term solution, but we commend developers who are already getting onboard with this process. In markets where there is historically a tight supply of rentals available, municipalities can have a positive impact by fast tracking purpose-built rental housing applications. Demand and population growth to live in key areas of B.C. are likely not going to change drastically so adding to the supply is the way to go. Purpose-built rental is expensive to build. We need senior levels of government, in particular, to provide financial incentives if we hope to achieve the scale of development needed. And we need cities and municipalities to create an optimal regulatory environment to increase the supply of purpose-built rental housing.

The definition of influence is: the capacity to have an effect on the character, development, or behaviour of someone or something. This is my wish list of what I hope we can influence as an organization and we’ll continue to work towards “raising the bar” for the rental housing industry in B.C.

By A Would-Be Rental Housing Developer in Vancouver

“It’s time to address the imbalance of profit and risk which present themselves to housing developers who must choose between building condominiums and rentals.”

Metro Vancouver’s renters are suffering the worst rental crisis in two generations. The root cause? Demand for rental homes in the Lower Mainland vastly outstrips supply. Vacancy rates are intolerably low at less than 1 per cent in almost every category across the region and have stayed stubbornly below this threshold despite new rental construction. The region’s robust economy is creating new jobs and by consequence, new renters. Conflating these conditions would lead the casual observer to expect new purpose-built rental to materialize and in such magnitude as to cause a rise in the vacancy rate, thus affording renters relief when they search for a place to live. Indeed, construction of purpose-built rental housing has grown in the City of Vancouver and across the region as a whole, but nowhere near the required scale.

So while we are seeing growth in new purpose-built rental construction, we should not be fooled into complacency. Because rental construction badly tailed condominium construction for most of the past two decades, there have not been enough new units built.

While the total number of new housing units of all types including units available on the secondary rental market has more or less kept pace with growth in the number of households in the region over the past two decades, most of those newly-built units were ultimately occupied by purchasers, not renters. Non-resident foreign investors not recorded in household formation figures and vacation rentals have also taken up part of this new supply. The result is a veritable cordoning off of new housing supply from Metro Vancouver’s renters.

The market’s failure to deliver an adequate supply of rental housing is glaring. It is also perfectly understandable when existing housing policy is taken into account. The barriers which favour the construction of condominium housing over rental housing in British Columbia are numerous. Chief among these is the issue of risk mitigation. The developer of a condominium can pre-sell part or all of a project to individual buyers at any price she chooses and before putting a shovel into the ground. Should prices fall once the

project is complete, the buyers assume this loss. The developer thus has certainty as to profit before construction starts. By contrast, the rental developer assumes all the risk. Profit for the rental developer is tenuous.

Renters may wonder why this matters to them. The question of whether or not a developer makes a profit would seem to be irrelevant to renters. But developers act based on their desire to maximize profit and to reduce the risk of losing money. They can and will make choices when deciding whether to build rental or condominium. As Metro Vancouver’s housing start statistics bear out, developers have, absent incentives to do otherwise, built condominium instead of rental over the past decade. This is precisely why there has been and continues to be a grossly inadequate supply of new rental housing in Metro Vancouver.

Government policies can change this situation for the better. The City of Vancouver’s policy to offer increased density in exchange for secured market rental has definitely helped to shift multi-family construction towards purpose-built rental — in Vancouver, two out of every five new multi-family units built are rentals versus one out of every four for the region as a whole. But the fact is that an inadequate number of new rental housing starts are being commenced in Vancouver and elsewhere, as reflected in the continued ultra-low vacancy rates recorded for purpose-built rental apartments.

So what can government do to fix this problem? The answers are too numerous to list in a single article. Briefly, however, the most effective policy levers are those which address the imbalance of profit and risk which present themselves to housing developers who must choose between building condominiums and rentals. Municipalities can offer meaningful density bonuses for rental, property tax exemptions and fast-tracking of applications. Senior governments can rebate sales and other taxes. GST in particular is crippling because it applies not only to materials but also to labour and land.

Renters need to know that rental housing will only be built in sufficient quantities when the profit-risk ratio between condo and rental reaches equilibrium or, better yet, favours rental. The herculean task of putting in place appropriate policies falls to politicians in city hall, the legislature and Parliament. If our politicians fail to deliver, it is renters who will continue to suffer.

FEDERAL UPDATE AND CFAA CONFERENCE

By John Dickie, president, CFAA Since CFAA’s last report to you, there have been numerous developments affecting landlords in B.C. and across Canada.

NATIONAL HOUSING STR ATEGY The federal Liberal Government is committed to bringing in a National Housing Strategy. CFAA has been very active in the consultation leading up to that strategy. In particular, we took a leading role in the National Housing Collaborative (NHC), which brought CFAA together with social housing providers, the Home Builders, the Canadian Alliance to End Homelessness and numerous charitable foundations who work for the relief of poverty.

Thanks to CFAA’s work, the NHC’s recommendations are very supportive of what landlords and LandlordBC want. The NHC advocates: • A Canada-wide, broad based program of portable housing benefits, open to renters of most age groups and providing a significant benefit, especially in high-rent areas, such as Vancouver and Victoria.

• Low-interest loans for repairs to existing private rental housing and loans or an equity support fund for new construction of affordable rental units, by both the private or for-profit sectors.

• Funding for the regeneration of social housing.

• Increased funding to address homelessness.

The portable housing benefit program may roll out later as part of a federal poverty reduction strategy, but wherever it is placed, it is a key reform to help low-income tenants pay their rents in full and on time, thus relieving public pressure for tighter regulation of rental housing. CFAA’s submission is available at www.cfaa-fcapi.org. The NHC submission is available at www.nhc-cpl.ca.

MARIJUANA LEGALIZATION The government’s Task Force on Marijuana Legalization and Regulation reported in December. Landlords can support many of the recommendations. However, the Task Force recommends that any adult be permitted to grow up to four marijuana plants in their home, regardless of whether that home is rented or owner-occupied, or whether it is a single family dwelling or in a multi-unit building.

Medical users would continue to be able to grow much more.

Landlords would have no ability to prevent that and would not even have any right to know it is happening.

Most major cities require remediation in buildings after any marijuana is grown and insurance companies often cancel their policies if any marijuana is grown. In turn, that can often lead to the owner’s mortgage being called. Both actions can cause enormous difficulties and expense for landlords.

CFAA is seeking changes so that landlords will not be caught in the cross-fire, including the prohibition of marijuana growing in multi-unit dwellings and in rented dwellings of any size. Provincial

landlord associations may need to address issues of insurance with the provinces.

BRINGING “MILITARY PRECISION” TO RENTAL HOUSING MANAGEMENT

By Dave Marshall, Kelson Group Property Management Hello. My name is Dave Marshall and I’m currently employed with Kelson Group Property Management, a family-owned company based in Kamloops, B.C. I’m the assistant property manager and my job entails helping and supporting our two property managers who oversee a Kelson Group’s personal portfolio of more than 3,400 residential rental units, based in nine different cities across B.C. and Alberta.

How would you know that your list was complete and not missing a vital component or two?

My main task this past year has been to oversee and prepare Kelson Group’s B.C. buildings for accreditation into LandlordBC’s Certified Rental Building Program (CRB). We currently have six buildings certified in the Fraser Valley and are actively working towards certifying another 25 buildings in Kamloops and Kelowna.

Fortunately, all these requirements are planned out in advance at the highest levels of the army command and the necessary information comes down to the unit commander as part of his orders package. He will know exactly what he has to accomplish, how he is to accomplish it, and how much time and resources he has to work with along the way.

Prior to joining Kelson Group, I was fortunate enough to have a full 25 year career in the Canadian Military. I enrolled in the army in September 1983 as an infantry soldier, holding the lofty rank of private.

After many wonderful adventures, five overseas deployments and numerous postings across Canada, I eventually took my retirement in April 2008 as an infantry officer, in the rank of captain.

Eventually, several months later, the unit emerges from their cycle of preparation as a fully trained, cohesive unit ready to deploy overseas. The last portion of the preparation is an intense field training exercise where all aspects of the unit will be tested and evaluated by qualified army officers from outside the unit. Should the unit successfully pass the final field portion, the unit is declared fit and ready for deployment overseas.

As an observation, one of the aspects of military life which I always marvelled at was their amazing ability to take the rules and regulations and equally apply them to everyone. While no system is ever perfect, life in the army basically means that all the rules apply to all the people all the time. In other words, a simple annual fitness standards policy is enforced upon every member who is on duty, regardless of rank or position.

Now imagine for a moment that you are the owner/operator of a portfolio of rental properties or the owner of a licensed thirdparty property management company, and you are looking for a competitive edge over your rivals in the residential rental market. In the midst of running your company, how do you find the time to do a comprehensive review of all aspects of your company to see if you could be doing things better? Even if you had the time, would you have the requisite insight and ability to properly analyze your own company? As the old saying goes, a person doesn’t know what they don’t know. As the owner of the company, how can you implement something that you don’t even know about?

What I would now hope to relate to you is where I see the parallels between how the military conducts parts of its business and how the CRB program can significantly help a landlord or owner in the residential rental housing business.

First, I’ll need to provide you with some context. We are going to compare the method used by the army to prepare a large group of soldiers for an overseas peacekeeping mission to the method used within the CRB program to ensure compliance to its 50 Standards of Practice. Let’s start on the army side first.

When Ottawa decides to send Canadian soldiers overseas, a set of orders will be issued and those orders will then start to make their way down the military chain of command. A tour of duty on a peace keeping mission will generally last for a six month duration and involve between 1,000 and 1,500 soldiers so there are a million things to do in advance to prepare that many people to go overseas for that length of time.

Now imagine for a moment that you are the commanding officer of the unit being deployed and you have just received your orders to prepare your unit. Where would you begin the task of organizing everything? What if it was your responsibility to draw up a master list of all the requirements of the various equipment, training, ammunition, rations, vehicles, weapons, etc. that would be needed?

This is where the CRB comes into the picture. CRB has been created and built by leading experts in the Canadian residential rental housing industry as a way to provide a comprehensive, detailed, master set of best practices that an owner or property manager can use to examine and improve their overall methods of operation. Just like our unit commander with his orders package in the example above, owners and property managers can use the CRB program as a multifaceted tool to accomplish their desired mission of being certified as one of the best in their industry.

The actual process is quite simple to follow. Once the owner of a portfolio of rental properties decides to enroll in the CRB program, they simply contact LandlordBC and fill out the registration paperwork for the properties they want in the program (I recommend the entire portfolio). LandlordBC will then send out a detailed set of instructions that will include the 50 Standards of Practice. These standards are divided as follows into five categories: Human Resources Management, Resident Management, Operational Management, Financial and Risk Management, and Environmental Management.

The plan is now set for the company to follow. At their own pace, they review each CRB Standard and compare it to the current way they conduct their business and it quickly becomes apparent which parts of the company are running well, which things will need to be adjusted and, in some cases, new policy and procedures will need to be created and implemented to cover any gaps identified.

The huge advantage to each company that joins CRB is they don’t have to spend time and resources on trying to determine on their own what the best practices are for their industry. It is provided to them with clarity and they can simply devote their time and resources to implementing the changes required to become compliant with the CRB Standards.

Once a company has determined that they are ready, just like the unit commander above, there is a final test. They organize with LandlordBC for an independent auditor with specialized knowledge of the industry to visit the company, review the head office procedures and conduct site visits at each property that was registered into the CRB program.

Once the audit is passed, those properties and the company are entitled to be CRB certified and can use this accreditation in their marketing, put it on their website, use it in social media platforms and advertise on signage at the buildings, etc.

It really is a win-win scenario for all involved. The company can operate on a daily basis knowing it is using recognized rental

housing industry best practices and the residents of the buildings are assured a high level of professional management that they would not have in a non-CRB building. On a personal level, I equate the CRB accreditation as being very similar to the hotel star ranking system. If you are travelling somewhere for a holiday and wish to stay in a five-star hotel, are you going to even consider looking at a three-star hotel? You’ve already decided that you want a certain level of comfort and professional management and that’s all you’re looking for.

Having CRB accreditation is a five-star advantage for an owner/ operator and a property management company. Although there is an obvious cost and time investment required to become accredited, it will pay off in the quality of the rental prospects that will come to your buildings and eliminate operating inefficiencies that invariably infiltrate an organization when policies and procedures are not consistently understood and applied by the entire team.

Having quality tenants living in CRB accredited buildings that are professionally managed sounds like a winning long term formula for any rental housing provider. Just like the army unit commander we discussed earlier, having a well thought out plan to follow is always half the battle. It is very difficult to correctly move forward if you don’t know where you are headed.

A recent survey of participants shows an impressive 91 per cent satisfaction among owners and managers.

In October 2015, FortisBC launched the RAP program with one simple goal — to make it easy for landlords to reduce their natural gas consumption and associated costs. While landlords have had access to some utility programs over the years, RAP is the only program focused on helping landlords plan and implement upgrades from start to finish. The program provides four benefits: 1. Free high-efficiency showerheads/aerators; 2. Free energy assessments; 3. Free professional support for implementing capital upgrades; 4. Access to rebates for high-efficiency equipment.

This represents the biggest energy-efficiency effort undertaken in the rental apartment sector in B.C. As RAP is quickly becoming a critical program for helping landlords reduce operating costs, FortisBC wanted to know if the program was working and warranted continued investment by the utility. To evaluate if the program was meeting the needs of building owners and managers, FortisBC hired Cohesium Research to conduct an independent, third-party survey of program participants.

While the people managing the RAP program had anecdotal reports that it was being well received, it was important for FortisBC to get an independent evaluation of landlords’ experiences. The survey was anonymous so respondents would feel free to share their honest opinions.

RESULTS While positive results were expected, the degree of participant satisfaction was impressive. Nine out of 10 landlords were satisfied with the program and would recommend it to other owners and managers (91 per cent and 88 per cent, respectively). These are exceptionally positive satisfaction rates and indicate the program provides value to owners and managers alike.

WHAT WERE THE REASONS FOR THE HIGH SATISFACTION R ATE? • The most common reasons landlords gave were: • It was a smooth process and a great experience overall;

Landlords’ comments about program benefits included: “The bill did go down … tenants were quite happy … A lot of people are interested in saving energy” “We’re in need of replacing the boiler, the timing was great, the people I was in contact with were exceptional and quick in getting back to me. The engineers that walked us through the quotes were very helpful. Looking forward to not having to go to the apartment building this year to rescue the heating in the building” When given an opportunity to provide any other general comments about the program, common responses included: It was a good, well-run program and increase awareness so more landlords know about it.

While the program managers are pleased with the results, they are working on ways to further improve the program. This includes refining the energy assessments to provide more information, finding ways to better communicate technical details in easy to understand language, further strengthening communications from start to finish and evaluating opportunities for providing products and services that meet building needs in an efficient manner.

If you are considering whether it’s worth enrolling your building in RAP, this final comment from a participant summed up the program well: “I realized it was good for everybody, tenants, owners, the environment, and the buildings. I couldn’t talk myself out of this program. I am a busy woman, so I look for excuses not to put it on my plate. I couldn’t find a reason why not”

• The program gave them many benefits; • They were saving energy and money; • Good communication and responsive program personnel.

WHY LANDLORDS MUST HAVE A POWER OF ATTORNEY

By Seth Baker and Mike Biehuizen, Multi-Family Real Estate Services Bob and Karen (names changed to protect privacy) were dedicated apartment building investors. They worked hard to build their portfolio and owned three apartment buildings totaling 68 units. Bob had grown up working in house construction with his uncle. He took care of all the building maintenance and apartment repairs. Back in the 70s, Karen had taken some bookkeeping courses in college.

She looked after the building finances. She was never keen on fancy spreadsheets, but always kept a detailed ledger for each building for each calendar year.

Bob and Karen’s eldest son Dave had no other option than to apply to court to get appointed as Bob’s committee (pronounced commi‘tee). It cost Dave more than $6,000 in court fees, legal fees and taxes and took four months of effort. Worse yet, from that point on, Dave had to pay $25,000 annually as the premium for the surety bond that was ordered by the court and had to submit an accounting of his fathers’ assets every year to the Public Guardian and Trustee along with a $525 annual review fee. After two years of Dave managing the buildings while slogging through this bureaucracy, Bob passed away.

In their late 60s, Bob and Karen had taken all the “right” steps to prepare for later stages of their investment career. They had an estate plan, including a will, ensuring the properties would pass to their spouse when they passed away. They each were Power of Attorney (POA) for the other, in case something happened.

But Bob and Karen’s legacy lives on. The four kids enjoy equal ownership of the buildings. Bob and Karen have provided for their children in extraordinary ways.

Three years ago, Bob had a stroke. Luckily with the POA, Karen was able to sign on Bob’s behalf to renew the mortgage on one of the buildings.

But while Bob slipped further into incapacity, Karen suddenly passed away from undiagnosed cancer. The family was shocked. It was a brutal one-two punch that caught them totally off guard.

Because the three buildings were owned jointly between Bob and Karen, when Karen died, full ownership of all three buildings transferred to Bob. Unfortunately, Bob was mentally incapable and Karen was listed as his only POA. The buildings were now frozen. Their kids were helpless.

To make matters worse, Karen’s will left everything to Bob as well.

The issue was clear though. The buildings were stuck in limbo during Bob and Karen’s illnesses. When one spouse died, the buildings were frozen. Nothing could be done at this point to alleviate the children from grief and expense. However, if Bob and Karen had set up their POW correctly in the first place, it would have been a smooth, inexpensive transition for the family.

Planning your POA properly can mean the difference between achieving a dream and a nightmare for your successors. Landlords who own significant real estate assets need a POA to avoid massive problems if they become incapacitated or pass away.

WHAT IS POWER OF ATTORNEY ?

A Power of Attorney is where one person (called the “principal”) grants another person (called the “attorney” or “agent”) the authority to act on their behalf for legal or financial matters. It is a legal document that is usually prepared by lawyers or notaries.

Powers of attorney is granted to take care of a variety of transactions, such as executing a contract, re-mortgaging a property, selling an asset, or simply taking care of everyday banking. POA can be written to be either general (full) or limited to special circumstances. A traditional POA is terminated when the principal dies or becomes incapable, but the principal can also revoke the POA at any time.

In B.C., “enduring” POA are common. These are popular as they can still be used when the principal loses mental capacity. Most enduring powers of attorney last from the time the document is signed with a lawyer or notary to the time the principal revokes it or dies, regardless of incapacity.

There are two types of POA: a) a general POA, which covers all financial and legal affairs; and b) a limited

alone. You may consider appointing adult children, siblings, cousins, a trusted friend, business partner, or unrelated trust company. The key element is trust. Every once in a while, there is a story on the news about someone being ripped off by someone using their POA. The best way to prevent this is to name the right trusted person in the first place.

WHAT CAN A POWER OF ATTORNEY DO? A Power of Attorney can authorize someone to make any financial or legal decisions, including paying bills out of bank accounts; managing investments; renewing mortgages; selling real estate; negotiating and executing contracts; managing tenant disputes; voting the shares in a company; and start, defend or settle lawsuits.

TOP MISTAKES TO AVOID REGARDING POWER OF ATTORNEY ?

POA, which only grants powers confined to specific matters, such as managing some bank accounts, selling a piece of real estate, or executing company documents. A POA can also be set to expire on a specific date.

If there is a chance that it could be used to transfer real estate in the future, a lawyer or notary should witness all of the signatures.

WHEN DOES A LANDLORD NEED POWER OF ATTORNEY ?

Powers of attorney used to be for doing deals. They allowed a business-person to authorize documents when travelling. They provided a way to make sure you didn’t miss out on some important deal while vacationing in Mexico.

In modern times, widespread availability of internet and electronic signatures is quickly making this type of POA irrelevant.

Today, you need a POA to protect your assets when the unforeseen happens and you become incapacitated. If you’re incapacitated, real estate in your name can’t be mortgaged or sold without very expensive and time consuming court procedures. This includes properties with joint ownership (ie. two spouses on title, as both need to sign transfer papers) and properties owned in a corporation.

Now, no one expects to be in an accident or become seriously ill.

Most people don’t like to think about or prepare for undesirable outcomes. Bob and Karen’s story is a sad one. But, we all know that accidents happen. Illness happens. And it never happens at a good time. The smartest landlords take the steps necessary to protect their investment and their legacy.

A POA is cheap insurance in case something happens to you. It protects your family from expensive court proceedings. If you get knocked on the head and are in a coma, your spouses, kids, nephews, god-children, or whoever, will be able to take actions to protect your property, carry out your wishes and protect your legacy.

WHO SHOULD BE YOUR POWER OF ATTORNEY ?

Typically, a landlord will appoint a POA plus an alternate, just in case the first is unwilling or unable to act. It’s not enough to name a spouse

The three biggest mistakes a landlord can make is only appointing a spouse as POA, without having an alternate; appointing an untrustworthy person; and assigning a POA of a private company to owner of another private company.

As shown in the story about Bob and Karen, appointing only a spouse as POA can be a mistake. It’s important to have an alternate, allowing someone else to make decisions in the event that both you and your spouse are incapacitated.

The name of the game with POA is trust. Keep in mind, there aren’t many checks and balances for someone acting with a POA. While legally, your chosen person can only use your money for your own benefit, there are plenty of cases where people have massively abused this power.

Assigning POA over a property owned by a corporation must be approached with caution. In B.C., many apartment buildings are owned in holding companies. If you assign POA of your holding company to the owner of another private company, CRA may view the two companies as “related companies” for tax purposes. Depending on the income levels of the two companies, this could have hugely negative tax consequences.

If you own a company, consider appointing someone who does not own another company as your POA. If stuck, there is a way to carefully assign a specific POA for your company to that other company owner.

Talk to your wills and estates lawyer to see if this could apply to you and make sure you don’t get caught.

As you’ve seen by the story about Bob and Karen, apartment building owners need a POA. As a result of good planning, your legacy can be protected.

IS IT PRIVATE?

• Credit card information, however if both parties agree to rent being processed by credit card, this information would be given by the tenant to the landlord;

I often receive questions from landlords asking what information they can request from their tenants and prospective tenants. This issue is becoming even more relevant with the influx of refugees seeking rental accommodation in British Columbia. For the purpose of this article, the term tenants include prospective tenants.

• Criminal record;

BC PERSONAL INFORMATION PROTECTION ACT The BC Personal Information Protection Act (“PIPA”) governs how landlords collect, use and disclose personal information of their tenants. While PIPA references the term “organization,” this includes a person. Personal information is defined by PIPA as, “information about an identifiable individual and includes employee personal information…” If a tenant feels that their landlord is acting in contravention of PIPA, they can lodge a complaint against the landlord with the Office of the Information and Privacy Commissioner (OPIC).

INFORMATION A LANDLORD CAN ASK FOR When requesting information from a prospective tenant, a landlord may only request information that is reasonably necessary for the landlord to determine whether or not to rent the property to them.

A prospective tenant can refuse to provide personal information if the landlord’s request extends beyond this scope. However, what is reasonably necessary at the time may change and further information may become reasonably necessary during a tenancy. A landlord must have a reasonable purpose for requesting personal information, which must be disclosed to the tenant. A landlord cannot use that information for a reason other than the original purpose unless receiving consent from the tenant.

CONSENT Usually a landlord requires consent from the tenant to collect, use, or disclose the tenant’s personal information. There are some circumstances in which a landlord does not require consent of the tenant. Some situations include: • If a statue or regulation requires it; • In response to a warrant or subpoena; or • To collect a debt; There are also some situations in which consent is deemed to have been given under PIPA.

INFORMATION A LANDLORD CANNOT REQUIRE A landlord cannot request consent from a tenant to collect, use, or disclose information beyond what is reasonably necessary, as a condition of renting the property or providing any service. Some of which includes:

• Educational background; • Driver’s license, however a landlord can request to examine identification to verify a tenant’s identity when entering into a tenancy agreement; and • Health card number.

When determining whether information is reasonably necessary, it may also be helpful to consider Section 10 of the BC Human Rights Code (“Code”) which governs discrimination in tenancy premises.

Subject to a few exceptions, section 10 of the Code states that a person must not deny a person the right to occupy, as a tenant, space represented as being available or discriminate against a person regarding a term or condition of the tenancy of the space because of a protected ground under the Code. Protected grounds include, “… race, colour, ancestry, place of origin, religion, marital status, family status, physical or mental disability, sex, sexual orientation, gender identity or expression, age or lawful source of income of that person or class of persons, or of any other person or class of persons.”

For example, requesting information regarding a person’s religion is not reasonably necessary to determine whether to rent a property to an individual, as not renting a property to somebody based on that information is discriminatory under the Code.

DISCLOSING INFORMATION TO THE TENANT If a tenant provides a written request to access personal information that the landlord has, the landlord must respond to the request within 30 business days, which can be extended in certain circumstances. A landlord can charge a fee for covering the costs of providing the information to the tenant. The landlord must give the tenant an estimation of the fee before providing the information. When the tenant makes the request, the landlord must also advise the tenant how it was used and if it was disclosed and to whom. It is important to note that there are situations in which the landlord may refuse a tenant’s request for information, situations in which a landlord must refuse a tenant’s request for information, and situations in which information must be severed or blacked out on a document.

BOTTOM LINE The bottom line is, if the tenant’s personal information is not currently needed, don’t collect it. If you are unsure about your rights under PIPA, you can contact a lawyer or contact the OPIC for more information.

$600 per suite, per year for property owners and managers. Rental suites with separately metered utilities showed about a 48 per cent reduction in energy consumption, in contrast to non-metered suites.

Landlords have also reported that once residents are being billed for one utility, there is a habitual reduction in usage across the board.

Submetering also adds a level of efficiency in that all billing and customer service inquiries are externally handled, freeing up time and resources for owners and managers to focus on other issues. There is no other energy management technology or service — deployable to a multi-unit building — that can generate greater savings.

Q: WHAT ARE THE PROVEN ENVIRONMENTAL BENEFITS? A: Given the growing demand for a substantial global reduction in greenhouse gas emissions, the environmental advantages of submetering almost outweigh the financial and operational advantages in terms of significance. Data collected from our monthly billing analysis has shown that every time a unit is converted to a submetered system, the monthly energy usage drops by an average 150kWh per suite. This reduction is equal to 1.25 metric tons of carbon dioxide savings, or 32 trees grown over 10 years, for each suite. Though separate utility submetering continues to infiltrate buildings across Ontario, B.C. and other Canadian provinces at an increasing rate, there are still thousands of rental residential suites yet to be sub-metered. This represents a considerable opportunity to continue our industry’s world-changing contributions to greenhouse gas reductions.

Q: WHAT CHALLENGES AND RESTRICTIONS DO PROVIDERS IN THE SUBMETERING INDUSTRY FACE? A: There has been a slight hesitation from owners and managers with buildings in areas that have slightly weaker rental markets, due to concern that a building may not be as competitive from a marketing perspective with separately billed electricity and utilities. However, this concern is diminishing quickly as submetered buildings become more and more prominent across the nation and the financial and

ecological benefits begin to outweigh these concerns. There are certain provinces, such as Quebec and Manitoba, that have had trouble implementing submetering systems due to restrictive regulatory environments. In response to this issue, adaptable solutions are in the process of being developed.

In addition, some providers have advanced web portals for both residents and property management teams – delivering sophisticated amounts of information in easy-to-use, simplified formats.

As submetering increasingly becomes the norm across Canada, landlords face a new pressure to not only implement sumbetering systems, but to evaluate the various providers in the industry to ensure the most professional and efficient billing and customer service for their residents. Despite these challenges, the delivery of sub-metering is increasing at a very rapid rate in most provinces across the country.

Q: WHAT LIES AHEAD FOR THE SUBMETERING INDUSTRY ?

A: Increasingly, economical metering can be expected from new, compact water sub-meters that are equipped with Wi-Fi enabled communication devices. The advancements in new, compact multicustomer metering systems are also facilitating the completion of comprehensive projects, previously deemed economically unfeasible. European based Thermal or BTU metering is gaining traction in new construction and existing rental properties. Forwardthinking sub-metering providers are offering full integration between

Screening applicants for your rental unit who may have this license is not an option in this situation as license is specific to the rental property and cannot be obtained prior to tenancy. Additionally, screening against persons who require medical marijuana to treat an illness would constitute unlawful discrimination under the Human Rights Code.

Medical marijuana grow operations in rental housing is not new, but the issues they can present to landlords still persist. There was a recently published article in the media regarding a tenant’s ability to obtain a license to grow medical marijuana through Health Canada without any consultation with the landlord. While the focus of the article paints a bleak picture of landlords stuck in a situation where they may feel their options are limited, there are several avenues a landlord can explore to mitigate their potential loss and possibly end tenancy.

WHAT DO YOU DO IF THE LICENSE IS VALID AND THE TENANT IS COMPLYING WITH THE STIPULATIONS REGARDING NUMBER OF PLANTS?

Health Canada does issue licenses to grow marijuana for medicinal use to tenants of rental properties without consulting the homeowner but, these tenants are still subject to the rental agreement and Residential Tenancy Act and tenants do not necessarily have carte blanche to alter the rental unit and put the landlords lawful right in significant jeopardy.

Ask your tenant for a copy of their license and contact the RCMP/local police through their non-emergency number. They will be able to authenticate its veracity. If it is an expired license or otherwise invalid, the tenant would be running an illegal grow-op and would be handled by the authorities.

The Residential Tenant Act has several protections in place that while they may not seem obvious at first glance, afford landlords the right to protect their property. The Residential Tenancy Act gives landlords the ability to end tenancy based on: • the tenant seriously jeopardizing the lawful right of the landlord; • the tenant putting the property at significant risk; • the tenant causing extraordinary damage to the rental unit and, • the tenant failing to comply with a material term.

A landlord may find that their situation meets one or more of these reasons to end tenancy when their tenant is running a legal marijuana grow operation. For example, if the landlord insurance is cancelled or invalidated because of the grow operation, the landlord would have grounds to argue that their legal right has been seriously jeopardized. In this scenario, the landlord may also have a clause in their agreement that specifically states that the tenant will not do anything that could invalidate the landlord’s insurance – this would be a breach of a material term of the tenancy.

Since then we have had a great deal of interest in the program and have certified 23 more buildings (eight additional Hollyburn buildings, five Redbrick Properties buildings, seven Kelson Group buildings, three Orr Development Corp. buildings). This brings the total number of certified buildings in B.C. to 73. Kelson Group and Orr Development Corp. are the most recent companies to complete certification. Congratulations to Kelson Group and Orr Development on their recent certification!

In order to become certified you must be a member, in good standing, with LandlordBC and must complete an application and screening process. Once registered in the program you have access to the 50 standards of practice (SOPs) involved in the program. You then begin to build a ‘compliance binder’ (digital or print) to show how your company meets the standards of the program. “This space makes me feel (insert adjective here).”

We’ve all been there before: a grey room on a grey day, a red feature wall that is more distracting than demure and a purple which only reminds you of Crayola’s Purple Heart, not ideal. You’re not wrong to feel a certain way when surrounded by a given colour. Although we all have personal preferences, there is a large body of evidence which supports colour psychology and selecting a colour to meet your unique goal for the space at hand can be a daunting task.

After recently partnering with a colleague of mine to project manage our own office makeover, my colleague and I did extensive research about colours: the best for productivity, the most calming and for me as a marketing manager, the most on brand. We gathered up data, selected a few of our favourite shades along with our affiliated colour consultant, and put them out to our team. Even with a

small office crew, the decision was quite personal and split down the middle between a corporate blue and a more modern green.

One of our key points of research reference for the new hue was the Plutchik Wheel, developed by Robert Plutchik in 1980 which relates emotion to colour. The Wheel features three tiers of emotion each worsening in severity the closer they get to the middle.

In the end, a vote declared an on brand, modern moss green to the feature wall of our new office, along with clean white on accompanying walls, doors and frames. Shortly after, we felt a boost in our productivity and creativity too, proving to us that colour does impact an interior space.

According to the Plutchik Wheel, green can relate acceptance, trust and admiration: great for an office space. Further in our research, popular business resource Forbes, blankets that green sparks creativity while yellow is a seldom adored colour. Blue is known as the most widely accepted business shade and red reduces the ability to engage analytically (bringing injury to the mind, therefore elevating stress levels). Further, the article suggests that orange is often associated with good value, white can cultivate boredom and pink is calming. This article speaks to North Americans, as colour has much to do with geography and culture, too.
