New-home sales surge after pandemic letdown

Forecasts were grim for metro Phoenix’s home building market during the early days of COVID-19.

Potential home buyers were expected to stay out of new subdivisions and model homes due to health concerns, and many home builders shut sales offi ces.

But record low-interest rates, mask requirements, virtual new-home tours and pent up demand from buyers who can’t fi nd existing Valley homes they can aff ord has spurred a surge in new-home sales across the Phoenix area.

New-home sales in the Phoenix area

are poised to climb back to March levels, which was a four-year high for the market still recovering from the crash.

“In April, new-home sales plummeted 28% from March,” said Arizona home building expert Jim Belfi ore. “But in August, sales should be back at March’s high level.”

New-home prices are expected to rise with the demand. That’s because builders didn’t have many cancellations in April and May and don’t have a backlog of houses already built and ready to sell.

Back to home building high for decade In mid-April, Belfi ore dropped his 2020 forecast for new-home construction in the Valley to 16,500 from 27,400.

In 2019, 25,000 new Valley homes were built, compared to 23,500 in 2018.

Former MLB pitcher sells Paradise Valley estate for $3.85M Former Major League Baseball player Chad Bettis was among the buyers and sellers of this week's priciest homes in metro Phoenix.

Among the luxury features in this week's homes: courtyards, floor-toceiling windows and an outdoor kitchen.

$8,500,000 Mary Anne and James Carlson of Great Falls, Virginia paid cash through a trust for a 0.63-acre property in Scottsdale’s Desert Mountain community.

The property will be a single-family residence, according to Maricopa County Recorder documents.

Brian and Joni Wilkerson were the sellers.

$6,100,000 Jeffrey and Nicole Knox of Washington, D.C. paid cash for a 7,208-square-foot mansion in Scottsdale’s DC Ranch community.

The estate has six bedrooms, seven bathrooms and was built in 2018. The home features floor-to-ceiling windows, a separate guest house and a five-car garage.

Michael and Brigette Smith sold the house through a trust.

$4,365,000 Jason K. Singer paid cash through a trust for a mansion in Paradise Valley’s Mockingbird Lane Estates.

The open-floor plan mansion has views of Mummy Mountain and features vaulted wood beam ceilings and a spacious chef’s kitchen with a walk-in pantry. The 6,800-square foot home has five bedrooms and six bathrooms.

Grounds of the one-acre estate feature private courtyards, an outdoor kitchen and a negative edge pool with swim-up bar.

$3,845,000 Bettis, former pitcher for the Colorado Rockies, and his wife, Kristina sold their 6,459-square-foot Paradise Valley mansion. Bettis announced his retirement from professional baseball in June.

The contemporary-style estate was built in 2019 and has five bedrooms and six bathrooms. The home has an executive-style home office and a climatecontrolled four-car garage. Grounds of the estate include a resort-style pool and a large putting green.

Home builders require mediation and arbitration Real Estate Law Christopher A. Combs Guest columnist

Question: We signed the builder’s purchase contract to buy a new home in the San Tan Valley. The builder’s sales agent made numerous false statements, especially in regard to the upgrades that were available in the home. The “bottom line” is that we canceled the purchase contract and demanded our $20,000 earnest money back.

The builder refuses to give the $20,000 earnest money back to us. In

addition, the builder demands reimbursement for the $28,000 cost of upgrades that the builder says are worthless to any new buyer of the home.

Under the builder’s purchase contract we are required to mediate this dispute and, if mediation is unsuccessful, go to arbitration. The mediation and the arbitration will be pursuant to the rules of the American Arbitration Association (AAA).

Do we have to go to mediation and arbitration?

Answer: Yes. Builders’ purchase contracts generally require mediation and arbitration, usually with AAA.

The reason for mediation and arbitration is to try to settle disputes quickly and inexpensively. In addition, the builder wants arbitration, rather than litigation, because the builder does not want the home buyer to have the right to a jury trial, because the jury could be prejudiced against the builder.

Although mediation and arbitration are required, the cost of hiring a mediator and an arbitrator can be signifi cantly reduced by not using AAA. In other words, instead of paying fees to AAA to appoint a mediator and, if the mediation is unsuccessful, then appoint an arbitrator, you and the builder can agree to directly hire the mediator or arbitrator.

tors and arbitrators, including many retired judges.

Note: Arbitration is basically a minitrial with documents as exhibits, and the testimony of witnesses. The arbitrator serves as the judge. Arbitration is usually cheaper than litigation, but there is generally no appeal from an arbitration ruling. In other words, if an arbitrator rules that grass is blue, and the sky is green, there is no appeal from that ruling even if there was overwhelming evidence that grass is green, and the sky is blue.

But with higher than expected demand from hew home buyers during May, June and July, he again sees metro Phoenix home building permits topping 27,000 this year.

If interest rates climb above the current record lows, higher prices could shut the door on more buyers.

Aff ordability is still a big concern for Phoenix-area home buyers, said the housing analyst.

Homebuilders looking for more affordable land are going back out to the Valley’s most far-fl ung suburbs — areas that became ghost towns with half-built subdivisions during the housing crash of 2008-2011.

Belfi ore said Valley housing markets that have been dormant since the crash, in areas like Coolidge, Florence and Casa Grande in the southeast Valley, are seeing builders and buyers again.

A lot of construction materials are hauled into metro Phoenix via rail. The crash of a Union Pacifi c Railroad train on the Tempe Town Lake bridge last week could slow the fl ow of building materials to the area.

That could cause delays in the con-

struction of new homes and other developments and potentially raise costs.

Volkswagen delivers two ’20 Jetta GLI trims Greg Zyla

This week, we’re driving the 2020 Volkswagen Jetta GLI Autobahn, powered by a 2.0-liter turbocharged fourcylinder engine. However, before we delve into the performance GLI Jetta model, remember that the lower cost Jetta models (that deliver 40 MPG highway) are always available at mostly attractive entry prices.

These lower priced Jettas off er outstanding values with numerous choices well below our upper price tester GLI. The entry level Jetta S with a six-speed manual starts at just $18,745. And, when equipped with a recommended $450 optional safety driver assistance package, which adds VW’s Forward Collision Warning with Autonomous Emergency Braking (Front Assist), Blind Spot Monitor and heated side mirrors, you can park one in your driveway for a retail of $20,115 including $920 delivery.

If you want the eight-speed automatic transmission, add another $800. (The above mentioned safety items are standard on the GLI trims).

Jetta then moves up to the SE at $22,645, R-Line at $22,695, SEL at $25,495 and SEL Premium at $27,945.

These Jettas receive motivation from a 1.4-liter turbo four that develops 147 horsepower with 184 lb. ft. of torque.

Most important is that the two available 2020 Jetta GLIs (S and Autobahn) are similar in horsepower and drivetrain components. Both feature the powerful GLI turbocharged four-cylinder delivering 228 horsepower and 258 lb. ft. of torque.

Two transmissions are available, the standard six-speed manual or for $800 more, a seven-speed dual-clutch automatic.

Our GLI arrived with the automatic, and it performed fl awlessly with downshift rev-matching and nice, fi rm shifts under acceleration.

Also notable is the GLI performance-

bred suspension features. Both S and Autobahn feature fully independent sport-tuned four-wheel setups with struts up front and a multilink rear similar to its sibling performance Golf GTI. Although still classifi ed as a Jetta, the two GLI trims are now stand-alone performance sedans that won’t show up when studying the “normal” Jettas online. You’ll have to click on the Jetta GLI “Performance Sedan” button to fi nd VW’s two available off erings. The S starts at $26,245 while the Autobahn starts at $29,945. Our GLI came in at a fi nal $31,665 with the $800 automatic and $920 delivery included.

The big diff erence between the two

GLI trims is the Autobahn’s Dynamic Chassis Control, also known as Adaptive Chassis Control. This high-tech addition features fi ve modes of adaptive chassis settings (Eco, Comfort, Normal, Sport and Custom) that are selectable and easily tweaked by the driver ala steering stiff ness, diff erential, throttle, engine sound and climate control settings to suit all driver likings. From the Comfort setting for freeways to dialing in the Sport mode for stiff er, better handling results, GLI Autobahn delivers.

And how fast are these GLI Jettas?

Expect zero to 60 in about 5.8 seconds, 14.4 second quarter miles and a governed top speed of 155 mph. Yes, they truly are Volkswagen’s performance front-drive sedans.

However, even the “normal” Jettas are quite nice cars and very popular amongst compact car consumers. Jetta is now in its seventh generation as of last year, featuring a longer wheelbase than the sixth generation model. This new design is really a ground up rebuild as our GLI looked great wherever we took it. You can tell by the slippery and fi nessed lines and sporty touches that the Jetta GLI is special, although so are the lower cost Jettas as they look grand, too.

The United States Forest Service (USFS) has filed an application with the Bureau of Land Management (BLM) to extend for an additional 20-year term a withdrawal established

by Public Land Order (PLO) 7467 (65 FR 61180), which will expire on October 15, 2020. PLO 7467 withdrew 74,689 acres of National Forest System lands in the Coconino National Forest, San Francisco Peaks/Mount Elden Recreation Area, Arizona. The PLO withdrew these lands from settlement, sale, location, or entry under the general land laws and the United States mining laws, but not from leasing under the mineral leasing laws.

The BLM provided notice of the application and opportunity to comment in the Federal Register published June 16, 2020 (85 FR 36416). Comments must be received by September 14, 2020. All comments should be sent to the BLM Arizona State Office, One North Central, Suite 800, Phoenix, Arizona 85004; faxed to 602-417-9452; or sent by email to BLM_AZ_Withdrawal_Commen ts@blm.gov. PUBLIC NOTICE OF AN APPLICATION FOR AN ORDER AUTHORIZING ARIZONA PUBLIC SERVICE COMPANY TO ISSUE, INCUR, AND AMEND EVIDENCES OF LONG-TERM INDEBTEDNESS, AND SHORT-TERM INDEBTEDNESS, TO EXECUTE NEW SECURITY INSTRUMENTS TO SECURE ANY SUCH INDEBTEDNESS, AND FOR DECLARATORY ORDER CONCERNING VARIABLE INTEREST ENTITIES DOCKET NO. E-01345A-20-0063 Arizona Public Service Company (Company) filed an Application with the Arizona Corporation Commission (Commission) for an order authorizing the Company to issue additional long-term debt by increasing the existing “cap” by $1.6 billion from $5.9 billion to $7.5 billion, and to continue its current authorizations regarding short-term debt and certain related financial instruments. The application also seeks declaratory relief as to the treatment of Variable Interest Entities and non-traditional forms of debt such as certain leases and other long-term service obligations. The application further seeks removal of the annual $150 million “cap” on equity infusions into the Company from its parent Pinnacle West Capital Corporation. The application is available for public inspection on the Internet via the Commission’s website (www.azcc.gov) using the e-Docket function, in Docket No. E-01345A-20-0063 and via the Company’s website (www.aps.com).

Intervention in the Commission’s proceedings on the Application shall be permitted to any person entitled by law to intervene and having a direct substantial interest in this matter. Persons desiring to intervene must file a Motion to Intervene with the Commission which must be served upon the Applicant and each party of record on the service list, which can be found in the Docket for the case and which, at a minimum, shall contain the following information: 1. The name, address and telephone number of the proposed intervenor and of any person upon whom service of documents is to be made if different than the intervenor.

2. A short statement of the proposed intervenor’s interest in the proceeding.

3. Whether the proposed intervenor desires a formal evidentiary hearing on the application and the reason for such a hearing.

4. A statement certifying that a copy of the Motion to Intervene has been mailed to the Applicants.

5. The granting of Motions to Intervene shall be governed by A.A.C. R14-3-105, except that all Motions to Intervene must be filed within 15 days after the date of this notice.

6. If the proposed intervenor is not represented by an attorney who is an active member of the Arizona State Bar, and is not representing himself or herself as an individual, sufficient information and any appropriate documentation to demonstrate compliance with Arizona Supreme Court Rules 31, 38, 39, and 42, as applicable.

The granting of Motions to Intervene shall be governed by A.A.C. R14-3-105, except that all Motions to Intervene must be filed within 15 days after the date of this notice. As I listened to the Bronco brain trust outline highlights of Ford’s upcoming off -roader, I could practically hear Jeep Wrangler strategists slapping their heads: “Why didn’t we think of that?”

Because they didn’t have to. The Wrangler, direct descendant of nearly 80 years of vehicles with great off -road ability, doesn’t have anything to prove.

The 2021 Ford Bronco, due to go on sale next spring, does. It’s heir to a modest tradition of quirky and customizable pickups and SUVs Ford built from 1966 to ’96. Most drivers have never seen one on the road. The Wrangler, with imagebuilding predecessors all the way back to the World War II Willys Jeep, is ubiquitous on American roads, trails and in fi lm, TV and streaming around the world.

Wranglers have a loyal, built-in audience. The Bronco needs to create passion for a family of SUVs, inspiring buyers to choose a nameplate they may never have heard of.

It needs to be so head-slappingly innovative and good that owners will dedicate themselves to proving they’re smarter and better than Jeep drivers they never gave much thought to before they became Bronco-nistas.

That’s why Ford’s best and brightest pulled out all the stops, from a rail to mount GoPros and iPhones to onboard space to store the Bronco’s removable doors.

On paper, the results looks good.

The smaller Bronco Sport will go on sale late this year, months before the Bronco. Using the same platform as the Ford Escape and Lincoln Corsair, it has a unibody construction and less off -road capability than the truck-based Bronco.

All-wheel drive is standard, though it wouldn’t be shocking to see a frontdrive model at some point.

Because of COVID-19, it’s still unclear when and how K-12 students in Arizona will return for in-person classes.

Whatever your child’s school decides on for the upcoming school year – whether it’s entirely online, hybrid or delayed in-person learning – chances are your apartment home is about to transform into a makeshift classroom.

Because distance learning may be a temporary measure, set up your athome classroom so it’s easy to break down when necessary. Consider attaching wheels to the bottom of furniture such as a small desk and chair so you

can wheel it out of the way when class is over for the day.

Most distance learning requires internet access. Create a desk space for your child that includes a computer. If you do not have internet access, reach out to your apartment community’s management to see if they off er deals with the various internet providers.

Your child may need either a computer with a camera or a webcam to video chat with his or her teacher via Zoom or another video service. Talk to your community’s management team about setting up Wi-Fi in your home if it not implemented already.

Prior to the start of distance learning, make sure you gather all the necessary school supplies for your child so it’s at his or her fi ngertips by the fi rst day of school. This includes a notebook, scratch paper, pens, pencils and art

supplies such as crayons or colored pencils. Most schools post the list of school supplies on their websites.

Disorganization can be distracting and confusing to your child so make sure his or her desk area is clutter-free.

Search your apartment home or go to your local craft store to purchase plastic organization chests to store your child’s school supplies so it is easy to fi nd and even easier to put away during clean-up.

Consider placing a plastic carpet protector or machine-washable throw rug under your child’s desk area so they can color and create without worrying about spills and accidents.

Your child is likely used to a structured schedule when it comes to school so it’s important to do your best to create a similar level of stability at home.

Consider investing in a large wall calendar, whiteboard, chalkboard or bulletin

board so you can lay out your child’s schedule for the day as well as keep track of his or her progress.

Food fuels your child’s mind. Prepare for the “lunchtime rush” by meal prepping ahead of time. Begin by cleaning your fridge out so you have plenty of room for the week’s breakfasts and lunches. Look up easy recipes online and store the food in airtight food containers so you can pull them out of the fridge hassle-free whenever your child is hungry. Make sure to write the “meal of the day” on your wall schedule so your child can have something to look forward to each day.

Finally, encourage healthy breaks for your child to relax his or her mind and to get some fresh air.
