Foundations help support new movement of renters’ activism
In
After years of rising rents, a group of Kansas City, Missouri, renters came together in 2019 to form KC Tenants, armed with an annual budget of $30,000 and demands for a bill of rights to protect renters from rising prices, unjust evictions and landlord abuse.
Four years and one pandemic later, KC Tenants is a nonprofit tenants union with a budget that grew almost twentyfold and a track record of advocacy victories. For instance, the group got its bill ofrightsenactedbythecityandisworking to make sure all tenants have the right to a lawyer when facing evictions.
Tenants unions are membershipbased groups that advocate for the collective rights of renters, often at the locallevel.Manyoperatesimilarlytolabor unions by charging member dues, offering member benefits and appointing tenant leaders.
The progress at KC Tenants comes as a growing number of foundations are working with a revitalized tenants movement to confront the nation’s housing crisis. The current wave of organizing is the country’s most significant since the1970s, when inflation and momentum from the Civil Rights Movement led to rent strikes across the country and new policies like rent control.
Now rents are rising again, and tenant organizers, who led the fight for pandemic-era eviction moratoriums, have turned toward new permanent protections for tenants.
The pandemic “exposed a live wire about the lack of protections and vulnerabilities tenants face,” says Jennifer Angarita, of Funders for Housing and Opportunity, a grantmakers group. After losing their jobs during the pandemic, many tenants struggled to pay rent and would have lost their homes without eviction moratoriums.
Angarita says an increase in national grantmakers’ support for local tenant movements is part of a broader shift in philanthropythatprioritizessupportfor the people most closely affected by social issues.
In2021,HouseUS,anationalorganizing fund that supports local tenants movements, launched with $7.5million. It received $5.5million from the Ford Foundation and $2million from

the Robert Wood Johnson Foundation, which has since awarded another $4million. The fund – which supports KC Tenants, Colorado Homes for All, the Nevada Housing Justice Alliance and others – has continued to attract money from other large foundations. It raised more than $4million in the past three years from grantmakers such as the Oak Foundation, which provided $2million, andtheMelvilleCharitableTrust,which gave $200,000. “Nothing pulls people in quite like momentum,” says Kevin Simowitz, codirector of HouseUS.
The national tenants movement has helped make recent changes across the nation:
h KeepLAHoused,InquilinosUnidos and others won Los Angeles City Council approval for protections that require landlords to provide clear causes, like nonpayment of rent, for evictions and relocation assistance for tenants displaced by rising rents.
h In New York, Housing Justice for All, a coalition of nonprofits, successfully fought for new laws and protections such as limitations on security deposit charges and requirements to noti-
fy tenants before making certain rent increases.
h The Miami Workers Center, a tenant collective, won approval for a countywide bill of rights protecting renters from housing discrimination based on prior evictions and a guarantee they’ll be notified if a building shifts ownership.
“Communities have been preparing for a moment when they can realize change,andIthinkwehaveitnow,”says MeshieKnight,seniorprogramofficerat the Robert Wood Johnson Foundation. “I see philanthropy as being able to contribute to that reimagination of a new and more equitable future.”
During the pandemic, KC Tenants became an advocate for emergency tenant protections, including a temporary eviction moratorium in the state. The group,withabudgetofnearly$600,000 from both local and national grants,

Eviction ban in California cities about to end

Haile has paid property taxes, insurance and other bills on a house she lets out in Oakland, but for more than three years her tenants have paid no rent thanks to one of the longest-lasting eviction bans in the country.
The eviction moratorium in the San Francisco Bay Area city expires next month and Haile can’t wait. The 69year-old estimates she is owed more than $60,000 in back rent, money she doubts she will ever see. Moreover, the tenants have trashed her house and it will cost tens of thousands of dollars to make it habitable, she says.
“It’s unbelievable and it’s like, how can they have the nerve to just let something like this happen? If this happened to them, how would they feel?” Haile said of her tenants. “Dealing with this whole thing gets me so upset.”
Eviction moratoriums were put in place across the U.S. at the start of the
pandemic in 2020 to prevent displacement and curb the spread of the coronavirus. Most expired long ago, but not in Oakland or neighboring San Francisco and Berkeley, all places where rents and rates of homelessness are high.
While it’s more common to see tenants converging on city halls in California to demand greater protections, in Oakland and surrounding Alameda County small-property landlords staged protests earlier this year demanding an end to the moratoriums.
Many of the landlords were Black, like Haile, or Asian American, and they saidtheevictionbanshadsaddledthem with debt and foreclosure worries while their tenants, who have jobs, live rentfree.
They scolded elected leaders for allowing tenants to self-certify that their inability to pay was tied to the pandemic. Unlike large corporate landlords, these small-property owners said they didn’t have the means to evict, and were

“We were engaging in direct action to shutdownevictionsbywhatevermeans we could find,” says Tara Raghuveer, founding director of KC Tenants. “Along the way, we started organizing neighborhood tenant unions.”
It’s that kind of nimbleness – and those victories – that persuaded some foundations that tenant unions should continue their work after the spread of COVID-19 eased.

“Thereisnothingnaturalaboutbeing forced to house and have people live in your property for over three years and not pay,” said Michelle Hailey, who is also Black and owns a triplex where both her tenants stopped paying. “There is nothing natural, ethical or even humane about that.”
Alameda County let its moratorium expire at the end of April. In Oakland it ends July 15. Tenants must start paying rent in August in most cases, but cannot be evicted for back rent if their financial hardship was caused by the pandemic.
Moratoriumbackerscalledthebansa lifesaver that kept countless families housed and off the streets. They said low-income residents are still struggling from the pandemic and need protections from ruthless landlords.
Nationwide, eviction filings have come roaring back since the bans ended – to more than 50% higher than the prepandemic average in many cities, according to Princeton University’s Eviction Lab, which tracks filings in three

He says the foundation’s restructuring emerged from the sentiment that “more work needed to be done to build political will and make more transformative changes to our housing system.”
While previous waves of tenant organizing were often led by national tenant organizations, local tenant unions have largely spearheaded the movement in recent years, Frey says. Many groups grew from the ground up during the pandemic, when they began generating momentum for citywide eviction protections.
In 2021, the HouseUS fund began rampingupitssupportforMissouritenant movements outside of Kansas City. With the guidance and financial oversight of KC Tenants, HouseUS has provided$100,000yearlysince2021tohelp createanonprofittenantsunioninCape Girardeau in rural southeast Missouri.
It’s been an uphill battle to persuade rural tenants to join the union, says AaronLerma,anorganizerleadingthecampaign. Many tenants were concerned

In Oakland, a city rich in Black history, some Black families who migrated from the South during World War II were able to purchase homes, despite redlining and other discriminatory practices by banks and government.
But a recession and subprime mortgage crisis followed by rapidly rising home prices and gentrification pushed out many Black residents, and homelessness escalated.
Carroll Fife, a Black city councilwoman and housing advocate, called for a housingoverhaulthatfocusesonhomes for people instead of profit for a few. She acknowledged that some people “took advantage of the moratorium,” but says most renters desperately needed the help.
Hailey, the triplex owner, considers herselfluckybecauseshewasabletorecoup some money through a rent-relief program. The tenants moved out, but shehasastackofbillsandcan’taffordto renovate.
She purchased the property in 1999
about being blacklisted from renting in the small city.
However, Lerma says, he’s seeing a growing willingness among residents to help direct what comes next – and a sense that it might lead to real change.
“That sense of fear has also contributed to a lot of hopelessness in our communities,”Lerma says. “We have to generate our own hope about what’s possible.”
Lerma spent six months knocking on doors before holding the group’s first meeting in June 2022. At that meeting, tenants shared their priorities for improvinghousingconditions.CapeGirardeau tenant leaders have been able to build credibility with other residents through policy work and by being their advocates. For instance, when Cape Girardeau renters are evicted or a landlord refuses to make repairs, they now have someone to call.
The group recently negotiated an agreement with the town’s inspectionservices supervisor to restructure Cape Girardeau’s code-inspection department. The town plans to hire more inspectors so it can do more to enforce safe housing standards. Cape Girardeau Tenants, which now has around 60

“So this was my entire plan, and I’ve just kind of watched it go up in smoke,” said Hailey, 59. “We’ve never had a situation where you would have government-sanctioned freedom to not pay your rent.”
Haile doesn’t know why the family who rented the house her parents left her stopped paying rent in April 2020. The property management company said they couldn’t ask because of the eviction ban.
Reached by The Associated Press, the tenant, Martha Pinzon, said at the advice of a community nonprofit she stopped paying after she lost her hotel housekeeper job during the pandemictriggered shutdown in March 2020. Even now, she can’t afford the $1,875 monthly rent on her pay as a custodian at a homeless shelter.
Pinzon’s 19-year-old daughter, Brigitte Cortez, said the moratorium gave her mother “peace of mind” during the pandemic. She said the property management company has for years ignored their requests for repairs.

John Williams, 62, hopes that three years of worry and stress are coming to an end.
Williams, who is part of a lawsuit against Oakland and Alameda County over the bans, said his tenant stopped paying the $1,500 monthly rent when the pandemic started. She offered no explanation while operating a storage business out of the apartment and would not cooperate so he could get money from the city’s rent-relief program, he said.
As a Black man, Williams had experienced rental discrimination and he thought his Victorian duplex in West Oakland would be a way for him to retire and house others. He started renting to the mom with two kids in 2013.
In late 2020, he tried to sell the house, but she refused to move, and the sale fell through. In late 2021, Williams was so stressed he was hospitalized, placed on disability and could not work. He was forced to move into the unit above his tenant. It no longer felt like his house.
The tenant did not return messages from the AP left at a phone number for a business she operates.

Scottsdale was named for U.S. Army Chaplain Winfield Scott, who in 1888, bought land and started a farming operation that was made possible by water from the new Arizona Canal. Helping to provide a reliable water supply, Granite Reef Dam (1908) and Roosevelt Dam (1911) made a significant impact on the growth of the Salt River Valley. In later years — but still early days — the area was home to hundreds of thousands of acres of ranching operations that inspired ‘The West’s Most Western Town’ moniker. Scottsdale currently has nearly 250,000 residents and counts some 6 million tourist visits annually.

The Honda CR-V and Toyota RAV4 are two of the most popular SUVs on sale today. With their spacious cabins, large cargo holds and the elevated ride height SUV shoppers love, each makes a strong case as a family-friendly people mover with room for five on board. In the engine bay of the 2023 HR-V is a 2.0-liter four-cylinder that sends 158 horsepower to the front wheels via a continuously variable automatic transmission (CVT). Unfortunately, acceleration is meager, and the HR-V quickly runs out of steam on the highway.
The Toyota Corolla Cross provides a similar driving experience. All three of theCorollaCrosstrimlevelscomewitha 2.0-liter four-cylinder that produces169 horsepower and works with a CVT. Despite the power advantage, acceleration is just as leisurely.

Comfort
This competition seesaws depending on where you’re perched. Edmunds found the front seats in the HR-V exceedingly firm and compared them to sitting on a wooden bench. But overall headroom and legroom in either row are
generous.
In the Corolla Cross, the front row is where you want to be thanks to its more supportive seats. Things are less rosy behind. If you regularly travel with taller rear passengers, the HR-V is the better pick. The Corolla Cross does have a smoother ride, however.

Cargo space and technology
The HR-V and Corolla Cross have simple and user-friendly cabins. Each has an intuitive operating system that comes standard with wired Apple CarPlay and Android Auto, multiple USB ports, and optional features like wireless device charging and wireless smartphone connectivity. The Honda’s screen measures 7 inches wide, though a 9-inch screen is fitted to the rangetopping EX-L trim. An 8-inch screen is used in all Corolla Cross trims.
Cargo space on the spec sheet is a
neardeadheat.TheHR-Vhas24.4cubic feet of room behind its folding split second row, versus 24.3 cubic feet of space in an all-wheel-drive Corolla Cross. But in real-world testing, we found the HRV’s cargo area to be a little roomier.

Pricing and value
Value is a huge draw among small SUVs with fuel-conscious engines, and the HR-V and Corolla Cross follow this establishedblueprint.Eachcomesstandard with advanced driver assist features such as adaptive cruise control, lane departure warning, automatic high-beam headlights and a rear-seat reminder.
Their base prices are closely matched, starting at about $25,000 including destination fee. Fully loaded trims of either similarly run to just under $30,000. Both the HR-V and Corolla Cross come with a three-year/36,000mile limited warranty and a fiveyear/60,000-mile powertrain warranty, plus two years of free scheduled maintenance.

Question: We live in a beautiful community of about two dozen homes. Our community’s covenants, conditions and restrictions require any amendment of these rules to have the approval of the majority of the homeowners. Everyone in our community has always been opposed to short-term rentals. Therefore, when someone bought a home in our community last year with the intention of using it as a short-term rental, we hired a lawyer and filed a lawsuit. Immediately after the lawsuit was
filed, the owner who wanted to use the house as a short-term rental sold it to a familyanddidn’trespondtothelawsuit. Only three homeowners in our community paid our attorney’s fees of $8,500. Can we recover that money from the homeowner we sued?
Answer: Probably not. The community’s covenants, conditions and restrictions are a contract among all of the homeowners. Under Arizona law, the winning party in a contract dispute that is a “contested action” is entitled to reasonableattorney’sfees.Theprospective short-term rental owner, however, never answered the lawsuit. Therefore, therewasno“contestedaction,”andyou three homeowners probably have no claimagainsttheformerhomeownerfor the recovery of your $8,500.
