WHO WILL RAISE YOUR CHILDREN IF TRAGEDY STRIKES? The Wills Lawyer The following story is from the book “Where There’s An Inheritance”, written by Les Kotzer and Barry Fish.

Rebecca and Kevin had two children aged six and eight at the time they made their wills. They decided to name Rebecca’s sister, Pamela and her husband, Herb, as guardians of their children. Rebecca and Kevin trusted Pamela and Herb to the ends of the earth.

Less than a year after making their wills and appointing Pamela and Herb as their guardians, an accident claimed the lives of both Rebecca and Kevin. The provisions of their wills now meant that Pamela and Michelle Kotzer Herb were to be guardians of the two young children.

As devastating as the loss of their parents was for these two children, there was even more bad news in store for them. A few months after the two children had settled in to live with Pamela and Herb, Pamela caught Herb having an extramarital affair. Now a nasty divorce was placing the children of Rebecca and Kevin right in the heat of the battle between their aunt and their uncle. Herb unexpectedly raised the stakes in his negotiations with Pamela by claiming custody of Rebecca and Kevin’s children.

The fight was bitter. Pamela and Herb had no children of their own, and Pamela accused Herb of using his young niece and nephew as pawns in his battle to extort a better settlement from her. For months, the children seemed to be at risk of having to move out from their aunt Pamela’s home.

Pamela ultimately obtained custody of her niece and nephew, but the divorce was both expensive and stressful. If only Rebecca and Kevin had named Pamela as sole guardian, and had not mentioned Herb, Pamela’s little niece and nephew would have been spared a great deal of the pain and suffering they had to endure. To Pamela, it was clear that, if her sister Rebecca could have seen how Herb had abused her trust, and used her two young children as pawns, she would have been horrified.

In my wills practice, I see many couples with young children. The discussion of who to appoint as guardian in case both spouses are killed in an accident, is a difficult one. As I once mentioned in a previous article, I do not know how parents with young children can sleep at night without a will appointing a guardian. The person you appoint as guardian will raise your children until they reach the age of 18.

Deciding who to appoint as guardian of your children if you pass away is a difficult task, and you should give great thought as to who you are appointing.

As the story above illustrates, if for example, you are appointing your sister as guardian, it may be prudent to only appoint her and not her husband.

Alternatively, if you are appointing your brother, the same thinking applies.

Moreover, some people name the same person as both executor and guardian in their wills. This combination could lead to a potential conflict of interest. It may be prudent to appoint a different guardian than executor in your will. By separating your guardian from your executor, you are establishing checks and balances within the administration of your estate.

It is important to remember that the guardian you have named in your will may not accept his or her appointment as guardian once you have passed away. It is important to tell your proposed guardian of your intention to appoint him or her in your will. You should also consider appointing a back-up guardian in the event your primary guardian does not accept the appointment when you pass away.

I grew up in over 13 towns and cities across the country and experienced the public education system and its imagined Canadian identity in every one of those places.

Yep — I learned the propaganda that every Canadian my age learned: We are a nation built on universal values of democracy, human rights and environmentalism intimately connected through a "mosaic" of diversity, a northern climate and pristine landscape.

Let’s get real … all Canadians must question the legitimacy of these "imaginary" claims due to the historical hatred directed toward the First Peoples of this land and the ongoing lack of awareness, education, and movement building toward reconciliation and the forging of reciprocal relationships based on equality and respect.

Just today I was on Facebook calling for the resignation of Sen. Lynn Beyak, who said earlier this year that "good deeds" and "remarkable works" on the part of well-meaning residential school officials have been ignored in favour of more negative reports by the Truth and Reconciliation Commission. Just yesterday I was donating mon-

ey to the GoFundMe campaign initiated by the relatives of Barbara Kentner, an indigenous woman living in Thunder Bay who was the victim of a drive-by assault in January 2017 by a white man who shouted, “I got one,” after throwing a very large trailer hitch at her body from a moving vehicle.

My challenge is to answer the call of one of Canada’s most worthy senators, the former chief commissioner of the Truth and Reconciliation Committee who, in response to Beyak’s statements during a public forum in Ottawa on missing and murdered indigenous women, asked Canadians: “Why can’t you always remember this?"

He was referring to the deliberate amnesia that Canadians have when they ‘imagine’ who they are.

“Why can’t we remember and honour the truth of our nation ... this is about memorializing those people who have been the victims of a great wrong."

I’m remembering who and what Canada actually is … and therefore I’m imagining what we could become. A confederation that chooses not to forget its past - but rather memorializes it in order to imagine and build something better.

How about Kanata 150?

Acknowledging the rich history already embedded deep in the land that includes the principle that rights, equity and respect should belong to all.

Overarching Statement of Cultural Heritage Value or Interest The David Dunlap Observatory (DDO) is a place of high cultural value manifest at all currently recognized levels/categories associated with heritage significance. Its cultural heritage landscape is comprised of a 19th century farmstead overlain with the University of Toronto’s remarkable astronomical research campus conceived as well as a memorial to the husband of the facility’s donor and patron. The three major structures within this landscape each exhibit a particularly high quality of design and use of materials – Elms Lea as a particularly fine and ‘architect’ designed 19th century farmhouse; the Observatory manifesting ‘leading edge’ functional innovation as the envelope for the great telescope, and the Administration Building profoundly combining the ceremonial and scientific in the Beaux-Arts form of the period. The building interiors each have outstanding features such as: the 74” telescope, largest in the Commonwealth when installed within the Observatory, and its raison d’être; the first floor plan of the Administrative Building with the main axis set to the cardinal points intersecting at the memorial at its core, and the main winder stair at Elms Lea which appears to be almost floating.

Deep historical associations ranging from the locally significant Alexander Marsh family, to the rise of astronomical research at University of Toronto and Canada generally and culminating with important contributions to the world’s understanding of astronomical phenomena.

SPECIFIC TO THE CULTURAL HERITAGE LANDSCAPE Statement of Cultural Heritage Value The David Dunlap Memorial Observatory Site is a complex cultural heritage landscape comprised of the ‘overlay’ of a 20th century ‘state of the art’ astronomical observatory on a 19th century farmscape. There are two major layers/themes which are represented. The first is that associated with the farmstead of Alexander Marsh. Marsh, the grandson of area pioneer Robert Marsh, inherited Lot 42, Concession 1 Markham Township from his grandfather in 1852 and established a prosperous farm there (as well as on adjacent Lot 17 to the east) through the second half of the 19th century. His farmstead came to include 300 acres, three houses, and seven barns and/or stables. Originally occupying a frame house on the site which may have dated to the original patentee he had a new home for his family designed and built c.1864. This fine dichromatic brick house which came to be known as Elms Lea brought together eclectic influences in a picturesque composition. Sited on a rise deep within the property reached by a long lane from Yonge Street and screened by a stand of spruce, it later became the residence of C.A. Chant and subsequent directors of the DDO. The dream of C.A. Chant, referred to by many as ‘the father of Canadian astronomy’ (who originally hailed from the area), the David Dunlap Memorial Observatory has been the site of much important astronomical research (including several ‘ground breaking’ discoveries), the cornerstone of astronomical education for generations of University of Toronto students and the site of pioneering efforts in Radio astronomy spearheaded by the late Donald MacRae, also a DDO director.

The property, encompassing Lot 42 and the south half of Lot 43, was originally selected as the Observatory site for its topography - a pronounced rise relative to the surrounding area - lack of light pollution and relative accessibility to the University. Major earthwork further enhanced the location selected for the Observatory itself creating a

podium like plateau. The circular observatory structure was designed and prefabricated in Great Britain to house the 74” telescope, largest in the British Empire at that time. The telescope, with its 5,000 pound mirror, is supported by the ‘great pier’, the concrete core of the building, constructed prior to the arrival and erection of the building shell in 1935. The large copper dome is built to rotate and there is a 15’ wide section which retracts for siting the telescope. The Administration Building, designed

by Mathers and Haldenby, is a particularly fine Beaux-Arts composition which also incorporates three copper observatory domes, the most northern of which houses the University’s original telescope from 1906.

The siting of the two structures, placed at right angles to each other and at cardinal points, is indicative of the formal landscape which was originally designed for the site, the key axis being the approach to the Observatory from the south. The realization of this concept was only achieved, in a modified form, in 1959. Also in the 1950’s the Radio Astronomy program was established with the associated construction of a ‘Radio Shack’, (designed as a picturesque cottage), pyramidal horn antenna and ‘zig zag’ antenna directly east of the Administrative Building.

With the construction of the modernist Caretaker’s Residence in 1970, in a form which, along with its carport, provides a gateway to the site, three dramatically different periods and architectural styles could be said to be harmoniously represented on the property.

At its opening in May 1935, attended by Prime Minister Mackenzie King, the David Dunlap Memorial Observatory was proclaimed “a gift to science all over the world” and the Royal Train carrying King George VI and the future Queen Elizabeth II stopped in acknowledgment of its importance site during their visit of 1939.

Achievements directly associated with the Observatory such as Helen Hogg’s work on variable stars in globular clusters and C.T. Bolton’s investigation of Cygnus X-1 as a black hole as well as the determination of the absolute flux density of Cas A at 320 MHz have indeed significantly contributed to our understanding of the universe.

Important internationally for the research it has produced it is also a local landmark to the suburban community which grew up around it and has been the site of many birthday celebrations and weddings.

Richmond Green Park is Undergoing Renovations Richmond Hill’s Public Works Operations Parks Division is performing some renovations at Richmond Green Park. Construction is underway and is expected to be complete by the end of June.

The 2017 program has reserved $30,000 toward heritage restoration projects. Owners of designated heritage properties are encouraged to apply for a grant of up to 50% of the total cost of eligible restoration work, to a maximum of $5,000 per project. Grants are reviewed on a first-come-first-served basis.

We won’t be intimidated

TheLiberal.

A group of disgruntled city councillors in Brampton seem to be confusing freedom of the press with freedom from the press.

Angry with recent coverage by the local newspaper, some councillors are proposing a motion to scrutinize the media’s questioning of elected officials. It’s a thinly veiled attempt to intimidate reporters. The motion calls for all media inquiries to be posted on the city website along with responses. Councillors want future meeting agendas to include time to respond to media coverage.

Meanwhile, at least one member of Brampton council has taken to Twitter, suggesting the local paper isn’t providing "real news."

If it sounds reminiscent of the antics of President Donald Trump and his staff, that’s because there’s a strong and troubling parallel.

This is all in reaction to assertive reporting that is critical of the city’s leadership.

Councillors say they have put the press on notice.

Such a statement demonstrates a blatant disregard for, or ignorance of, the checks and balances already strongly entrenched in the Canadian media system.

Accountability starts with the news outlet itself.

Complaints can be made directly to a journalist, editor, or publisher.

If the response is unsatisfactory, individuals can contact the press council. The National NewsMedia Council deals with matters concerning fairness of coverage, relevance, balance and accuracy. Its members (including this newspaper) abide by its decisions. It’s a free and open process for the public.

When media make a mistake, we own it very publicly.

That’s not something everyone can say.

And there is the law. Canada has very strict libel laws. These laws protect the reputation of individuals and organizations from false and derogatory remarks.

Media are bound by these laws.

There have been no formal complaints made regarding recent coverage of Brampton. Instead, this is about a group of councillors lashing out because they are upset with what strong local reporting has unearthed.

These councillors forget that media are not accountable to elected officials. Media are accountable to the public, the same group whose money these councillors are spending. Claiming to put the press on notice is a poorly disguised attack on the fundamental freedoms laid out in the Canadian Charter of Rights and Freedoms.

Councillors are trying to stifle critical voices and control our free, independent and responsible media.

Any attempt by elected officials to limit the free flow of information is an attack on the basic democratic principles our society upholds.

It won’t work.

• LETTERS TO THE EDITOR • Clarity on MPAC assessments and property taxes Re: Residents should be fuming about tax increase, April 27.

I’d like to take this opportunity to clarify the relationship between MPAC property assessments and tax increases, as referenced in the letter to the editor published April 27, 2017.

The Municipal Property Assessment Corporation (MPAC) determines property value assessments.

When your property value increases, it does not necessarily mean your property taxes will increase.

When property values increase, Richmond Hill’s tax rate is adjusted down to accommodate the increase.

Richmond Hill receives the same total amount of taxdollar revenue, but it is allocated to different taxpayers.

In the 2016 Property Assessment Notices, the average market increase for a Richmond Hill residential property is 47 per cent (four-year phase-in change will be approximately 11.8 per cent each year).

This means those who have an assessment above the average could see an increase on the Richmond Hill portion of their tax bill and those who have an assessment less than the average could see a reduction on the Richmond Hill portion of their tax bill.

This is in respect to the reassessment impact only.

Observatory development upsets neighbourhood I bring to your attention an issue which I feel needs public exposure.

There are two streets in Richmond Hill facing south of the observatory land developments owned

by Corsica and Metrus Developments.

A huge five-foot-diameter drainage pipe is presently being installed on Fern Avenue and Somerset Crescent relating to the observatory land development.

In other words, the road is being torn up at the disruption and inconvenience

of the householders. This construction will benefit the expediency and financial profit of Corsica and Metrus.

The only notice given to the residents was a pamphlet delivered door to door 10 days prior to commencing construction. I feel it was kept secret for fear the residents would voice an objection, delaying or terminating the project.

Nothing can be corrected or changed. It is too late. The noise and disruption is indescribable.

The constant beep beep of the backup alarm on vehicles is mind-shattering.

This project was commenced without informing the residents in a fair time frame and will be of no benefit to the residents.

Walking through a union information picket at a Woodbridge LCBO outlet June 1, George McKenzie said he doesn’t want to see the privatization of liquor sales.

"They shouldn’t privatize it. We’re getting good service as it is now, it’s working well, so why change it?" the Toronto resident said outside the store at 7850 Weston Rd. north of Hwy. 7.

"If they privatize it, it just gives the government a whole whack of money at one time and there’s no more revenue from this over the years."

The June 1 information picket came just days before the Ontario Public Service Employees’ Union (OPSEU) filed a no board report June 5, indicating labour negotiations are struggling and signalling a possible strike at LCBO stores by Canada Day. At the Vaughan store last week, half of dozen union members holding signs and waving a flag drew customers’ attention to a number of labour concerns including job security and the use of casual workers.

They also warned cus-

tomers that LCBO management is "pushing a privatization agenda" which would make it easier to expand the private sale of alcohol, putting at risk $2.4 billion in annual revenue used to pay for provincial services.

With the union and the LCBO in the middle of labour negotiations, OPSEU employees are holding information pickets are liquor stores across the province.

Privatization would mean less revenue for teachers, hospitals, universities and highways, OPSEU Local 376 president Evan Wickham said.

"This is the public’s domain, this is their business. By turning it over, we’re doing exactly what we did to (toll road Hwy.) 407. Look at what happened, it’s a large loss of revenue for us and what did that turn into? Higher taxes," he said.

"Where is the money going to come from if it’s not coming from the LCBO?" Wickham is also concerned privatization could make it easier for underage consumers to buy liquor.

LCBO media relations coordinator Christine Bujold referred questions

about the union’s concerns to the Crown corporation’s blog, lcbonegotiations.com "The introduction of greater competition in the marketplace has changed the beverage alcohol landscape in Ontario, and we have been very clear on the ," a May 18 entry said.

"The LCBO’s new business as a wholesaler to grocers gives the government a higher return than what it receives from the LCBO’s retail sale of beverage alcohol.

But Rudy Alonzi, of Woodbridge, said he doesn’t want to see privatization of the LCBO. The retired brewery worker worries about employees losing their jobs, higher prices and the negative impact on taxpayers.

"Someone else will be making money and we’ll be paying for it," he said.

Anita Preta, of Toronto, is concerned privatization could result in a lower selection of product because LCBO is now able to capitalize on its significant buying power.

York Region residents are living in Canada’s first monarch butterfly-friendly region.

The designation, from the United States National Wildlife Federation, recognizes the region’s commitment to supporting the endangered butterfly by encouraging residents to create butterfly habitat and supporting the sale and use of native plants.

The designation is one of several efforts by the region to promote the environment through its Greening Strategy.

"York regional council’s investment in the Greening Strategy including tree planting and the protection of the forest has many benefits to our communities," chair Wayne Emmerson said in a statement.

"This is not a one-time action, as we will continue to work with residents and partners to support and preserve green space across York Region."

Last year, the planted more than 93,000 trees, surpassing its target of 70,000 trees and shrubs.

The region’s current tree canopy is 31 per cent, moving it closer to its goal of 35 per cent by 2031.

The region also achieved LEED (leadership in energy and environmental design) platinum certification on the Bill Fisch Forest and Stewardship Education Centre and collaborated with the Evergreen Foundation and the region’s school boards on greening pilot projects and designing outdoor learning spaces.

You’ve heard of snakes on a plane, well this is snakes in the schoolyard.

In all, there were five boa constrictors, and one giant lizard the size of a medium-sized dog.

This is what one Richmond Hill man witnessed released into the grassy area behind O.M. Mackillop Public School, near Yonge Street and Elgin Mills Road West, on Saturday afternoon.

"I couldn’t believe what I was seeing," he said.

Steve Somerville, photographer at the Richmond Hill Liberal, said he was out for walk with his dog when he saw a 16 year old with a shopping cart full of backpacks.

Before he knew it, the approximately 15-foot reptiles were released into the grass along with a monitor lizard.

Somerville said after getting "anxious", worried the teen was releasing them back into nature, he quickly called York Regional Police.

After arriving at the scene, police and animal control officers spoke to the young man involved only to discover that it’s entirely legal to "walk" your pets in the schoolyard.

PUBLIC NOTICE PASSAGE OF THE REGIONAL MUNICPALITY OF YORK DEVELOPMENT CHARGE BYLAW On Thursday May 25, 2017, York Regional Council passed The Regional Municipality of York development charge bylaw, No. 2017-35, which will come into effect on June 17, 2017.

Development charges are fees collected from developers and are a primary source of revenue to help pay for the cost of growth-related capital infrastructure including water, wastewater, roads, transit, the Toronto-York Subway extension, police, paramedics, waste diversion, courts and public health services.

The purpose of Bylaw No. 2017-35 is to fund growth-related capital costs for The Regional Municipality of York. This Region-wide development charge bylaw will apply to all lands in The Regional Municipality of York with the exception of wastewater development charges for the Village of Nobleton. The Village of Nobleton’s wastewater development charges are levied under an area-specific development charge bylaw (No. 2016-40). The map below illustrates the location to which the bylaw applies.

The development charges under this bylaw will apply to both residential and non-residential development. The rates, as set out in the bylaw, are as below.
