With regard to leaving gifts of The Wills Lawyer money under your Will, consider the following important matters: - The gift which you intend to leave will be effective only if there is enough money in your estate to satisfy that gift. Accordingly, you must consider whether, at the time of your death, there will be enough money in your estate to fund various cash gifts that you were thinking of leaving to your beneficiaries. A shortfall in such funding can cause confusion and acrimony among your beneficiaries because the gifts will not be capable of payment as you contemplated in Michelle Kotzer your Will. Furthermore, even if, at the time of your death, there will be enough cash to fund all these gifts, you must remember that all of your debts and taxes have to be paid in full before any cash gifts can be distributed to your beneficiaries. - There is one fundamental piece of advice which applies to every gift which you are providing for in your Will, including gifts of money. It is always prudent to name one or more substitute beneficiaries to take the gift in the event that your primary beneficiary passes away before you do. - Conflicts among your beneficiaries could arise from what is sometimes known as an unintended double legacy. That term describes a situation where a beneficiary under your Will who is to receive one gift of money, in the event of a common disaster, such as a motor vehicle accident, ends up receiving two gifts of money as a result of the death of both parties in that common disaster. In considering this matter, let us first start off with the question of intention. In the case of a husband and wife each leaving $10,000.00 to their grandson Robert, is it their intention that Robert receive two gifts of $10,000.00 in the event that the husband and wife are involved in a common disaster and pass away? Or, on the other hand, is it their intention that Robert inherit the $10,000.00 gift only once, on the death of the last to die of the husband and wife? This is a situation which is often overlooked and which is capable of creating havoc within your family. If your lawyer is not advised of your intention, and the matter becomes overlooked, an unintended windfall of this nature can be a great source of dissension among those who survive you because the unintended gift will reduce what is left to distribute among the other beneficiaries. CHARITABLE GIFTS If you wish to give something to a charity under your Will, you should consider the following points: -In your Will, you may wish to benefit a charity by leaving a particular sum of money or perhaps a share of your estate. It is important that you name the charity correctly and that your lawyer inserts that correct name in your Will. You can obtain the exact legal name of your favourite charity by contacting them. -Make sure you speak to your lawyer about what happens if the charity named in your Will does not exist at the time of your death. Do you wish a similar charity to benefit or do you want the gift that was left to such charity to fall into your estate and to be shared by your other beneficiaries? "One too many" leads to lopsided split-grade class KIM ZARZOUR kzarzour@yrmg.com Two students and their families at a Richmond Hill elementary school have given their teachers, principals, teachers union and Catholic school board failing grades after a "disastrous" year in a split Grade 7/8 class. The students say they have been made to feel like outcasts while their parents are "livid" over the way the York District Catholic School Board handled their concerns. The students are in a split grade, but that’s not the issue. Alessia Magno and Michelle Kiwan are used to that. Their school, Corpus Christi Catholic Elementary, is a smaller school and they’ve been in split grades for five years. But this year is different. The girls are two of only four Grade 8 students in their class. The remaining 27 students are in Grade 7. As a result, they say they are isolated and left out of lessons and activities with the rest of their grade in their last year of elementary school. "The four children in Grade 8 have not been taught since the start of the school year, and it’s all because the other Grade 8 teacher won’t take one more student than the class cap," said Paolo Magno, Alessia’s father. The problem comes down to numbers. There are 33 Grade 8 students and a class size cap, under the board/OEC-

York Catholic District School Board spokesperson Sonia Gallo said the board is aware of the concerns raised by parents, but is required to follow class size maximums. There are two other children in this split class, but their families did not provide comments. The Magnos and Kiwans contacted the media because they say they want others

to be aware of the board’s "mistake" that has affected their lives. The families were aware last June that the students would be in the minority, but the four students were chosen for their good grades and the split-grade teacher had a strong reputation, said mom Patricia Magno. "We knew it wasn’t ideal but we thought, ’OK, these are professionals, they know what they’re doing,

they’ll work it out’. But that isn’t what’s happening." The students say they have been sent to quiet places to learn the subject matter with worksheets, away from the distraction of their teacher teaching a full, busy class of Grade 7s. At recess, they discuss lessons with students in the main Grade 8 class to find out what they missed or "Google-learn" after

school. They are expected to practise their music instruments in the hall to avoid disturbing the Grade 7s and when the Grade 7s are away on class trips, they are sent to be "babysat" in the younger classrooms. Michelle and Alessia say they missed out on fun Grade 8 activities and group projects involving other students their age. Their grades have

dropped and many days, they have come home from school in tears. "The situation is affecting my daughter’s daily life," Michelle’s father, Abdo Kiwan, said. "Unlike previous years, she tries to find any reason to not be at school. My daughter can’t wait for the school to be done; this crucial last year of her learning before entering high school has ruined all the good memories she built on and the good times she enjoyed being at Corpus Christi for the last nine years." The parents say they have been urging the school to rectify the situation for months. Heather Manassis, president of the teachers union, says it comes down to a hard-won class size limits that respect teachers and students alike. Even 32 is large, she said, but in split grades, four students is considered a "workable group". "We have a contract and we stand behind it." Besides, she added, it is late in the school year to move students. Gallo said a mid-April meeting with the board’superintendent, school principal and intermediate teachers created solutions to ensure the integration of the four Grade 8 students with the full class of Grade 8s in some of the subjects. They participate together in field trips, she said, and special school presentations designated for the Grade 8 students. Too little, too late, the two families say. They still feel like outsiders. "The union is there to protect employees with employers," Patricia said. "It shouldn’t get in the way of students’ education."

Plan a prudent first step toward housing affordability

If the first step toward solving a problem is acknowledging you have one, then Ontario’s Liberal government deserves at least some credit for introducing policies aimed at trying to slow down southern Ontario’s runaway real estate market. Concerned about rising rents and skyrocketing house prices, Premier Kathleen Wynne unveiled her government’s Fair Housing Plan on April 20. It included 16 measures intended to help make housing more affordable, while improving market stability. Arguably, the most highly-touted move was the decision to follow Vancouver’s lead and introduce a 15-per-cent nonresident speculation tax that would apply to non-citizens, non-permanent residents and non-Canadian corporations buying one to six single family residential units in the Greater Golden Horseshoe. Wynne stressed Ontario is a welcoming place for newcomers, adding the tax is intended to target speculators looking to make a quick buck. Other components of the plan include expanding rent control to cover all private rental units, not just those built prior to 1991, and potentially allowing municipalities to levy taxes on vacant homes within their borders. Additionally, the plan calls for the province to work with municipal governments to identify surplus lands that could be used to develop more affordable housing. The reaction to the Fair Housing Plan was mixed. Several economists came out in favour of the proposals, while the Federation of Rental-housing Providers of Ontario expressed disappointment with Wynne’s announcement. Toronto Mayor John Tory said he welcomed many of the ideas put forward and Ontario Real Estate Association CEO Tim Hudak said he was happy the government acted, adding something had to be done to address the issue of housing affordability. NDP leader Andrea Horwath feared the changes would be too little, too late. PC housing critic Ernie Hardeman cast doubt on the notion the tax will have the desired effect and blamed red tape for preventing the development industry from building the kinds of units required. Time will tell how these measures will affect the market but if nothing else, the province is taking reasonable steps to address the issue. Doing too much risks putting homeowners in the poorhouse, while inaction leaves too many Ontarians - young people especially - scarcely able to afford rent let alone a down payment given that home prices have skyrocketed at a time when wages are stagnant. The plan isn’t perfect and will likely require tweaking in the months and years ahead - but it’s a start.

• LETTERS • Residents should be fuming about tax increase Re: Richmond Hill taxpayers face 2.6% increase, March 6. A recent report in the Liberal (March 6, 2017 by Kim Zarzour) on the town of Richmond Hill’s approved portion of the municipal portion of property taxes increasing 4.39 per cent was titled by the headline Richmond Hill taxpayers face 2.6 per cent increase. If you are looking to buy or sell a home here, you may already know it, but survey results released this week by Royal LePage confirm: housing prices in Richmond Hill are sizzling. According to the Royal LePage House Price Survey released April 18, Richmond Hill prices outpaced all other areas in the country with a 31.5 per cent increase in the first quarter of 2017. The aggregate price of a home in the GTA increased 20 per cent to $759,241, but in Richmond Hill, the price surged to $1,209,741. Oshawa, Vaughan, Markham and Oakville followed close behind, posting gains of 28.2 per cent, 25.8 per cent, 23.2 per cent and

would see in the criminal justice system." The police agreed that these men did not fit the typical criminal profile. "Unfortunately, there was a lot of married men," said Det. Sgt. Thai Truong, who oversaw the fouryear investigation dubbed Project Raphael. The operation is simple: men looking for a prostitute contact an advertiser on the web, not knowing the person on the other end of the email or text is a police officer. Once contact is made, the officer makes it clear the would-be victim is aged 13 to 16. If the man moves on at this point, he is left alone by police. If he engages, a deal is made over text. When he shows up at the hotel, he is arrested. The texts of a 25-year-old pilot on one night highlight how brazen these men are; he said he was willing to pay $250 for a 13-year-old girl. At a news conference on April 21 at York police’s Aurora headquarters, investigators detailed statistics showing how successful the sting has been - 32 guilty pleas and five trials resulting in guilty findings and only five charges withdrawn. Truong said investigations began around Christmas 2012 when police tried to get just one underage victim home for the holidays. Police discovered 31 women being trafficked, nine of whom were younger than 18. "That led us to the genesis of how we are going to combat child sex trafficking," he said. The sting has proved effective considering how hard it has been in the past to extricate underage victims from the world of prostitution, he added. "Enlisting co-operation from these victims is very difficult," Truong said, explaining that out of the 85 minors identified as trafficked in the region, only 49 were extricated by police and their pimps charged. "Getting them to trust us is challenging." Orlando said she has assigned a team of Crowns to help prosecute these crimes and help train others to do the same. So far, sentences have ranged from three to seven months in prison. As for the men charged, a list shows seven from Vaughan, six from Richmond Hill, 11 from Markham, three from Newmarket, one from Aurora, three from Stouffville and one from Bradford. The prices negotiated for the would-be victims’ services ranged from $60 to $120 for a half-hour and $140 to $300 for an hour, Truong said.

This can negatively affect their future when applying to college or university or when looking for employment, and could potentially be a criminal offence 4. Talk to your children about inappropriate content and how to deal with it

THE STUDY The Ontario Ministry of Transportation (MTO) has retained MMM Group Limited, a subsidiary of WSP Global, to undertake the Detail Design and Class Environmental Assessment (Class EA) Study for the widening of a 10.4 km section of Highway 404 to include the addition of one High Occupancy Vehicle (HOV) lane along each of the northbound and southbound lanes, replacement of the Rouge River Bridges, rehabilitation needs throughout the corridor and reconfiguration of the 16th Avenue interchange ramps. The HOV lanes will begin from the existing terminus on Highway 404 north of the 407 ETR and extend to Stouffville Road, in the Regional Municipality of York. The study area is shown on the key plan. BACKGROUND Following the Preliminary Design Study completed in 2016, a Transportation Environmental Study Report (TESR) documenting the transportation needs, rehabilitation, safety and operational improvement requirements for a 26 km section of Highway 404 from 407 ETR to Green Lane was published for public review, and subsequently received Environmental Assessment approval. This Detail Design and Class EA Study will be carrying forward a portion of the 2016 approved TESR, which will be divided into a series of construction contracts. THE PROCESS This study will follow the approved environmental planning process for Group ‘B’ projects under the Class Environmental Assessment for Provincial Transportation Facilities 1999, as amended in 2000, with the opportunity for public input throughout. Upon completion of the Detail Design and Class EA Study, a Design and Construction Report (DCR) will be prepared and made available for public review. A DCR will be prepared for each contract. CONSULTATION AND COMMENTS Public consultation is an important part of the Class Environmental Assessment process. One Public Information Centre (PIC) will be held at a key milestone during the study to provide agencies, municipalities, business owners, members of the public, and other stakeholders with an opportunity to review, comment on, and discuss the study with members of the Project Team. Tree planting helps town grow greener If you ever get a chance to view Richmond Hill from the skies, you’ll notice it’s looking a lot greener these days. Community volunteers planted 750 trees at Lake Wilcox Park April 21 as part of Richmond Hill’s annual Earth Day celebrations. The event is one of several town initiatives that have helped increase Richmond Hill’s tree canopy cover by almost 5 per cent since 2010. The canopy cover - how much land, when viewed from above, is covered by trees or bushes - increased from 24.5 per cent in 2010 to approximately 29.1 per cent in 2016 (2,912 hectares in total), according to a town report. "This is a remarkable result given the severity of recent events such as the Emerald Ash Borer, the ice storm and human-induced pressures such as development," said Terry Ricketts, director of environment services. As well as beautifying the community, trees create energy-saving shade, improve air and water quality by absorbing pollutants and slowing down stormwater run-off, Ricketts said. They also provide food and homes for wildlife. "We are extremely proud to have increased our tree canopy cover," said Mayor Dave Bar-

row. "This was due in large part to the tree planting efforts of this community and we will continue to build on this accomplishment together." The town has several tree planting and stewardship events coming up this spring. The Healthy Yards Program offers residents the opportunity to purchase native trees, shrubs, and perennial flowers for their own property at a subsidized cost. Rain barrels are also available at a wholesale cost. Last year, residents purchased 1,110 trees and shrubs, 3,485 perennial flowers and 198 rain barrels. This year’s plant and garden sale is on until May 12. Residents can visit RichmondHill.ca/HealthyYards for details and to place an order. LEAF (Local Enhancement & Appreciation of Forests), is a nonprofit organization and partner of the town offering York Region residents subsidized tree services on private property including on-site consultation with an arborist and full tree planting services. ONTARIO GOVERNMENT NOTICE Application of Larvicide for Mosquito Control on Ministry of Transportation Property As part of the Ontario government’s commitment to reduce the health risks from West Nile virus in York Region, the Ministry of Transportation (MTO) will treat catch basins from May to October 2017. Larvicide will be applied to control the mosquito population. The larvicide methoprene (Altosid Briquettes, Registration #27694 under the Pest Control Products Act, Canada) will be applied to catch basins on King’s Highways, MTO service centres, patrol yards, carpool lots and truck inspection stations. Over the next seven months, Richmond Hill Fire and Emergency Services (RHFES) staff will be going door-to-door to approximately 5,000 homes in our community delivering an important safety message to residents - smoke alarms save lives! In the wake of several recent fatal fires in the province, we are urging the community to make fire safety a priority. Early detection and warning of a fire in your home is crucial to your survival. Everyone should have working smoke alarms in their home and have practised a home fire escape plan with everyone in their household. The Ontario Fire Code requires working smoke alarms on every storey of your home and outside all sleeping areas. For added
