Conference Release Agreement I understand and agree that because of the novel coronavirus pandemic (COVID-19), to attend the RJO Summer Buying Show] (“Conference”) I must agree to the following terms and conditions:
I am fully aware that there are a number of risks associated with attending the Conference because of the COVID-19 pandemic including without limitation: I could be exposed to or contract COVID-19, which could result in a serious medical condition requiring medical treatment in the hospital or could possibly lead to death.
I understand the following persons have been identified as having a higher risk of developing severe illness if they contract COVID-19 (“At-Risk Persons”): o 65 years and older A person with one of the following medical conditions: o chronic lung disease or moderate to severe asthma; o serious heart conditions; o immunocompromised, including as may be caused by cancer treatment, smoking, bone marrow or organ transplantation, immune deficiencies, poorly controlled HIV or AIDS, or prolonged use of corticosteroids and other immune weakening medications; o a body mass index [BMI] ≥40; o diabetes; o chronic kidney disease, including undergoing dialysis; o liver disease; or o pregnancy.
If I am an At-Risk Person, I understand and agree that I am assuming this higher risk of severe illness should I contract COVID-19 while at the Conference.
In consideration for being granted the opportunity to attend the Conference, I, for myself, my heirs, assigns, and next of kin do hereby release and forever discharge, indemnify, and hold harmless RJO, Inc., its board, owners, officers, employees and agents (collectively, the “released parties”) from any and all claims, liabilities, losses, damages, injuries, costs or expenses, including health care costs and expenses (collectively, “Damages”), whether described in this agreement or otherwise, that may arise out of or that may in any way be related to my attendance at the Conference, whether caused by the negligence of the released parties or otherwise.
Without limiting the foregoing, I, for myself, my heirs, assigns, and next of kin waive all rights to pursue any claims, lawsuits or legal actions, and an Damages, of any type against the released parties that I may at any time have arising out of or in connection with any exposure to or becoming infected by COVID-19 at any time during the Conference. This agreement shall be
effective to release the released parties from liability even if such Damages are caused, in whole or in part, by the negligence of the released parties, including failure to properly sanitize and/or clean facilities, equipment, supplies, packaging and other materials used in connection with the Conference.
I understand that I am responsible for my own medical and/or liability insurance coverage in the event of personal injury or illness as a result of my attendance at the Conference, including but not limited to any and all health care costs and expenses, even if related to exposure to or becoming infected by COVID-19 at any time while at the Conference. I, for myself, my heirs, assigns, and next of kin release and forever discharge the released parties from any claim whatsoever which may arise on account of any first-aid treatment or other medical services rendered in connection with an emergency or injury during the Conference.
I, for myself, my heirs, assigns, and next of kin further promise not to sue the released parties, and agree to indemnify and hold them harmless from any and all Damages arising out of or relating to my attendance at the Conference.
In agreeing to this agreement, I acknowledge and represent that I have been fully informed of the content of this agreement, that I have reviewed it and understand what it means and that I have signed this agreement with full consent. This agreement shall be binding upon my heirs, executors, administrators, and assigns in the event of my personal injury, including death.
I agree that I am personally responsible for my safety and actions while attending the Conference. I agree to comply with all Conference policies and rules while in attendance.
I understand this authorization is voluntary. That is, I can refuse to agree to the terms hereof, but if I do refuse to agree to such terms I will not be allowed to attend the Conference.
I hereby certify that each of the following is true, and will be true as of the date of the Conference, or I must not attend the Conference: o I have not at any time been diagnosed as having COVID-19 or within the last 30-days been in the presence of someone diagnosed as having COVID-19. o Within the last 30 days, I have not traveled internationally or to or from the State of New York. o Within the last 14 days, I have not had any of the following symptoms: cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking, muscle pain, headache, sore throat or new loss of taste or smell. I agree to report to RJO immediately if during my attendance at the Conference I develop any of the symptoms described above.
I expressly agree that this agreement is intended to be as broad and inclusive as permitted by applicable law.
