Family sues Mackenzie Health after grandmother sexually assaulted at hospital

JEREMY GRIMALDI jgrimaldi@yrmg.com Ran Shirdan remembers it clear as day, walking into Mackenzie Health to see his grandmother Sonja Shirdan, 90, and witnessing the state of his best friend, his Savta - the Hebrew word for a particularly cool grandmother.

"She had stopped talking entirely," the 30-year-old Maple resident said. "She had clenched fists over her all the time, one over her chest and one over her crotch."

But this wasn’t all, Sonja had bruised lips and arms, black, blue and purple and a clenched jaw. She could not fall asleep.

For months after the incident, which occurred in September 2015, Ran and his mother Eva Shirdan did their best to help Sonja recuperate, prodding the formerly talkative senior citizen to say something, anything. They had nominal luck.

It wasn’t until two months later they’d find out the ghastly reason why Sonja was so agitated. She’d been raped while in hospital.

Yet finding out all the details from Mackenzie Health management proved similarly trying.

The process began with a barrage of phone calls, up to seven a day, from one hospital manager who repeatedly failed to leave a message.

nearly 20 calls, Eva, who explained she rarely returns calls from unknown numbers, called the number and reached Mackenzie Health’s operation director for emergency, medicine and critical care, Heather Riddell.

Eva was told, "We’d like to share what went wrong with your mother."

"I was so happy because they usually try and hide (those things)," she said. "I had convinced myself that she took the wrong medication."

On Nov. 26, Eva walked into a hospital conference room, where several hospi-

tal representatives were seated: Riddell, Charmaine Ambrose, a patient care manager; Dr. Victoria Chan, chief of medicine; and an administrative assistant. The following is her account of what happened at that meeting.

After 30 minutes of talk about her mother’s current condition, she said the women got up and were about to leave, when she interrupted: "Wait ... you still haven’t told me what happened?"

To which they responded: "Do you really want to know?"

She was eventually told

how, months previous, a Mackenzie Health nurse walked into her mother’s semiprivate room to find the curtains drawn around her bed. When they were pulled back, a hospital personal support worker was seen "aggressively sucking" on Sonja’s breasts.

When Eva asked what else occurred, she was told "other things ... you don’t want to know, it was horrible."

One person present said members of the hospital’s senior leadership team, including president and CEO Altaf Stationwalla and vicepresident, chief operating

officer and chief nursing executive Susan Kowlek had been made aware of the incident, Eva says.

When she asked what the police said, she was told management decided not to call police because sexual assault charges would jeopardize the hospital’s reputation. The hospital said in a later statement its policy at the time was to report allegations to police only with the consent of the patient involved.

When Eva suggested calling the police, she said they told her, "There’s no point in you doing it now, because your mother will not tell them anything anyway and it’s been such a long time."

They added that because it had been more than two months since the incident, the police would not be able find physical evidence.

Another alleged victim’s daughter - who spoke to yorkregion.com for an earlier investigation into how Mackenzie Health handled sexual assault charges would eventually report the incident to police.

In the ensuing days, Eva was again inundated with phone calls from the hospital, totalling about 12 messages asking her to call back, she said.

This time she did not call back. Instead she spoke to a lawyer and then the police, giving them a videotaped statement of what had occurred.

United Ways will be stronger together

If ever there was proof that there is strength in numbers, it’s the results of the United Way fundraising campaigns in Toronto and York Region after the organizations amalgamated in 2015.

Before they merged, the two charities separately raised a total of $97 million.

Together, in 2015 they raised $100.2 million. And in 2016, that rose to $102 million.

Now the United Way Toronto and York Region hopes to raise $103 million in its annual fundraising campaign, launched last week to fight poverty, build strong communities and help kids.

The decision to combine organizations was clearly a good idea in 2015. And it raised the question of why more United Ways across the Greater Toronto Area (GTA) don’t join forces to create one powerhouse charity working to create a better life for everyone in the region.

Last week, that idea came a step closer to reality with the announcement that the boards of trustees of United Way Peel (representing Mississauga, Brampton and Caledon) and United Way Toronto and York Region have unanimously agreed to amalgamate. If members of Peel agree to it at a meeting on Oct. 26, the organizations will unite on April 1, 2018.

That would be a welcome move, indeed.

As Daniele Zanotti, CEO of the United Way Toronto and York Region, noted, the merger will allow those involved in United Way to do more to strengthen communities across the GTA: "Whether it’s giving young people the right start in life or solving local poverty, these issues aren’t contained to one spot on the map."

Peel’s interim CEO and president, Anita Stellinga, believes the proposed merger, will strengthen their fundraising while also allowing them to continue to meet the needs of the communities they serve. She said there’s increasing competition for fundraising dollars and joining the world’s largest United Way in the Toronto York organization will give them greater reach. If approved, she feels it will increase her organization’s scope and give it a more impactful voice in the region while also better serving residents and their donors.

The ability to raise more funds with a bigger regional agency is happy news for the hundreds of charities that depend on each of these United Ways for support.

Indeed, last year, the United Way Toronto and York Region provided ongoing support for 220 local agencies, while Peel supports 53 agencies with a fundraising goal this year of $11.4 million.

Whether those agencies house the homeless, feed the hungry or shelter the abused, they all deserve our support.

The fall campaigns are now underway at all United Way agencies across the region. Please give generously.

The community you build with your donations is ultimately your own.

• LETTERS & COMMENTARY • Don’t confuse the ’R’s Re: York Region residents recycle 91 per cent of their garbage, Oct. 1.

York Region residents should be proud of their accomplishments with respect to waste management.

We were early adopters of the blue box and green bin, and current initiatives like textile recycling demonstrate an ongoing commitment to the "3 Rs." But those three Rs exist in a hierarchy, with "reduce" at the top, followed by "reuse" and completed by "recycle." (There is now a fourth R, "recover," as in recovering energy from waste.) The distinction matters: yes, our waste diversion rate is high, but our total amount of waste produced - regardless of where it ends up - is also

high. While obviously preferable to landfills, recycling still comes with significant environmental and economic costs.

True waste reduction is cheaper and cleaner, and does not require bureaucracies, trucks or processing plants. It requires a simple choice by residents to consume smarter, and consume less. The Region’s SM4RT Living Plan identifies food waste as the best place to start on the path to "zero waste." Let’s keep moving in this direction, but remember not to mistake the third R for the first.

The first thing to address this issue is to fire all involved regional officials as being either incompetent or dishonest.

We’ve seen this movie many times before: first government spends like a drunk sailor and then says: "We ran out of money and need to tax you more". Look at the grandeur of Highway 7 featuring empty lanes and buses, massive shelters and elaborate masonry.

This is an epitome of building a house for a Christmas dinner, if we use Mr. Titherington’s smart metaphor. Nice but not affordable.

Community Living project worthwhile Re: Filling the ’abyss’,

I read with interest the article in the Oct. 5 paper.

Thought it a very worthwhile project, yet nowhere in the article does it say where one could contribute some money. Kind of misses part of the point. Perhaps this could be rectified.

The paper is awfully small these days. I understand the smaller size, but then shouldn’t it be thicker?

The letter commentaries used to be about five and now only two. We gone from three papers to one paper to half a paper. What’s next? I still really enjoy reading the paper, despite all the technology.

There’s always so much to keep up with in this town.

The newspaper is an important communication tool.

Newmarket-Aurora MPP Chris Ballard paid a visit to Trinity Glen Housing Corporation in Newmarket to announce new funding from the provincial government for repairs and retrofits to social housing in York Region.

The $17.3 million earmarked for the region comes from Ontario’s Climate Change Action Plan and is funded by proceeds from the province’s carbon market.

"There is concern about the rise of hate crimes and terrorism and it is something we deal with far too often.

There is no place for hate crimes in Canada," she said. "Regardless of our sex, age or culture, we should be able to feel safe in our community."

Hamida Merchant, property manager for the corporation, said the funding will cover half of the cost of the security upgrades in the community that offers rent geared to income to 600 residents, the majority being Muslim.

"When we see media reports about hate crimes, like the mass shooting at a Quebec mosque, our residents get nervous and think they could be next," she explained. "We have some security in place but have some gaps and with more cameras, we will discourage hate crimes."

The cameras and security infrastructure is expected to be installed by Oct. 23.

Securing the grant also took support from York Region, Town of Richmond Hill and York Regional Police.

"This community does such wonderful things, like integrating new comers into the local community and providing seniors with affordable housing and these grants allow us to provide support."

The now 25-year-old was bounced around from foster home to foster home and spent much of her time at the Richmond Hill-based organization dedicated to helping youth overcome crisis and transition to a state of safety and stability.

It was safe and the programs were useful.

"No matter where you are in your life they have resources to help you," she said. "One winter I was having a difficult time keeping food on the table and a roof above mine and my daughter’s head."

She turned to 360Kids knowing they would be able to help. After completing the Base 4 Success program, she found herself with two job offers paying above minimum wage.

"It gives you a sense of accomplishment and

boosts your self-esteem when you can provide for yourself and your family instead of taking handouts," she said. "This program is the difference between sitting on the couch and having a reason to get up."

Now, 360Kids has banked $2.1million in federal funding to help York Region youth like Sarah gain skills and work experience.

Richmond Hill MP Majid Jowhari announced the project that will give youth job skill training and hands-on work experience.

Up to 276 youth are expected to participate in the Base 4 Success program, which is delivered by 360Kids.

Youth will participate in two weeks of in-class training. Youth will gain certificates such as WHMIS, first aid and Smart Serve and gain life skills like budgeting and financial planning as well as job preparation skills like resume writing, job interview skills and knowing their legal rights.

The following 10 weeks will be spent working in the retail, manufacturing and service industries.

There will be seven sessions of the program held throughout the region annually including sites in Richmond Hill, Newmarket and Vaughan, according to 360Kids’ Bonnie Harkness.

The program is geared to fit each youth, not the other way around, she added.

The program also works alongside the organization’s many other services including the iGrad program that helps youth earn their high school diploma through a partnership with the York Region District School Board.

Those between 15 and 29 years are eligible with a referral from a partner organization or self-referrals can be made by filling out a form available on the website.

Notice of Completion GO Rail Network Electrification Transit Project Assessment Process Metrolinx and Hydro One, as co-proponents, have completed an Environmental Project Report (EPR) in accordance with Ontario Regulation 231/08 for the GO Rail Network Electrification Project.

The Project As part of Regional Express Rail, Metrolinx is proposing to electrify GO-owned corridors. The GO Rail Network Electrification undertaking will entail design and implementation of a traction power supply system and power distribution components including: an Overhead Contact System (OCS) along the rail corridors, electrical feeder routes, and a number of traction power facilities located within the vicinity of the rail corridors.

THE ANSWER FROM SALIM ALIBHAI, YORK REGION’S DIRECTOR OF CAPITAL PLANNING AND DELIVERY: To accommodate growth and increased travel demand, York Region widened Bloomington Road from Bathurst Street to west of Hwy. 404 (west of the rail bridge) in Aurora and Richmond Hill.

Construction for the Bloomington Road widening began in July 2012 and the project was completed in April 2016.

The section of Bloomington Road between Leslie Street and Hwy. 404 is built over swampland with poor soil conditions and water on both sides of the road.

A period of settlement, when building over this type of ground conditions, is considered normal.

With the new lanes being built adjacent to the existing two-lane road, which had settled over time, it was always anticipated there would be uneven settlement between the new and existing road until the ground conditions stabilize. Rehabilitation to the roadway will be performed when required.

Zadeh with 13 sexual assault charges. The alleged victims totalled six and included patients at Mackenzie Health as well as other locations where Zadeh worked after he was fired from the hospital.

According to York Regional Police Information to obtain documents, once police began their probe into the alleged sexual assaults, hospital management refused to give simple information to officers and forced them to seek judicial authorization for information including the names of the other victims.

The information and opinions in the court documents have not been tested in court, but are the police’s record of their investigation and interviews.

According to those documents, Ambrose refused to admit to the police that Zadeh’s actions were "sexual in nature" instead calling them "inappropriate and rough".

Mackenzie Health’s director of quality and risk management Wendy Hooper denied the hospital had done anything wrong by keeping the alleged sex assaults from the police.

"If given the chance to do things over in this incident, Wendy Hooper would not do anything differently and would still not contact police in regards to the sexual assault allegations," York police Const. Stephanie Couture wrote.

In May, the Crown dropped all the charges against Zadeh in a deal that had him avoid trial by pleading guilty to one assault charge, involving a slap on the rear end of an anonymous female patient at the hospital.

The Shirdans learned of the deal days later and said the Crown told them there was insufficient evidence and the victims had "frailties".

At least two families, including the Shirdans, are now suing the hospital.

That all executives who knew about the alleged sex assaults to lose their jobs 4. An explanation by The Crown as to why the charges were dropped "There’s a pattern of negligence when it comes to caring for our elders," he said.

"This isn’t about us, it’s about everyone. When you are brought to the hospital you are weak, it’s supposed to be a safe haven. There could be a pedophile in our hospitals too, but we would never know if every situation was treated like this."

Despite repeated requests, Health Minister Eric Hoskins refused a chance to be interviewed on the subject.

The ministry sent a statement, saying it "upholds a zero-tolerance policy for any sexual abuse of patients and expects all health system partners to do the same."

"It is the ministry’s expectation that hospitals will appropriately notify police

of any potential criminal matters involving patients that take place within their facilities, prioritizing the safety and well-being of patients at all times," the statement says.

"The ministry is now exploring options for a more rigorous registry that provides PSWs, employers and the public with the information they need to ensure that the care they are receiving from their PSW is competent and safe."

Mackenzie Health representatives also declined to be interviewed or comment on this specific incident. The hospital did release a statement, which said it has revised its policies and now requires all allegations of criminal behaviour at the hospital to be immediately reported to police.

Sonja died on March 7, 2017. Her physician told the family said her health began to decline after the assault.

Despite her family’s best efforts, they never managed to unclench her hands.

He vowed to share the story with others, but discovered talking about his photos was "too emotional." Instead, he created a narrated slide show, then worked with local Coun. David West, Marj Andre (Richmond Hill’s Citizen of the Year) and Georgina Indigenous activist Suzanne Smoke to arrange a showing in conjunction with the film screening.

Jeremy Holye, lead singer of the tribute band the Strictly Hip, will perform The Stranger from the film and Prof. Emeritus Shirley Williams will give the keynote address.

Pearl Wenjack Achneepineskum and Daisy Munroe (Chanie’s sisters) are also expected to take part.

Their trip to Richmond Hill is a big undertaking, Clements says. Pearl lives halfway between Thunder Bay and Hudson Bay. Her journey includes a $400 cab trip plus charter flight, but the sisters’ presence will make

the story - and struggle more real, he says.

"This issue is still so important and this is what Gord told us to do," Clement said, referring to the 2016 Tragically Hip concert in Kingston where Downie made his public call to action.

"He said we need to do something about this problem. We are going to do something this weekend and hopefully people will leave this event prepared go out and do something, too."

Clements hopes the event in Richmond Hill will open the eyes of residents in York Region "so that people will change how we look at things and question our own attitudes."

This weekend’s special screening of Gord Downie’s "The Secret Path" in Richmond Hill will be especially poignant, coming on the heels of the musician’s death Tuesday night.

The Tragically Hip frontman, who died of brain cancer Oct. 17, made "The Secret Path", and the issue of Canada’s Indian Residential School System, one of his last passions, legacies and calls to action.

Downie’s re-telling of the story of Chanie Wenjack, a residential school runaway, will be shared through song, film and words at the Richmond Hill Centre for Performing Arts.

Ironically, the date that was available for this first licenced screening in Canada also happened to be the 51st anniversary of Chanie’s death - and Downie’s passing comes close to that date also.

Co-organizer and Richmond Hill resident Joel Clement said it’s still unclear whether Downie’s brother, Mike, will be able to introduce the film and talk about the filming process, as was originally planned.

But he said the issue Gord believed in remains as relevant as ever and he hopes the screening event will inspire others to follow the musician’s lead.

For Clements, it is the culmination a heart-rending memorial journey that started last fall. The Richmond Hill photographer volunteered to join up with Downie’s fundraising

ROUGE RIVER BREWING COMPANY This Markham craft brewery at 50 Bullock Dr., founded by Jordan Mills, releases new, small-batch beers — hop forward Americanstyle ales, sour beers, Belgian Farmhouse-style ales — weekly. TMS Speaker Series in Richmond Hill a huge success On Oct. 5, TMS was thrilled to host Dr. Alex Russell, who spoke to over 250 parents, staff and community partners on the value of building resilience in our children.

Russell is a Torontobased psychologist and author who helps children develop resilience to succeed at school and life. Russell’s talk was well aligned with TMS’ theme for year - To Thrive - as he focused on the positive and emotionally rewarding role parents and educators can play in children’s lives.

The lively presentation resonated well with parents of children ranging in age from toddlers just starting their journey at TMS (formerly Toronto Montessori Schools) to students in Grades 11 and 12 planning their next steps beyond TMS. Parents heard about strategies they can take to understand the impact of technology on their children, ways to encourage them to become effective decision makers and, as parents, ways to safely and supportively guide them toward independence.

One parent described

the tremendous effect of the learning: "Dr. Russell was engaging and informative. He supported our value systems as parents while at the same time challenging us to think about the impact our personal biases may have on our decisionmaking. What he said will definitely affect the discussions we have with our children. Taking the time to pause and identify our own feelings and concerns before addressing them with our children is essential to fostering positive relationships as we guide our children along the road to independence."

TMS, established in 1961, is a leading independent school that combines the Montessori and International Baccalaureate frameworks to provide students the foundation for a life of goodness and excellence. TMS operates from two campuses in Richmond Hill with exceptional learning environments for children of all ages and stages.
