I don’t want to say we feel vindicated -but we do. Last week the Office of the Information and Privacy Commissioner (OIPC) ruled that, yes, in fact, the city does have to provide the Richmond News with documents that may shed light on why the opening of the Minoru Centre for Active Living (MCAL) was delayed by three years. (See page 4) The centre was originally expected to open in 2017 but didn’t fully open until September 2020. This information tussle between the city and ourselves began back in 2017 when the first anticipated opening date came and went, with still no new facility. We began asking why. At the time, we were told it had to do with bad weather and a labour shortage. Indeed, there had been bad weather and a

labour shortage but that still didn’t explain a full year’s delay. Besides, we could point to other similar projects that were getting finished on time, or at least close to.
We immediately appealed to the OIPC to review the case, but that process didn’t start until almost two years later in 2021 — talk about an exercise in patience.
In February 2019, our reporter Maria Rantanen filed a Freedom of Information (FOI) request with the city, asking to see documents related to delays in the facility’s construction.
During that time, in February 2020, the construction company hired to build the facility, Stuart Olson, launched a lawsuit against the city regarding the project.
The city didn’t respond for another five months but in the meantime (March 2019) announced that the facility would open — just in time for March Break. Two weeks before the grand and longawaited for opening, however, the city announced that while the seniors centre would open, the pools would not because they had found cracks in them. In July 2019, five months after we had submitted our FOI, the city responded saying that it would not provide any documents other than four, three of which of which were press releases that they’d already sent out.
In their pitch to the OIPC, the city said it couldn’t disclose the documents because making them public could give Stuart Olson, now their adversary in court, a legal advantage. That, even though Stuart Olson didn’t launch its lawsuit until well after we had made our FOI request. Regardless, last week the OIPC adjudicator announced many of the documents had to be disclosed to the Richmond News because, in part, most of the information in them had been shared with a third party, so is already accessible to Stuart Olson. Making the documents public would not damage the city’s case in court, he stated. Now, I can’t say what’s going on in the
minds of the city lawyers, but I would guess there is nothing the adjudicator said in his recent report that they didn’t already know. In other words, they knew Stuart Olson would have access to the information and that giving it to us would not impact their case. However, as we all know there is the court of law and then there’s the court of public opinion. And it’s the latter that they’re trying to control. It is not our intent to give one side or another an unfair legal advantage. It is our intent, however, to ensure the citizens of Richmond are privy to how a multimillion dollar project, being built in their name with their money, is being handled. These documents may very well prove to be tedious reading. We have no reason to suspect there’s a smoking gun nestled in there. But that doesn’t mean this little victory isn’t important. In fact, it’s really important if we believe in public accountability.

The City of Richmond has been ordered by the privacy commissioner’s office to hand over information about the construction of the Minoru Centre for Active Living (MCAL) to the Richmond News after a three-year battle over the documents. The project was delayed by almost two years, and the aquatic portion was further delayed by about 18 months after cracks and leaks were found in and under the pools. After being told repeatedly that delays were largely due to the weather and labour shortages, the News filed a freedom-of-information request in February 2019 to see documents related to the delays. By this time, the city was being sued by the builder, Stuart Olson, for $7 million over the construction project, and the city claimed releasing the documents
would jeopardize the lawsuit, giving an advantage to the builder. The News asked the Office of the Information and Privacy Commissioner (OIPC) to review the city’s decision. In a decision released late last week, an OIPC adjudicator stated the documents should be made public because much of what’s in them is already available to the opposing party.

The adjudicator has indicated to the city which records — either wholly or partially — need to be released to the News, and has given a deadline of May 16.

Suspected arsonist may have thrown Molotov cocktail into home Alan Campbell

A suspected arsonist has been charged with targeting the same Richmond home twice in two days. Maximino Dauz is alleged on March 29 to have set fire to a garage door of a home in the 9,000 block of Auburn Drive, in the South Arm neighbourhood. According to police, the homeowner was able to extinguish the fire, which resulted in moderate damage to his residence. But two days later, Dauz is alleged to have returned to the home and thrown a “Molotov cocktail” inside. The homeowner, say police, found the explosive device but, fortunately, it failed to ignite. In reviewing video surveillance, Richmond Mounties spotted who they believed to be the same individual approaching the residence and committing the alleged offences. The man was ultimately identified, quickly arrested, and held in custody. The BC Prosecution Service has since approved 10 charges against Dauz, including arson, arson causing property damage and mischief endangering life. He was remanded and remains in custody. “Fortunately, no one was injured but the sheer lack of regard for human life and wanton destruction of property in these alleged offences is frightening,” said Insp. Michael Cohee, officer-in-charge, Richmond RCMP Operations Support. “…our investigators were able to identify and quickly arrest this suspect before something even worse happened.” The investigation, added police, remains active and ongoing. Gold fraud suspects arrested and called the police.

Two suspects were arrested as part of an ongoing fraud investigation in Richmond. A stash of fake gold jewelry and other items were seized as part of the fraudulent gold transaction that occurred in Richmond earlier this month, according to the Richmond RCMP. A man was approached by another man and woman who tried to sell him gold for cash in the 5500-block of Garden City Road on March 19. The man suspected the gold to be fake and declined the two people
On March 22, police arrested two suspects and executed search warrants that showed evidence they were part of “a sophisticated” gold fraud operation. “We are very pleased to have made such significant progress on our investigation so quickly,” said Cpl. Ian Henderson, media spokesperson with the Richmond RCMP, adding the investigation involved different police units. “More information will be forthcoming once charges have been approved.” Richmond RCMP said fake gold jewelry is a problem across Canada and not just in B.C. Police forces are warning the
public to be wary of people approaching them with gold jewelry offers for cash while on the streets, reads an RCMP statement. It added that gold fraudsters typically target people who appear approachable and then “play on their emotions” such as telling stories of needing money to get home. “Their stories are bogus and so is their gold,” said Henderson. “If you are approached, say ‘no thank you,’ get to a safe location, and call police.” If you have information on similar suspicious activity, call Richmond RCMP at 604-278-1212 or anonymously through Crime Stoppers at 1-800-222-TIPS (8477).
Alleged B.C. fraud ring busted by cops Four men have been charged in connection with an alleged fraud ring perpetrated across B.C. Richmond RCMP’s economic crimes unit (ECU) carried out an investigation over the last 18 months or so in multiple cities, including Richmond, Vancouver, Surrey, Langley, Cranbrook, Kamloops, Kelowna and Regina. Their probe resulted in multiple search warrants being executed at locations allegedly connected to the fraud ring in Richmond and Vancouver. The BC Prosecution Service has approved a total of 24 charges, including fraud, forgery, possession of property obtained by crime and unauthorized possession of a fire-
arm against one of the accused. Those charged are: Christopher Birkbeck, of Surrey; Michael Ridley, of Ontario; Richard Yeltatzie, of Richmond; Ayron Borovic, of Vancouver. Yeltatzie has also been charged with eight crimes, including fraud, on another Richmond file. That file relates to February 2020, when Richmond’s ECU team conducted an investigation where a residence was allegedly sold by fraudulent means, unbeknownst to the homeowner. In this case, the BC Prosecution Service has approved eight charges against Yeltatzie and three against a Kieran Yeltatzie.

Armed kidnapper pleads guilty A 30-year-old man has pleaded guilty to kidnapping a victim from a vehicle at gunpoint in Richmond. Michael Husain appeared from custody at Vancouver Provincial Court on Wednesday, where he faced a string of charges connected to the incident in September of last year. Husain admitted three charges, including kidnapping using a firearm, assault causing bodily harm
and using a firearm to commit an indictable offence. He will appear back in court in September, when he will be sentenced for the offences. Three other people were charged in connection with the kidnapping — Ashley Smith, 30, Harman Parmar, 24, and a fourth person, whose name is subject to a court publication ban. According to a Vancouver Police Department (VPD)
statement last fall, the victim was assaulted, restrained and suffered significant, but non-life threatening injuries. Following a “brief pursuit” by police, the victim was rescued by VPD officers and the four suspects were arrested in Richmond. An investigation into home invasions, said police, led to the suspects being charged with kidnapping. —Alan Campbell/News

A mediated resolution at the end of March means Richmond city staff members, who were put on unpaid leave on Dec. 20 because they refused to show proof of vaccination, were allowed to return to work and get back pay to Feb. 21. This resolution came just days before the city lifts its vaccine mandate on April 8 when these workers would have been allowed back to work. Thirty-six city staff members, includ-

The issue was settled with a mutually-agreed-upon mediator, Randall Noonan. Noonan was the arbitrator who ruled in December that the city’s vaccine mandate could continue when the unions asked for an emergency decision. In his January decision, Noonan
said he didn’t have enough evidence to prove there was an acceptable alternative to the city’s mandate that would “meet the goals of preventing the spread of the virus while eliminating those personal consequences.” Those employees who aren’t vaccinated cannot work in “front-facing” jobs until the vaccine mandate is lifted on Friday, said city spokesperson Clay Adams. Some staff chose to use their vacation time to cover the unpaid time — this vacation time will be reinstated, Adams explained, adding funds to pay for the retroactive pay will be covered by the current budget.

According to the owner, Alderbridge Way LP, the construction lender suspended funding early in the COVID-19 pandemic. Alderbridge Way LP applied Friday to the B.C. Supreme Court for protection under the Companies’ Creditors Arrangement Act, which would allow for restructuring of its business, rather than bankruptcy. Under court supervision, the owner will then either figure out a way to move forward with the project or find a buyer. The family of a murdered man is still looking for answers, almost three years after he got into an argument on a Richmond transit bus before being brutally stabbed to death in broad daylight. Several Richmond students and activists attended Monday’s general purposes committee meeting to advocate supporting the international treaty. The treaty aims to end new exploration and production of coal, oil and gas, phase out existing production of fossil fuels and create a transition for workers, communities and countries in the industry. Six people shared personal stories on how climate change is affecting the world and why they believe endorsing the treaty would be beneficial to the city. In the end, in a 5-4 vote, council decided to ask city staff to bring back more information in a month and then they will decide whether to endorse it. City Couns. Michael Wolfe, Harold Steves, Chak Au and Carol Day voted to endorse the treaty and to further work on more climate change solutions. However, Couns. Bill McNulty, Andy Hobbs, Alexa Loo, Linda McPhail and Mayor Malcolm Brodie all opposed endorsing the treaty at this time, saying there wasn’t enough information for council to make a decision right away. Instead, city council sent the motion to city staff for referral and have it return in a month after a report on the “analysis and specific
implications of the treaty” is made.
“By referring this (motion) back, I don’t treat this as a time-waster or a deflection,” said Brodie, adding the referral to city staff will clarify all the implications for the treaty to be endorsed. “I think we will get much farther by having a stronger motion and referral to staff will accomplish that.” During the meeting, councillors highlighted the city’s opposition to the jet fuel line and the Tilbury LNG expansion as well as its work on dykes being done around the city to tackle climate change. Despite the “disappointing” outcome of the meeting, Richmond students Naomi Leung and Sandra Chang said they were inspired by the speeches made by their peers and “understood where (councillors) were coming from.” “I am in agreement with Coun. McNulty and others who presented on how further climate leadership must take place beyond endorsing the call for this treaty,” said Leung. Both the youth said they will be researching and educating themselves in preparation of returning to city hall to talk about the treaty again next month. Q: What is the difference between having an immediate denture and a denture that is made after I have extractions?

Immediate dentures are always best, unless there is so much mobility in your teeth that taking an impression may cause an accidental extraction when the impression is removed. The immediate denture will act as a band aid as well as to help reshape the bone to a kinder more rounded form, rather than leaving the sharp edges that are formed by the circumference of the extraction socket. Follow up must be done by your dental practitioner in order to keep up with the changing shape as the bone and tissue heal. If you have extractions done and the denture is made after a period of couple months then the bone from the circumference of the socket has prematurely healed and is now standing up. When a denture is placed on the tissues, the bone from underneath now stabs you from the inside out. There is one way that you can do the latter method. Once your initial wound site has closed, then you must massage the bone together towards the center of gum. This will tell the body that the bone must reshape to a rounder shape. Two hundred more garden plots in Richmond are ready to be planted with fruits, veggies, legumes or flowers — depending on the individual gardener’s taste.
The city has been adding elements to the Garden City Lands after buying it in 2010 for about $59 million. Over the past 100-plus years, the 136acre parcel has had various uses — and various plans, some of which were eventually shelved or fell through.
However, all the plots, located at the Garden City Lands, are already spoken for, and the waitlist city-wide for community garden plots continues to be in the 500-person range. At the official opening on Monday morning, Richmond Mayor Malcolm Brodie pointed out 40 to 50 years ago, Richmond residents usually had room in their own large-lot backyards to garden, but with the city densifying, this is no longer possible for many residents.

This 200-plot community garden, which is in the Agricultural Land Reserve, is larger than many other community gardens in Richmond, some of which have just a few dozen plots.

The city received a grant a few years ago of $175,000 from the Federation of Canadian Municipalities to study the soil contamination, something that will take two to three years to complete. There were other ideas on how the Garden City Lands could be developed. A stadium was proposed on the Garden City Lands in conjunction with the 1994 Commonwealth Games, which Richmond was bidding for. Later, the Lands were proposed as an international broadcast centre for the 2010 Olympics, while another idea was to pull it out of the ALR and make it a residential area with sports facilities. None of these materialized, and, finally, in 2010, city council voted to buy the land. While Brodie said it’s fair to call the current plans “piecemeal,” a larger vision of the Garden City Lands is being worked on. “We have an overall concept but we have to drill down on (details),” he said, adding, however, everything that is done on the Lands needs approval from the ALC.

JARVIS, Marcus Dennis Brian May 22, 1928 – March 27, 2022 Brian was born in Croydon, England to parents Frederick and Muriel, younger brother David and older sister Jennifer who have both predeceased him.
As many of that generation did, he emigrated to Canada in 1951 after the Second World War, eventually ending up in Vancouver where he married Minka, a fellow émigré from Holland, in 1954. She sadly passed away in 2007. Together they had six children: Michael (Diane) deceased, Anne (Randy), Richard, Philip, David, Vincent (Julie), four grand- children Lindsay (Brandon and great-grandson Nolan), Stephanie (Adam), Austyn and Keigan. Brian’s lifelong career in the airline industry began with Dehavilland and A.V. Roe Canada and ended with Canadian Pacific and CPAir as the Manager of Line Maintenance, International. Through the years he and Minka enjoyed travelling, attending many concerts performed by the Vancouver Symphony Orchestra, and sailing his self-built Fraser 30. He was an avid gardener always looking forward to spring and the next planting season for his beans and prize tomatoes, as well as his many roses. He was also a great cook, making canned salsa and tomato sauce from his abundant crop, and he was the family authority for making pastry, especially his sausage rolls and Cornish pasties. The family is thankful he was able to remain in his home largely independently until the final months with help from family, caregivers and the Fraser Health team. Memorial will be held at 2:00 pm on April 30th, 2022 at Valley View Funeral Home and Cemetery, 14660 72nd Ave, Surrey.
