The prices are right, the selections are plentiful and the affordability is out of sight. There has never been a time in the thirty one years that I have been a real estate broker in Lake Placid that I have seen all of these factors align like they are now. Average home prices have dropped ten percent or more in the past year and the inventories of unsold property are excessive. There is a great selection of both new and used homes, townhouses and condominiums. There are some highly desirable five to ten acre building lots that are priced below what they sold for many years ago. Interest rates are at historic lows for variable and fixed rate mortgages. The monthly payment for a $200,000 mortgage is between $844 and $984 per month depending on the type of mortgage selected. The mortgage interest is deductible, further reducing the cost of actual home ownership. There are a number of no money down loan programs for qualified buyers. As a destination, Lake Placid has welcomed visitors to enjoy the clean air and clear waters of the Adirondacks for over 100 years. And though there are ongoing challenges, tourism remains a critical component of the region’s economy. Popularity of the Adirondacks as a destination soared in the late 1800s when the nation’s most wealthy and influential citizens built their Great Camps here. The social elite would “vacate” the stifling summer heat of Northeast cities for the cool Adirondack air. (Yes, this is the origin of the word – it’s where vacations began!) Today, Lake Placid is a real, healthy, vibrant village that offers all kinds and levels of adventure, recreation, arts and amenities in one place. With a storied past that includes two Olympic Winter Games, Lake Placid continues to host contemporary world class competitions year round, including popular races such as the Lake Placid marathon and Ironman USA in summer. The economic downturn has dominated the media agenda for the past year, but it turns out, 2010 was a good year for Lake Placid. A community largely dependent on visitors from the large northeast metropolitan areas actually benefited from the economic downturn’s resulting consumer trends. According to a comScore survey this summer, 3 out of 4 consumers feel pessimistic about the economy, and 60% are cutting back on travel expenses. Of the travelers who are cutting back: 50% are staying closer to home 40% are looking for deals and discounts 30% choose driving over flying In all, these trends place Adirondack destinations in a good position to receive visitation from our feeder markets in the New York metro, and the Quebec and Ontario provinces of Canada. And the numbers prove it. The Lake Placid CVB is the accredited destination marketing organization responsible for promoting Lake Placid and Essex County. The County lodging properties collect an occupancy tax, which serves as a good mechanism to measure and compare visitation from year to year. Essex County’s occupancy tax collections through August 31, 2010 are up 12% over year-to-date collections in 2009, and even with 2008 year-to-date. The month of August 2010 itself was up 13% compared to the month of August 2009, and even with 2008.
Looking forward, there are a number of positive infrastructure improvements that affect tourism in the area. One such improvement is the addition of the Plattsburgh International Airport, which opened in 2007. The existence of a commercial airport just an hour’s drive from Lake Placid and the other regional destinations, and the US Airways access from the Boston market enhances access to our region - a largely drive-to destination. The airport has been very successful, and can be considered an integral component of the Adirondacks as a destination. The potential is especially important for the meetings market as we promote the new Conference Center at Lake Placid. Technologically savvy and environmentally sound, the highly-anticipated Conference Center at Lake Placid is ready to welcome groups in the spring of 2011! Limited partners, on the other hand, can only receive a share of the profits based on their investment. Their liability is also based upon their proportion of their investment. “C” Corporation- created by the filing of articles of incorporation. It is a separate entity having its own rights, privileges and liabilities, separate and apart from those individuals forming the corporation. This complex business structure is comprised of shareholders, directors and officers. Since the corporation is an entity in its own right, it can own assets, borrower money, and perform business functions without directly involving the owners of the business. The corporation has an additional distinct advantage of shielding legal liability to the owners of the business.
Since the Adirondack Park is a perfect vacation destination, it is also a great place to own investment property. I am often asked by my clients, who purchase non primary residences, if they should own an income producing property “individually” or form a legal entity to protect their other assets. From a legal standpoint, a landlord entering into a long term lease or even a vacation weekly rental agreement, should always be concerned with the appropriate way to protect other assets from the threat of litigation. Also, from a revenue standpoint, consideration should be given to the manner in which the rental income will be taxed and if any tax benefits are available. New York has many forms of legal organizational structures which offer unique tax and liability benefits. Sole Proprietorship- one person operating a business as an individual. Although the most common form of business organization, profits are taxed as income directly to the owner personally. Legal liability is assumed personally by the owner as well, but the owner retains complete control of the business. General Partnership- exists when two or more persons join together in the operation and management of a business. A written partnership agreement outlines procedures such as who will be responsible for performing each task, if any consultation is needed between partners before making major decisions, and what would happen if a partner dies or leaves the business. Under a general partnership, each partner is held to be liable for all debts of the business. Profits are taxed as income to the partners based upon their ownership percentage of the business.

“S” Corporation- a subchapter S corporation of the tax code allows a standard corporation to be taxed as a partnership or sole proprietorship. As such, profits are taxed at the individual rate, rate than at a higher corporate rate. There are specific rules in order to qualify for S corporation status all of which are outlined in the tax code. Limited Liability Company - this structure is a combination of corporate and partnership characteristics but still maintains the status of a legal entity separate from it owners. As its own entity, it can acquire assets, incur liabilities, and conduct business. It is comprised of members and it limits liability for all owners. Members risk only their investment and not personal assets, which makes this entity the most attractive structure for individuals who own a second home or income producing property, but who are not in this type of business full time. Always consult with a tax accountant and/or an attorney for a review of New York’s recognized legal entities and which is best for your individual situation as an owner of income producing property.
