It was a first for Richmond Hill, and quite possibly a first in Ontario: the provincial superior court has overturned a municipal committee decision to audit a local politician’s election expenses. According to solicitor Barnet Kussner, who represented the joint audit committee that called for the audit of Ward 1 Councillor Greg Beros’ expenses last year, this is the first case he is aware of in which a decision by an audit committee to order an audit was overturned on appeal. Region municipalities, to audit Beros’ expenses. That decision was made in 2015 after resident Kristi Kanitz questioned a flyer that Beros mailed out shortly before the 2014 election. Under the Municipal Elections Act, all municipalities must have compliance committees in place. An elector, who is entitled to vote and believes a candidate has contravened a provision of the Act, may apply for a compliance audit of the candidate’s election campaign finances.
